L'exigence de sécurité juridique dans le recouvrement des créances / The requirement of legal certainty in debt collectionNiane, Mamoudou 06 May 2014 (has links)
Inspiré par une croyance fondée sur l’inégalité des parties, le droit del’exécution poursuit le dessein d’un recouvrement rapide, sûr et peu coûteux descréances. Afin de relever ce défi, le droit OHADA a fait de la sécurité juridique uneexigence fondamentale devant démontrer son aptitude à répondre aux attentes desdifférentes parties. Cependant, la pratique du recouvrement permet d’identifier dessources d’insécurité juridique préjudiciable au climat de confiance voulu par lelégilateur communautaire. Ainsi, le caractère quasi-informel du recouvrementamiable, la résistance des juridictions nationales ou l’ineffectivité de certainesdécisions judiciaires perturbent la prévisibilité inhérente à l’exigence de sécuritéjuridique. Conçu comme un système cohérent, le droit de l’exécution OHADA offredes ressources interprétatives propices à la correction des lacunes observées. Dansces conditions, le juge occupe un rôle central dans la promotion de la sécuritéjuridique. D’une part, il assure le contrôle des prérogatives individuelles des partiesdans le sens de réguler les conflits d’intérêts induits par des attentes souventcontradictoires. Dans cette optique, l’une des finalités de l’intervention du juge estd’assurer le respect du recours à la contrainte dans l’exécution. D’autre part,l’exigence de sécurité juridique servira au juge à établir une meilleure corrélationentre toutes les techniques garantissant le paiement du créancier dans un souciconstant d’efficacité. En l’absence d’une consécration explicite de la sécuritéjuridique, la proposition d’une relecture de la théorie de l’exécution en droit privé offrel’opportunité de voir tous les mécanismes de son intégration dans le recouvrementdes créances en tenant compte de la réalité juridico-économique de la créance. / Inspired by the belief grounded on inequalities between parties, theenforcement law continues to design a fast, safe and inexpensive debt recovery. Tomeet this challenge, the OHADA law made legal certainty requirement which mustshow its ability to live up to the expectations of the different parties. However, therecovery practice identifies sources of legal uncertainty detrimental to the climate oftrust advocated by the Community legislature. Thus, the quasi-informal nature of debtcollection, the resistance of national courts or the ineffectiveness of certain judicialdecisions disrupt the predictability pertaining to the requirement of legal certainty.Designed as a coherent system, The OHADA enforcement law affords interpretativeresources conducive to the rectification of the flaws spotted. In these circumstances,the judge plays a central role in promoting legal certainty. On the one hand, hemonitors the individual prerogatives of the parties in the direction of regulatingconflicts of interest arising from the often conflicting expectations. In this context, oneof the purposes of the intervention of the judge is to ensure compliance of coercion inthe execution. On the other hand, the demand of legal certainty will allow the judge toestablish a better correlation between all techniques guaranteeing the payment of thecreditor for the constant sake of efficacy. In the absence of an explicit consecration oflegal certainty, the proposal for a reinterpretation of the theory of enforcement lawprovides the opportunity to see all the mechanisms of its integration in debt recovery,taking into account the legal and economic substance of the claim.

Från denna generella princip finns undantag från skatteplikt, varav försäkringstjänster är ett av undantagen. Undantaget för försäkringstjänster har nästan inte behandlats i doktrin och därför är uppsatsens syfte att utreda vad som omfattas av undantagsbestämmelsen för försäkringstjänster. Undantaget från skatteplikt för försäkringstjänster stadgas i 3 kap. 10 § mervärdeskattelagen<! [if !supportFootnotes] >[1]<! [endif] >, ML, vilket motsvaras av art. 135.1 a i mervärdesskattedirektivet<! [if !supportFootnotes] >[2]<! [endif] >. Då EG-rätten är överordnad svensk rätt, i och med Sveriges medlemskap i EU, sker utredningen av undantagsbestämmelsen i 3 kap. 10 § ML utifrån EG-rätten. Inom EG-rätten är mervärdesskatten reglerad i mervärdesskattedirektivet, som den svenska mervärdesskattelagstiftningen bygger på. Den svenska mervärdesskattelagstiftningen återfinns i ML. Vad som omfattas av undantaget för försäkringstjänster definieras varken i mervärdesskattedirektivet eller ML och ledning måste därför sökas i rättspraxis. EG-domstolen har tolkat omfattningen av bestämmelsen i förhandsbesked begärda av medlemsstaterna. Bestämmelsen delas upp i två delfrågor som EG-domstolen besvarar i förhandsbeskeden. Delfrågorna är vad som omfattas av en försäkrings- och återförsäkringstransaktion och vad begreppet tjänster med anknytning till en försäkrings- och återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent omfattar. Av EG-domstolens uttalanden kan slutsatsen dras, att det avgörande för en försäkringstransaktion är att en försäkringsgivare eller skattskyldig person tillhandahåller försäkringstagaren en försäkringstjänst. Försäkringstagaren ska erlägga en premie till tillhandahållaren av försäkringen och i utbyte erhålla ett skydd mot risken. Inträffar en händelse ska försäkringsgivaren tillhandahålla den prestation som avtalats om. En återförsäkringstransaktion föreligger endast när försäkringsgivaren överlåter den överenskomna risken till ett återförsäkringsföretag. Vad som omfattas av begreppet tjänster med anknytning till en försäkrings- och återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent