Les infortunes de l’autisme de type Asperger en droit pénal canadien

Ce mémoire offre un nouvel éclairage sur la transition en cours de l’institution pénale contemporaine d’une fonction essentiellement morale et symbolique vers la gestion effective des risques dans la société. Nous estimons que c’est en juxtaposant ses différentes pratiques – pratiques discursives entourant la responsabilité criminelle des accusés atteints de troubles mentaux non psychotiques, pratiques en matière de criminalisation préventives et nouvelles pratiques en matière de peine – que cette transformation fonctionnelle est la plus appréciable. Afin d’illustrer ces différentes pratiques, nous proposons de suivre le parcours pénal réservé par l’institution pénale aux sujets autistiques. Tout en étant fortement déterminés dans leur développement moral, social, sexuel et émotionnel et dans leur capacité à se conformer à la loi pénale, ceux-ci demeurent toutefois minimalement réceptifs aux technologies pénales. Nous pensons que leur incorporation à l’intérieur de la logique pénale résulte essentiellement de cet attrait utile de la peine au prix même de la déformation de nos principes fondamentaux collectifs de justice. Ce mémoire offre la première analyse systématique de la jurisprudence concernant la responsabilité criminelle et la peine des personnes autistes au Canada ainsi qu’une synthèse des plus récentes découvertes juridico-cliniques sur l’autisme. L’intégrité physique et psychologique des personnes autistes étant menacée comme jamais auparavant par l’inflation du quantum des peines en raison de l’arrêt Friesen et des réformes du gouvernement Harper, nous invitons les juristes, les avocats, les experts cliniques à s’intéresser davantage à l’intervention de l’institution pénale envers ces personnes hautement vulnérables. / This thesis sheds new light on the ongoing transition of the contemporary penal institution from a moral and symbolic function to the effective management of risks in society. We believe that it is by juxtaposing its different practices – discursive practices surrounding the criminal responsibility of defendants with non-psychotic mental disorders, preventive criminalization practices and new sentencing practices – that this functional transformation is most appreciable. To illustrate these different practices, we propose to follow the penal circuit reserved by the penal institution for autistic subjects. While being strongly determined in their moral, social, sexual, and emotional development and in their ability to comply with penal law, they nevertheless remain minimally receptive to penal technologies. We think that their incorporation within the penal logic results from this useful attraction of the penalty at the very price of the deformation of our collective fundamental principles of justice. This thesis offers the first systematic analysis of the case law concerning the criminal liability and sentencing of persons with autism in Canada as well as a synthesis of the most recent legal and clinical findings on autism. As the physical and psychological integrity of people with autism is threatened like never before by the inflation of the quantum of sentences due to the Friesen decision and the legislative reform by the Harper government, we invite jurists, lawyers, clinical experts to take a greater interest in the intervention of the penal institution towards these highly vulnerable individuals.

Cette thèse questionne l'enseignement de la proportionnalité à des élèves de 11 à 16 ans relevant de l'adaptation scolaire et de la scolarisation des élèves handicapés. Les travaux de didactique des mathématiques ont montré l'inaboutissement fréquent du projet d'appropriation de la proportionnalité auprès des élèves jusqu'au collège, et tout particulièrement en ASH.Afin de savoir si une adaptation peut se faire sans dénaturer le savoir, nous proposons donc une progression sur l'enseignement de la proportionnalité en classe de Quatrième SEGPA.Nous insistons sur l'importance de l'organisation des savoirs au sein de cette progression et sur la pertinence des contextes et des valeurs des variables didactiques numériques. Les analyses de nos observations se font dans le cadre de l'analyse statistique implicative, de la Théorie des Situations Didactiques ainsi que de la double approche utilisée dans l'analyse des pratiques des enseignants.La mise en œuvre de la progression construite nécessite pour les enseignants des connaissances mathématiques. Afin de réactiver ces connaissances, nous proposons des représentations symboliques qui illustrent les techniques de résolution de problèmes relevant de la proportionnalité simple. / The purpose of this thesis is to investigate the teaching of proportionality to 11 to 16-year old pupils registered in special-needs schools including pupils with more severe learning disabilities.Studies related to the teaching of mathematics have shown that the understanding of proportionality by pupils up to middle school age and more particularly by children with significant learning difficulties is often inappropriate. In order to find out if an adjustment can be made without any impact on the knowledge requirements, we experimented a teaching plan concerning the learning of proportionality by children with special-needs in the context of our study. We insist on the importance of the organization of the different types of knowledge within this teaching plan and also on the relevance of backgrounds and values of numerical didactical parameters. Analysis of our observations is carried out with statistical implicative analysis, Theory of Didactical Situations and with the frame of the double approach used to analyse the practices of teachers.The implementation of such a teaching plan requires, for teachers, mathematical knowledge. In order to reactivate this knowledge, we propose a symbolic scheme for each resolving technique applied to problems involving direct proportionality.

