Transexualidade: dos transtornos às experiências singulares

The implications of the sexual-anatomic and gender determinism in the process of the development of the subjectivities of the transsexuals are discussed; the pertinence of the Gender Identity Disorder (GID) psychiatric diagnosis for transsexuality is questioned; the psychoanalytic conceptions that support the psychosis diagnosis for transsexuality are analyzed; the possibility of sex change surgery subverting the sex-gender binary order is investigated; and finally, the implications of sex change surgery are considered in the subjectivities of the transsexuals. The data was collected and analyzed according to the qualitative research method and the semi-structured interview was used as the main instrument for the field research. The participants were male-to-female (MTF)transsexuals who had already undergone the surgery or were still waiting for the opportunity to do so. The data collection took place in the Gynecological Clinic in the Hospital das Clínicas da Universidade Federal de Pernambuco (UFPE) and the results were discussed in light of the theoretic contributions of Michel Foucault and Judith Butler, in the philosophical area, as well as those of Robert Stoller, Catherine Millot, Márcia Arán, Jurandir Costa and other contemporary authors, in the psychoanalytic area. The research results demonstrate that in deconstructing the normative conceptions inherent in the sex-gender binary system, the transsexuals transcend the limits of the psychopathologic certainties and, at the same time, confirm their subjectivities / Esta pesquisa problematiza a categoria da transexualidade, em sua dimensão psicopatológica, e questiona seu caráter normativo, que pretende alinhar sexo, gênero, prática sexual e desejo, concernente às identidades sexuais. Ao desenvolvê-la, são discutidas as implicações dos determinismos anatomosexual e de gênero, no processo de subjetivação das transexuais; também se reflete quanto à pertinência do diagnóstico psiquiátrico de Transtorno de Identidade de Gênero, para a transexualidade; analisam-se concepções psicanalíticas que sustentam o diagnóstico de psicose para a transexualidade; investiga-se a possibilidade da intervenção cirúrgica de transgenitalização subverter a ordem binária sexo/gênero e, finalmente, consideram-se as implicações da mudança de sexo, nas subjetividades das transexuais. Os dados da pesquisa foram coletados e analisados, segundo a práxis do método qualitativo, utilizando-se a entrevista semiestruturada como principal instrumento de trabalho de campo. Os participantes da pesquisa são transexuais de homem para mulher, que já haviam realizado a cirurgia de transgenitalização ou que ainda aguardavam a oportunidade de fazê-la. A coleta de dados foi realizada no Serviço de Ginecologia do Hospital das Clínicas da Universidade Federal de Pernambuco UFPE. Seus resultados foram discutidos à luz das contribuições teóricas de Michel Foucault e Judith Butler, no campo filosófico, e de Robert Stoller, Catherine Millot, Márcia Arán, Jurandir Costa e outros autores contemporâneos, no campo psicanalítico. The aim of this study is to explore how a number of transgender individuals with an autism diagnosis relate to contemporary discourses such as neurotypicality and gender binarism. To achieve this aim, the study applies the tools of discursive psychology in combination with qualitative interviews. The over-arching theoretical and methodological platform on which this study is based derives from a social constructivist perspective emanating in an analytical approach based on discourse psychology. The results show that the informants construct themselves and their surroundings in ways that are dependent on the various interpretative repertoires employed to justify identities seen as deviant. The informants characterise themselves in accordance with or in contrast to neurotypical stereotypes. Despite displaying differing reactions to a binary two-gender system, the informants give the impression that they, in various ways, accept this perception in constructing openness to their social surroundings. The choice between either conforming to a norm or being open about ones gender identity and diagnosis is constructed in relation to the stigma that the category of deviant implies. Being diagnosed with autism seems to inhibit the transformation of gender identity, but to ease the coming-out process of being transgender due to the low or non-existent expectations of their immediate surroundings.