kan slutsatsen dras utifrån EG-domstolens uttalanden, att det krävs ett direkt eller indirekt rättsförhållande mellan försäkringsmäklaren eller försäkringsagenten och försäkringsgivaren och försäkringstagaren. Vad som bedöms som en försäkringsmäklare och försäkringsagent ska avgöras utifrån vad verksamheten består i och att verksamheten kännetecknar en försäkringsmäklare och en försäkringsagents verksamhet. Utifrån ett svenskt perspektiv är svenska domstolar skyldiga att tillämpa direktivkonform tolkning av nationella regler som bygger på gemenskapsrättsliga bestämmelser. Regeringsrätten och Skatterättsnämnden har tolkat omfattningen av undantagsbestämmelsen i ett flertal fall. Avseende begreppet försäkringstransaktion skiljer sig Regeringsrätten och Skatterättsnämndens uttalanden från EG-praxis, genom att de inte uttalar sig om att även en skattskyldig person kan tillhandahålla en försäkringstjänst. I övrigt följer Regeringsrätten och Skatterättsnämnden EG-praxis avseende tolkningen av begreppet försäkringstransaktion. Regeringsrätten och Skatterättsnämnden verkar däremot göra en snävare bedömning än EG-domstolen av vad som omfattas av begreppet tjänster med anknytning till en försäkrings- och återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent, då de ställer upp ytterligare kriterier för vad som krävs för en undantagen försäkringstjänst. Vid tolkning av undantagsbestämmelsen ska hänsyn tas till de allmänna rättsprinciper som finns i EG-rätten. Principerna är överordnade bestämmelserna i mervärdesskattedirektivet och därför ska bestämmelserna vara förenliga med principerna. Uppsatsen syftar därför vidare till att analysera huruvida undantagsbestämmelsen i 3 kap. 10 § ML är förenlig med principerna om konkurrensneutralitet och rättssäkerhet. Principerna är komplexa och definieras på olika sätt i doktrin. I uppsatsen definieras principerna och analyseras utifrån den uppställda definitionen. Analysen som görs utvisar att såsom bestämmelsen ser ut idag, är den inte konkurrensneutral eller rättssäker. Ett nytt förslag om ändring av direktiv 2006/112/EG om ett gemensamt system för mervärdesskatt, i fråga om behandling av försäkringstjänster och finansiella tjänster har lagts fram av kommissionen. [endif] > Value Added Tax, VAT, is a general consumption tax that is added to almost all consumption of goods and services. From the general principle there are some exemptions from tax duty whereof insurance services are one of those. The exemption has been very little discussed in doctrine hence the purpose of this thesis is to examine what is covered by the exemption from VAT for insurance services. The exemption from VAT for insurance services is stated in chapter 3 section 10 in the Swedish VAT act<! [if !supportFootnotes] >[1]<! [endif] >, which corresponds to article 135.1 a of the VAT directive<! [if !supportFootnotes] >[2]<! [endif] >. Since EC Law is superior to Swedish law, with Sweden’s entry to the European Union, the examination of the exemptions rules is grounded from the EC law. Within the EC law the VAT is regulated in the VAT directive, which also lay ground for the Swedish VAT regulation. The Swedish VAT regulation is found within the Swedish VAT act. What is included in the term insurance services is not defined either in VAT directive nor the Swedish VAT act, hence conclusions must therefore be sought in case law. The European Court of Justice, ECJ has perceived the scope of the provision in advance notice demanded from the membership states. The provision is divided in two sub-questions that the ECJ answers in the preliminary decision. The sub-questions are; what is covered by an insurance and a reinsurance transaction, and what the concept; services related to an insurance and a reinsurance transaction that is performed by an insurance broker or insurance agent covers. From the ECJs’ statements can be concluded that; the crucial factor for an insurance transaction is that an insurance provider or a taxpayer provides the insurance holder an insurance service. The insurance holder shall pay a premium to the insurance provider and in return receive protection against the risk. Should an action occur, to which the insurance holder has insurance, the insurance provider shall offer the agreed performance. A reinsurance transaction exists only when the insurance provider alienate the agreed risk to a reinsurance company Regarding what is covered by the term; services related to an insurance and a reinsurance transaction that is performed by an insurance broker or insurance agent, a conclusion can be made from the statements of the ECJ, that a direct or indirect legal relationship between the insurance broker or the insurance agent and the insurance provider and the insurance holder is required. What is judged as an insurance broker and insurance provider shall be determined from what the main activity consist of and that the activity characterize an insurance broker and insurance agent’s activity. From a Swedish perspective the Swedish courts are obliged to interpret the national law in conformity with EC law, when the national law is based on EC law. The Supreme Administrative Court of Sweden and Skatterättsnämnden have interpreted the extent of the exemption rules in a number of cases. Regarding the term insurance transaction the Supreme Administrative Court of Sweden and Skatterättsnämndens’ statement differ from EC case law, since they fail to mention that also a taxpayer can provide an insurance service. Apart from that the Supreme Administrative Court of Sweden and Skatterättsnämnden follow EC case law regarding the interpretation of the term insurance service. The Supreme Administrative