The constitutional rebuilding of the South African private law : a choice between judicial and legislative law-making

A tension arises whenever the South African private law fails to meet constitutional right norms. To remedy a deficiency, two law-making options are available. The first is for the judiciary to develop or change private law principles and rules in order to provide protection for the implicated constitutional norm. The second is for the judiciary to enforce an obligation upon Parliament to enact legislation to amend or replace existing private law rights and obligations so as to safeguard the norm against interference from a private individual or entity. The former is the more conventional option, but, in recent years, the law reports record an increasing reliance on the legislative duty to protect constitutional right norms in private legal relationships. The thesis investigates the extent to which the latter phenomenon - which will be described as a 'pivot towards legislative remedies' - exists, and the circumstances in which the courts pivot towards legislative remedies rather than developing private law of their own accord. The thesis finds that legislative schemes that give effect to constitutional rights are likely to contain an array of benefits that are absent from or reduced in the judicial law-making process. The judicial pivot towards legislative remedies is thus a strategy to enhance the process through which conflicting rights are resolved, as it allows for the constitutional rebuilding of private law in a way that the judiciary is unable to do on its own. Importantly, however, theories of judicial deference do not explain the pivot. On the contrary, the courts have exercised a strict level of control over the legislative law-making pathway. Through either statutory interpretation or the review of legislation, the courts require legislation to contain the essentials of the judicial law-making framework. From this perspective, the judicial law-making process produces the floor of the rebuilding project and the legislative law-making process enhances that framework.

L’approche juridique de la notion de création est confuse. Elle est traditionnellement envisagée à travers les droits de propriété intellectuelle (droit d’auteur, brevet, dessins et modèles, etc.). Mais cette approche est insuffisante. Les droits fondamentaux permettent de s’en apercevoir. En effet, la création constitue à la fois une activité humaine (un acte créatif) et un objet de propriété (un bien créatif). L’acte créatif est garanti par la liberté de création. La nature de cette dernière demeure toutefois incertaine. Elle oscille entre un rattachement à la liberté d’expression ou à la liberté du commerce et de l’industrie. De plus, le test de proportionnalité conduit à examiner les limites de la liberté de création à l’aune des « lois du genre créatif ». Les droits fondamentaux invitent alors à dépasser la conception de l’acte créatif compris comme un message.Le bien créatif est protégé par le droit de propriété. Les droits fondamentaux conduisent cependant à remettre en cause la conception française des biens créatifs en soulignant davantage leur dimension économique. De plus, le test de proportionnalité implique de redessiner les limites du droit de propriété en tenant compte de ses fonctions sociales. En définitive, les droits fondamentaux brouillent la frontière entre le droit de propriété et le droit de la concurrence déloyale. / The legal approach to the notion of creation is vague. It is traditionally considered in the light of intellectual property rights (copyright, patent, design, etc.), but this approach is insufficient. Fundamental rights show us this. They let us distinguish between its different dimensions: creation as both a human activity (a creative act) and an object of property (a creative good). The freedom of creation protects and ensures the creative act. However, the nature of the former remains unclear. It fluctuates between falling within the freedom of expression and the freedom to conduct a business. Furthermore, the proportionality test leads to the limits of creative freedom being examined in terms of “laws of the creative type”. Fundamental rights then require us to go beyond the concept of the creative act as a message.The creative good is protected by property law. Fundamental rights, however, bring into question the French concept of a creative good by further emphasising their economic aspect. Moreover, the proportionality test means retracing the boundaries of property law by taking into account its social functions. Fundamental rights therefore blur the line between property law and unfair competition law.

