Negotiating repect(ability). A transnational ethnography of Indonesian labor brokerage

This dissertation studies how the Indonesian state facilitates the migration of its female citizens for employment as domestic workers in Hong Kong. Applying the research perspective of ethnographic migration and border regime analysis, I scrutinize the multiplicity of state and non-state practices in one of Asia’s major ‘labor brokerage’ countries. Building on a 12-month multi-sited ethnography in Indonesia and Hong Kong, the study sheds light on the desired and lived subjectivities of the workers and asks how these negotiate visions of national development and official expectations brought forward to them. Informed by Foucauldian, postcolonial, and feminist perspectives, I carve out how a variety of actors are invested in making Indonesia’s migrant domestic workers more respectable. I introduce the concept of respectability and situate official notions of the ‘ideal migrant’ in aspirations to modernize Indonesian brokerage on the one hand and in discourses that circle around national dignity on the other. I discuss respectability in light of the tensions inherent in labor brokerage. I show that in their subjective practices, migrant domestic workers in Hong Kong challenge official strivings for respectability, thus engaging in everyday politics from below that have repercussions on the Indonesian society. The dissertation extends earlier studies that highlight the role of gendered morality in disciplining migrant labor force. In addition, it incorporates notions of progressiveness and class distinction and points out that negotiations over migrants’ subjectivities are indicative of fundamental contestations over the self-conceptions of labor brokerage states. By examining a sending state in the Global South, it provides a global view and productively connects research on transnational migration in Asia with ethnographic migration and border regime analyses, which have hitherto mainly focused on European and North American border regimes. The dissertation gives insights in how transnational labor migration shapes the modes in which questions of (national) belonging and visions of societal well-being are negotiated in post-authoritarian Indonesia.

Digital platforms and tools have already taken over a large part of human daily lives and with the latest pandemic of COVID-19 it is clear how these technological trends have just increased, in both intensity and complexity, across most of the different aspects that comprehend our everyday activities. For instance, people are staying more at home and people now socialize, consume and work with help of different digital tools, which in other words means that the homes’ original role is changing to a more multifaceted and integral function. Based on such reality, this master thesis aims to investigate how property owners of housing rentals in Stockholm could extract value from these mentioned trends and context by incorporating new alternative income streams in their current business models. Moreover, this academic inquiry also intends to investigate the financial effect that these streams incorporation could have on a property valuation in the housing rental sector of Stockholm.  This thesis project follows two different, yet subsequential, lines of research, where the first one is an interview with local industry experts that provided insights in which kind of potential new value streams that property owners could incorporate in their current business models. They also shared information regarding which kind of digital tools are needed nowadays to make the new offering to the tenants in the most effective way within the Stockholm Private Rental Sector context. The industry experts also gave estimations of the cash flows enhancements that these service incorporation could bring to the owner . This information created the foundation that was used to later interview property owners. The property owners gave information of which kind of digital tools they used today, and what their view was about incorporating the new services and contracts that the industry experts had pointed out as possible new income streams. Both sets of interviews were analyzed with help of finding themes and reviewed literature that allowed the authors of this project to move on to evaluate the financial effect on a housing rental property in Stockholm whenever the new cash flows of the filtered income streams were considered.  