The Sound of Silence: First Nations and British Columbia Emergency Management

In this thesis I offer a brief overview of the current legislative, regulatory and treaty frameworks impacting emergency management in British Columbia, with a particular emphasis on Crown-identified First Nation roles. I show that the regime overwhelmingly positions non-First Nation governments, contractors and other organizations to manage emergencies on behalf of First Nations. I explore emergency management as a manifold process that includes protracted planning, mitigation and recovery phases, which, unlike emergency response, are carried out with lower levels of urgency. I consider Canadian Constitution Act, 1982 (s. 35) Aboriginal rights in light of the lack of statutorily prescribed inclusion of First Nations in off-reserve emergency management, particularly at the planning, mitigation and recovery phases concluding that the jurisprudence to date (including the duty to consult and Aboriginal title) does not appear to have revolutionized the regime. While the constitutional status of Aboriginal rights should operate to insure adequate First Nation direction in each stage of emergency management, the regime continues to restrictively prioritize other constitutional priorities, such as division of powers and civil liberties. To better understand the omission, I theorize the lack of Crown implementation of s. 35 Aboriginal rights generally as an ‘obligation gap’, highlighting how an analysis of s. 35 Aboriginal rights as ‘negative rights’ fails to compel implementation of the full scope of Crown obligations implicit within the jurisprudence to date. I then offer a new framework for s. 35 as justiciable ‘recognition rights’ and juxtapose ‘recognition rights’ with the idea of justiciability of government inaction through a brief comparative analysis of socioeconomic rights in South Africa’s constitution and Canada’s constitutional Aboriginal rights. With a decided emphasis on the obligations of the Crown, this thesis attempts to offer fodder to First Nations and legal practitioners seeking to challenge the emergency management landscape where First Nations seek an enhanced role in protecting and restoring their respective territories in anticipation of, and in the wake of, disaster. For convenience and clarity, contemporary geographical and jurisdictional references to the areas now known as Canada and British Columbia are used throughout the thesis without intention to detract from the integrity of First Nation claims to their traditional and ancestral territories.

