Kunst. Politik. Wirksamkeit. / Betrachtungen zwischen Niklas Luhmann und Jacques Rancière

Die historischen Avantgardebewegungen haben mit dem Angriff auf die Autonomie der Kunst ein Erdbeben erzeugt, das sowohl die zeitgenössische Kunstpraxis als auch die ästhetische Theorie nachhaltig bewegt. Das Vermächtnis der historischen Avantgarden bleibt insofern als the Living Dead bestehen, als die Forderung, politisch wirksame Kunst zu schaffen, seit dem Beginn des 20. Jahrhunderts immer wieder begraben und wiederbelebt wird. Auf der Ebene der Theorie pendeln diese Debatten zwischen der Konzeption einer autonomen Kunst einerseits und einer heteronomen Kunst andererseits, wobei Erstere einer philosophischen und Letztere einer soziologischen Kontextualisierung von Kunst entspricht. Die vorliegende Arbeit stellt diese beiden Perspektiven – einmal die ästhetische Theorie von Jacques Rancière und einmal die Gesellschaftstheorie von Niklas Luhmann – nebeneinander und zeigt, wie ein künstlerisches Schaffen – hier Marko Peljhans Projekt Makrolab – zugleich politisch wirksam und politisch unwirksam sein kann. Mit diesem Schritt wird die Diskussion über politische Kunst auf die Diskussion über die Wirksamkeit verschoben. Es wird festgestellt, dass die Frage nach politisch wirksamer Kunst nur im Rahmen einer kulturhistorisch spezifischen Vorstellung von Wirksamkeit möglich ist. Wird diese Vorstellung von Wirksamkeit durch eine andere ersetzt, verliert die Frage nach politischer Kunst ihren Sinn, es erschließt sich jedoch ein neues Verständnis des gesellschaftlichen Wandels, das weit über die Themen der Kunst hinausgeht. / By attacking the autonomy of the arts, the historical avant-gardes caused an upheaval which has resonated in the contemporary artistic practices as well as in art theory to this day. The legacy of the historical avant-gardes remains in the state of the living dead, since the demands to make political art have since the beginning of the 20th century repeatedly been buried and resuscitated. On the level of theory, these debates have been oscillating between the concept of an autonomous sphere of art on the one side and the heteronomous sphere of art on the other, whereas the former corresponds to a philosophical and the latter to a sociological contextualisation of the arts. This text combines both of these perspectives, putting Jacques Rancière’s philosophy of art and Niklas Luhmann’s social theory side by side in order to show how a singular artwork – here Marko Peljhan’s project Makrolab – can be understood as politically efficient and not politically efficient at the same time. With this step the discussion about political art is shifted to a discussion about efficacy and brought to the conclusion that the question of political art is only possible within a frame of a culturally and historically specific conception of efficacy. When this specific conception of efficacy is replaced by another, the question about political art loses its meaning. However, it is exactly at this point that a new understanding of social change opens up, which reaches far beyond the domain of art theory.

After presenting the main aspects of Luhmann s theory on modern society, mainly the system of law and its relation to education system, this work will try to assess the most remarkable aspect of Luhmann s concept of the inclusion/ exclusion relationship within a new reality of functionally differentiated society, in which individuals are not only situated out of society but also, to be precise, within its the exclusion domain. In that way, Luhmann has put lights on some fundamental issues regarding the implicit norm of full inclusion, which seems to be the main focus relied on inclusion/exclusion debate nowadays. Following this new path, Luhmann also directs his attention to the different conditions of inclusion/exclusion as being surrounded and here it is really important to map the theoretical ground out by conditions within function systems, organization and interaction systems. Luhmann s point of view comes down to the idea that inclusion is not the rule anymore, by contrast, exclusion is. This work closes off with a critical analysis of Luhmann s re-description of the quoted distinction and, raising the reality of basic educational access in Brazil, considering, moreover, the quality of it, suggests that the system theory might suffer from an empirical deficiency. In the present work, once having the figures on educational inclusion/exclusion in Brazil and its further developments exposed, we come across the fact that the system theory seems to have difficulties to grasp and to depict the actual mechanisms of social exclusion in the world / Esta dissertação tem como objetivo, partindo da forma que Niklas Luhmann observa a sociedade moderna e tendo como modelo empírico a realidade da educação média no Brasil, questionar as noções básicas da teoria sistêmica acerca do debate sobre a distinção inclusão|exclusão. Além de apresentar os principais aspectos da teoria de Luhmann sobre a sociedade moderna, especialmente o sistema jurídico e a sua relação com o sistema educacional, este trabalho tentará, ainda, acessar, a partir da teoria sistêmica, o mais relevante aspecto da distinção inclusão|exclusão em uma sociedade diferenciada funcionalmente, na qual os indíviduos estão não somente fora da sociedade, mas também, para ser preciso, inseridos no domínio de exclusão. Desta forma, Luhmann ilumina alguns dos mais fudamentais problemas relacionados com a norma implícita da inclusão total, que parece ser o principal foco do debate sobre inclusão|exclusão nos dias de hoje. Seguindo este caminho de observação, Luhmann também irá direcionar sua atenção para as diferentes condições de inclusão e exclusão e afirma que esta distinção é determinada e aqui entender a questão é de suma importância para caminhar pelo solo da teoria sistêmica pelas condições internas dos sistemas funcionais, organizacionais e de interação. Luhmann defende a idéia de que inclusão não mais seria a regra, pelo contrário, a exclusão é que seria.. Esta dissertação pretende trabalhar com uma análise crítica da forma como Luhmann re-descreve a distinção inclusão|exclusão. Destacando a realidade do acesso à educação no Brasil, considerando, acima de tudo, a sua qualidade, sugere, então, que a teoria dos sistemas possa sofrer de uma deficiência empírica ao observar a distincão da forma que o faz. Havendo exposto os números sobre a educação no Brasil, sugerimos que a teoria sistêmica encontra dificuldades em apreender e descrever os atuais mecanismos de exclusão social no mundo

