跳脫國際政治的攻勢及守勢現實主義:體系穩定的互動與結構解釋之嘗試 / Beyond the Offensive and Defensive Realism in the International Politics: An Attempt of Interaction and Structure Explanations on the Stability of the International System

本文試圖為當前現實主義中,國際政治理論發展的問題與瓶頸,作一概略的檢視、提出可能的倡議,並進行實證研究加以檢驗。本文發現攻勢與守勢現實主義之爭,是理論發展上不必要的誤會,現實主義內的理論爭議,其實仍是分析層次的問題:單元層級的解釋混亂繁瑣而難以驗證,但體系層級基於權力分配結構的解釋,卻也不盡圓滿。因此,本文嘗試在現實主義的物質能力傳統中,對體系穩定的變動提出「體系穩定的互動解釋」與「體系穩定的結構解釋」之新嘗試,以求在名稱上貼近解釋倡議的實質內容,跳脫過去攻勢、守勢現實主義理論名稱劃分的漩渦,並作為未來建立國際政治理論的可能選擇。 本文指出,互動能力的概念,不僅是新的解釋來源,也是界定體系範疇的前提,未來的國際政治理論應利用攻守平衡的解釋邏輯,在結構之外的互動能力解釋來源中,開發科技與地理等兩項解釋變數;並發掘結構解釋來源中,絕對的權力分配作解釋變數,再分別從此導出推論;而有關穩定的意涵,也應從戰爭的避免,擴大為對和平的威脅。本文的實證研究範圍訂在一六四八年至今的歐洲乃至全球體系,本文將先分別呈現各項解釋變數在各個時代的變化,以及依據推論所應出現的結果,再對照實際上體系穩定的變異狀態,以檢驗各項推論。整體而言,本文所進行的實證研究大致上是獲得了相當的正面結果。 / The purposes of this thesis are: examining the current obstructions in Realist theory of international politics, proposing alternatives, and conducting empirical studies. The thesis finds that, the debates between Offensive and Defensive Realism are unnecessary. The level of analysis problem is still crucial: unit level explanations are complex and hard to test, but system level explanations base on the structure of relative power distribution are not satisfactory either. Thus, to get rid of the offensive and defensive labeling, the thesis proposes two alternatives within the Realist material tradition: “interaction” and “structure” explanations on the stability of the international system. The thesis argues that, interaction capacity is both a source of explanation and the precondition of a system. In the future, the theory of international politics should take offense-defense balance as logic of explanation to explore technology, geography, and absolute power distribution as independent variables. In addition, the concept of stability as a dependent variable should also be expanded. Stability is not merely the avoidance of war, but the threat to peace. The scope of the qualitative empirical studies are European and global international systems from 1648 to present. In general, the thesis finds rather positive results to support the interaction and structure explanations.

