From the scamander to syracuse: studies in ancient logistics

This dissertation discusses logistical aspects of the Persians invasion of Greece; the Athenian need for timber for building warships; supply problems in their assault on Syracuse; and the march of Alexander's army from Macedonia into Asia. The amount of cereals needed by the Persian and Greek armies and navies is calculated from modern nutritional data and an estimate of the numbers of combatants. The location and size of the Persian food dumps; the excavation of the Athos canal; and the ships and materials needed to build the bridges of boats are considered. The Athenian need for ship-timber led to the costly occupation of Amphipolis. An assured supply of cereals was one motive for the disastrous Sicilian Expedition. The Athenian fleet was an inefficient long-range support for an army which had to protect its non-combatant sailors. In times of intense legislative activity, the debate concerning to the nature of the decision given by the Maritime Court strengthened when the art. 529, item X of the Brazilian New Procedural Code (enacted on House of Representatives version) gave force to the maritime court as an enforceable judgment. In this study, within the limits of a master thesis, our purpose is to research the possibility of exercising judicial activity outside the boundaries of the Judiciary Power - here called "shared jurisdiction , where we will be able to highlight a focus on the activity performed by the Maritime Court. On the ground of this delimitation of the subject, we shall briefly input our research outline. Initially, it was analyzed the maritime law as an autonomous science with emphasis in its codification, its concept, its sources and its spatial boundaries. Then, it was examined the special maritime procedures listed in the Codes CPC/39, CPC/73 and NCPC. For a deep investigation of the maritime special due process, it was consider absolutely necessary, yet concisely, to track the historical evolution of the concept of jurisdiction in order to be able to enter the second part of the work with regards to judicial review of decisions of the Maritime Court - linking, thus, to the so-called shared jurisdiction by having the Maritime Court performing judicial activity / Ainda que por intermédio de poucas palavras, julga-se conveniente delimitar e aclarar o objeto deste trabalho. Em época de intensa atividade legislativa, acirrou-se o debate acerca da natureza da decisão proferida pelo Tribunal Marítimo Brasileiro quando o art. 529, inciso X do NCPC (versão aprovada pela Câmara dos Deputados) atribuiu força de título executivo judicial ao acórdão marítimo. Neste trabalho, e nos limites de uma dissertação de mestrado, o propósito é estudar a possibilidade de exercício de atividade jurisdicional fora do âmbito exercido pelo Poder Judiciário em uma espécie do que aqui se denominou jurisdição compartilhada do enfoque da atividade judicante desempenhada pelo Tribunal Marítimo, na Lei n. 2.180/54 (Lei Orgânica do Tribunal Marítimo LOTM). Cette thèse présente les traductions des trois traités de navigation écrits en latin (et restés à ce jour inédits) par Giovanni Poleni, professeur de mathématiques, physique, astronomie, philosophie mécanique expérimentale, navigation et construction navale à l’université de Padoue : La meilleure manière de mesurer sur mer le chemin d’un vaisseau, indépendamment des observations astronomiques (1733), Dissertations latines sur les ancres portant sur La figure optimale selon laquelle les ancres peuvent être formées, De la technique la plus performante pour forger les ancres, La manière d’éprouver la force des ancres, soit leur résistance (1737), le troisième traité concerne l’amélioration de l’usage du cabestan : De Ergatae Navalis praestabiliore, facilioreque Usu, Dissertatio (1741). Ces trois traités furent primés par l’Académie Royale des Sciences de Paris (prix Rouillé de Meslay). Un corpus traduit de la correspondance latine de Poleni avec les savants européens, la traduction des programmes latins de ses cours de navigation ainsi qu’une enquête in situ à Venise, Vérone ou à Padoue furent nécessaires pour contextualiser les traités. La reconstitution grandeur nature de deux machines de navigation de Poleni : le cabestan et la machine pour mesurer la force du vent, réalisée par des étudiants de BTS Développement Réalisation Bois et des élèves de CAP Serrurerie Métallerie furent testées en mer. Le premier volume propose une biographie de Giovanni Poleni, les « appels à projets » de l’Académie Royale des Sciences de Paris (1733-1741), les traductions commentées des trois traités de Poleni ainsi que la reconstitution de ses machines. A translated corpus of the Poleni's latin correspondence with the others European scholars, the translation of the latin programmes of his shipping courses and an on-site survey in Venice, Verona and Padua were required in order to contextualize the essays. The full-scale reconstruction of Poleni’s shipping machines: the capstan and the machine to measure the wind force, made by the students of BTS Development Achievement Wood and the pupils of CAP Metal Forming and Ironwork were tested in sea. The first volume provides a biography of Giovanni Poleni, the “Calls forProjects” of the Royal Academy of Sciences in Paris (1733-1741), the translations commented of the Poleni’s three shipping essays and the reconstruction of his shipping machines. The second one collects the manuscripts or original printouts' facsimile written by the Paduan academic.