A questão da justiça é tema sempre presente nas perquirições da filosofia do direito. Como tema recorrente deve ser submetido a novas investigações à luz de paradigmas teóricos alternativos e inovadores. A teoria dos sistemas de Niklas Luhmann representa um marco teórico capaz de inaugurar novos percursos investigativos no estudo da função do direito e de sua relação com a justiça, ora como função, ora como capacidade de adaptação. A ideia da autopoiese e sua elaboração na teoria dos sistemas de Luhmann torna possível observar essa relação entre direito e justiça dentro do contexto do aumento da complexidade e da contingência na sociedade moderna. A presente tese busca produzir uma investigação jusfilosófica, com inspiração interdisciplinar ao combinar-se com especulações teoréticas da sociologia jurídica de inspiração luhmanniana. Ao utilizar uma metodologia fundada na pesquisa bibliográfica primacialmente nos idiomas originais, a tese persegue a reconstrução da teoria da justiça na perspectiva do funcional-estruturalismo de Niklas Luhmann. Na consecução deste projeto, a tese utiliza a metáfora do horizonte, de matriz fenomenológica, para propor a dualidade entre justiça operativo-funcional e justiça adaptativo-mutante. Dualidade que servirá de baliza para conclusões desta tese que poderá trazer uma contribuição original à cultura jurídica nacional. / The problem of justice is an ever-present issue in the investigations of philosophy of law. As a recurring theme, it should be subjected to further investigation in the light of alternative and innovative theoretical paradigms. The systems theory of Niklas Luhmann is a theoretical framework capable of opening new routes for studies and researches on the role of law and its relation to justice, either as function either as adaptability. The idea of autopoiesis and its elaboration in Luhmann´s systems theory makes it possible to observe the relationship between law and justice within the context of the increased complexity and contingency in modern society. This thesis aims to produce an investigation in the philosophy of law with interdisciplinary inspiration when combined with theoretical speculations of legal sociology of luhmannian inspiration. Using a methodology based on a primary bibliographic research in works in their original language, the thesis pursues the reconstruction of the theory of justice from the perspective of functional-structuralism as thought by Niklas Luhmann. In pursuing this project, the thesis uses the metaphor of the horizon, in its phenomenological matrix, to propose the duality between justice as operation and adaptation (mutant). This duality will serve as a beacon for the conclusions produced in this thesis that can bring an original contribution to legal culture.

