Decretação ex officio nos contratos relacionais de consumo: o estudo da Norma de Ordem Pública do CDC

The controversy was underestimated by this candidate. This underestimation has never been caused by disrespect or contemptuous treatment of the legal controversy, on the contrary. The challenges and difficulties arisen as something thought not possess such profound implications, not only within the material law, but also in procedural law (feared), only made the study and the search for answers more enticing. The Judge s expression in itself (ex officio) about the material law turned itself to certain immanentism of the material law with procedural law. So, as researcher of the Consumer Protection Law, it arises impacts or not on the Judge s expression of an unfair terms or any other contra legem interpretation it is not as simple as it might seem. Modulations, forces and various decisional effects had to be addressed in the search for a better answer. Variation which is amplified both on individual as well as on class actions. In parallel with such a confrontation (discovery), also came the complicating element of demystifying what would be the definition of public order. In Brazilian law, the rule is to perceive public order as something imperative, law binding, unattainable. Those features do not cover encompass all situations of the Brazilian Consumer Law (CDC) and forced the researcher to seek more details in foreign sources. The search for definitions, characteristics and effects in foreign law systems widened up even more what the research sought to analyze. Nevertheless the research s scope, it was realized the confrontation of the features of public order would of use to Brazilian law in itself as the focus on different foreign systems would aggrandize and justify the option for the CDC. Finally, as during this investigation the Superior Court of Justice (STJ) pronouncement number nº. 381, whose content goes against this thesis, came to light, its analysis and confrontation turned out to be inevitable / De algo tido como claro e pacífico a tese de doutorado que se propõe busca estudar a fundo a possibilidade da decretação de ofício, ou seja, sem provocação das partes, das cláusulas abusivas nos contratos relacionais de consumo e, como corolário a tal possibilidade, o que pretendeu o legislador do Código de Proteção e Defesa do Consumidor ao qualificar tal norma como de ordem pública. É confessado por este candidato que o tema, a controvérsia, foi subestimado. Tal subestimação jamais foi causada por um possível desrespeito ou um tratamento desdenhoso da controvérsia estritamente jurídica. Muito pelo contrário. Os desafios e as dificuldades que surgiram com algo que se imaginava não possuir um grau tão profundo de implicações não só dentro do direito material, mas principalmente, e mais desafiador sob o direito instrumental (temido) só tornaram o estudo e a busca por resposta mais apaixonantes. Da decretação em si sob o direito material retornou-se a certo imanentismo do direito material com o direito processual. Logo, como materialista do direito consumerista surgem impactos que a mera decretação de ofício ou não de uma cláusula ou qualquer outro ato jurídico contra legem não é simples como aparenta. Modulações, forças e diversos efeitos sentenciais tiveram que ser tratados na busca de uma melhor resposta. Variante que se amplifica tanto nas ações individuais, quanto nas coletivas. Paralelo a tal enfrentamento e a reboque do mesmo veio o complicador de desmistificar o que define a ordem pública. No direito pátrio as doutrinas só preveem a ordem pública como algo imperativo, norma cogente, indisponível. Característica que não engloba todas as situações do CDC e que obrigou o pesquisador a buscar fontes estrangeiras. As buscas no direito estrangeiro por definições, características e efeitos ampliaram mais ainda o que sempre se buscou delimitar na tese. Não obstante, ao olhar sobre a delimitação da tese, cientificamente, percebeu-se que o enfrentamento das características da ordem pública seria de grande valia ao direito pátrio e que o estudo sobre sistemas estrangeiros diferentes só engradeceria e justificaria ainda mais a opção do CDC. Por fim, como no decorrer do estudo surgiu à edição da Súmula 381 do STJ, cujo teor vai de encontro a presente tese, inevitável tornou-se seu estudo e enfrentamento

The study justifies itself when we see the growth possibilities of knowledge of matters of public order by the judge, and, withal solidifies a defensive jurisprudence in the Superior Courts, and still, when examining the possibility of knowledge of such matters on appeal to the Superior Court of Justice what one sees is the occurrence of such a possibility in the case of knowledge of the appeal. The paper has the intention of identifying whether the matters of public order have constitutional guard, making the balance of principles with the constitutional prohibition inscribed in art. 105, III of CF/88, for instance, that allows to Superior Court of Justice to hear an appeal or the Superior Court of Justice, only where the matter has really been appreciated by lower stage of appeal. The study aims to systematize the possibility of knowledge of matters of public order in exceptional appeals, whether such phenomenon actually takes place, in which cases, and if it implies turn the Superior Courts into a third stage of appeal or not / O presente trabalho tem por objetivo abordar a problemática da cognição de ofício nos recursos excepcionais, quais sejam, recurso especial, extraordinário e embargos de divergência. A necessidade do trabalho surge quando verificamos o crescimento das possibilidades de conhecimento das matérias de ordem pública de ofício pelo magistrado, e, ao mesmo tempo se solidifica uma jurisprudência defensiva nos Tribunais Superiores, e ainda, quando da análise da possibilidade de conhecimento de tais matérias em grau de recurso especial, o que se vê é a ocorrência de tal possibilidade no caso de conhecimento do recurso. O Trabalho tem o intuito de identificar se as matérias de ordem pública tem resguardo constitucional, fazer o contrapeso principiológico com a vedação constitucional insculpida no art. 105, III, da CF/88, por exemplo, que permite que ao Superior Tribunal de Justiça conhecer de um recurso especial, somente no caso de a matéria ter efetivamente sido apreciada pela instância ordinária. O estudo visa sistematizar essa possibilidade de conhecimento das matérias de ordem pública nos recursos excepcionais, se tal fenômeno realmente ocorre, em que casos, e se isso implica em transformar os Tribunais Superiores numa terceira instância ou não