Le transport maritime par conteneurs est devenu universel compte tenu de son caractère multimodal. Le succès de ce mode de transport est aussi lié à l’implication de plusieurs professionnels tant du monde privé que du monde public. Cependant, le transport de conteneurs constitue un univers de contentieux parfois inconnus. L’usage de ces boîtes fait l’objet de contentieux de nature privé, mais également des contentieux de nature administrative. Bien que des Conventions internationales règlementent le transport maritime en général, l’inadaptation de certaines de ces normes ne facilite pas la résolution de ces contentieux. Et, comme l’administration des douanes est en amont et en aval dans l’exécution du contrat de transport, son intervention ne reste pas sans soulever des contentieux dont la résolution implique deux ordres de juridictions. / The container shipping has become universal because of its multimodal nature. The success of this mean of transport is also linked to the involvement of many professionals from both private and public sectors. However, the container shipping constitutes a field of litigation sometime ignored. The use of these boxes involves not only litigations of private nature but also of administrative nature. Although some international conventions regulate shipping in general, the unsuitability of some of these norms does not help the settlement of these litigations. And, as the customs administration is upstream and downstream involved in the execution of the contract of carriage, its involvement is a source of disputes whose settlement implies two different kinds of courts.

Spatial ecology of marine top predators

Species distribution maps can provide important information to focus conservation efforts and enable spatial management of human activities. Two sympatric marine predators, grey seals (Halichoerus grypus) and harbour seals (Phoca vitulina), have overlapping ranges but contrasting population dynamics around the UK; whilst grey seals have generally increased, harbour seals have shown significant regional declines. A robust analytical methodology was developed to produce maps of grey and harbour seal usage estimates with corresponding uncertainty, and scales of spatial partitioning between the species were found. Throughout their range, both grey and harbour seals spend the majority of their time within 50 km of the coast. The scalability of the analytical approach was enhanced and environmental information to enable spatial predictions was included. The resultant maps have been applied to inform consent and licensing of marine renewable developments of wind farms and tidal turbines. For harbour seals around Orkney, northern Scotland, distance from haul out, proportion of sand in seabed sediment, and annual mean power were important predictors of space-use. Utilising seal usage maps, a framework was produced to allow shipping noise, an important marine anthropogenic stressor, to be explicitly incorporated into spatial planning. Potentially sensitive areas were identified through quantifying risk of exposure of shipping traffic to marine species. Individual noise exposure was predicted with associated uncertainty in an area with varying rates of co-occurrence. Across the UK, spatial overlap was highest within 50 km of the coast, close to seal haul outs. Areas identified with high risk of exposure included 11 Special Areas of Conservation (from a possible 25). Risk to harbour seal populations was highest, affecting half of all SACs associated with the species. For 20 of 28 animals in the acoustic exposure study, 95% CI for M-weighted cumulative Sound Exposure Levels had upper bounds above levels known to induce Temporary Threshold Shift. Predictions of broadband received sound pressure levels were underestimated on average by 0.7 dB re 1μPa (± 3.3). An analytical methodology was derived to allow ecological maps to be quantitatively compared. The Structural Similarity (SSIM) index was enhanced to incorporate uncertainty from underlying spatial models, and a software algorithm was developed to correct for internal edge effects so that loss of spatial information from the map comparison was limited. The application of the approach was demonstrated using a case study of sperm whales (Physeter macrocephalus, Linneaus 1758) in the Mediterranean Sea to identify areas where local-scale differences in space-use between groups and singleton whales occurred. SSIM is applicable to a broad range of spatial ecological data, providing a novel tool for map comparison.

Svenska rederiers syn på krishantering : En kvalitativ undersökning om krishanteringsplaner