La conversion entre intimité et publicité : essai d'imagination sociologique

Avec ce mémoire, j’ai souhaité cerner ce qui serait le propre d’une conversion, soit ce que j’ai appelé un processus de trans-formation. Avec ce concept original, j’ai voulu orienter le regard de l’observateur vers les points de basculement de l’intimité à la publicité qui caractérisent les conversions. Pour ce faire, il m’est apparu fertile de mobiliser et de réhabiliter l’étude des valeurs, un thème classique en sociologie. Des valeurs portées par des individus aux valeurs publiques, la notion de « valeur » recèle le potentiel heuristique nécessaire pour étudier les conversions à différentes échelles d’analyse et par-delà des qualifications a priori religieuses, politiques, sexuelles, etc. Avec cette perspective théorique pragmatique inspirée par Dewey et articulée à la sensibilité aux positions sociales des cultural studies, je me suis donné les moyens d’analyser la façon dont change au cours d’une vie ce à quoi les gens tiennent. Cette représentation dynamique de la conversion vient ajouter des éléments de compréhension à un phénomène trop souvent appréhendé à la lumière de « lectures préférées » modernes et coloniales qui demandaient à être subverties pour redonner place à l’exercice de l’imagination sociologique. Les apports du concept de trans-formation sont illustrés à partir de la comparaison de quatre études de cas individuels : Paul Claudel, un écrivain converti au catholicisme ; Michelle Blanc, une transsexuelle québécoise ; Joe Loya, un Mexican American qui modifie ses conceptions du bien et du mal en isolement carcéral ; et Mlle Pigut qui est devenue « vegan ». / In this master thesis, I had the objective to pinpoint what is peculiar to conversions, that being what I have called a process of trans-formation. With this original concept, I wanted to guide the observer’s eyes toward the shifting points from intimacy to publicity, which are central in conversions process. To do so, I considered fruitful to acknowledge and reinstate the study of values, a classical theme in sociology. From values held by individuals to public values, the notion of “value” comprises the necessary heuristic potential to study conversions at different analytical scales and across assumed qualifications such as religious, political, sexual, etc. My pragmatic theoretical approach informed by Dewey and the cultural studies’ sensibility to social positions allowed me to analyse how what people value changes in the course of their life. This dynamic representation of conversions adds some insights to grasp a phenomenon often tackle from the perspective of modern and colonial “preferred readings”; readings that need to be challenged and revisited as to allow the exercise of sociological imagination. The contributions of the trans-formation’s concept are illustrated by the comparison of four individual case studies: Paul Claudel, a writer converted to Catholicism; Michelle Blanc, a québécoise transsexual; Joe Loya, a Mexican American who modifies his conceptions of good and bad in solitary confinement; and Mlle Pigut who becomes vegan.

Issues considered as complexes, however, such as transsexualism that according to the International Classification of Diseases (CID 10) is considered to be a 'Sexual Identity Disorder' and still raises deeper understanding from part of Society, the judiciary power, the executive power and the legislative power. The Brazilian Health System – SUS – has began allowing in Brazil the gender reassignment surgery, in which sexual reassignment is done, and legal criteria was therefore settled for this accomplishment. After surgery, however, comes a new problem: civil identity; because the person's new gender is not in line with his/her new civil register, causing him/her embarrassment. There is no law that regulates this matter at all. From this research observation, the present study aims to explore judicial decisions, from all states in the federation, by means of research in sites from respective courts, as well as high courts, seeking with terms as: 'transsexual' and 'first name'; using time filtering in the search, since 1988, which was the promulgation year of the Citizenship Letter, through the end of 2010. Having in view the lack of a law to regulate this issue, the primary scope here consisted in obtaining the narrative of how demands have been decided into this regard. The study conclusion suggests that although there is no established legal framework, the discourse of the judiciary power uses several arguments from the social, psychological and legal order, being properly, systematic and appreciated, as well as the legal principles, being in this case the principle of human person's dignity, as laid down in the Magna Carta, the most used one. / À luz do instituído pela Constituição Federal de 1988, os direitos fundamentais passaram a ser vistos sob um novo olhar. Todavia, temas considerados complexos, como o transexualismo, segundo a Classificação Internacional das Doenças (CID 10) considerado 'Transtorno de Identidade Sexual', ainda suscitam maior aprofundamento por parte da sociedade, do poder judiciário e do poderes executivo e legislativo. O Sistema Único de Saúde – SUS passou a permitir a cirurgia de transgenitalização no Brasil, na qual se opera a redesignação de sexo, tendo sido estipulados por lei critérios para a sua realização. Após a cirurgia, surge um problema: o da identidade civil, uma vez que o novo gênero da pessoa operada não se coaduna com o seu registro civil, causando-lhe constrangimento. Não há lei que regule a matéria. A partir desta constatação, o presente estudo se propõe a explorar as decisões judiciais de todos os estados da Federação, por intermédio de pesquisa nos sites dos seus respectivos tribunais, bem como das cortes superiores, buscando os termos 'transexual' e 'prenome' e utilizando o filtro temporal a partir de 1988, ano da promulgação da Carta Cidadã, até final de 2010. Tendo em vista a falta de lei que normatize a matéria, o escopo primordial consiste na obtenção de uma narrativa de como vêm sendo decididas as demandas na temática ora proposta. A conclusão do trabalho sugere que apesar de não haver um marco normativo estabelecido, o discurso do poder judiciário se utiliza de diversos argumentos de ordem social, psicológica e jurídica, devidamente sistematizados e apreciados, bem como de princípios jurídicos, sendo, nesse caso, o princípio da dignidade da pessoa humana, previsto na Carta Magna, o mais utilizado.