The thesis has reached the conclusion that an incorporation of provision of services can create value for both the tenant and the property owner, even though specific services that should be incorporated aren't pointed out. The market was, at the time this thesis was written, immature and fast moving, which makes it hard to say which services will be successful in the Swedish market. Despite this are the results pointing out that contracts as home-electricity and insurances are among the services that have the lowest barrier to implement, and have already been tried by some actors in the industry. For those actors that have started an incorporation of provision of services have already noticed new cash-flows streams, even if they today are minor. The second conclusion is that those cash-flows will in the future trigger higher property values as properties will be a more attractive asset to possess. To be able to identify the demand and extract value from it in a successful way is a user-centered approach a key aspect, as the transaction must create new value for all actors involved / Digitala plattformer och verktyg har redan tagit över en stor del av människors dagliga liv och med den senast Corona-pandemin är det tydligt hur teknologiska trender har ökat, i både intensitet och komplexitet, och påverkar de flesta människors vardagsaktiviteter. Under Corona-pandemin har människor spenderat mer tid hemma och människor har socialiserar, konsumerar och arbetar med hjälp av olika digitala verktyg, vilket innebär att hemmets originella funktion har förändrats till en mer mångfacetterad funktion i människors liv. Baserad på detta så undersöker denna masteruppsatsen hur fastighetsägare, av hyresrätter i Stockholm, kan extrahera värde från dessa nämnda trender genom att inkorporera nya intäktsströmmar i deras befintliga affärsmodell. Denna akademiska uppsats undersöker också vilken påverkan dessa nya intäktsströmmar har på fastighetsvärden i hyresrättssektorn i Stockholm.  Metoden för att nå en slutsats är uppdelad i två processer, där den första är att intervjua vad som benämns i uppsatsen som industri-experter inom ämnet proptech. Dessa bidrar med insikt kring vilka nya intäktsströmmar som möjliga att inkorporera i fastighetsägares nuvarande affärsmodell. Dom understödjer också med information kring vilka digitala verktyg som är nödvändiga för att kunna inkorporera tjänsteförmedling på ett effektivt sätt till hyresgäster i Stockholms privata hyressektor. Utöver detta så ger industri-experterna estimeringar kring vilka värden som kunde tillfalla fastighetsägarens för varje enskild tjänsteförmedling. Denna information används som ett underlag vid nästa skede av intervjuprocessen med fastighetsägarna. Fastighetsägarna bidrar med information kring vilka digitala verktyg dom använde, vid tidpunkten denna uppsats skrevs, och deras syn på att inkorporera förmedling av de tjänster och kontrakt som industri-experterna pekar ut under första intervjuprocessen. Intervjuerna analyseras med hjälp av tematisk analys och parallellt med detta analyseras litteratur, vilket skapade möjlighet att utvärdera vilka finansiella effekter som en inkorporering av tjänsteförmedling kan få på hyresrättssektorn i Stockholm.  Uppsatsen når slutsatsen att inkorporering av tjänsteförmedling kan skapa värde för både hyresgästen och fastighetsägaren, även om de specifika tjänsterna inte pekas ut. Marknaden var vid tidpunkten när denna uppsats skrevs omogen och utvecklades snabbt vilket gör det svårt att svara på vilka tjänster som kommer vara framgångsrika i en svensk marknad. Trots detta pekar resultat på att kontakt som hushållsel och hemförsäkring hade låga ingångsbarriärer i marknaden att implementera, och vissa fastighetsägare har redan påbörjat denna process. Denna inkorporering har för dessa aktörer inneburit vissa nya intäktsströmmar, som dock är väldigt begränsade. Den andra slutsatsen är att de nya intäktsströmmar i framtiden kommer utlösa högre fastighetsvärderingar då fastigheter kommer bli en attraktivare tillgång att inneha. För att kunna identifiera efterfrågan och extrahera värdet ur en tjänsteförmedlingen, på ett framgångsrikt sätt, är en användarcentrerad strategi en viktig aspekt då transaktionerna som sker mellan fastighetsägaren och hyresgästen måste vara värdeskapande för alla inblandade aktörer.