國際貿易實務上,「信用狀」係往來銀行提供信用狀擔保付款之模式,確保跨國貿易之順利完成、加速貿易進行,為當今世界重要付款方式。「信用狀統一慣例(UCP)」係國際商會(ICC)制定之信用狀交易實務慣例,自1933年首次頒布以來,目前已成為全世界公認遵行之信用狀標準處理方針。2007年,國際商會公佈最新修訂版本之第600號出版物“UCP 600”,明定因應銀行及航運實務發展、檢討UCP 500之規範文字及語體、抑制銀行拒絕付款率等為主要修訂目標。 鑑於UCP 600對於未來國際貿易發展之影響力,實有全面且深入研究UCP 600條款內容及規範目的之必要。本文以UCP 600新增定義解釋條款、審查單據條款、及運送單據條款為研究主題,透過闡釋條文涵義、比較與UCP 500之差異、探究新條款影響、檢討修訂目標之成效等,俾使信用狀當事人及相關銀行正確理解及適用UCP 600條款內容。 本文首先介紹信用狀之特性、經濟功能及信用狀統一慣例之定位適用等基本概念;其次從文義解釋、法律性質及當事人間法律關係等觀點切入,闡釋UCP 600本次新增之定義及解釋條款;並研究銀行實務最常發生爭議之審查單據程序,詳盡分析UCP 600規定之審單標準、符合提示、拒付瑕疵單據等重要條款。此外,本文探討UCP 600所規定國際航運常見之提單、多式運送單據、不可轉讓海運單及傭船提單等運送單據條款。最後,本文針對UCP 600條款之重要修訂內容予以彙整,嘗試提出該等條款之修正趨勢及未來發展。 / In international trade practice, “letter of credit”which is the most important type of payment in the world is the means of settlement that an issuing bank independently undertake to honour a complying presentation , and that ensures international trade to successfully completed, and speeded up the transactions.“ICC Uniform Customs and Practice for Documentary Credit(UCP)”is the rules of international letter of credit practice promulgated by the Commission on Banking Technique and Practice of the International Chamber of Commerce(ICC).The 2007 Revision, UCP 600, is the latest of a series of revisions of these ICC rules that date from 1933 and have in their evolution become the universal norm for commercial letter of credit. The introduction of UCP 600 expressly indicated the main revised objective was to address developments in banking and transport industries, to look at the language and style used in UCP 500, and to reduce the rejections of the documents presented under letter of credit. In consideration of the influence of UCP 600 for the development of international trade in the future, it was necessary to generally and deeply research the clauses and provisions of UCP 600 and the revised objective. This paper’s research subjects include the formal definitions and interpretations of UCP 600, the provision regarding examination of documents, and the provisions regarding transport documents. In order to make the parties of letter of credit and the relevant banks correctly understand and apply the UCP 600 clauses, this paper interprets the meaning of UCP 600 clauses, compares the differences between UCP 600 and UCP 500, analyses the influence of new provisions, and look at the achievements of this revision. This paper first introduces the fundamental concepts included the characteristic of letter of credit, the economic functions of letter of credit, and the position and application of UCP 600.The second part is to discuss the formal definitions and interpretations that UCP 600 new formulated from the perspectives of language interpretation, quality of law, and the law relationship of the parties. Then this paper discusses the rules for the examination of documents that most controversial in banking industries, and analyses the important provisions regarding standard for examination of documents, complying presentation, and rejection of discrepant documents. Moreover, this paper is referring to the general transport documents clauses stipulated in UCP 600, including bill of lading, multimodal transport document, non-negotiable sea waybill, and charter party bill of lading. Finally, this paper synthesizes the significant revised provisions, and recommends several suggestions about modifying the relevant provisions in UCP 600 and development in the future.