Court of Sweden and Skatterättsnämnden seems to make a more narrow interpretation than the ECJ when it comes to what is covered by the term, services related to a insurance and a reinsurance transaction that is performed by a insurance broker or insurance agent as they add even more criteria about what is needed by an exempted insurance service. In the interpretation of the exemption rules consideration has to be taken to general legal principles that exists in the EC law. The principles are superior the provisions of the VAT directive and therefore the provisions must be in accordance with the principles. The examination is therefore conducted from whether or not the exemption rules in chapter 3 section 10 in the Swedish VAT act corresponds with the principles of competition neutrality and legal certainty. The principles are complex and defined in different ways in doctrine. In the thesis the principles are defined and analyzed based on that definition. The analysis in this thesis concludes that as the provisions are today, they neither fulfill the principle of competition neutrality nor the principle of legal certainty. A new proposal to amend the directive 2006/112/EC on the common system of VAT, as regards the treatment of insurance and financial services, has been presented by the European Commission. Från denna generella princip finns undantag från skatteplikt, varav försäkringstjänster är ett av undantagen. Undantaget för försäkringstjänster har nästan inte behandlats i doktrin och därför är uppsatsens syfte att utreda vad som omfattas av undantagsbestämmelsen för försäkringstjänster. Undantaget från skatteplikt för försäkringstjänster stadgas i 3 kap. 10 § mervärdeskattelagen<! [if !supportFootnotes] >[1]<! [endif] >, ML, vilket motsvaras av art. 135.1 a i mervärdesskattedirektivet<! [if !supportFootnotes] >[2]<! [endif] >. Då EG-rätten är överordnad svensk rätt, i och med Sveriges medlemskap i EU, sker utredningen av undantagsbestämmelsen i 3 kap. 10 § ML utifrån EG-rätten. Inom EG-rätten är mervärdesskatten reglerad i mervärdesskattedirektivet, som den svenska mervärdesskattelagstiftningen bygger på. Den svenska mervärdesskattelagstiftningen återfinns i ML. Vad som omfattas av undantaget för försäkringstjänster definieras varken i mervärdesskattedirektivet eller ML och ledning måste därför sökas i rättspraxis. EG-domstolen har tolkat omfattningen av bestämmelsen i förhandsbesked begärda av medlemsstaterna. Bestämmelsen delas upp i två delfrågor som EG-domstolen besvarar i förhandsbeskeden. Delfrågorna är vad som omfattas av en <i>försäkrings- </i>och<i> återförsäkringstransaktion</i> och vad begreppet<i> tjänster med anknytning till en försäkrings- </i>och<i> återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent</i> omfattar.</p><p>Av EG-domstolens uttalanden kan slutsatsen dras, att det avgörande för en <i>försäkringstransaktion </i>är att en försäkringsgivare eller skattskyldig person tillhandahåller försäkringstagaren en försäkringstjänst. Försäkringstagaren ska erlägga en premie till tillhandahållaren av försäkringen och i utbyte erhålla ett skydd mot risken. Inträffar en händelse ska försäkringsgivaren tillhandahålla den prestation som avtalats om. En <i>återförsäkringstransaktion </i>föreligger endast när försäkringsgivaren överlåter den överenskomna risken till ett återförsäkringsföretag.</p><p>Vad som omfattas av begreppet <i>tjänster med anknytning till en försäkrings- </i>och<i> återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent </i>kan slutsatsen dras utifrån EG-domstolens uttalanden, att det krävs ett direkt eller indirekt rättsförhållande mellan försäkringsmäklaren eller försäkringsagenten och försäkringsgivaren och försäkringstagaren. Vad som bedöms som en försäkringsmäklare och försäkringsagent ska avgöras utifrån vad verksamheten består i och att verksamheten kännetecknar en försäkringsmäklare och en försäkringsagents verksamhet.</p><p>Utifrån ett svenskt perspektiv är svenska domstolar skyldiga att tillämpa direktivkonform tolkning av nationella regler som bygger på gemenskapsrättsliga bestämmelser. Regeringsrätten och Skatterättsnämnden har tolkat omfattningen av undantagsbestämmelsen i ett flertal fall. Avseende begreppet <i>försäkringstransaktion </i>skiljer sig Regeringsrätten och Skatterättsnämndens uttalanden från EG-praxis, genom att de inte uttalar sig om att även en skattskyldig person kan tillhandahålla en försäkringstjänst. I övrigt följer Regeringsrätten och Skatterättsnämnden EG-praxis avseende tolkningen av begreppet <i>försäkringstransaktion</i>. Regeringsrätten och Skatterättsnämnden verkar däremot göra en snävare bedömning än EG-domstolen av vad som omfattas av begreppet <i>tjänster med anknytning till en försäkrings- </i>och<i> återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent</i>,<i> </i>då de ställer upp ytterligare kriterier för vad som krävs för en undantagen försäkringstjänst.</p><p>Vid tolkning av undantagsbestämmelsen ska hänsyn tas till de allmänna rättsprinciper som finns i EG-rätten. Principerna är överordnade bestämmelserna i mervärdesskattedirektivet och därför ska bestämmelserna vara förenliga med principerna. Uppsatsen syftar därför vidare till att analysera huruvida undantagsbestämmelsen i 3 kap. 10 § ML är förenlig med principerna om konkurrensneutralitet och rättssäkerhet. Principerna är komplexa och definieras på olika sätt i doktrin. I uppsatsen definieras principerna och analyseras utifrån den uppställda definitionen. Analysen som görs utvisar att såsom bestämmelsen ser ut idag, är den inte konkurrensneutral eller rättssäker.