The research supports the right of social relations, resulting in the parameter effectivity of private law and the protection of civil liberties, addressing the private legal relationships and the dignity of the human person. Deals with the transformation in paradigm of Civil law, i.e. the despatrimonialização resulting from the making of intersubjective relations. A result of this new vision in Hatcher, touches of Oversights, in conclusion, further, that in the present day, for the judicial review of contracts, their requirements have already been overcome. The new civil Constitution order allows to interpret the direct application of the provisions of the Federal Constitution in exceptional character, provided that there are shortcomings in the standards that make up the open system of Civil law. This is because the principles and general clauses allow the interpretation of the system and enable contours and limits established by the system itself. Civil contracts negotiating relations are mandatory and sustain the economic system. Is that solidarity and the normative dirigisme have joined economic relations and, therefore, the parties no longer have antagonistic interests and the need to work cooperatively. With this vision, the analysis becomes a credit transfer agreements, which influence the movement of wealth, possessing umbilical relationship with the guarantee of a decent life. More precisely, this study tackles the credit assignment due for payment and the systematic recently amended by constitutional c. Supreme Court. The second phase of the work part of the contract of assignment of credit for payment of bringing arguments for their judicial review, preserving the balance between the parties, for the use of general clauses and principles of constitutional civil (private autonomy, consensus, relativity of contracts, mandatory conservation covenants, strength, solidarity, equality, good faith and social function). Indeed, deviates from the application of the theory of oversights in the present day, since the revision of the contract is justified by changing the base of legal business, being that the main ground of review must be based on the social function of the contract. With these aspects, the dissertation justifies his academic significance and invites the reader to rethink old ways through a new look, oxygenated by critical constructivism and ruled by a line of social function of contracts, all to keep in mind the balance between the Contracting Parties / Em linhas gerais, o estudo é traçado em duas fases, sendo que a primeira pretende delimitar o objeto partindo da visão geral do Direito Civil até chegar ao objeto central da dissertação: o contrato de cessão de crédito oriundo de precatório; por sua vez, a segunda fase justifica a importância da revisão judicial de tais contratos pela quebra da base do negócio jurídico, superando os requisitos para a aplicação da teoria da imprevisão. A linha de pesquisa respalda-se no Direito das relações sociais, tendo por parâmetro a efetividade do Direito privado e a tutela das liberdades civis, abordando as relações jurídicas privadas e a dignidade da pessoa humana. Aborda-se a transformação no paradigma do Direito Civil, isto é, a despatrimonialização decorrente da funcionalização das relações intersubjetivas. Fruto dessa nova visão toca-se no nascedouro da Teoria da Imprevisão, concluindo-se, mais adiante, que nos dias atuais, para a revisão judicial de contratos, seus requisitos já foram superados. A nova ordem civil constitucional possibilita ao interprete a aplicação direta dos preceitos da Constituição Federal em caráter excepcional, desde que haja lacuna nas normas que compõem o sistema aberto do Direito Civil. Isso porque os princípios e as cláusulas gerais permitem a interpretação do sistema e possibilitam contornos e limites estabelecidos pelo próprio sistema. Os contratos civis decorrem de relações negociais obrigacionais e sustentam o sistema econômico. É que a solidariedade e o dirigismo normativo passaram a integrar as relações econômicas e, por isso, as partes deixaram de possuir interesses antagônicos e passaram a ter necessidade de atuação cooperativa. Com essa visão, a análise se converte aos contratos de cessão de crédito, os quais influenciam na circulação de riquezas, possuindo umbilical relação com a garantia de uma vida digna. Mais precisamente, o estudo aborda a cessão de crédito decorrente de precatório e a sistemática constitucional, recentemente alterada pelo C. Supremo Tribunal Federal. A segunda fase do trabalho parte do contrato de cessão de crédito decorrente de precatório trazendo argumentos que justificam a sua a revisão judicial, preservando o equilíbrio entre as partes, pela utilização das cláusulas gerais e alguns princípios de civil constitucional (autonomia privada, consensualismo, relatividade dos contratos, força obrigatória dos pactos, conservação, solidariedade, igualdade, boa-fé e função social). Com efeito, afasta-se a aplicação da teoria da imprevisão nos dias atuais, pois a revisão do contrato é justificada pela alteração da base do negócio jurídico, sendo que o principal fundamento da revisão deverá estar pautado na função social do contrato. Com essas vertentes, a dissertação justifica seu significado acadêmico e convida o leitor a repensar as velhas formas através de um novo olhar, oxigenado pelo construtivismo crítico e pautado pela linha-mestra da função social dos contratos, tudo no sentido de manter presente o equilíbrio entre as partes contratantes