The work is devoted to The Memorial of Master John Hus as his presupposed birthplace. The first part deals with the history of this monument, it brings the summary of proprietary relations and maps the care about this historical object and the looks of Hus{\crq}s house. It also deals with the honour to the personality of Master John Hus and its forms through the historical periods. There are the oldest mentions about this respect, some legends, celebrations and other forms of respect in various periods. The second part deals with contemporary effort of professional public which is aimed to preparation of a new expozition in the Memorial of Master john Hus in Husinec. This preparation started in 2004 - 2005 by means of professional lectures. Finally the work introduces the project The Restoration of the Birthplace of Master John Hus which reakts on professional discussions from previous years and which is the alternative solution of current renewal of actual expozition installed in 1975. There is also pictured enclosure prezenting previous and current looks of Hus{\crq}s birthplace.

The theoretical perspective has as main founts: (1) contributions done by Marcel Mauss on the theme of sociability nets, which are built around structures of giving and reciprocity; (2) the contributions done by Bourdieu on the theme of honour among the Kabila; (3) the contributions done by Simmel, with his discussion on sociability forms. In order to understand the social organisation of hammock sellers and theirs wives in the context of hammocks and other sales and other craft-works sales, I used the ethnographic method and did semi-structured interviews. Besides it I made direct observation and participated in informal chats between hammock sellers I chose, in order to have some life stories. Among the main outcomes of my research I bring out the following: (1) the honour of the hammock sellers from Patos-PB is built with reference to the debt logic; (2) the sociability of hammock sellers is determined by the imposed reciprocity of debt, which helps them in building and make strong social links; (3) the hammock sellers honour expresses itself in varied forms according to the different places in which hammock sellers circulate. It varies as well as a function of social roles they play at the community. / Neste trabalho analiso as formas de sociabilidade dos redeiros de Patos-PB, incluindo as vivências com seus cônjuges, a partir da observação e mergulho nos aspectos do cotidiano de suas vidas. A perspectiva teórica adotada tem como principais matrizes:os conceitos de dádiva e reciprocidade na constituição de redes de sociabilidade (MarcelMauss0; a noção de honra (Bourdieu)e forma de sociabilidade (Simmel) (1) a contribuição de Marcel Mauss, com sua discussão relativa às redes de sociabilidade constituídas em torno das estruturas de dádiva e de reciprocidade; (2) a contribuição de Bourdieu, em seus estudos sobre a honra entre os Kabilia; (3) a contribuição de Simmel, com sua discussão a respeito das formas de sociabilidade. Para compreender a organização social dos redeiros-vendedores e das suas mulheres no contexto das vendas das redes, cangas e mantas, bem como as maneiras pelas quais eles constroem e reconstroem as mais diversas formas de sociabilidade e trabalho frente a outros sujeitos sociais nos múltiplos espaços por onde transitam ao efetivarem suas vendas, utilizei a etnografia como metodologia, realizando entrevistas semi-estruturadas, conversas informais, observação participante e sistematizando algumas histórias de vida. Dentre as principais conclusões do trabalho destaco as seguintes: (1) a honra entre os redeiros de Patos-PB é construída a partir da lógica da dívida; (2) a sociabilidade dos redeiros é determinada pela reciprocidade obrigatória da dívida, que favorece a construção e fortalecimento de laços sociais; (3) a honra se expressa de várias formas nos diferentes lugares e papéis sociais ocupados e desempenhados pelos redeiros na relação da dádiva

Le XVIe siècle est souvent perçu comme un temps de massacres motivés par les haines confessionnelles, une litanie de carnages et d’exactions à laquelle succéderait, à partir des années 1650 une culture de la reddition honorable, une guerre réglée et limitée caractérisée par une nette amélioration du sort des vaincus. Une humanisation de la guerre se donnerait à lire au travers d’une codification des procédures de capitulation et de reddition des places. Ce travail, suivant les pistes ouvertes par l’anthropologie historique, questionne cette vision caractéristique d’une déréalisation de la guerre pour montrer que la reddition honorable émerge précocement et ne constitue jamais qu’un idéal toujours soumis aux intérêts des belligérants. Mobile de la clémence, l’intérêt est également celui de la rigueur. Tout au long des XVIe et XVIIe siècles, la reddition reste un risque pour l’honneur et la vie des vaincus. Cette histoire de la reddition entend déconstruire le mythe déréalisant de la «guerre en dentelles» pour rappeler que les guerres du règne de Louis XIV ne sont pas le théâtre d’une limitation de la violence. / The XVIth century is often perceived as an era of religious driven massacres, a litany of carnage and exactions directly followed, from 1650 onward, by reversing habits of honourable capitulation, a closely regulated and restricted warfare characterized by a great improvement in the fate of the defeated. A humanization of the war would show through a codification of the surrending procedures and the transfer of forteresses. This essay investigates this derealizing vision of warfare, based on historical anthropology’s theoretical leads. It shows that honourable capitulation come about earlier on as an ideal led by the interest of belligerent parties. These interests appear as a major motive for both leniency and rigorousness. All along the XVIth and XVIIth cent., capitulation stands as a risk for the honor and life of the losers. This history of capitulation intends to deconstruct the derealizing myth of chivalrous and limited warfare, to recall the fact that wars under the reign of Louis XIV often led to repeated acts of unleashed violence.