</p><p>Ett nytt förslag om ändring av direktiv 2006/112/EG om ett gemensamt system för mervärdesskatt, i fråga om behandling av försäkringstjänster och finansiella tjänster har lagts fram av kommissionen. [endif] ></p><p>Value Added Tax, VAT, is a general consumption tax that is added to almost all consumption of goods and services. From the general principle there are some exemptions from tax duty whereof insurance services are one of those. The exemption has been very little discussed in doctrine hence the purpose of this thesis is to examine what is covered by the exemption from VAT for insurance services. The exemption from VAT for insurance services is stated in chapter 3 section 10 in the Swedish VAT act<! [if !supportFootnotes] >[1]<! [endif] >, which corresponds to article 135.1 a of the VAT directive<! [if !supportFootnotes] >[2]<! [endif] >. Since EC Law is superior to Swedish law, with Sweden’s entry to the European Union, the examination of the exemptions rules is grounded from the EC law. Within the EC law the VAT is regulated in the VAT directive, which also lay ground for the Swedish VAT regulation. The Swedish VAT regulation is found within the Swedish VAT act. What is included in the term insurance services is not defined either in VAT directive nor the Swedish VAT act, hence conclusions must therefore be sought in case law. The European Court of Justice, ECJ has perceived the scope of the provision in advance notice demanded from the membership states. The provision is divided in two sub-questions that the ECJ answers in the preliminary decision. The sub-questions are; what is covered by an <i>insurance </i>and<i> a reinsurance transaction</i>, and what the concept<i>; services related to an insurance </i>and<i> a reinsurance transaction that is performed by an insurance broker or insurance agent</i> covers.</p><p>From the ECJs’ statements can be concluded that; the crucial factor for an <i>insurance transaction</i> is that an insurance provider or a taxpayer provides the insurance holder an insurance service. The insurance holder shall pay a premium to the insurance provider and in return receive protection against the risk. Should an action occur, to which the insurance holder has insurance, the insurance provider shall offer the agreed performance. A reinsurance transaction exists only when the insurance provider alienate the agreed risk to a reinsurance company</p><p>Regarding what is covered by the term;<i> services related to an insurance </i>and<i> a reinsurance transaction that is performed by an insurance broker or insurance agent</i>, a conclusion can be made from the statements of the ECJ, that a direct or indirect legal relationship between the insurance broker or the insurance agent and the insurance provider and the insurance holder is required. What is judged as an insurance broker and insurance provider shall be determined from what the main activity consist of and that the activity characterize an insurance broker and insurance agent’s activity.</p><p>From a Swedish perspective the Swedish courts are obliged to interpret the national law in conformity with EC law, when the national law is based on EC law. The Supreme Administrative Court of Sweden and Skatterättsnämnden have interpreted the extent of the exemption rules in a number of cases. Regarding the term insurance transaction the Supreme Administrative Court of Sweden and Skatterättsnämndens’ statement differ from EC case law, since they fail to mention that also a taxpayer can provide an insurance service. Apart from that the Supreme Administrative Court of Sweden and Skatterättsnämnden follow EC case law regarding the interpretation of the term insurance service. The Supreme Administrative Court of Sweden and Skatterättsnämnden seems to make a more narrow interpretation than the ECJ when it comes to what is covered by the term, <i>services related to a insurance </i>and<i> a reinsurance transaction that is performed by a insurance broker or insurance agent</i> as they add even more criteria about what is needed by an exempted insurance service.</p><p>In the interpretation of the exemption rules consideration has to be taken to general legal principles that exists in the EC law. The principles are superior the provisions of the VAT directive and therefore the provisions must be in accordance with the principles. The examination is therefore conducted from whether or not the exemption rules in chapter 3 section 10 in the Swedish VAT act corresponds with the principles of competition neutrality and legal certainty. The principles are complex and defined in different ways in doctrine. In the thesis the principles are defined and analyzed based on that definition. Previous issue date: 2011-02-08 / This work deals with the principle of protection of legitimate expectations on tax matters and modulation effects of the ruling. At first, we made an approach about the relationship between state and society, exploring the formation of the confidence. Further, we studied the relationship of taxation and pointed the need to protect the citizen, as a taxpayer, in spite of acts emanating from the state. We explain the concept of confidence, whose protection is moving up to the level of principle, discussing their relationship with other principles and including other sciences such as accounting and economics. We also developed the need to use the balance (proportionality and reasonableness) on the relationship between principles. Later, we move to analysis of the principle of protection of confidence in Brazil, especially by the judiciary and particularly in the sphere of taxation. From this point, we started thinking about the meaning and scope of expression jurisprudence, explaining that there are situations where its modification is necessary or even inevitable, necessitating the analysis of their effects in relation to citizens, even when it comes of tax matters. In addition, we seek plea in modulating effects of the judicial decision to justify the protection of legitimate expectations of taxpayers. Finally, we analyze some cases tried in both the administrative and the judicial tax, than we could conclude by the need to safeguard the citizen's right not to be surprised by the abrupt change of