Esta tese busca analisar os limites e possibilidades do regime da responsabilidade internacional do Estado como garantia da Ordem Pública Internacional, procurando demonstrar os riscos da implementação unilateral da responsabilidade. Inicialmente, através da análise do desenvolvimento normativo do instituto da responsabilidade internacional do Estado, a partir do pós-Segunda Guerra Mundial, buscamos apontar os principais indicadores do momento de transição paradigmática do sistema internacional contemporâneo, ao revelarem-se tanto as bases de identidade desse sistema quanto os traços de transformação que o atravessam. Partimos da hipótese de que as mudanças normativas operadas no instituto da responsabilidade internacional, no período em estudo, têm sido orientadas, em sua maioria, no mesmo sentido das transformações valorativas verificadas no âmbito do Direito Internacional Público como um todo. O que, já adiantamos, significa dizer, em apertada síntese, mudanças no sentido de um direito interestatal ? relacional e bilateral ? para um direito da comunidade internacional no seu conjunto. Tendo, então, em mente a realidade de descentralização em que se concretizam as normas internacionais, nossa segunda hipótese é de que esses avanços normativos não têm par no plano institucional e que essa lacuna gera à comunidade internacional os riscos da implementação unilateral da responsabilidade. Especificamente, analisamos o conceito, os valores, a legitimidade e as consequências substanciais e instrumentais do instituto da responsabilidade internacional do Estado como garantia da ordem pública internacional, focando a projeção da noção de comunidade internacional no seu regime, e os obstáculos normativos e sistêmicos que a sua proteção enfrenta em um sistema internacional descentralizado.

"En ohyra på samhällskroppen" : Kriminalitet, kontroll och modernisering i Sverige och Sundsvallsdistriktet under 1800- och det tidiga 1900-talet

This thesis presents an analysis of crime trends and social control during the dramatic transformation of Sweden's social landscape in the nineteenth and early twentieth centuries, set against the background of the modernization process in the country as a whole and the city of Sundsvall and environs in particular. What assumptions about crime were evident in public debate? How did crime levels vary from region to region, and what were the changes over time? What strategies did government and local authorities try for combating crime? Did the joint efforts by government, local communities, and the voluntary sector actually solve the problems that social change was believed to have caused?When it comes to theory, the interpretative framework is based on Anthony Giddens's argument about modernity and modernization, making particular use of a few central points about what the changes meant for the structuration of society. Giddens's ideas about changes in social control are refined with Michel Foucault's and David Garland's work on the increasingly disciplinary trend seen in the exercise of the law and public control. The analysis of modernity's ramifications for the transformation of both social structures and crime alike has also benefitted from Robert Putnam's and Travis Hirschi's insights into the importance of social capital and social bonds for a well-functioning, low-crime society.The process by which Sweden was transformed from an overwhelmingly agrarian country to an urban, industrial society left its mark on crime patterns. To the contemporary mind, industrialization, migration, and urbanization were the underlying causes of the high levels of serious crime in the society. The start of the nineteenth century had seen a rise in criminality, with both petty crime and lethal violence becoming more common. At the same time, there was a heated debate about the socio-economic problems that were such a strain on the structure of society. The analysis finds that there were large differences in prosecutions in the country and between cities. The Sundsvall area was among those that saw a dramatic change in crime in the course of becoming a major industrial region. At the same time, the thesis shows that there were plenty of cities in Sweden, however rapidly they grew, that had low crime rates. However, the widespread fear of industrialization, migration, and urbanization was often unfounded. For example, both lethal violence and public order offences reached their lowest recorded levels in the interwar period. By then, new cures were sought for the social and moral ills of society. The state's sphere of influence had expanded. New social reforms, including a modified crime policy, were launched. The state became even more assertive, and the same was true of civil society. Society would attend to the moral education of a number of different groups. Moral virtues were to be instilled in the workshy, alcoholic, or criminal, in order to produce disciplined and cultured citizens. The attention of social activists, the scientific community, civil servants, and local and national politicians shifted from crime per se to the far broader issue of asociality. Modernization gave the voluntary sector a significant role in the social organization of the day, shaping new forums for interpersonal relationships and strengthening social ties. The thesis makes the case that two distinct periods, each with its specific social structures and crime patterns, can be observed; one belonging to the nineteenth century, the other to the first four decades of the twentieth century.Finally, the similarities between the history of crime in Sweden and, for example, the US or the UK are highlighted. As in Britain and North America, the early industrialization period saw weakened social bonds, and a time of greater violence and disorder ensued. After a while however, the situation stabilized, and crime rates began to drop again. When industrial societies ceased to be 'frontier communities' at the forefront of modernization, and instead became more mature communities, crime levels fell as people's commitment to their communities was renewed.