Biblical scholars have grown increasingly aware of the importance of looking at texts not only in their historical or literary contexts, but also in their socio-cultural contexts. Many studies have shown that honour and shame were core social values in the ancient Mediterranean world. By scrutinizing the available research on the topic of honour and shame, one realizes that there were indeed four major social values in the Mediterranean world, that is i) honour and shame, ii) patronage and reciprocity, iii) kinship and iv) purity. Modern biblical scholars would often appeal to the works of the classical authors in order to show how important these values were in the ancient world. Unfortunately claims that are being made in modern studies concerning honour and shame are usually based on the biblical and classical writings. These scholars seldom consult patristic writings. In this study it is argued that the ancient Church Fathers were indeed aware of these social values. The four social values mentioned above are taken as a basis to unlock the social context of Clement of Alexandria’s Paedagogue. Cette thèse porte sur les relations entre la noblesse et le prince dans les duchés de Lorraine au coursd’une période qui s’étend des années 1620 à 1737. Elle les explore dans le cadre d’un renforcement du pouvoirducal et dans une période de transition troublée.Dans cet État souverain des confins, la noblesse représentée par quelques puissantes familles issues del’ancienne chevalerie incarne l’élite sociale, morale, et politique. Étroitement associée aux responsabilités, elleest affectée au premier plan par les ruptures qui scandent le XVIIe siècle : la guerre, l’occupation française etl’exil. Autant d’évènements qui déstabilisent le service princier et éprouvent la fidélité au duc, fondementessentiel des rapports de la noblesse au pouvoir. Cette étude revisite les notions de service, de devoir etd’honneur, constitutives de l’identité nobiliaire.Après plus d’un demi-siècle de désordres, la paix de Ryswick (1697) ramène la stabilité et le princeretrouve ses duchés. Le rétablissement de l’État s’effectue dans une dialectique entre tradition et changement. Lanoblesse qui aspire à retrouver sa place auprès du duc est confrontée à de nouvelles incertitudes qu’elle surmontegrâce à la résurgence de la faveur princière et au prix d’une recomposition de l’ordre.L’équilibre des forces est mis à mal en 1729 avec l’avènement de François III dont le destin se joue pardelàles frontières. Détaché de son territoire patrimonial, le jeune souverain rompt le lien avec la noblesselorraine et met fin à l’impératif absolu du service princier.L’étude des relations entre la noblesse et le duc durant le long XVIIe siècle est une réflexion sur lasociété politique d’un État aux limites sensibles et aléatoires. / This study tackles the relation between nobility and prince in the Duchies of Lorraine during the periodthat spans from the 1620s to 1737. The academic frame in which it is explored is one marked by reinforced ducalpower and by much turmoil within a transitory period.In such a border-line sovereign state, the nobility as represented by a few powerful houses stemmingfrom ancient chivalric backgrounds, embodies the social, moral and political elite of the day. Closely involved inthe Duke’s wields of executive power, and more than any other social body, nobles suffered from the manypoints of rupture that punctuated the 17th century : wars, French occupation and exile did indeed challeng thePrince’s service. These points of rupture jeopardized the fidelity to the Duke, one of the essential foundations ofthe link between the nobility and Power. The study revisits such key-notions as service, duty, and honour,notions which shape up nobles’ identity.After more than a half-century of disorders of all kinds, the Ryswick Peace (1697) brought the situationback to a relative stability and the Prince regained his Duchies. Putting back the State to its feet implied adialectical tension between tradition and change. The nobility eager to regain former responsabilities isconfronted with new uncertainties that will be partly overcome by the resurgence of princely favours and areshuffling of the Order.The balance of forces is put at stake in 1729 when Francois III comes to the throne and his fate is tomaterialize beyond frontiers. Detached from its heritage territory, the prince unbinds the ties which linked thenobility and puts an end to the absolute imperative of a prince’s service.The study of relations between nobility and duke throughout the long 17th century consists in an overallquestioning of a political society in a border-conscious and border-moving state.

Lost his voice? interrogating the representations of sexualities in selected novels by Gabriel Garcia Marquez