Arbetet till sjöss är förenat med risker som kan medföra att olyckor sker. Det ska finnas en plan för krishantering redan innan en olycka har inträffat. Det grundläggande förutsättningarna för att hantera följderna av en händelse finns reglerade i svensk lagstifting men hur följs den drabbade sjömannens hälsa upp av rederiet som arbetsgivare? Med denna frågeställning som bakgrund är syftet med det här arbetet att undersöka hur svenska rederier använder sin krishanteringsplan med fokus på förberedande arbete och omhändertagande av personal efter en kris. För att få svar på frågeställningen har en kvalitativ intervjuundersökning används som metod för datainsamling. Undersökningen omfatter en delvis strukturerad intervju med sju respondenter från sex olika svenska rederier. Resultatet av undersökningen visar att rederierna förhåller sig till gällande krav och regelverk och för att uppfylla en del av kraven tar de hjälp av externa aktörer såsom företagshälsovård och psykologer. Rederierna poängterar att det är svårt att utforma en krisplan för något som inte har hänt, att förutse alla scenarion som kan inträffa betraktas inte som möjligt oavsett hur mycket de övar. Besättningen anses dock som det absolut viktigaste för verksamheten och det sätts inga gränser för att främja deras välbefinnande i kriser. / Shipping is often associated with risks which can lead to accidents. There should be a plan for crisis management even before an accident has occurred. Basic prerequisites to deal with the consequences of an accident are regulated in national legislation but how well monitored is the affected sailor’s health by the shipping company as an employer? With that question as a background, the purpose of this thesis is to research how swedish shipping companies use their crisis management plan to support and care for their crew after a crisis. In order to answer the question, qualitative interviews were used as a method for collecting data. The research survey includes a semi-structured interview with seven respondents from six different shipping companies. The research shows that the shipping companies adhere to the requirements and regulations and in order to meet parts of the requirements, they use services of external actors such as occupational health providers and psychologists. The shipping companies explain that it is difficult to create a plan of action for something that has not occurred. To predict a complete scope of crisis scenarios is not deemed as possible, regardless of the amount of drills conducted. The crew is considered the most important element of the business and no restrictions is put on their well being during a time of crisis.

The importance of selective filters on vessel biofouling invasion processes

The spread of exotic species is considered to be one of the most significant threats to ecosystems and emphasises the need for appropriate management interventions. The majority of marine non-indigenous species (NIS) are believed to have been introduced via ship biofouling and their domestic spread continues to take place via this mechanism. In some countries, biosecurity systems have been developed to prevent the introduction of NIS through biofouling. However, implementing biosecurity strategies is difficult due to the challenges around identifying high-risk vectors. Reliable predictors of risk have remained elusive, in part due to a lack of scientific knowledge. Nonetheless, invasion ecology is an active scientific field that aims to build this knowledge. Propagule pressure is of particular interest in invasion ecology as it describes the quantity and quality of the propagules introduced into a recipient region and is considered to be an important determinant in the successful establishment of NIS. Environmental history affects health and reproductive output of an organism and, therefore, it is beneficial to examine this experimentally in the context of biofouling and propagule pressure. The aim of this thesis was to examine how voyage characteristics influence biofouling recruitment, survivorship, growth, reproduction and offspring performance through the ship invasion pathway. This was to provide fundamental knowledge to assist managers with identifying high-risk vessels that are likely to facilitate the introduction or domestic spread of NIS, and to understand the processes affecting biofouling organisms during long-distance dispersal events. Chapter One provides an introduction to the issues addressed in this thesis. Each data chapter (Chapters Two – Five) then focused on a stage of the invasion process and included field experiments using a model organism, Bugula neritina. Finally, Chapter Six provides a summary of key findings, discussion and the implications to biosecurity management. Throughout this thesis, the effect of donor port residency period on the success of recruits was highlighted. Chapter Two focused on recruitment in the donor region. As expected, recruitment increased with residency period. Importantly, recruitment occurred every day on vulnerable surfaces, therefore, periods as short as only a few days are able to entrain recruits to a vessel hull. The study presented in Chapter Three showed that there was high survivorship of B. neritina recruits during 12 translocation scenarios tested. In particular, the juvenile short-residency recruits (1-8 days) survived voyages of 8 days at a speed of 18 knots; the longest and fastest voyage simulated. Interestingly, variation in voyage speed and voyage duration had no effect on the survivorship of recruits, but did have legacy effects on post-voyage growth. Again, B. neritina which recruited over very short residency periods of 1 day continued to perform well after translocation and had the highest level of reproductive output after the voyage scenarios (Chapter Four). Recruits that were older (32-days) and reproductively mature at the commencement of the scenarios failed to release any propagules. Even though the number of ‘at sea’ and ‘port residency’ days were equal, reproductive output was higher after short and frequent voyages than after long and infrequent voyages. Finally, the study presented in Chapter Five examined transgenerational effects of B. nertina. Results showed that although the environmental history of the parent colony had a carry-over effect on offspring performance, it was the offspring environment that was a stronger determinant of success (measured by reproductive output and growth). Although cross-vector spread is possible (i.e. parent and offspring both fouling an active vessel), offspring released from a hull fouling parent into a recipient environment will perform better. In combination, these studies have provided new insights into NIS transport via vessel biofouling. Although shipping pathways are dynamic and complex, these results suggest that juvenile stages that recruit over short residency periods and are then translocated on short voyages, may pose a higher risk for NIS introduction than originally assumed. This has implications for marine biosecurity management as short residency periods are common and short, frequent voyages are typical of domestic vessel movements which are largely unmanaged.