Esta pesquisa analisou o efeito transgressor de gênero artístico, de identidade de gênero, de sexualidade e de comportamento social apresentados na peça teatral Escravagina, produzida pelo grupo Rainha de Duas Cabeças, de Curitiba-PR, produção teatral estreada em 2014. A peça conta com dramaturgia e direção de Cesar Almeida e com atuação da atriz Maite Schneider. O espetáculo narra a história pessoal da atriz que passou por um processo de transexualização. Na peça são discutidos padrões de beleza corporal, instituições normatizadoras e reguladoras de sexualidade, gênero, orientação sexual, desejo e comportamentos sociais impostos. Buscamos compreender a maneira como os artistas utilizaram-se das tecnologias e das técnicas de cena, ou seja, os elementos e procedimentos constituintes para a produção do espetáculo teatral com o propósito de transgressão (FOUCAULT, 2009) das noções socialmente estabelecidas sobre identidades focadas em polaridades ou identidades fixas. Nossa pesquisa apontou para a utilização de traços do grotesco e da carnavalização (BAKHTIN, 2013), do kitsch (MOLES, 1975), da ironia, da paródia e do intertexto (HUTCHEON, 1991), do hibridismo cultural (CANCLINI, 2013), do Business gay (LIPOVETSKY, 2015), do paradoxo (COMPAGNON, 2010) e da profanação (AGAMBEN, 2007), percebidos por meio de elementos e procedimentos que incluem uma ou múltiplas técnicas/tecnologias da cena para obtenção do efeito desejado. Nossa pesquisa também questionou as aproximações entre corpo e tecnologia e sua relação com a transexualidade. Para tanto, o estudo se utilizou de metodologia da Análise dos Espetáculos (PAVIS, 2015) e da Análise Matricial (BRITO, 1999). Os materiais primários de análise foram o vídeo do espetáculo e o texto teatral. Como material secundário utilizamos as entrevistas realizadas com os artistas (em 2015 e em 2016), o material de divulgação, o paratexto publicitário, os diários de itinerância e a tomada de notas realizada pela pesquisadora durante a observação in loco do espetáculo, assistido no ano de 2016. / This research analyzed the transgressive effect of artistic genre, gender identity, sexuality and social behavior presented in the play Escravagina, produced by the group Rainha de Duas Cabeças, from Curitiba/PR, a theatrical production premiered in 2014. The play counts on the dramaturgy and direction of Cesar Almeida, as well as the performance of the actress Maite Schneider. The show narrates the personal story of the actress who underwent a process of transsexualization. In the play, the standards of body beauty are discussed, as well as the normative institutions and regulators of sexuality, gender, sexual orientation, desire and social behaviors imposed. We seek to understand the way in which the artists used the technologies and techniques of scene, that is, the constituent elements and procedures for the production of the theatrical spectacle, with the purpose of transgression (FOUCAULT, 2009) of socially established notions on identities focused on polarities or fixed identities. Our research pointed to the use of traces of the grotesque and carnivalization (BAKHTIN, 2013), of kitsch (MOLES, 1975), the irony, parody and intertext (HUTCHEON, 1991), the cultural hybridity (CANCLINI, 2013), the Business gay (LIPOVETSKY, 2015), paradox (COMPAGNON, 2010) and the profanation (AGAMBEN, 2007) perceived by means of elements and procedures that include one or multiple scene techniques/technologies to achieve the desired effect. Our research also questioned the approximations between body and technology and their relation with transsexuality. For this, the study was based on the methodology of Analysis of Spectacles (PAVIS, 2015) and Matricial Analysis (BRITO, 1999). The primary materials of analysis were the video of the theatre show and the theatrical text. As secondary material, we used interviews with the artists (in 2015 and 2016), the advertising material, the advertising paratext, the itinerancy journals and the notes taken by the researcher herself during the on-site observation of the theatre show assisted in 2016.