This Doctoral thesis entitled the Constitutionality of Employers' Investigative Procedures and Disciplinary Hearing Processes with Specific Reference to Dismissal of Employees on the Basis of Criminal Misconducts in South Africa, focusses on individual labour law principles of fair labour practices entrenched in section 23(1) of the Constitution. The thesis deals with fairness in situation where an employee who is suspected of committing a criminal act is investigated and subsequently goes through a disciplinary hearing for dismissal. It determines the extent to which an employee’s criminal guilt is decided before dismissal. As such, the thesis is based upon South African judicial interpretation of the right to fair dismissal. In the process the thesis examines the application of principles informing the employer’s duty to provide fair reason concerning the dismissal of employees criminal suspects. In examining if employers observe constitutional transformative objective when conducting criminal investigations and disciplinary hearings - the thesis reviews the extent to which the employer respects constitutional rationales of equity based on the principles of natural justice. These natural justice principles are the basis upon which section 23(1) fairness is founded. Section 23 (1) is implemented through the LRA provisions. The thesis then concludes that, only one principle of natural justice - audi alteram partem is respected within employer flexibility-based fairness while the other principle - nemo judex in propria sua causa is ignored. It is this denial that causes serious procedural challenges in the quest for equity intended in section 23(1) fair labour practices. It is upon these foundational equity concerns that this thesis opposes the flexibility in employer’s criminal investigations and disciplinary hearing processes entrenched in item 4 (1) of Schedule 8 of the LRA fair procedure for dismissal of employees suspected of criminal acts. The thesis interlinks labour law and criminal law to advocate for the missing constitutionally justiciable fairness for employees who have committed criminal misconducts. It argues that the current judicial interpretation of labour law fairness is based upon the principle of flexibility underlying dismissals, asserting that fairness based on flexibility breeds informal procedural processes which exempt employers from observing crucial constitutional fairness principles expressed through proportionality-based prescripts. The thesis concludes that the practice of including the right against self-incrimination in employment law, done in other common law countries be introduced into the South African labour law through section 39 of the Constitution so that the identified procedural challenges are regulated. / Mercantile Law / LL.D.

La dialectique de l’ordre public et des libertés sillonne la pensée juridique depuis le XVIIIème siècle. Généré par de nouvelles formes de délinquance et de criminalité, le renforcement des exigences de l’ordre public impose de s’interroger sur la limitation des droits fondamentaux constitutionnels. En dépit de la place névralgique qu’il occupe entre ordre public et libertés, le processus de limitation demeure indéterminé en droit français. Cette recherche, organisée autour de la détermination des limites aux droits garantis, de l’identification des « limites aux limites » aux droits fondamentaux, puis de la redéfinition des droits fondamentaux par les limites, permet de préciser ce mécanisme, mais aussi de cerner les restrictions apportées à l’exercice des droits et libertés. L’autolimitation du Conseil constitutionnel marque un infléchissement progressif de la protection des droits fondamentaux. Ce constat invite à réfléchir sur l’encadrement supra-législatif de la limitation des droits garantis, et conduit à se positionner en faveur de l’insertion d’une clause de limitation des droits fondamentaux dans la Constitution. / The dialectics of public order and freedoms has been traveling throughout legal thought since the 18th century. Sparked by new forms of delinquency and criminality, the strengthening of public order requirements leads to questioning the limitation of fundamental constitutional rights. Despite its crucible place between public order and freedoms, the limitation process remains undetermined in French law. This research, which aims at determining the limitations to protected rights, identifying the limitations to those limitations themselves, and then redefining fundamental rights through those limitations, not only helps to specify this mechanism, but also to identify the restrictions brought to the enjoyment of rights and freedoms. The Conseil constitutionnel self-restraint reveals a gradual shift in the protection of fundamental rights. Acknowledging the former leads to considering a supra legislative framework to the limitations to protected rights, and advocating in favor of the constitutional entrenchment of such a clause.