An enforced cooperation : understanding scientific assessments in adversarial polities through Quebec shale gas policymaking, 2010-2014

Les biotechnologies, le réchauffement climatique, les ressources naturelles et la gestion des écosystèmes sont tous représentatifs de la “nouvelle politique de la nature” (Hajer 2003), un terme englobant les enjeux marqués par une grande incertitude scientifique et un encadrement réglementaire inadapté aux nouvelles réalités, suscitant de fait un conflit politique hors du commun. Dans l'espoir de diminuer ces tensions et de générer un savoir consensuel, de nombreux gouvernements se tournent vers des institutions scientifiques ad hoc pour documenter l'élaboration des politiques et répondre aux préoccupations des partie-prenantes. Mais ces évaluations scientifiques permettent-elles réellement de créer une compréhension commune partagée par ces acteurs politiques polarisés? Alors que l'on pourrait croire que celles-ci génèrent un climat d'apprentissage collectif rassembleur, un environnement politique conflictuel rend l'apprentissage entre opposant extrêmement improbable. Ainsi, cette recherche documente le potentiel conciliateur des évaluation scientifique en utilisant le cas des gaz de schiste québécois (2010-2014). Ce faisant, elle mobilise la littérature sur les dimensions politiques du savoir et de la science afin de conceptualiser le rôle des évaluations scientifiques au sein d'une théorie de la médiation scientifique (scientific brokerage). Une analyse de réseau (SNA) des 5751 références contenues dans les documents déposés par 268 organisations participant aux consultations publiques de 2010 et 2014 constitue le corps de la démonstration empirique. Précisément, il y est démontré comment un médiateur scientifique peut rediriger le flux d'information afin de contrer l'incompatibilité entre apprentissage collectif et conflit politique. L'argument mobilise les mécanismes cognitifs traditionnellement présents dans la théorie des médiateurs de politique (policy broker), mais introduit aussi les jeux de pouvoir fondamentaux à la circulation de la connaissance entre acteurs politiques. / Biotechnology, climate change, natural resources, and ecosystem management are all representative of the “new politics of nature” (Hajer 2003), a term encompassing policy issues with high scientific uncertainties, unadapted regulatory regimes, and acute political conflict. In the hope of diminishing these tensions and generating a consensual understanding, several governments mandated ad hoc scientific institutions to document policymaking and answer stakeholder’s concerns. But do those scientific assessments really help to generate a shared understanding between otherwise polarized policy actors? While it would be possible that these create inclusive collective learning dynamics, policy learning has been shown as being extremely unlikely among competing policy actors. Accordingly, this research documents the conciliatory power of scientific assessments using the Quebec shale gas policymaking case (2010–2014). In doing so, it mobilizes the literature stressing the political nature of science to conceptualize scientific assessment in light of a scientific brokerage theory. Empirically, the research uses Social Network Analysis to unravel the collective learning dynamics found in two information networks built from the 5751 references found in the advocacy and technical documents published by 268 organizations during two public consultations. Precisely, findings demonstrate that scientific brokerage can redirect information flows to counteract the divide between collective learning and political conflict. The argument mobilizes cognitive mechanisms traditionally found in policy brokerage theory, but also introduces often forgotten power interplays prominent in policy-related knowledge diffusion.