"Inga politiker mellan våra ben" : – om den offentliga diskursen kring tvångssteriliseringen av transsexuella

Denna uppsats granskar policydokument som behandlar avskaffandet av det steriliseringskrav som tidigare var en del i Lagen om fastställande av könstillhörighet. Med målet att undersöka den syn på transsexuella som går att återfinna i det samtida svenska, offentliga samtalet har en kvalitativ, kritisk textanalys utförts. Mer specifikt åsyftar studien synliggöra och granska antaganden om kön, könsidentitet, sexualitet och även reproduktion. Som teoretisk utgångspunkt har den queerteoretiska ansatsen den heterosexuella matrisen använts. Studien finner synen på transsexuella i dagens politiska diskurs vara tämligen nyanserad och mer öppensinnad än vad som påvisats i tidigare forskning. Dock återfinns ännu en normativ föreställning om kärnfamiljen. Idén om kärnfamiljen som naturlig, norm och ideal ter sig knappt ifrågasatt och verkar fungera som en avgörande faktor för utformningen av de politiska förslag de granskade policydokumenten lägger fram, och för vad de utelämnar.

Navigating The Landscape of Sexuality and Gender : The trans, lesbian, and women’s movements in Sweden 1964–1999

This thesis is situated at the intersection of trans, lesbian, and women’s history. It is an exploratory study that has sought to combine the disparate strands of the social movements organised around the identity categories trans, lesbian, and woman. Using a semibiographical and intersectional approach, the study follows in the footsteps of the transsexual lesbian woman Eva-Lisa Bengtson as she navigated the trans, lesbian, and women’s movements between 1964–1999. The analytical focus is on mapping Eva-Lisa’s presence in the movements, dissecting the production, reproduction, and negotiation of identities within and between the movements, and identifying identity-based conflict. The study finds that similar mechanisms of differentiation and the creation of new normativities occurred across all three movements in a recognisable pattern.

Transtorno de identidade sexual em adultos e justiça: laudo psicológico para mudança de prenome / Transsexualism and justice: the impact of the psychological appraisal on forename change litigation