從共用資源理論觀點暨公共選擇角度而言,原住民部落資源與傳統領域土地乃一「封閉式共用資源」,若由原住民部落團體共有並自主經營管理,社群內部將可能透過個體的合作,創造共同利益,發揮傳統生態知識、善用在地組織,避免原住民地權流失,並進一步達到資源永續發展的目的。但由於受限於「經濟人」與「國家理性主義」之假設,且忽視了人與自然資源會相互影響、相互限制的事實,人們常引用Hardin(1968)的「共用地悲劇」,指出共用資源必將陷於過度使用的危險之中,最終肇致環境的退化。 為釐清此議題,本研究以新竹縣尖石鄉後山兩個具有共用資源自主治理個案的泰雅族部落為例,選取現今既有的「部落地景」、「河川魚群」、「森林產物」等三種形式之共用資源進行觀察;在時間上則以這些資源在保育目的下被部落共同維持開始,到被賦予促進部落經濟期待後的發展為主要的範圍。以新制度經濟學為理論基礎,藉由實證調查和比較,並經「組織中的個人制度選擇」、「社會中的共管組織」以及「社會生態系統」等三個層面的分析,討論有哪些因素影響個人遵守集體的正式與非正式規範?群體如何制定符合當地條件的共用資源治理規範,並維持組織的長期存續?而社會與自然生態之間的互動關係又是如何形成?冀以探討影響「以部落為基礎的自然資源自主治理」之內外部因素及其互動關係,俾提供後續共用資源管理制度設計思考的基礎。 / From the perspective of “common pool resources” (CPR) theory and public choices, the tribal resources of aboriginals and traditional territories are a “closed-access” type of common pool resources. If aboriginal tribes manage the CPR in a self-governing way, the communities may be able to, through the cooperation of individuals within, create collective interests, leverage traditional knowledge regarding the ecosystem, utilize local organizations in order to avoid the lapse of aboriginal land, and achieve the sustainable development of resources. However, people are limited to the hypotheses of “homo economicus” and “raison d’état” along with an overlook of the fact that mutual influences and restrictions lie between humans and natural resources. They often quote the essay “Tragedy of the Commons” by Hardin (1968), according to which common resources are under the constant threat of overuse that will eventually degrade the environment. To establish clarity on this issue, this paper uses an Atayal county with two CPR self-governing cases to observe three types of common pool resources currently seen today: tribe landscape, river fish and forest produce. The time horizon starts at the time point when these resources were placed under tribal management for conservation purposes, and ends at the time point when these resources are expected to prompt economic development. This paper conducts empirical investigations and comparisons based on the theoretical foundations of new institutional economics, and analyzes three aspects of these issues: choice of personal systems within an organization, collective management organizations in a society, and Social-Ecological Systems (SESs). This paper discusses the factors that affect how individuals conform to social norms, formal and informal. How a public choice is made to design the rules which are proper to local CPR situation and maintains the organization long-term sustainability? How do the interactions between society and the natural ecosystem come into being? By exploring the internal and external factors of self-governance of natural resources by tribes and the resulting interactions, this paper aims to provide a foundation for subsequent studies in the design of the management systems for common resources.

公司治理與動態資本結構關係之研究 / Two Essays of the Effects of Corporate Governance on Capital Structure Dynamics