台灣不動產仲介業,從1977年成立公司組織發展至今32年、不動產仲介業務網路化從1996年至今13年、公部門為不動產交易安全建置e-house從2007年開始運作至今2年,對照2002年至今台灣不動產仲介交易糾紛逐年攀升現象;顯見,付出高額仲介費用買屋及賣屋的不動產消費者,並未因不動產仲介業者的組織規模龐大、營業收入豐碩、網路發達,資訊科技精進及政府成立e-house網站,而得到較完備的不動產交易安全保障。 本研究以滿足消費者需求為基礎,並以提供網絡仲介不動產交易安全環境的“推動方式和實實務層面”為主題,從不動產仲介之起源、不動產仲介市場現況、不動產仲介問題、e-house現況及e-house問題等過程為論述軸線.探討不動產仲介作業流程、不動產仲介交易糾紛原因、不動產網路仲介交易運作、聯賣制度運作不成功、自售網之崛起及e-house網站的政策目標等課題,經由(1)以交易成本及代理理論為基礎的論證;(2)對現行管理仲介業者的不動產經紀業管理條例之法制面與規範的認知;(3)對不動產消費者、不動產服務業者、政府三方不動產網路仲介交易相關主體特性的瞭解; (4)對於民間不動產網站及官方e-house網站仲介交易實務與現行法制規範相互影響,造成推動不動產交易安全障礙的課題進行探討; (5)分析影響不動產消費者使用民間不動產網站及官方e-house網站存在仲介代理問題及高昂仲介費用的交易成本等相關文獻面、法制面、實務面及一般會員使用e-house的問卷調查。綜合研究顯示:(1)台灣不動產仲介業與政府本身皆存在影響不動產交易安全推動的問題;(2)不動產仲介業對消費者可能存在委託代理問題及使用不動產網站產生交易成本的疑慮;(3)不動產仲介交易產生的代理問題及交易成本,會影響消費者對不動產交易行為的決策形式;(4)消費者利用網路進行不動產交易,是一項極為專業且繁瑣的消費活動,不動產仲介交易過程必須專業分工,才能消弭或降低代理問題及交易成本,促進交易安全。 本研究針對影響消費者使用仲介網站交易不動產的問題,嘗試建構「e-house網路交易不動產示範網站」的新思維,提供消費者消除或減少代理問題和交易成本,以促進不動產交易安全;另一方面,也考慮到其他不動產專業人士的權益及政府行政效能的提升。新思維的內容包括(1)建構“整合仲介交易過程之不動產專業分工機制” (2)改造e-house成為「e-house網路交易不動產示範網站」(3)研擬不動產網站經營者之資格條件、不動產網站作業內容及消費者與不動產業者網路作業等規範,並建議政府從「政策面」、「法制面」、「資訊面」、「推動面」及「執行面」等五個構面制定配套措施,消弭或降低代理問題及交易成本,推動不動產交易安全。 關鍵字:不動產仲介業、不動產經紀人、交易成本理論、代理理論、代理問題、e-house網路交易不動產示範網站 / Taiwan real estate brokerage industry appeared as company organization in 1977. In 1996, the real estate brokerage business launched onto internet website. In 2007, Public Security Department setup “e-house” network platform. However, from 2002 till now, the real estate transaction disputes still increase annually. Obviously, large organized real estate firms, developed network, sufficient information nor “e-house” network platform will not guarantee consumers who pay high broker fees to receive better and comprehensive real estate transaction safety. This study is to provide “promoting and practicing aspects” to real estate transaction safety network environment to satisfy consumers’ demands. It intends to look into the starting of real estate brokerage business, the current status of real estate brokerage market, the real estate broker problems, the current “e-house” status and its problems by examining the process of Taiwan real estate brokerage, the real estate transaction disputes, the real estate broker operating network, the failure of MLS, the rise of free broker fee network, and the policy objectives of “e-house” network platform by: (1) Demonstration on the basis of transactional cost and broker theory; (2) Comprehension on the procedures and the norms of Real Estate Broker Management Act; (3) Understand the characteristics of three participants, government, real estate service providers and the consumers, in the real estate transaction; (4) Investigate the conflicts between real estate operation network and the existing regulations that makes the promoting real estate transaction safety to be difficult; (5) Analyze the cost structure between private brokerage system and the official “e-house” system and how a consumer may react to two different systems with regards to legal system, practice and survey. A general conclusion from research indicates the following: (1) Problems appear on both sides of private and government agencies to promote safer and more transparent real estate transaction (2) Real estate brokers have doubts on buyers/seller’s trust on representation issue and the actual transactional cost for using a on-line web-site (3) Cost and representation issue arising from the actual real-estate transaction may Affect forms of consumers’ decision making. (4) Procedures for making an online real estate transaction are very complicated for consumers. Professional brokers have to monitor every step of the way in order to eliminate representation issue, reduce transactional cost, and promote safer transactional security. This study focuses on the problems emerging from consumers using an online real-estate website, while trying to demonstrate a safe “e-house” network platform can actually complete the real estate transaction. Once consumers have enough trust in the “e-house” network platform, it could potentially reduce representation issue problems and transactional cost. On the other hand, this system also protects brokers’ privileges while enhancing government’s efficiency. New concepts to be discussed in this study will include (1) Create a professional and integrated real-estate transactional mechanism. (2) Transform “e-house” into a demonstrated network platform for online real-estate transaction. (3) Set strict standards for qualifying private brokerage to operate an online real-estate network platform, to provide website contents, and operational model between consumer and real-estate broker. (4) Propose necessary measures to government in five aspects: “policy”, “legal system”, “information”, “promotion”, “implementation”. 