jurisprudence, to the extent that there are effective tools to prevent this violation of a constitutionally protected right to life. / O presente trabalho trata do princípio da proteção à confiança legítima em matéria tributária e a modulação de efeitos da decisão judicial. Em um primeiro momento, fizemos uma abordagem a respeito da relação entre o Estado e a sociedade, explorando a formação da relação de confiança. Na sequência, estudamos a relação tributária e apontamos a necessidade de proteção do cidadão, na qualidade de contribuinte, em face dos atos emanados do Estado. Explicitamos o conceito de confiança, cuja proteção é galgada ao nível de princípio, discorrendo sobre sua relação com outros princípios e inclusive outras ciências, tais como a contabilidade e a economia. Também desenvolvemos a necessidade do uso da ponderação (proporcionalidade e razoabilidade) na relação entre princípios. Posteriormente, avançamos para análise da aplicação do princípio da proteção à confiança no Brasil, especialmente pelo Poder Judiciário e particularmente no âmbito tributário. A partir desse ponto, iniciamos a reflexão a respeito do significado e da abrangência da expressão jurisprudência, esclarecendo que há situações em que sua modificação se torna necessária ou mesmo inevitável, tornando necessária a análise de seus efeitos em relação aos cidadãos, inclusive quando se trata de matéria tributária. Ademais, buscamos fundamento na modulação de efeitos da decisão judicial para justificar a proteção da expectativa legítima dos contribuintes. Ao final, são analisados alguns casos julgados tanto na esfera judicial quanto administrativa tributária, do que pudemos concluir pela necessidade de se resguardar o direito do cidadão de não ser
surpreendido abruptamente pela mudança jurisprudencial, na medida em que há instrumentos eficazes para evitar essa violação a um bem da vida constitucionalmente protegido.

Enfant de la jurisprudence, le droit à l'image est une prérogative attachée à l'individu qui a longtemps été discutée. Si aujourd'hui une certaine stabilité théorique a été trouvée, celle-ci demeure néanmoins relative du fait de sa non-reconnaissance par la législation française. Il recouvre différentes réalités et ainsi concerner l'image d'une oeuvre, celle d'un bien mobilier ou immobilier, ou encore, être relatif aux traits des individus eux-mêmes. C'est sur cette dernière dimension que la présente étude a entendu s'attarder, celle-ci présentant une certaine complexité juridique liée à la défaillance législative et à la place prépondérante de la jurisprudence au sein du droit à l'image. Le choc résultant de la rencontre entre un droit théorique, dépourvu de régime juridique officiel, et la pratique judiciaire conduit de facto, à une instabilité et une insécurité juridique avérées, en incompatibilité totale avec la notion de droit de la personnalité telle qu'énoncée par la théorie des droits de l'Homme.Les interrogations induites par cette étude ont abouti à des conclusions quelque peu funestes. Tout d'abord, le droit à l'image demeure fondé sur un régime hybride dont la nature apparaît être, plus que jamais, juridiquement contestable et largement contestée. Ensuite, la seconde conclusion met en évidence la place trop importante laissée aux juridictions en cette matière, ce qui conduit à des disparités inconciliables avec les notions d'égalité, d'impartialité et de fiabilité. Dès lors, une révision globale du droit à l'image, et la mise en place d'un régime juridique légal autonome semblent être aussi bien nécessaires qu'inévitables. / Image rights are a concept derived from Nineteenth Century jurisprudence and have been mutating for a long time. If some kind of theoretical stability has now been established, it remains only relative because image rights are in fact excluded from French legislation. Image rights bring together different realities. They could concern the image of a work and derive from copyright, thereby concerning property law; or concern the features of individuals themselves.This study will deal with this second aspect, presenting a degree of legal complexity linked to inadequate legislation and the dominant role of jurisprudence in image rights. The shock of the encounter between a theoretical right having no proper juridical status and judicial practice leads de facto to evident legal uncertainty and instability which are completely incompatible with the notion of rights inherent to the human being as outlined by human rights theory. The questions raised by this study, which involve both the imperfections of the legal framework conferred on image rights and existing incompatibilities between theory and practice, have reached unsatisfactory conclusions. To being with, the first conclusion underlines that image rights remain based on a hybrid which seems more than ever contestable, and often contested, from a juridical point of view. And secondly, the excessively important role left to jurisdictions in image rights leads to disparities which are inconsistent with notions of equality, impartiality and dependability. Therefore, a comprehensive review of image rights, and the establishment of an independent statutory legal regime appear to be both necessary and inevitable.