L'obligation de non-concurrence dans les sociétés de professionnels : vers une théorie de liberté de choix contractuelle

La concurrence entre professionnels pour la délivrance de leurs services dans l'économie est très importante. D'une part, la société de professionnels désire protéger ses intérêts économiques et, d'autre part, le professionnel a le droit de gagner sa vie. C'est ainsi que les clauses de non-concurrence visent à protéger ces deux intérêts divergents. La jurisprudence portant sur les clauses de non-concurrence en matière de contrats de travail et de contrats de vente d'entreprise est bien établie. Il s'agit de déterminer si la clause est raisonnable selon les critères de la limitation dans le temps et dans l'espace. Cependant, tant la jurisprudence que la doctrine s'est très peu penchée sur le défi particulier que présente les clauses de non-concurrence dans les sociétés de professionnels. En effet, l'ordre public se veut plus exigeant vis-à-vis les professionnels étant donné que ces derniers sont régis par codes de déontologie qui prévoient le droit du public de choisir un professionnel. Dans le cas des avocats, ce droit se trouve également dans les chartes canadiennes et québécoises. Il s'agit donc de facteurs qui s'appliquent uniquement aux professionnels. Notre objectif est de proposer un cadre d'analyse propre aux clauses de non-concurrence dans les sociétés de professionnels qui privilégient la liberté contractuelle des professionnels, particulièrement à la lumière de la définition de la notion d'entreprise prévue au Code civil du Québec depuis 1994. Les tribunaux reconnaissent que les clauses de non-concurrence consenties entre professionnels d'égale valeur sont valides. Ces clauses doivent être raisonnables afin de respecter l'ordre public. Dans le cas particulier des professionnels, les tribunaux doivent tenir compte du droit du public de choisir son professionnel. Ce droit est tributaire de la relation intuitu personae qui existe entre le professionnel et son client. Afin de respecter ce droit, les tribunaux ont été réticents à ordonner des injonctions contre le professionnel-quittant et ont plutôt choisi de lui imposer des sanctions économiques. En donnant effet aux clauses pénales contre le professionnel-quittant, les intérêts économiques de la société de professionnels sont protégés et l'équilibre entre les droits du professionnel et de l'entreprise rétabli. Finalement, qu'ils soient salariés ou associés, les professionnels ont un devoir de loyauté envers leur employeur. Cette obligation est prévue à l'article 2088 du Code civil du Québec. À ce devoir s'ajoute le devoir de tenir le secret professionnel prévu dans les codes de déontologie qui régissent les professionnels de sorte que le professionnel a non seulement un devoir de loyauté envers son employeur mais aussi un devoir de loyauté vis-à-vis son client. Le statut particulier du professionnel dans le marché du travail est donc le résultat des obligations qui lui sont imposées par la déontologie professionnelle. / Professional parlnerships offer services to the public and in the services industry the most valuable asset to an enterprise is its clients. Due to the nature of competition in the marketplace, an entreprise wishes to protect its most valuable asset. Professionals have a right to work and wish to protect their clients. Non-competition clauses are thus designed to strike a balance between the deparling professional's right to work and the parlnership's right to protect its clients. Although the caselaw in matters of restrictive convenants as they apply to employment contracts and sales of enterprises is well-established, more consideration is needed in matters relating to non-competition clauses between professionals and the parlnerships in which they worked given the Iimited caselaw and doctrine on the subject. In fact, non-competition clauses as they relate to professionals must take into account factors such as the public's right to choose a professional provided for in specifie Codes of Ethics and, with respect to attorneys, present in the Canadian and Quebec Charlers. Our objective is to bring to light these factors as they apply to professionais and professional parlnerships. Our analysis emphasizes freedom to contract between