外國證券商跨境提供國內投資人證券經紀服務之監理法制 / A study on the regulatory regimes governing the foreign securities firms providing securities brokerage service to the domestic investors on a cross-border basis

隨網際網路、行動載具及數位科技之進步,金融服務之提供不再受限於地域上之隔閡。邇來,有許多國際性投資銀行擬透過其所經營之網路交易平台向我國投資人提供證券經紀服務,然因我國現今並未開放外國證券商得跨境提供我國投資人證券經紀服務,在相關規範上付之闕如。 然而,法律上之禁止並無法阻止科技進步興起之跨境證券活動浪潮。如有朝一日我國擬開放外國證券商跨境提供我國投資人證券經紀等金融服務時,應採取何種規範方式及相關規範內容為何,有其討論之需要性及必要性。 按此,本文首先將介紹我國現行證券商相關之規範制度,後參酌美國、澳洲及德國對於外國證券商跨境提供其國內投資人證券經紀服務之規範方式及內容,輔以國際證券管理機構組織所歸納使用於跨境證券活動之三種規範制度,嘗試提出我國對外國證券商跨境提供我國投資人證券經紀服務得採行之規範方式及內容之建議。 本文研究結果建議,我國應針對不同身分別之投資人分別採用國民待遇規範制度及認可規範制度。即在非屬專業投資人部分,採用國民待遇規範制度;而在專業投資人部分,採用認可規範制度。同時,建議就有關跨境提供證券經紀服務之開放可分階段進行。最後,針對我國現行證交法及其相關規定,本文亦參考美國、澳洲及德國在相關規範架構下之細部規定,提出法規修正之建議及我國可能可以考慮之細部規範內容。 在跨境金融服務興起的今日,重新思考及架構一套符合證券及金融市場國際化之規範架構及方式是一個必經的歷程,希望透過本文之研究結果及建議,能幫助我國在此波金融國際化之浪潮中立足國際。 / With the progress of the Internet, mobile vehicles and digital technology, the provision of financial service is no longer limited to geographical barriers. Recently, there are a lots of international investment banks intend to provide securities brokerage services to our domestic investors through their electronic trading platform. However, since Taiwan is not yet open to foreign securities firms to provide securities brokerage service to our domestic investors on a cross-border basis, there is lack of any relevant regulation. Nonetheless, the legal prohibition on the provision of service on a cross-border basis can not stem the tide of the cross-border securities activities resulted by the technological advancement. If one day Taiwan opens the foreign securities firms to provide securities brokerage services and/ or other financial services to our domestic investors on a cross-border basis, it is necessary and a must for Taiwan to consider what regulatory model and what regulations should be taken. Given the above, this study will first introduce the current regulatory regime related to the securities firms in Taiwan, and then take the regulatory regime and regulations governing the foreign securities firms providing securities brokerage service to the domestic investors on a cross-border basis adopted by the US, Australia and Germany and the three types of regulatory regimes summed up by the IOSCO, which are used for the regulation of cross-border securities activities, into account to try to propose the suggestions on the possible regulatory regime and regulations for Taiwan to adopt for this issue. The results of this study suggest that Taiwan should adopt the regulatory tools called National Treatment and Recognition and used them depend on the type of investor. That is, as to the non-professional investor, Taiwan should adopt National Treatment to regulate the cross-border securities brokerage service; and as to the professional investor, Taiwan should adopt Recognition to regulate the same. At the same time, this study suggests the cross- border provision of securities brokerage service could be considered to be opened by phases. Finally, as to the current Taiwan Securities and Exchange Act and its relevant regulations, this study also provide the proposed amendments and the relevant details by making reference to the regulations adopted by the US, Australia and Germany under the regulatory regime of each of them. In today’s world, it is a must to rethink and structure a regulatory regime and regulations that conform to the internationalization of securities and financial markets. It is hopeful that the results and suggestions in this study could assist Taiwan to gain a footing in the arena of the international financial market.