POTERE PUBBLICO E AUTOTUTELA AMMINISTRATIVA / Public authority and autoprotection powersSILVESTRI, MAURO 08 July 2019 (has links)
La tesi ha per oggetto l’autotutela amministrativa, specialmente quella c.d. decisoria “spontanea”, ovvero quell’insieme di poteri che consentono all’amministrazione di riesaminare i propri provvedimenti e di rimuoverli a vario titolo.
Di questi poteri si è indagato il fondamento dogmatico e positivo.
La questione del fondamento è stata per lunghi anni affrontata dalla dottrina e dalla giurisprudenza in termini totalmente pre-critici e non problematici: l’esistenza di questi poteri era semplicemente scontata e le riflessioni sulla loro base giuridica si esaurivano perlopiù nella constatazione della loro necessità nell’immemore consenso circa la loro ammissibilità.
Negli ultimi anni, invece, una parte degli Autori ha disconosciuto la natura implicita e per così dire “originaria” di questi poteri e ne ha perciò patrocinato la stretta riconduzione al principio di legalità: in altre parole, l’annullamento e la revoca non sarebbero affatto conseguenza della c.d. inesauribilità del potere amministrativo – negata da questa dottrina – e sarebbero perciò oggi ammissibili unicamente nei casi e nei modi disciplinati dalle due norme introdotte nella legge sul procedimento nel 2005. Ciò a garanzia della certezza dei rapporti giuridici e del legittimo affidamento dei destinatari dei provvedimenti ampliativi.
Secondo un filone ricostruttivo in pare contrastante con il primo, altri Autori hanno inteso valorizzare gli elementi de iure condito a favore della obbligatorietà dell’avvio del procedimento di riesame, auspicandone contemporaneamente la generalizzazione, nell’ottica di una più complessiva trasformazione dell’annullamento d’ufficio in un nuovo istituto ibrido, rispondente alla funzione di alternative dispute risolution system o, se si vuole, di ricorso gerarchico. Per le stesse ragioni, l’istituto dovrebbe perdere il carattere ampiamente discrezionale, in favore di una vincolatezza totale o parziale. Questo secondo “fronte di attacco” alla ricostruzione tradizionale intende offrire soluzione al venir meno del sistema dei controlli di legalità sull’azione amministrativa.
Lo studio ha sottoposto a verifica entrambi i filoni evolutivi richiamati, discostandosi dal secondo e, pur accogliendo parte delle argomentazioni ad esso sottostanti, anche dal primo.
Quanto alla teoria dell’esauribilità del potere amministrativo, oggetto della prima linea evolutiva, si è ritenuto di condividere le considerazioni circa la tutela dell’affidamento degli interessati e della stabilità dei rapporti giuridici. È parsa tuttavia meglio rispondente alle categorie generali e alle esigenze del sistema (anche sulla base di una visione del diritto amministrativo quale “diritto dei terzi”, per natura volto alla tutela dell’interesse generale e non solo dell’interesse privato particolare coinvolto dall’esercizio del potere) la conservazione della tradizionale inesauribilità del potere, seppur assai mitigata, nella pratica, con riferimento all’esercizio dei poteri di ritiro degli atti favorevoli ai privati il cui affidamento sia concretamente meritevole di tutela.
La natura discrezionale dell’annullamento d’ufficio (e della revoca), sottoposta a critica dalla seconda linea evolutiva, viene difesa sia sul piano del diritto positivo e pretorio (attraverso la riconduzione dei principali casi di annullamento c.d. doveroso al modello generale), sia sul piano delle categorie generali, a partire dalla natura dei poteri coinvolti e dall’analisi delle posizioni giuridiche dei soggetti interessati dai procedimenti di secondo grado. / The thesis focuses on the Italian system of so called autoprotection or selfprotection. This expression refers to the powers of public administration to revoke its own acts when deemed necessary to repair a vice of legitimacy or a vice of opportunity, without being bind to resort to the courts.