professionals given the commercial nature of professional services confirmed by the Civil Code of Quebec in 1994 in its definition of the notion of enterprise. The caselaw demonstrates that Courts have generally recognized that non-competition clauses entered into by competent professionals are valid insofar as they are reasonable. The clauses must therefore respect the traditional criteria of limitation in time and space. However, public order considerations with respect to professionals dictate that clients have a right to choose their professionals given the intimate nature that often characterizes professional client relationships. In order to respect this right Courts have been reluctant to impose injunctions on the professionals that compete for the clients with their former firm. However, the balance between the interests of the professional partnership and those of the professional and the client is struck by enforcing penal clauses against the departing professional thus imposing monetary sanctions that serve to protect the economic interests of the partnership. Final/y, the obligation of loyalty and trust that an employee owes to his employer provided for in article 2088 of the Quebec Civil Code also applies to professionals whether they are salaried or partners in the partnership. In addition, all professionals are subject to the obligations contained in their respective Code of Ethics such as professional secrecy. Selon l’article 5 du code civil, les juges ne peuvent « se prononcer par voie de disposition générale et règlementaire sur les causes qui leur sont soumises ». L’article 1134, alinéa 1er, du même code pose le principe de la force obligatoire du contrat. Or, la jurisprudence de la chambre sociale de la Cour de cassation est normative ; son immixtion dans le contrat de travail est patente. Déséquilibré, soumis à un ordre public spécifique, source d’un conflit de droits et de libertés, le contrat de travail présente certaines spécificités. Ces dernières paraissent guider l’action du juge. L’adaptation du contrat constitue l’une des principales manifestations de son intervention. Elle se caractérise par l’enrichissement de l’accord de volontés ou, à l’inverse, par son amputation. De nombreuses obligations sont ajoutées au contrat. Si le fondement avancé par le juge varie, les articles 1134, alinéa 3 et 1135 du code civil justifient, en réalité, cette addition. La soustraction revêt diverses formes. Elle est parfois la source d’un pouvoir créateur ; celui-ci n’est pas toujours susceptible d’être rattaché à la protection des libertés et droits fondamentaux. Au-delà, la réfection conduit le juge à rebâtir et réécrire le contrat. Ce dernier est rebâti sur le fondement de l’article 1134, alinéa 2, du code civil. La volonté des parties est objectivée ; leur volonté réelle n’est pas nécessairement respectée. La réécriture du contrat découle, notamment, de l’application de l’article 1152 du code civil. Mais elle s’étend au-delà de ce texte. Originale et audacieuse, la relecture judiciaire du contrat de travail est liée au particularisme de cet accord. / According to article 5 of the French civil code, the judges cannot « decide through the mean of general and statutory rules on the causes they are submitted with ». It is characterized by the improvement of the agreement of the wills or, on the contrary, by its amputation. Many obligations are added to the contract. If the reasons exposed by the judge vary, actually, article 1134 al.3 and article 1135 of the French civil code justify these additions. This subtraction has different forms. It is the source of a creative power ; such creative power is not always linked to the protection of freedoms and fundamental rights. Besides, the rework leads the judge to the rebuilding and redrafting of the contract. Said contract is rebuilt in accordance with article 1134 al.2 of the French civil code. The willingness of the parties becomes objective ; their real willingness is not necessary complied with. The redrafting of the contract is the result of, in particular, article 1152 of the French civil code. However it can be extended beyond this article. Original and audacious, the judicial way to read the labor contract is linked to the sense of the identity of such labor contract.