The study is based on the hypotheses that the EoC represents a possible means of Catholicism to influence the economic system by acting simultaneously both at civil and religious level. The importance and relevancy of this study lies in the fact that it introduces the EoC in a wider context according to the theory of Social Systems by Niklas Luhmann, which understands modern societies as an entity composed of sub-systems, each of them representing diversified, specialized and relatively autonomous, but inter-related functions for the maintenance and evolution of the major society. Thus religion is recognized as a system co-existing side by side with others, finding ways to maintain itself in relation to them, once it lost its hegemony as a source for social order. Based on the analyses to the emergence, delimitation and the role of the EoC according to Luhmann s approach, the present study argues that EoC can be considered a means in which Catholicism influences non-religious fields by assuming an inter-systemic relation / A presente pesquisa analisa a Economia de Comunhão (EdC), um projeto que surgiu no interior do Movimento dos Focolares católico, ecumênico, inter-religioso e intercultural, presente em 182 países, a partir das hipóteses, segundo as quais, a EdC atua simultaneamente nas esferas civil e religiosa, além de ser um possível meio de a religião cristã católica atuar sua influência na esfera civil, neste caso, no sistema econômico. A importância e pertinência deste estudo podem ser justificadas pelo fato de introduzir a EdC em um contexto mais amplo, a questão da função da religião na contemporaneidade, segundo a abordagem da Teoria dos Sistemas Sociais de Niklas Luhmann, considerada adequada, exatamente, por entender a sociedade contemporânea funcionalmente diversificada e especializada, organizada em sistemas relativamente autônomos, que possuem uma lógica própria, mas que estão continuamente em relação com os demais sistemas da sociedade. Assim sendo, a religião é entendida como um sistema que co-existe ao lado dos outros, tendo de encontrar modos de manter-se em relação com eles, uma vez que, a partir da modernidade, perdera a hegemonia como fonte da ordenação social. This thesis deals with the transmission of information about hard drugs which were concealed by social system in the 70th and 80th of 20th century from perspectives of drug users. We focus on the problematics of informational sources and channels by means of the social system and the systems theory of Niklas Luhmann. We analyse, by using grounded theory, information environment which influenced the drug subculture. The data sources consist of 35 interviews with addicts who were actively taking hard drugs before 1989. The aim of this thesis is a comprehensive look at the functioning of the drug subculture, transmission of taboo information in society 70th and 80th of 20th century by the theory of social capital and social systems.

The Law BusinessmanTM : Five Essays on Legal Self-efficacy and Business Risk

The thesis challenges the notion of effectiveness of law as being based on the formal institutions of courts, law enforcement and written law. It argues that the best way to measure the effectiveness of law is the legal self-efficacy of laymen who are the end users of law.  It presents a new perspective on the effectiveness of law. It turns the traditional perspective of studying the effects of legal institutions around and instead studies the effect of how individuals perceive their own ability to use law. This self-reflexive ability - legal self-efficacy -  is the answer to the question “How comfortable are with communicating with legal terminology?”. The thesis makes several comparisons using the traditional perspective and legal self-efficacy and finds that legal self-efficacy is a better measure of legal effectiveness. This thesis analyzes 246 businesspeople in Russia and their risk behavior  with regards to economic transactions in relation to legal self-efficacy.  The theory behind legal self-efficacy is a combination of Luhmann’s theory of law as communication and Bandura’s concept of self-efficacy.  The first paper applies the traditional approach. It analyzes the effect of legal efficiency on leverage and debt maturity for listed and non-listed companies. The second paper is describes the conceptual foundation of the legal effectiveness based on the individual. The third paper compares the effect of private order (including legal self-efficacy) and public order institutions on the granting of trade credit.  The fourth paper analyzes the impact of legal self-efficacy and formal legal institutions on sanctions against clients in a comparative perspective. The final paper seeks out possible sources of legal self-efficacy. Legal self-efficacy can be used to better understand the interaction of individuals and law including such fields of research as behavioral accounting, behavioral law and finance, legal sociology and legal studies.

盧曼社會系統理論的去主體化問題 — 從自我同一性弔詭與環境同一性弔詭出發

這篇論文的目的是為盧曼社會系統理論中的一個難題提供可能的解決之道。此難題即為:社會系統既是去主體化的,又是主體化的。這個難題的出現,乃肇因於盧曼認為系統既是自我透明的,也是自我不透明的,既是環境透明的,也是環境不透明的。這兩種弔詭就是盧曼社會系統理論的自我同一性弔詭與環境同一性弔詭。因此,為了解決社會系統理論的去主體化問題,首先就必須解決自我同一性弔詭與環境同一性弔詭。對此,我們建議從盧曼與胡塞爾的比較開始。藉由此種比較以及隨之而來的清洗與重組,我們可以從他們那裡擷取有利於解決上述弔詭的概念與命題。這些概念與命題是:一、存在著諸系統;二、新的觀察概念:構造;三、社會作為內在於意識系統中的社會行動秩序,而溝通系統則作為內在於理解系統中的社會溝通秩序。 / This thesis is aimed at solving a dilemma in Luhmann's theory of social systems.The delimma is: social systems are both desubjectized and subjectized. This is because in Luhmann's theory, they are both transparent and intransparent to itself, and the environments are both transparent and intransparent to systems. These two paradoxes are self-identity paradox and environment-identity paradox. Therefore, if we want to solve the problem of desubjectization in Luhmann's theory, we must solve the self-identity paradox and environment-identity paradox at first. We suggest that it can begin with the comparison between Luhmann and Husserl. Through this comparison, and correspondingly, cleaning and recombination, we can take concepts and propositions which can be used for resolving the above-mentioned paradoxes. The concepts and propositions are: 1. there are systems; 2. new concept of observation; and 3. society as the order of social actions in a consciousness system, and communication system as the order of social communications in a understanding system.