本研究旨在探討公司治理與動態資本結構之間的關係,以及產品市場競爭對此關係的影響。 第一篇文章探討公司治理品質如何影響動態資本結構。本篇文章同時考慮負債的「接管防禦」與「懲罰」效果,對最適資本結構調整速度的影響。我們的實證結果發現,雖然低負債(underlevered)和高負債(overlevered)公司,皆呈現公司治理品質愈差,調整速度愈慢的結果,但原因並不相同。以低負債且弱治理的公司來說,因負債所扮演的懲罰角色帶來的成本,高於使用負債作為接管防禦工具所帶來的利益,因此公司傾向減少負債的使用,並以較緩慢的速度朝向目標資本結構調整。但就高負債弱治理的公司而言,因面臨較嚴重的接管威脅,為了驅逐潛在的掠奪者,公司選擇增加負債的使用,而不願調降其負債水準至目標值,因此也降低了資本結構的調整速度。 第二篇文章主要探討產品市場競爭在公司治理品質與動態資本結構關係中所扮演的角色。文獻中已有許多研究探討市場競爭對經理人的怠惰行為的影響。然而,到目前為止,仍然沒有文獻研究產品市場競爭程度的高低如何影響公司治理與資本結構調整速度之間的關係。我們的文章因此補足目前研究文獻不足之處。實證結果顯示,公司在競爭的狀態下,更願意以追求股東財富極大化為其目標,此舉也因此提升公司資本結構朝向最適目標值調整的速度。除此之外,我們的實證結果亦發現在一個高度市場競爭的環境下,弱治理與強治理公司之間調整速度的差距會縮小。 / This study contains two essays on the relationship between corporate governance on capital structure dynamics, and how production market competition affects this relation. Essay 1: Corporate Governance and the Dynamics of Capital Structure: New Evidences The effects of corporate governance on optimal capital structure choices have been well documented, though without offering empirical evidence about the impact of corporate governance quality on the adjustment speed toward an optimal capital structure. This study simultaneously considers two effects of debt originating from agency theory—the takeover defense and the disciplinary effects of debt—on the speed of adjustment to the optimal capital structure. Corporate governance has a distinct effect on the speed of capital structure adjustment: weak governance firms that are underlevered tend to adjust slowly to the optimal capital structure, because the costs of the disciplinary role of debt outweigh the benefits of using debt as a takeover defense tool. Although, overlevered weak governance firms also adjust slowly, they do so because they are reluctant to decrease their leverage toward the target level to deter potential raiders, especially if they face a serious takeover threat. Therefore, this study finds that both overlevered and underlevered firms with weak governance adjust slowly toward their target debt levels, though with different motivations. Essay 2: Corporate Governance, Product Market Competition, and Dynamic Capital Structure The importance of product market competition for analyzing managerial slack or the impact of corporate governance on capital structure decision has been widely discussed. However, prior studies pay little attention to center on the impact of market competition on the relationship between corporate governance quality and capital structure dynamics. This paper thus fills this gap in the literature. Our study finds that competition makes firms with weak governance have stronger incentive to maximize shareholders’ wealth and thus increase their adjustment speed toward their target leverage. Moreover, the difference in the adjustment speeds between weak and strong governance firms become smaller when firms operate in highly competitive industries.