Cette thèse vise à l'analyse de la protection des personnes vulnérables dans le droit international privé brésilien. Son objectif est, d'abord, d'identifier si les règles conflictuelles qui existent actuellement dans la Loi Introductive au Règlement du Droit Brésilienne (1942) sont ou ne sont pas suffisantes pour une protection efficace des personnes vulnérables dans les relations privées internationales, et d'autre part, se il constate une précarité dans la protection des vulnérables, d'établir une proposition de la reconstruction axiologique des règles du droit international privé brésilien pour rétablir l'égalité et le dialogue avec la Constitution Fédérale (1988). Par conséquent, la recherche est organisée en trois chapitres. Dans le premier chapitre, la crise du droit international privé brésilien est présenté sur le paradigme de la règle conflictuelle traditionnelle et sur la justice formelle, soulignant l'insuffisance de la Loi Introductive au Règlement du Droit Brésilienne (1942) à la solution des problèmes contemporains de droit international privé. Le deuxième chapitre présente la proposition d'un nouveau départ, à travers les intersections de droit international privé avec le droit privé et le droit public, en particulier en ce qui concerne la pleine efficacité des droits fondamentaux et des droits humains dans les affaires privées, à la recherche d'une justice matérielle. Dans le troisième chapitre, il est proposé une reconstruction téléologique du droit international privé, d'être guidé par des valeurs constitutionnelles. Considérant le droit international privé essentiellement un droit de différent, se trouve le principe de l'égalité et de la protection des vulnérables pour la réalisation des valeurs constitutionnelles. Enfin, deux solutions sont proposées pour surmonter la crise: d'abord, il ya la proposition d'un changement législatif, afin d'établir la règle conflictuelle avec la connexion à la loi la plus favorable aux personnes vulnérables; seconde, tandis que la modification législative ne est pas effectuée, il est proposé une interprétation systématique-téléologique de l'article 17 de la Loi Introductive au Règlement du Droit Brésilienne (1942), de fonctionner comme une clause ouverte à la réalisation des droits fondamentaux et des droits humains dans les relations privées internationales, permettant l'application de la loi la plus favorable aux personnes vulnérables comme une forme de performance positive de l'ordre public constitutionnel. / A presente tese tem por objeto a análise da proteção do vulnerável no direito internacional privado brasileiro. Seu objetivo consiste, por um lado, em identificar se as regras de conflito atualmente existentes na Lei de Introdução às Normas do Direito Brasileiro (1942) são suficientes ou não para uma proteção efetiva do vulnerável nas relações privadas internacionais, e por outro lado, em se constatando uma precariedade na proteção do vulnerável, estabelecer uma proposta de reconstrução axiológica das regras do direito internacional privado brasileiro para restabelecer a igualdade e o diálogo com a Constituição Federal (1988). Para tanto, a pesquisa está disposta em três capítulos. No primeiro capítulo, é apresentada a crise do direito internacional privado brasileiro a partir do paradigma da regra conflitual tradicional e da justiça formal, apontando-se a inadequação da Lei de Introdução às Normas do Direito Brasileiro para a solução dos problemas contemporâneos de direito internacional privado. No segundo capítulo, apresenta-se a proposta de um recomeço, a partir das intersecções do direito internacional privado com o direito privado e com o direito público, especialmente no que diz respeito à eficácia plena dos direitos fundamentais e dos direitos humanos nas relações privadas, em busca de uma justiça material. No terceiro capítulo, é proposta a reconstrução teleológica do direito internacional privado, a ser orientada pelos valores constitucionais. Sendo o direito internacional privado essencialmente um direito dos diferentes, sobressai o princípio da igualdade e a proteção dos vulneráveis como concretização dos valores constitucionais. Ao final, são propostas duas soluções para a superação da crise: primeiro, há a proposição de alteração legislativa, para que se estabeleça a regra de conflito com a conexão da lei mais favorável ao vulnerável; segundo, enquanto não é realizada a alteração legislativa, propõe-se interpretação sistemático-teleológica do artigo 17, da Lei de Introdução às Normas do Direito Brasileiro (1942), para que funcione como cláusula aberta para a concretização dos direitos fundamentais e dos direitos humanos nas relações privadas internacionais, possibilitando a aplicação da lei mais favorável ao vulnerável como forma de efetivação positiva da ordem pública constitucional. / This thesis aims at the analysis of the protection of the vulnerable in the Brazilian private international law. Its aim is, first, to identify if the conflictual rules currently existing in the Introductory Act to Brazilian Law Rules (1942) are or are not sufficient for an effective protection of the vulnerable in international private relations, and on the other hand, if finding the protection of the vulnerable precarious, to establish a proposal of axiological reconstruction of the rules of Brazilian private international law to restore equality and dialogue with the Federal Constitution (1988). Therefore, the research is arranged in three chapters. In the first chapter, the crisis of the Brazilian private international law is presented from the paradigm of traditional conflictual rule and formal justice, pointing out the inadequacy of the Introductory Act to Brazilian Law Rules (1942) to the solution of contemporary problems of private international law. The second chapter presents the proposal of a new beginning, through the intersections of private international law with private law and public law, especially with regard to the full effectiveness of fundamental rights and human rights in private affairs, in search of a material justice. In the third chapter it is proposed a teleological reconstruction of private international law, to be guided by constitutional values. Private international law being essentially a right of the different, it stands the principle of equality and the protection of the vulnerable as achievements of constitutional values. Lastly, two solutions are proposed to overcome the crisis: first, there is the proposal of a legislative change, in order to establish the conflictual rule with the connection to the most favorable law to the vulnerable; second, while the legislative amendment is not performed, it is proposed a systematic-teleological interpretation of Article 17 of the Introductory Act to Brazilian Law Rules (1942), to function as an open clause to the achievement of fundamental rights and human rights in international private relations, enabling the application of the most favorable law to the vulnerable as a form of positive performance of the constitutional public order.