Transexualismo é definido como o desejo de viver e ser aceito como pertencente ao sexo oposto. É usualmente acompanhado por sentimento de desconforto ou inadequação em relação ao sexo anatômico, associado a desejo de se transformar cirúrgica e hormonalmente para tornar o corpo o mais congruente possível com o sexo pretendido. Com essa alteração, surge ainda a necessidade de adequação jurídica da pessoa física por meio de processo cível para mudança do nome e do sexo jurídicos, adequando-se, assim, o status civil/social. O objetivo deste trabalho foi observar como os laudos psicológicos poderiam ou não colaborar nas decisões judiciais, de acordo com a análise de sentenças judiciais para mudança de prenome em transexuais masculinos e femininos, submetidos ou não a cirurgia de transgenitalização. Realizamos levantamento por amostragem, que inicialmente caracterizou as variáveis sociais e demográficas dessa população e, posteriormente, sistematizamos os dados encontrados. A população estudada, que pleiteia a mudança do registro civil, foi mapeada a partir de dados de sentenças e processos para mudança de prenome, traçando-se um perfil nacional segundo os critérios definidos pelo SUS. Buscamos a amostra nos quatro centros credenciados para o processo transexualizador (Portaria no 457, de 19 de agosto de 2008). Encontramos 55 sujeitos que entraram com processo de mudança de prenome e/ou prenome e sexo, matriculados/acompanhados nos referidos hospitais. Observamos uma proporção de de 9:2 entre homem para mulher (MTF) e mulher para homem (FTM), semelhante ao que se relata na literatura internacional (4:1). Quanto às sentenças, apenas 5,50% (três) dos processos foram indeferidos, correspondentes a sujeitos do sexo biologico masculino que ainda não haviam sido submetidos à cirurgia. Observamos uma associação entre cirurgia e deferimento da mudança de prenome (p = 0,001). Em apenas 10,90% (seis) sentenças analisadas, havia menção ao laudo psicológico, que, portanto, foi omitido nas demais, 82,10% (49). Quando presentes, os laudos não foram elaborados por profissionais dos centros credenciados para o processo transexualizador, descaracterizandose como objetos deste estudo. Os resultados sugerem que os laudos psicológicos não influem na decisão judicial nos processos de mudança de prenome entre pacientes transexuais e que a realização prévia da cirurgia de readequação sexual está associada a um maior índice de êxito no pleito dos pacientes / Transsexualism is defined as a desire to live and be accepted as a member of the opposite sex, usually accompanied by a sense of discomfort (or inappropriateness) with one\'s anatomic sex, and a wish to have surgical and hormonal treatment to make one\'s body as congruent as possible with one\'s preferred sex. This change triggers the need for legal adjustment of the individual through civil proceedings for change the legal name and sex/gender. This study\'s objective was to observe whether psychological appraisals may or may not influence the judicial decision, by the analysis of the judges\' sentences for the change of forename in transsexual men and women, whether or not they underwent reassignment surgery. We performed a sample study where we initially characterized the social and demographic variables of this population, and then we systematized the data found. The population studied, who presented a plea to change theirs forename at the civil register, was mapped from data of trial sentences. From this data we present a national profile of patients according to criteria for the processo transexualizador, the treatment as laid down by the Brazilian National Health Care System. We seeked our sample at the four centers licensed for the \"processo transexualizador\" (Ordinance 457 of the Brazilian Health Care Ministry, dated August 19, 2008). We have found 55 subjects which entered pleas for changes of forename and / or pleas for changes of forename and sex. This subjects should be registered patients or be monitored at these hospitals. We found a proportion of 9:2 male to female (MTF) and female to male (FTM) patients, this finding is similar to reports from the international literature (4:1). When we analyzed for outcome of the judgments, we found that 5.50% (three) cases were rejected. This three cases belonged to biological male gender and had not yet been submitted to surgery. We observed a association between surgery and plea for first name\'s change (p = 0.001). Only 10.90% (six) of the sentences analyzed mentioned the psychological appraisal, which was omitted in 82.10% (49) of the sentences. We also found that when the psychological appraisals were present they were not issued by professionals working at licensed centers, therefore these did not meet the criteria for the study. Our findings suggest that the psychological appraisals do not affect the judicial decision over the pleas for forename changes among transsexual patients and the prior execution of the reassignment surgery is associated to a higher success rate in the patients\' litigations