Denna studie undersöker utvecklingen av digitala tjänster och integrationen av innovativ teknik hos försäkringsförmedlingsföretaget Portfolio Försäkra. Under de inledande diskussionerna med VD, Andreas Adolfsson, noterades att företaget hade vissa luckor i sitt digitala tjänsteutbud och saknade användning av innovativ teknik. Bristerna är inte unika för Portfolio Försäkra utan potentiellt förekommande inom hela försäkringssektorn, vilket innebär en stor inverkan på marknadens konkurrens.  I dagens digitala era är expertis inom teknik och innovativa metoder avgörande för försäkringssektorns framgång. Förbättrad digital tjänsteinnovation är nödvändig för att kunderna ska kunna använda information mer effektivt, vilket i slutändan leder till ökad kundlojalitet och kundnöjdhet. Därför är behovet av att förbättra de digitala tjänsterna inom försäkringssektorn absolut nödvändigt.  Syftet med denna undersökning är att fördjupa oss i de digitala möjligheter som finns tillgängliga för Portfolio Försäkra och andra försäkringsbolag som för närvarande saknar de senaste tekniska lösningarna. Vi antar rollen som forskare, genomför intervjuer och kommunicerar med anställda på Portfolio Försäkra. Vår dataanalys och våra intervjuer kommer att hjälpa oss att identifiera problemområden som kan hindra företagets utveckling och kundnöjdhet.  Resultaten tyder på att integrationen av innovation och digital teknik måste bli en integrerad del av Portfolio Försäkra företagskultur för att säkerställa en hållbar och långsiktig tillväxt. Resultaten av denna studie erbjuder värdefulla insikter för andra organisationer inom försäkringssektorn som vill förbättra sina digitaltjänsteinnovation och kundnöjdhet. / This study explores the digital service development and innovative technology integration of Portfolio Försäkra, an insurance brokerage firm. During the initial discussions with the CEO, Andreas Adolfsson, it was noted that the company faced gaps in its digital service offerings and lacked the adoption of innovative technologies. The observed shortcomings are not unique to Portfolio Försäkra but potentially prevalent across the insurance sector, signifying a major impact on market competition.  In today's digital age, expertise in technology and innovative practices is crucial to the success of the insurance sector. Improved digital service innovation is essential for the customers to utilize information more efficiently, ultimately leading to increased customer loyalty and satisfaction. Therefore, the need for digital service improvement in the insurance sector is imperative.  The aim of this research is to delve deeper into the digital opportunities available to Portfolio Försäkra and other insurance companies that currently lack the necessary technological advancements. We adopt the role of researcher, conducting interviews and communicating with Portfolio Försäkra's employees. Our data analysis and interviews will help identify problematic areas that could hinder the company's development and customer satisfaction.  The findings suggest that the integration of innovation and digital technology must become an integral part of Portfolio Försäkra's company culture to ensure sustainable and long-term growth. The results of this study offer valuable insights for other organizations in the insurance sector seeking to enhance their digital service offerings and customer satisfaction.

Comment les différentes étapes du cycle de vie d'une organisation rebelle sont-elles liées les unes aux autres? Comment les individus façonnent-ils les organisations rebelles? Comment les individus sont-ils transformés par leur passage au sein de groupes rebelles? Inspiré par la sociologie politique, la thèse soutient que la formation, le maintien et l'héritage des groupes rebelles sont conditionnés par les expériences, mentalités, liens sociaux et compétences des individus composant ces organisations. En retour, la participation au sein des organisations, de sous-unités et à divers rôles transforme les individus, façonnant les dynamiques de guerre et d'après-guerre. La thèse étudie des mécanismes et processus liant les étapes de vie des groupes rebelles, incluant le courtage, le bricolage institutionnel, la légitimation, la trajectoire de vie et la socialisation à vie. L'article I construit une théorie du bricolage dans la formation des groupes rebelles. Dans les milieux hétérogènes, les organisateurs emploient le courtage et le bricolage institutionnel pour renforcer leur capacité opérationnelle. À l’aide de l'analyse des réseaux sociaux et répertoires organisationnels, l’article retrace la formation de la guérilla urbaine du M-19 en Colombie. Les organisateurs de cette guérilla ont recruté des spécialistes de la violence par le courtage et ont réorganisé diverses formes organisationnelles à travers le bricolage institutionnel pour faciliter la coordination interne de l’organisation naissante. L’article II adopte l'approche relationnelle à la légitimité des groupes armés pour étudier la production culturelle et