La réception de la polygamie et de la répudiation par l’ordre juridique international français a connu une évolution fluctuant entre la tolérance et le rejet. Nous plaçant dans le cadre particulier des relations franco-marocaines, nous avons cherché à vérifier dans quelle mesure la réforme de ces deux institutions, introduite au Maroc par le nouveau Code de la famille, pouvait leur assurer un meilleur accueil. Mais au préalable, nous avons jugé utile de passer en revue leur histoire et leur évolution dans le cadre du droit marocain. Ensuite, nous avons examiné le parcours difficile de leur " immigration " en France, les différents bouleversements jurisprudentiels qu’elles ont subis et l’intervention de plus en plus sévère de l’ordre public prenant désormais appui sur le respect des droits fondamentaux tel que dicté par la CEDH. Loin de résorber tous les différends en la matière, la Convention franco-marocaine du 10 août 1981 a révélé ses insuffisances et ses limites. L’ambition de ce travail fut alors de proposer quelques solutions inspirées pour certaines d’entre elles de la doctrine, telles que l’adoption de nouvelles règles matérielles ou encore la théorie des accommodements réciproques. / The reception of polygamy and repudiation by the French international legal order has evolved, fluctuating between tolerance and rejection. Placing us in the specific context of French-Moroccan relations, we have sought to verify to what extent the reform of these two institutions, introduced by the new Code of family in Morocco, could provide them a better reception. But before, we thought it useful to review their history and their evolution under Moroccan law. Then we reviewed the difficult course of their " immigration " in France, the different jurisprudential dislocations that they underwent, and the more severe intervention of the public order now based on respect for such fundamental rights as dictated by the ECHR.Far from resolving all disputes in this area, the French - Moroccan agreement of 10 August 1981 revealed its shortcomings and limitations. The ambition of this work was then to offer some solutions inspired for some of them by the doctrine, such as the adoption of new substantive rules or the theory of reciprocal accommodations.

Igualdade / diversidade / vulnerabilidade: revisitando o regime das incapacidades rumo ao direito privado solidário de proteção à pessoa

La thèse propose l'étude critique du régime d'incapacité juridique dans le Code Civil brésilien de 1916 et 2002, fondé sur les considérations d'égalité, de diversité et de vulnérabilité, dans le contexte du droit privé contemporain de caractère solidaire et de protection à la personne humanine de sorte que, à la fin, cette recherche suggère de modifier la legislation. Dans la primière partie, Il est procedé à um approche classique du régime d’incapacité juridique en éxaminant toutes ses catégories qui différencient les sujets incapables de la pratique des actes de la vie civile, sous la considération que tous sont égaux devant la loi. Fondé sur la protection de la liberté (de faire des contrats) et l'égalité formelle qui a marqué le droit privé des XIXe et XXe siècles, la loi a distingué les sujets qui n'auraient pas la capacité, selon les catégories précédemment délimitées: les mineurs, les personnes souffrant de troubles mentaux, les sourdmuets, les absents, les femmes mariées, les prodigues, le peuple autochtone. Sous la justification de la protection, la loi fulminait d'invalidité les actes pratiqués par les incapables en raison de l'absence de volonté, présupposition essentielle, dans la théorie des contrats. La volonté qui n'est pas libre et qui n'est pas égale est marquée par la nullité ou l'annulation, conformément au Code Civil. Dans la seconde partie, la thése préconise le passage du droit privé d'une caractéristique individualiste, à un droit privé de solidarité qui prenne en compte la protection de la fraternité, dans le contexte du pluralisme, pour la construction d'une égalité matérielle (Suite)La méthode est renouvellée, laissant de côté l'herméneutique déductive classique, construite sur la sécurité du positivisme juridique pour une méthode fonctionnelle qui prend en compte le but des instituts, les valeurs de l'ordre juridique, principalement du point de vue constitutionnel et des droits de l'homme, en particulier en utilisant “le dialogue des sources”. Dans cet aspect, il est proposé de surmonter le paradigme d’incapacité juridique, en respectant la diversité dans la société plurielle, mais sans se soucier de la protection des sujets. On étudie les sujets jugés incapables, en défendant que, par la reconnaissance de la vulnérabilité et de la diversité, on obtient une protection plus adéquate pour ne pas aliéner complètement l'individu de la pratique des actes de la vie civile. En ce sens, la théorie de l'invalidité gagne une perspective plus fonctionnelle et pas seulement comme maque de volonté, mais en tant que protection des valeurs de l'ordre juridique. D'autre part, il est reconnu les effets juridiques de la volonté des vulnérables afin d'atteindre une plus grande visibilité de ces sujets dans l'ordre social. En conclusion, la thése présente une proposition d'amendement législatif visant à promouvoir une révision du régime d’incapacité juridique. / A tese propõe o estudo crítico do regime de incapacidade, delineado