社區營造共用資源自主治理之研究-以臺北市木柵二期重劃區為例- / Research on placemaking and self-governance in common-pool resources using the example of the Muzha second redevelopment zone in Taipei

台灣自1994年起由文建會推動社區營造,有別於中央主導的方式,,試圖以「在地行動」、「由下而上」的核心概念,讓社區發展以在地居民需求為導向,自發性地營造出各具特色的社區。但社造是涉及許多共用資源管理的複雜議題,早期臺灣地區居民缺乏社造經驗,參與公共事務的意願不高,加上未有一套完整的模式進行輔導,導致二十年來實際成功之案例並不多見。近年來隨著公眾議題發燒,臺灣民眾自主意識提升、開始重視公共事務,正是積極發展社造之際。但環顧國內社區對於共用資源的管理,能在期盼有一套良好的制度或模式得以依循。 本研究案例木柵二期重劃區,其自主組織「木柵二期重劃區促進發展協進會」透過社會生態系統(Social-Ecological System;以下簡稱SES)的應用,有效將自主治理理論(Self-governance Theory)運用於社造,用以解決共用資源的問題,甚至曾受邀請至世界衛生組織(WHO),分享成功經驗。但本研究發現,將自主治理理論應用於社造之研究竟付之闕如,更沒有一套可供社造工作者參考的模型。故本研究試圖以木柵二期重劃區為案例,建立一套社造自主治理之量化模型。 本研究整理自主治理領域的相關文獻後發現,自主治理的研究雖以質化研究為主,但隨著SES的演進與簡化,是有建立量化模型之可能性。故本研究先對本案例「木柵二期重劃區」進行深度訪談及問卷調查,匯整其成功自主治理之社造沿革、社造過程、社造結果的要素,並將其與SES各種核心子系統進行對應,發現有其適用性。據此,再參考2014年的架構,提出資源體系、資源單體、治理體系、參與者四個構面皆顯著影響作用情境之假設,建立本案例之社造社會生態系統模型,於2014年11月對區內20歲以上居民發放問卷。 因素分析的結果顯示,模型整體的建構效度良好;但核心子系統需修正為三個(因本案例之資源體系與資源單體的重疊性較高,故歸納為資源體系稱之)。其次,迴歸分析驗證之結果亦顯示本案例所提出之資源體系、參與者顯著影響作用情境,此兩個假設獲得支持;另外由於當初將治理體系的設定為地方政府,將自主治理組織木柵二期重劃區促進發展協進會歸納為參與者,導致結果顯示治理體系不會顯著影響作用情境。 故本研究的結果顯示,透過SES模型將自主治理理論導入社造是一條可行的方式,然社造的議題涉及層面與考量因素甚廣,且於世界各地亦有許多官方、民間的組織仍不斷的實作以及推廣。唯本研究僅以自主治理理論是否可導入社造為角度切入,與當前主流理論不盡相同,須就其優缺點、以及對現象的解釋力進行比較,然受限於本研究之時間、人力、成本,仍待後續研究者的協助。 研究者本身為協進會理事長,經由近十年之實務操作經驗,並透過本研究之驗證,深知社造之特徵實與自主治理理論概念相近、本研究所建立之社造SES模型,亦有良好的建構效度。故期望能將此實證建構之模型推廣到更多地區,建立社造成功的模式、營造更多桃花源般的社區,使人安住休息,並希望人類從此幸福、和諧、安康。 / Ever since 1994, the Council for Cultural Affairs (CCA) in Taiwan has pro-moted a placemaking movement totally different from the programs previously offered. With the core concepts of “local activities” and “bottom-up” in mind, the movement aims to help develop the communities around the island that could meet the demands of the local residents and automatically display their unique-ness. In the early days, however, the residents in Taiwan did not seem to get very actively involved in public affairs and have access to a good model to follow. Successful cases were rare in the past two decades. In the recent years, public issues have been under heated discussion and autonomous consciousness, raised among the general public. The time has come to develop the placemaking. Considering the management of common-pool resources involved with placemaking and the people’s total lack of the experience, a good system or model is needed to follow. However, the problems faced with the management of common-pool resources, home or abroad, have not been solved, either through the free market or the government centralization, until 1990 when Ostrom proposed his self-governance theory. But no research has been found on the application of self-governance theory to placemaking so far. Taking this into account, this research is intended to apply self-governance theory to the placemaking in “the second phase of re-planning the Mu-zha District” as an example. Through depth interviews and questionnaire survey, this study tries to know how residents themselves have worked on their placemaking, what are the key factors for their success, and, further, have a good grip of how their self-governance organization—The Community Development Association of the Second Phase of Re-planning the Mu-zha District —has applied self-governance theory to the placemaking so successfully. To illustrate, first, through depth interviews with experts, scholars, and local opinion leaders, this researcher collected the data on the evolution of placemaking in the second phase of re-planning the Mu-zha District, its process and outcomes, finding that “community resources in place” and “leaders with strong leadership” are the key factors for residents’ high satisfaction. Then, in the qualitative study, this researcher compared each of the counterparts both in self-governance system and social-ecological system (SES), finding that the self-governance theory has its applicability. Next, to establish a SES framework suited for this study, this researcher adapted the SES set by McGinnis and Ostrom in 2014 and proposed the resource system, the resource unit, the governance system and participants for factor anal-ysis. In November, 2014, questionnaires were handed out to the district residents aged 20 and over. Through factor analysis, it is found that the construct validity of the so-cial-ecological system for this study is good. Since there is a considerable overlap between the resources system in this study and the resources unit, we called them the resources system. The regression analysis also concludes that the resources system and participants proposed in this study are gaining support. Because the hypothesis of governance system in this research is local government, the inhab-itant trusts the Development Association; therefore the governance system cannot obviously affect the focal action situation. With one decade’s practical experience in the placemaking and through the verification of this study, this researcher, also the chairman of Community De-velopment Association realizes that the features of placemaking are quite close to the concept of self-governance theory. And the construct validity of the estab-lished SES in this study also proves to be good.It is therefore highly expected that the model of placemaking proposed in this study could be promoted to more re-gions around the whole world in the hope of building more wonderful communi-ties, where people could live peacefully and happily.