musicale des FARC en Colombie. L'article analyse 258 chansons, des documents internes de la guérilla et des prestations artistiques. L’article démontre que les FARC employaient la production culturelle pour légitimer la hiérarchie interne du groupe et leurs objectifs face aux élites établies et à la population civile. L'article III développe une typologie des trajectoires et des incidences biographiques des ancien.e.s combattant.e.s. L'outil conceptuel permet d’évaluer la position des individus par rapport à la politique, la violence et l'État ainsi que de retracer des dynamiques complexes au sein des trajectoires de vie. Une fois agrégées, les incidences biographiques contribuent à d'importantes dynamiques d'après-guerre. L'article élabore un nouveau programme de recherche portant sur les vies de l’après-guerre civile. L’article IV étudie les processus de socialisation à vie et l’engagement social des ancien.e.s combattant.e.s. L'article emploi une approche biographique pour retracer les trajectoires de 32 ancien.e.s combattant.e.s du M-19. La socialisation au sein des institutions de travail social et d'enseignement, avant le recrutement et pendant la guerre, a conféré aux ancien.e.s combattant.e.s du M-19 des dispositions et des ressources qui, en interaction avec les opportunités post-démobilisation, a façonné leur engagement social. La dissertation offre une vision holistique des cycles de vie des groupes rebelles et étudie des dynamiques liant l’avant, pendant et après guerre. La thèse contribue à notre compréhension des guerres civiles en analysant des processus longitudinaux façonnant les vies des individus, le contenu et la structure des groupes rebelles et les sociétés. / Political scientists recently started to analyse the organizational and social processes of civil wars. Despite progress, we know little about the trajectories of insurgents and the processes that span through the life cycle of rebel groups. In fact, most theories neglect the longue durée dimension of rebellions. Filling this gap, this thesis constructs a longitudinal approach to the life cycle of rebel groups. How are different stages in the life cycle of a rebel organization linked to one another? How do individuals shape rebel organizations? How are individuals transformed by their passage through rebel groups? Inspired by political sociology, the thesis argues that the formation, maintenance and legacy of rebel groups are conditioned by the experiences, mindsets, social ties and skills of individuals composing those organizations. In turn, participation in organizations, subunits and roles transform individuals, shaping wartime and post-war dynamics. The thesis studies mechanisms and processes linking insurgent group life stages, including brokerage, institutional bricolage, legitimation, life trajectory, and lifelong socialization. Article I constructs a theory of bricolage in rebel group formation. In heterogeneous environments, rebel organizers employ brokerage and institutional bricolage to build operational capacity. The article employs social network analysis and the analysis of organizational repertoires to retrace the formation of the M-19 urban guerrilla in Colombia. M-19 organizers recruited violent specialists through brokerage, and reorganized various organizational forms through institutional bricolage to facilitate internal coordination in the nascent organization. Article II employs the relational approach to armed group legitimacy to study cultural and music production within the FARC guerrilla in Colombia. The article analyses 258 songs, guerrilla internal documents, and artistic performances. It shows that FARC’s cultural production was employed to legitimize the group’s internal hierarchy and its goals in relation to established elites and the civilian population. Article III develops a typology of ex-combatant trajectories and biographical outcomes. The conceptual tool can be used to assess the position of individuals in relation to politics, violence and the state and track complex dynamics in life trajectories. When aggregated, biographical outcomes contribute to important post-war dynamics. The article elaborates a new research agenda on civil war afterlives. Article IV investigates lifelong socialization processes and social engagement amongst ex-combatants. The article employs a biographical approach to study the trajectories of 32 M-19 ex-combatants. Socialization in social work and education institutions in pre-recruitment and wartime life stages provided M-19 ex-combatants with dispositions and resources that, in interaction with post-demobilization opportunities, shaped their social engagement. The dissertation provides a holistic view of rebel group life cycles and studies dynamics linking prewar, wartime and post-war stages. The thesis contributes to our understanding of civil wars by analysing longitudinal processes shaping individual lives, the content and structure of rebel groups and societies. / Recientemente politólog@s han empezado a analizar los diferentes