no Código Civil de 1916 e 2002, a partir das considerações a respeito da igualdade, diversidade e vulnerabilidade, no contexto do direito privado contemporâneo de viés solidário e de proteção à pessoa com a proposição, ao final, de uma alteração legal no instituto. Analisa, na primeira parte, o regime clássico de incapacidade, cada uma das categorias construídas historicamente que diferenciavam os sujeitos incapazes da prática de atos na vida civil, sob a consideração de que todos, de forma geral e abstrata, são iguais perante a lei. Como proteção à liberdade (de realizar contratos) e a igualdade formal que marcaram o direito privado do século XIX e XX, a lei distinguia os sujeitos que não possuiriam capacidade, segundo categorias previamente delimitadas: menores, loucos, surdos-mudos, ausentes, mulheres casadas, pródigos, silvícolas. Sob a justificativa de proteção, fulminava de invalidade os atos praticados pelos incapazes por ausência de vontade, pressuposto essencial, na teoria do negócio, para a realização de contratos obrigatórios. A vontade que não é livre e não é igual é marcada pela nulidade ou anulabilidade, conforme determinado pelo Código Civil de forma a não preencher validamente os planos do negócio jurídico. Na segunda parte, defende uma transformação do direito privado de cunho individualista para um direito privado solidário que leve em conta a proteção da fraternidade, no contexto do pluralismo, para a construção de uma igualdade material O método se renova, abandoando-se a hermenêutica dedutiva clássica, construída na segurança do positivismo jurídico para um método funcional que leve em conta a finalidade dos institutos, os valores do ordenamento, principalmente sob a ótica constitucional e dos direitos humanos, a partir de um diálogo de fontes, repudiando soluções clássicas na construção da norma no caso concreto. Neste aspecto, propõe-se a superação do paradigma da incapacidade, respeitando a diversidade na sociedade plural, mas sem deixar de se preocupar com a proteção dos sujeitos. Estuda-se, a partir do conceito de vulnerabilidade e diversidade, os sujeitos antes incapazes, defendendo que, por meio do reconhecimento da vulnerabilidade, obtém-se uma proteção mais adequada de modo a não afastar completamente o indivíduo da prática de atos da vida civil. Nesse sentido também, a teoria das invalidades ganha uma perspectiva mais funcional e não apenas como ausência de requisito do negócio jurídico. A partir da construção de uma ordem pública de proteção ao vulnerável é possível que o intérprete afaste dispositivos por meio da nulidade em razão de contrariedade com os valores do ordenamento. De outro lado, reconhece-se efeitos jurídicos da vontade dos vulneráveis de forma a atender maior visibilidade desses sujeitos na ordem social. Em sede de conclusão, apresenta uma proposta de alteração legislativa que pretenda promover uma revisão no regime de incapacidade clássico. / This thesis proposes the critical study of the legal incapacity established in the 1916 Brazilian Civil Code and 2002 Brazilian Civil Code, based on the considerations regarding equality, diversity and vulnerability, in the context of contemporary private law. At first, it analyzes each one of the historically categories of legal incapacity that distinguished the incapable subjects, under the consideration that all individuals are equal before the law. Based on the protection of freedom (to execute contracts) and the formal equality that marked the nineteenth and twentieth centuries, the law distinguished the subjects that would not have legal capacity, according to categories previously delimited: minor, mentally handicapped person, deaf-mute, absent, married women, prodigal and Indians. All the acts practiced by the incapable were invalid according to the law under the pretext of protection. In the second part, it is proposed a transformation in private law: from an individualist characteristic to a private law of solidarity, that takes into account the protection of fraternity, in the context of pluralism, for the construction of a material equality. The method changes, leaving aside the classic deductive hermeneutics, built on the security of legal positivism for a functional method that takes into account the purpose of the institutes, the values of the legal order, mainly from the constitutional and human rights perspective Therefore, there is the importance of “dialogue of laws ” method. In this aspect, it is suggested to overcome the paradigm of legal incapacity, respecting diversity in plural society. The paper studies the subjects that once were incapables arguing that, through the recognition of vulnerability and diversity, a more adequate protection is obtained. Thus, the individual does not depart completely from the practice of legal acts. In this sense, the theory of invalidity gains a more functional perspective and not only as absence of elements of the contract. A public policy for the protection of the vulnerable must be considered in order to avoid contracts that are contrary to legal values such as human rights. On the other hand, it is proposed to recognize juridical effects of the will of the vulnerable person in order to reach greater visibility of these subjects in society. In conclusion, the paper proposes a legislative amendment that intends to promote a revision in classic legal incapacity.