“Doing” gender in South Africa : footprints of tension for transgender persons

Text in English / The ‘doing’ of gender in our society is constructed along the lines of power, knowledge and being. Power structures angle knowledge and understanding of transgender people and transgender lives in a way that relegates them almost to the museum to be observed as a spectacle or exotic objects. The emphatic frames of man and woman, even in South Africa where the Constitution is considered and understood to be liberal and generous, the life of a transgender body is an Other life. One is either male or female; any other form of doing and being gender suffers peripherisation and classification as special, different, strange or any other exteriorising definitions. This dissertation attempts to question the power or the tyranny of categorisations and classifications of man and woman, drawing from various discourses such as the medico-legal discourse classification. It further looks at how gender is being performed by transgender people. Further it aimed at gaining an in-depth understanding of the experiences and challenges of transgender people with regards to doing gender within a gendered society. The findings within the dissertation tells us, that the performativity of gender is not a neutral space, but enacted by various power structures and those who live outside the norms such as the transgender people, they are subjected to precariousness. It this dissertation seeks to contribute to an unmasking of some easy but harmful assumptions about gender and sexuality. Realizamos levantamento por amostragem, que inicialmente caracterizou as variáveis sociais e demográficas dessa população e, posteriormente, sistematizamos os dados encontrados. A população estudada, que pleiteia a mudança do registro civil, foi mapeada a partir de dados de sentenças e processos para mudança de prenome, traçando-se um perfil nacional segundo os critérios definidos pelo SUS. Buscamos a amostra nos quatro centros credenciados para o processo transexualizador (Portaria no 457, de 19 de agosto de 2008). Encontramos 55 sujeitos que entraram com processo de mudança de prenome e/ou prenome e sexo, matriculados/acompanhados nos referidos hospitais. Observamos uma proporção de de 9:2 entre homem para mulher (MTF) e mulher para homem (FTM), semelhante ao que se relata na literatura internacional (4:1). Quanto às sentenças, apenas 5,50% (três) dos processos foram indeferidos, correspondentes a sujeitos do sexo biologico masculino que ainda não haviam sido submetidos à cirurgia. Observamos uma associação entre cirurgia e deferimento da mudança de prenome (p = 0,001). Em apenas 10,90% (seis) sentenças analisadas, havia menção ao laudo psicológico, que, portanto, foi omitido nas demais, 82,10% (49). Quando presentes, os laudos não foram elaborados por profissionais dos centros credenciados para o processo transexualizador, descaracterizandose como objetos deste estudo. Os resultados sugerem que os laudos psicológicos não influem na decisão judicial nos processos de mudança de prenome entre pacientes transexuais e que a realização prévia da cirurgia de readequação sexual está associada a um maior índice de êxito no pleito dos pacientes / Transsexualism is defined as a desire to live and be accepted as a member of the opposite sex, usually accompanied by a sense of discomfort (or inappropriateness) with one\'s anatomic sex, and a wish to have surgical and hormonal treatment to make one\'s body as congruent as possible with one\'s preferred sex. This change triggers the need for legal adjustment of the individual through civil proceedings for change the legal name and sex/gender. This study\'s objective was to observe whether psychological appraisals may or may not influence the judicial decision, by the analysis of the judges\' sentences for the change of forename in transsexual men and women, whether or not they underwent reassignment surgery. We performed a sample study where we initially characterized the social and demographic variables of this population, and then we systematized the data found. The population studied, who presented a plea to change theirs forename at the civil register, was mapped from data of trial sentences. From this data we present a national profile of patients according to criteria for the processo transexualizador, the treatment as laid down by the Brazilian National Health Care System. We seeked our sample at the four centers licensed for the \"processo transexualizador\" (Ordinance 457 of the Brazilian Health Care Ministry, dated August 19, 2008). We have found 55 subjects which entered pleas for changes of forename and / or pleas for changes of forename and sex. This subjects should be registered patients or be monitored at these hospitals. We found a proportion of 9:2 male to female (MTF) and female to male (FTM) patients, this finding is similar to reports from the international literature (4:1). When we analyzed for outcome of the judgments, we found that 5.50% (three) cases were rejected. This three cases belonged to biological male gender and had not yet been submitted to surgery. We observed a association between surgery and plea for first name\'s change (p = 0.001). Only 10.90% (six) of the sentences analyzed mentioned the psychological appraisal, which was omitted in 82.10% (49) of the sentences. We also found that when the psychological appraisals were present they were not issued by professionals working at licensed centers, therefore these did not meet the criteria for the study. Our findings suggest that the psychological appraisals do not affect the judicial decision over the pleas for forename changes among transsexual patients and the prior execution of the reassignment surgery is associated to a higher success rate in the patients\' litigations