Given the aim of this powers – the same of first grade powers plus a semi-judicial one – they are usually meant by judges and scholars as “widely discretionary”. Furthermore, it has always been believed that the choice to activate the correspondent proceeding is totally free for public administration; consequently, a demand of interested parties does not make binding the start of the procedure, opposite to what happens with administrative appeal proceedings.
In recent years ECJ, ECHR and national case law has emboldened the limits to selfredress, making clear that legitimate expectations and the public interest to legal certainty must be taken into consideration and given sufficient protection. Lately, also the Legislator followed, making the annulment and the revocation harder to be put in effect when the first act is favorable to the addressed subject. In such cases, the revocation cannot be ordered for a mere reconsideration of already known circumstances (ius poenitendi) but only if new ones show up. At the same time, ex officio annulment is precluded after 18 months from the issuing of the first act, instead of the previous general limit of a “reasonable time”.
On the other hand, the case law has apparently pointed out some hypothesis of mandatory annulment, such as for “anticomunitarian acts” and cost-producing acts.
Based on these two orientation, some scholars suggested a global rethinking of the self-protection, its bases and its rules.
The study analyzes the case law and the latest legislative reforms, proving that no mandatory annulment exists in the Italian legal system. Therefore, nor the ECJ principle of equivalence nor other principles require that selfredress become generally obliged.
The thesis also aims to prove that selfprotection remains a discretionary power, in order to ensure that the contrasting needs (the rule of law on the one hand, and the legal certainty and legitimate expectation on the other hand) can be properly balanced in every decision, according to the Constitutional provision of article 97, which requires that both impartiality and good administration are pursued.

A utilização correta da jurisprudência conduzirá a sociedade brasileira a uma maior estabilidade jurisprudencial, com respeito ao princípio da isonomia, não somente diante da norma legislada como também perante a norma judicada.
Deve-se afastar a discrepância de decisões judiciais relativas ao mesmo tema, que tratam desigualmente os iguais, evitando assim o longo percurso das vias recursais para se obter um julgamento isonômico em situações idênticas. O princípio da isonomia visa garantir que todos recebam tratamento igualitário da lei e, de outro lado, oferece a certeza de que todos os juízes devem decidir de modo análogo quando se depararem diante de situações semelhantes.
A jurisprudência, uma vez que traduz a interpretação da norma, deve ser estável e previsível, com o fito de pautar as condutas dos jurisdicionados em virtude de se conhecer o entendimento da Corte máxima a respeito de uma determinada matéria. Um direito instável e imprevisível não gera a segurança jurídica, nem a pacificação social que razoavelmente se espera.
A aplicação da jurisprudência no tempo, através da modulação, ganha novos contornos em virtude de sua previsão legal no projeto do Código de Processo Civil. A mudança de entendimento sedimentado observará a necessidade de fundamentação adequada e específica, considerando o imperativo de estabilidade das relações jurídicas (art. 847, 1 do projeto concluído no Senado Federal). Privilegia-se, além do princípio da segurança jurídica, o princípio da confiança que deve ter como uma das suas consequências que a expectativa legítima do jurisdicionado seja respeitada mediante a aplicação da jurisprudência dominante antiga e mais benéfica para o jurisdicionado.
Neste contexto, em se pensando em uma reforma processual efetiva, deve-se ter como objetivo a ser seguido, além da celeridade processual e eficiência dos atos jurisdicionais, a uniformização da jurisprudência, eis que a necessidade de formação de uma só pauta de conduta para o jurisdicionado deve ser o objetivo almejado. E este objetivo só será alcançado quando houver uma uniformização e aplicação da jurisprudência dominante.
Os instrumentos processuais inseridos no Código de Processo Civil devem ser reavaliados e novos elaborados, já que até agora serviram para dirimir conflitos intersubjetivos e não mais respondem satisfatoriamente às novas situações, que são as necessidades e valores de uma sociedade globalizada, massificada. / The correct use of case law will lead Brazilian society to a greater judicial stability that complies with the principle of equality, not only before legal rules as well as before judicial norms.It should be avoided the discrepancy of judgments related to the same matter, which unequally treat the ones in the same circumstances, thus avoiding the long judicial journey in order to obtain a uniform judgment for similar situations. An unique agenda of conduct for the claimants should be desired as a goal. And this can only be achieved when there is a standardization and application of prevailing jurisprudence.