This thesis interrogates García Márquez’s representations of sexualities in the following selected novels: Chronicle of a Death Foretold (1981); The Autumn of the Patriarch (1975); One Hundred Years of Solitude (1967); The Sad and Incredible Tale of Innocent Erendira and her Heartless Grandmother (1972); and Memories of My Melancholy Whores (2004). It is argued here that García Márquez’s employment of the sexuality motif enables him to delve into many worldwide current concerns such as the irrelevance of some socio-cultural sexual practices; commercial sexual exploitation of children; the different manifestations of prostitution; and female powerlessness under autocratic rule. Earlier literary critics have tended to narrowly interpret García Márquez’s employment of the sexuality motif as just a metaphor for colonial exploitation of the colonised. The study also explores the writer’s artistic role and concludes that García Márquez speaks against commercial sexual exploitation of children as he concurrently speaks on behalf of children so exploited. Similarly, the writer speaks on behalf of prostituted womanhood by showing how prostitutional gains do not seem to cascade down to the prostitutes themselves. García Márquez also invests female sexual passivity as a coping mechanism against a dictator’s limitless power over the life and death of his citizens. However, the writer also constructs female agency that grows from the rejection of an initial victimhood to develop into an extremely flawed and corrupt flesh trade that co-opts and indentures children into sex work with impunity. Thus the study breaks new ground to show that García Márquez’s representations of different sexualities are not merely soft porn masquerading as art. His is a voice added to the worldwide concerns over commercial sexual exploitation of children in the main and also the recovery of a self-reliant female self-hood that was previously inextricably bound to male sexual norms. Quite clearly, García Márquez demonstrates that female prostitution is driven by a lack of social safety nets, a lack of other economically viable options and also a distinct lack of educational opportunities for female economic independence, hence the flawed female agency. / English Studies / D. L'honneur féminin à Montréal à travers les archives judiciaires (1698-1756)

Ce mémoire analyse l’honneur féminin à Montréal entre les années 1698 et 1756. Il observe les dynamiques de pouvoir dans lesquelles s’inscrivent les femmes justiciables à travers la problématique de la perte ou de la remise en question de l’honneur. Les archives de procès pour séduction, viol, prostitution et calomnies constituent la base de cette recherche. Au XVIII e siècle, l’honneur est un capital absolument essentiel, puisque sans lui les individus risquent la marginalisation. L’honneur féminin est primordialement lié à la sexualité et la justice joue à l’avantage ou au désavantage des femmes en fonction principalement de l’écart commis par rapport aux normes sexuelles. L’analyse se concentre principalement sur les justiciables, les dynamiques de pouvoir entre les femmes et les hommes justiciables, mais aussi entre les femmes et la société. L’analyse des dynamiques de pouvoir se fait en accordant une grande place à l’agentivité féminine et en prenant en compte l’imbrication des rapports de pouvoir dans lesquelles elles évoluent. Une approche intersectionnelle est donc mise de l’avant. Des questions importantes sont posées : comment le genre, l’ethnie et la catégorie sociale influence le déroulement de la justice ? Est-ce que la justice joue le même rôle pour toutes les femmes en justice pour une question d’honneur ? Quel facteur influence le traitement différentiel des femmes dans ce cas ? Ces questions trouve réponse par l’analyse du statut social des justiciables, des rapports de pouvoirs entre hommes et femmes et entre les femmes et leurs familles et leurs voisinages ainsi que par l’analyse du traitement que la justice à réservé aux femmes en fonction du type de procès. / This thesis analyses the women that came before the judiciary system in Montreal for a question of honour between 1698 and 1756. The analysis focuses on the power dynamics experience by these women. Seduction, rape, prostitution and slander trial archives serve as the basis for this study. In eighteenth-century Montreal, honour an essential capital to possess because without it women could experience marginalization within the society. Female honour essentially linked to their sexuality and the justice system going to either help or harm the women depending on the transgression of the sexual norms in place in the society. The analysis will focus on the litigants, on the power dynamics between the women and the men and between the women themselves. On the one hand, this study accords an extreme importance to the agency of the principal actors in the trials. On the other hand, this study focuses on the intersectional power dynamics. In this thesis, we ask: how does gender, race and social status influence the course of justice? Does justice play the same role for every woman in a trial linked to her honour? Which factors influence the differential treatment of the women during a trial? I will answer these questions by analyzing the litigants, the power dynamics between the men and the women and between the women themselves and the relations between the women, their family and the society.