Le train de vie en droit privé / Standard of living in private law

Locution issue du langage courant, le « train de vie » a été importée dans la sphère juridique dès la fin des années 1930 pour lutter contre la fraude fiscale. Depuis les années 1960 et surtout 2000 elle est utilisée dans toutes les branches du droit privé. Elle n’a pourtant reçu aucune définition. Partant de ce constat, la première partie de cette thèse s’intéresse au contenu juridique de la notion de train de vie. Elle y est définie comme la jouissance, à titre habituel d’une certaine quantité de biens et de services, caractérisant à la fois un niveau de vie et une habitude de vie. Il ressort de cette définition que tant les biens que les services peuvent être le support du train de vie, que cette notion s’apprécie en jouissance et non en propriété et qu’une condition de durée doit être remplie. La seconde partie de cette thèse s’intéresse aux effets qui sont attachés au train de vie. Il est toujours utilisé en tant que point de référence mais n’est pas toujours invoqué par la même personne. Ainsi, le train de vie peut être soit opposé à son bénéficiaire par un tiers, soit opposé par son bénéficiaire à un tiers. Dans le premier cas, il est un point de référence permettant d’identifier une disproportion, à laquelle sont attachées des conséquences juridiques néfastes pour le bénéficiaire du train de vie. Dans le second cas, il sert de point de référence pour apprécier et traiter une situation de rupture patrimoniale. Caractérisant une situation économique habituelle, le train de vie est doté d’une certaine inertie,qui nécessite qu’il ne soit pas arrêté brutalement. Il est alors de nature à conférer des droits à son bénéficiaire. / An expression usually found in everyday language, the « train de vie », or standard of living, wasbrought into the legal sphere as early as the late 1930’s in a bid to fight fiscal fraud. Since the 1960’s, and evenmore so since the 2000’s, it is found in all branches of private law. It has, however, never been defined.Therefore, the first part of this thesis looks into the legal content of the idea of « train de vie ». It is definedhere as the enjoyment of a certain quantity of goods and services that has come to be the habitual, markingboth a standard of living and a life habit. This definition of the expression leads to the conclusion that as goodsand services can support of the « train de vie », this is a notion that is to be assessed in enjoyment and not inpropriety, and that a condition of length of time is to be fulfilled. The second part of this thesis focuses on theeffects attached to the « train de vie ». It is still used as a reference point but not always invoked by the sameperson. Therefore, the “train de vie” can either be set against it’s beneficiary by a third party, or by it’sbeneficiary against a third party. In the first case, it becomes a point of reference allowing to identify a lack ofproportion, unto which are attached legal consequences unfavorable to the beneficiary of the « train de vie ».In the second case, it serves as a point of reference to asses and deal with a situation of a patrimonial break.Charaterizing a habitual economic situation, le “train de vie” is endowed with a measure of inertia, whichrequires that it not by stopped suddenly. It is thusfore of a nature to create rights for it’s beneficiary.

Esta tese tem como objetivo investigar os limites constitucionais ao emprego de normas tributárias extrafiscais, contribuindo, de maneira original, com o desenvolvimento de métodos que possibilitem que estes instrumentos sejam controlados de modo mais preciso pelo Poder Judiciário. Para a consecução deste objetivo central, trabalhou-se a partir de quatro blocos de investigação. Primeiro, a pesquisa centrou-se em discutir a importância de segregação das normas tributárias entre fiscais e extrafiscais, analisando as diversas propostas de métodos para a separação entre estas. Ao final, a tese sugere que as normas tributárias extrafiscais devem ser identificadas a partir das suas finalidades, conforme venha a ser interpretado pelo aplicador da norma. Superada a questão, passa-se à investigação dos fundamentos constitucionais que legitimam o emprego das normas tributárias extrafiscais, quando se debate em que sentido normativo se pode falar em neutralidade tributária. Em um terceiro módulo de investigação, as normas tributárias extrafiscais são contrapostas às limitações constitucionais ao poder de tributar, ao conflito entre competência regulatória e competência tributária, ao conceito constitucional de tributo, bem como aos limites ínsitos às espécies tributárias previstas pela Constituição Federal. Por fim, apresenta-se um modelo de protocolo decisório que pode ser utilizado para fins de controlabilidade das normas tributárias extrafiscais pelo Poder Judiciário, colocando-se em destaque os princípios da igualdade e da proporcionalidade. / The main goal of this thesis is to investigate the constitutional limits on the use of non-fiscal purpose tax laws, contributing, with originality, to the development of methods that allow a more precise control of these instruments by the Judiciary Branch. To achieve such goal, the thesis was divided into four parts. The first part focuses in discussing the importance of segregation of tax laws in two groups: fiscal and non-fiscal, and analyzes the numerous methods proposed for such classification. The thesis suggests that non-fiscal purpose tax laws must be identified by their purpose, as interpreted by those responsible for applying the law. The second part investigates the constitutional basis that legitimates the use of non-fiscal purpose tax laws and discusses to what normative extent one can speak of tax neutrality. In the third part, the non-fiscal purpose tax laws are compared to the constitutional limits on taxation, to the conflict between regulatory competence and fiscal competence, to the constitutional concept of tax, as well as to the limits involving the tax species provided by the Federal Constitution. Finally, a model of decision making protocol is presented for use a mean of control by the Judiciary Branch of the non-fiscal purpose tax, highlighting the principles of equality and proportionality.