La France et la Côte d’Ivoire sont deux États qui présentent des similitudes dues principalement à leur passé colonial commun ; mais il s’agit également de deux États qui présentent de nombreuses différences tenant notamment à leur niveau de développement. Si les règles de droit fiscal substantiel au sein de chacun de ces deux États permettent d’étudier les exigences de sécurité juridique et les moyens par lesquels elles sont prises en compte, c’est en réalité la pratique processuelle qui révèle de manière plus substantielle l’effectivité de cette prise en compte. Au demeurant, la problématique de la sécurité juridique n’est bien souvent réduite qu’aux seules exigences d’accessibilité, de stabilité ou de prévisibilité de la norme. Ce qui témoigne au fond d’une approche partielle de l’exigence de sécurité juridique tendant à en limiter l’étude à la qualité formelle et à l’évolution temporelle des actes juridiques. La prise en compte d’une pluralité de systèmes juridiques différents révèle cependant que la notion de sécurité juridique ne ramène pas nécessairement à un contenu univoque. En effet, l’insécurité juridique ne s’exprimant pas toujours en des termes identiques d’un cadre juridique à un autre, la sécurité juridique pourrait se révéler polysémique, voire antinomique, d’un système juridique et fiscal à un autre. Ainsi donc, au-delà de la norme, la sécurité juridique s’applique également au cadre et au système juridique ainsi qu’à la pratique juridique et juridictionnelle. La sécurité juridique apparaît donc, en droit fiscal, comme l’expression de la fiabilité d’un cadre et d’un système juridiques et fiscaux, à travers des normes de qualité offrant une garantie d’accessibilité et d’intelligibilité ainsi que des moyens pour le contribuable de bâtir des prévisions ou donner satisfaction à celles légitimement bâties. En outre, au-delà du cadre imposé par la présente thèse, il convient d’aborder la problématique de la sécurité juridique dans une approche moins restrictive, afin de ne point en occulter les aspects historiques, philosophiques, sociologiques et juridiques essentiels à une étude d’ensemble de la question. / France and Côte d'Ivoire are two countries with similarities mainly due to their common colonial past; but they are also two countries with many differences especially due to their level of development. While the rules of substantive tax law within each of these two countries make it possible to study the requirements of legal certainty and the means whereby they are taken into account, it is actually the procedural practice that reveals more substantively the effectiveness of this consideration. It should also be noted that the issue of legal certainty is often reduced to the only requirements of accessibility, stability or predictability of the standard. This actually reflects a partial approach to the requirements of legal certainty that tends to limit its study to the formal quality and the temporal evolution of legal acts. Taking into account a plurality of different legal systems, however, reveals that the concept of legal certainty does not necessarily lead to an unequivocal content. Indeed, since legal certainty is not always expressed in identical terms from one legal framework to another, legal certainty could prove to be polysemic, or even antinomic, from one legal and fiscal system to another. Thus, beyond the norm, legal certainty also applies to the legal framework and system as well as to the legal and judicial practice. Legal certainty thus, appears in tax law, as an expression of the reliability of a legal and fiscal framework and system, through quality standards, offering a guarantee of accessibility and intelligibility, as well as means for the taxpayer to build predictions or satisfy those legitimately built. Moreover, beyond the framework imposed by the present dissertation, it is important to deal with the problem of legal certainty in a less restrictive way, so as not to obscure the historical, philosophical, sociological and legal aspects essential to a holistic study of the issue.

El trabajo está montado como un intencionado diálogo con los criterios esgrimidos por el Tribunal Constitucional sobre esta materia (desbordamiento material de las leyes de presupuestos) en su ya dilatada jurisprudencia. Su autor defiende una concepción amplia del ámbito material de las leyes de presupuestos. Según esta posición, este tipo de ley debe incluir la materia presupuestaria, pero, como ley que es, puede cobijar otras materias, salvo prohibición constitucional clara al respecto. Esta posición es superadora de la concepción de la ley de presupuestos como ley meramente formal, de suerte que la concibe como una ley plena, emanada de la potestad legislativa del Parlamento, con la fuerza propia de la ley, esto es, no vinculada a la legislación previa y capaz (aunque no siempre idónea, desde la perspectiva de la técnica legislativa) de emprender innovaciones legales.Desde esa postura "amplia" el autor formula propuesta de solución o de mejora frente al desbordamiento material de las leyes de presupuestos. Asimismo tras analizar su problemática específica, plantea posibles soluciones en relación a la práctica de las leyes de acompañamiento. / El treball està muntat com un intencionat diàleg amb els criteris esgrimits pel Tribunal Constitucional sobre aquesta matèria (desbordament material de les lleis de pressupostos) en la seva ja dilatada jurisprudència. El seu autor defensa una concepció àmplia de l'àmbit material de les lleis de pressupostos. Segons aquesta posició, aquest tipus de llei ha d'incloure la matèria pressupostària però, com a llei que és pot acolir altres matèries, excepte prohibició constitucional clara al respecte. Aquesta posició és superadora de la concepció de la llei de pressupostos com a llei merament formal, de manera que la concep com una llei plena, emanada de la potestat legislativa del Parlament, amb la força pròpia de la llei, és a dir, no vinculada a la legislació prèvia i capaç (encara que no sempre idònia, des de la perspectiva de la tècnica legislativa) d'emprendre innovacions legals.Des d'aquesta postura àmplia, l'autor formula proposta de solució o de millora davant del desbordament material de les lleis de pressupostos.