An international maritime labour market study, the thesis focuses on the Dutch naval labour market, analysing wartime Zeeland admiralty crews. The research is based primarily on unique naval pay sources. Analysis of crew compositions has not been made on this scale in the period before. The 1667 Dutch Medway Raid is the starting point, where a few British played a leading role – amongst many others reported on the Dutch side. Pepys and Marvell primarily blamed their joining the enemy on the lure of superior Dutch payment. The thesis asks how many British there were really, how they came to be in Dutch service, and whether this involvement occurred, as indicated, at other times too. Part One is thematic and explores the background mechanisms of the maritime environment in detail, determining causation. First, the two naval recruitment systems are compared and completely reassessed in the light of state intervention in the trade sphere. Two new sets of ‘control’ data – naval wages and foreign shipping – are amongst the incentives and routes determined. British expatriate communities are examined as conduits for the supply of naval labour and civilian support. British personnel are compared and contrasted with other foreigners, against the background of Anglo-Dutch interlinkage and political transition from neutrality through conflict to alliance. Part Two is chronological, covering four major wars in three chapters. Micro-case studies assembled from the scattered record streams enable analysis of the crews of particular officers and ships. Seamen were an occupation that made them a very little known group: the thesis examines the different career types of British personnel of many different ranks, shedding light on their everyday lives. The thesis shows that British personnel were an integral part of Dutch crews throughout the period, even when the two nations were fighting each other. The basic need of subsistence labour for employment took precedence over allegiance to nation/ideology, demonstrating limitations in state power and the continual interdependence forced on the maritime powers through the realities of the labour market.

Delegering av flaggstatsskyldigheter : Hur påverkas sjösäkerheten av flaggstatens delegering av skyldigheter till klassificeringssällskap?

Arbetet har syftat till att undersöka och problematisera flaggstatens och klassificeringssällskapens roller såsom kontrollfunktion avseende sjösäkerhet. Frågor har ställts angående vilka skyldigheter flaggstater å ena sidan, och klassificeringssällskap å andra sidan, har vad gäller fartygskonstruktion och fartygssäkerhet. Vidare har arbetet även behandlat frågan vilka sjösäkerhetsrelaterade effekter som kan uppkomma av att flaggstaten delegerar skyldigheter avseende konstruktion till klassificeringssällskap. För att besvara frågorna har en kvalitativ dokumentstudie gjorts, med vissa inslag av rättsdogmatik i de delar som avsett finna gällande rätt på området. Materialet för dokumentstudiens del har till stor del valts ut genom en bred sökning i litteratur och avhandlingar på området. På så vis har det använda materialet redan genomgått en urvalsprocess och därmed ansetts vara relevant för arbetet. Resultatet visar att det finns en viss överlappning i kontrollfunktionsrollen för både flaggstaten och klassificeringssällskapen. Att delegering av skyldigheter sker från flaggstaten till klassificeringssällskapen är inte nödvändigtvis problematiskt. Dock kan en delegering få negativa effekter på sjösäkerheten i de fall klassificeringssällskapen inte är i paritet med flaggstaten eller båda parter saknar en effektiv kontrollfunktion med högt ställda krav. Skulle delegering ske till ett klassificeringssällskap som har en god kontrollfunktion med höga krav kan brister som finns inom flaggstaten, såsom bristande resurser och kompetens, avhjälpas. Trots att systemet till stor del verkar fungera tillfredsställande finns anledning att fortsätta forska inom området för att undersöka hur de problem som belysts i detta arbete kan åtgärdas eller förhindras i framtiden. / The aim of this paper has been to investigate and problematize the roles of the flag state and the classification societies in regard to their maritime safety control function. Questions have been raised regarding what obligations flag states on one hand, and classification societies on the other hand, have regarding ship construction and ship safety. Furthermore, the paper has also addressed the question of what maritime safety-related effects may arise from the flag state delegating their duties to classification societies. To answer the questions, a qualitative document study has been conducted, with some elements of legal dogmatics in certain parts in order to find the current legal situation. The material for the document study has been selected by thorough research into literature and dissertations in the area. Therefore, the chosen material has been previously reviewed and gone through a selection process and was thus considered relevant for this paper. The result has shown that there is some overlap in the control function for both the flag state and the classification societies. Delegating obligations from the flag state to the classification societies is not necessarily problematic. However, delegation of the said duties can have negative effects on maritime safety in cases where the classification societies are not on par with the flag state or both parties lack an effective control apparatus to enforce high standards. Should delegation occur to a classification society that has a good control apparatus with high requirements, possible shortcomings that exist within the flag state, such as lack of resources and skills, can be remedied by the high standard performance of the classification society. Even though the system might seem satisfactorily at first glance, there is room for further research in the area in order to investigate how the existing problems can be managed and prevented in the future.