procesos organizativos y sociales de las guerras civiles. A pesar de los avances, sabemos poco sobre las trayectorias de los insurgentes y los procesos que comprenden el ciclo de vida de grupos rebeldes. De hecho, la mayoría de las teorías omiten la dimensión a largo plazo. Llenando este vacío, esta tesis desarrolla una teoría longitudinal de ciclos de vida de grupos rebeldes. ¿Cómo se conectan las diferentes etapas del ciclo de vida de una organización rebelde? ¿Cómo los individuos dan forma a las organizaciones rebeldes? ¿Cómo se transforman los individuos durante su participación en grupos rebeldes? Inspirándose en la sociología política, la tesis argumenta que la formación, el mantenimiento y el legado de los grupos rebeldes están condicionados por las experiencias, mentalidades, vínculos sociales y habilidades individuales de sus participantes. Asimismo, su involucramiento en organizaciones, subunidades y roles también transforma los individuos, moldeando así las dinámicas de guerra y posguerra. Esta tesis estudia mecanismos y procesos que relacionan las etapas de vida de los grupos rebeldes, incluyendo la intermediación, el bricolaje institucional, la legitimación, la trayectoria de vida y la socialización vitalicia. El trabajo demuestra que las FARC empleaban la producción cultural para legitimar la jerarquía interna del grupo y sus objetivos frente a las élites establecidas y la población civil. El artículo III desarrolla una tipología de las trayectorias e implicaciones biográficas de los excombatientes. La herramienta conceptual permite evaluar la posición de los individuos en relación con la política, la violencia y el estado, así como rastrear dinámicas complejas dentro de las trayectorias de vida. La disertación ofrece una visión holística de los ciclos de vida de grupos rebeldes y explora las dinámicas que atraviesan el pre, durante y posguerra. La tesis contribuye a la comprensión de las guerras civiles analizando los procesos longitudinales que influyen vidas individuales, el contenido y la estructura de grupos rebeldes y sociedades.

La dépendance des distributeurs / The dependence of distributors

Les distributeurs sont des intermédiaires économiques car ils offrent sur le marché des produits ou services conçus, fabriqués ou exécutés par d’autres (les fournisseurs). Cette recherche démontre que le degré de protection accordé par le droit positif aux différents distributeurs n’est pas corrélé à leur degré de dépendance aux fournisseurs. Les qualifications de la dépendance sont multiples, incertaines, incohérentes et parfois artificiellement restrictives ou extensives, en droit du travail comme en droit économique. Des distributeurs connaissant un même degré de dépendance à leur fournisseur peuvent être traités de façon différente sans justification au regard des fondements des règles considérées. Il existe ainsi des inégalités de traitement. Il est donc proposé un nouveau droit de la dépendance des distributeurs, plus cohérent et égalitaire. Celui-ci se traduirait par un statut légal des distributeurs remplaçant les multiples statuts spéciaux existants, traçant une frontière plus nette avec le droit du travail et conciliant les intérêts des distributeurs avec la liberté des fournisseurs d’organiser la distribution de leurs produits et services. Dépassant la notion trop restrictive de contrat et les conflits de qualification, ce statut viserait la relation de distribution et prévoirait un régime appréhendant la complexité et l’évolutivité de la dépendance des distributeurs grâce à l’information, à une garantie de revenus et différentes indemnités de fin de relation. / Distributors are economic intermediaries because they offer on the market goods and services produced or served by others (the suppliers). This research demonstrates that the degree of protection offered by the Law to the various distributors isn’t correlated with their degree of dependence towards suppliers. The qualifications of dependence are numerous, incoherent and sometimes artificially restrictive or extensive, in labour law as in business law. Distributors experiencing a same degree of dependence towards their supplier can be treated differently without any justification regarding the grounds of the rules in question. Hence, appear inequalities towards the Law. Therefore, new legal rules are suggested. They would take the form of a statute ruling distributors and replacing the numerous statutes in force at the present time. It would draw a clearer line between labour law and business law and conciliate the distributors’ interests with the freedom of suppliers to organize the distribution of their goods and services. Going other the too restrictive notion of contact and the conflicts between qualifications, this statute would rule the relation of distribution and contain rules comprehending the complex and changing nature of dependence. It would ensure sufficient information of distributors and offer them an income guarantee and various compensations when the relation is terminated.