家族所有權、經營權、控制權對集團企業經營績效與創新之影響 / The Research of How Family Ownership, Control, and Management Affect Firms’ Performance and Innovation

從企業績效來看,在需持續創新、風險與產業技術複雜性較高的電子業,家族企業若聘用專業經理人經營,企業績效較差,反之,在產業技術變化性與風險較低的傳統產業,家族企業聘用專業經理人經營,反而企業績效較佳,這顯示,在面臨高度風險的環境時,家族企業中經營權與所有權的分離才會導致代理問題。同樣地,在電子業中,家族企業的控制權與所有權分離程度越高,企業績效越差,反之,在傳統產業中,家族企業控制權與所有權分離程度越高,企業績效反而越佳。這個結果顯示,在需持續創新、風險與產業技術複雜性較高的產業中,家族企業必須同時面臨兩種代理問題。 從企業對創新這類風險性投資的策略來看,本論文的研究結果顯示,經營權與所有權合一,企業所有者有能力及意願監督經營者,這將有助於企業投入較多的創新。反之,在控制權與所有權分離的情況下,因為投資的大部分是其他人的錢,企業的最終控制者能將創新的風險分散給外部股東,而較有意願投入創新。而家族控制者本身,因其規避風險的特質,而對上述兩類對創新有正向影響的治理機制有負向的調節效果(moderate)。但對家族成員而言,創新有助於企業的長期競爭優勢為了家族的永續發展,在經營企業上應該會採取長遠觀點(long-term perspective),而有意願投入創新,為了解開這個難題,本研究進一步將創新分為利用型創新(exploitative innovation)及開創型創新(explorative innovation)兩類,分析結果發現,家族企業雖然投入創新的數目較少,但在比例上有較多是較開創的創新,這個結果顯示,家族企業雖然害怕風險,但相對於非家族企業仍較具有長期經營的觀點並較具開創性。 / This dissertation concerns the effects of different governance structures on firms’ performance and innovativeness in business groups. In the first study, the ambivalent needs of control and growth of family firms in business group are explored. This study finds that in general, the excess control rights and controlling shareholdings will increase firms’ performance. In addition, family firms with such control structures will perform better in non-electronic industry while worse in electronic industry. Lastly, active control, namely family members control management and chairman at the same time, will perform better in electronic industry while worse in non-electronic industry. The second study focuses on comparing family and non-family group affiliated firms’ incentives to do innovations in different governance structures. Adopting behavior agent model, we propose that although family group affiliated firms are less innovativeness than non-family group affiliated firms in general, they have larger share of exploratory innovation than non-family firms. The empirical results support our hypotheses. However, in contrast to traditional agency perspective, the separations between ownership and control rights facilitate firms’ innovativeness. This finding may originate in pyramid ownership structure.

東突厥斯坦問題與中共對策研究 / Study of the CCP countermesaures for the East Turkistan issues

從歷史淵源而言,「東突厥斯坦」乙詞緣於19世紀沙俄試圖從地理名稱、宗教信仰與民族識別等深層的滲透方式,藉由「泛突厥主義」與「泛伊斯蘭主義」拉攏新疆信仰伊斯蘭教的少數民族,以東突的概念,將之納入已遭其併吞的中亞突厥斯坦地區,復以此話語的界定權,取得全世界對於俄國版地理分隔線的認同。復由於國共內戰時期,蘇聯鼓動成立「東突厥斯坦共和國」,毛澤東亦以「三區革命」稱許之,以期掀起遍地革命火種,給予現代新疆少數民族留下以語言及信仰為基礎的革命建國歷史記憶。 從中國的內政視野,政治穩定與否是東突問題載浮載沉的關鍵,清末與民國時期的內憂外患時期自不待言。中共建政之初,對少數民族採取相對溫和的社會主義改造政策,漸次形成了認同的政治文化,然而卻隨著左右傾路線發展遭到破壞;雖然1989年中共實施經濟改革後,新疆少數民族亦從中獲利,但幅度始終跟不上漢族的移入者,以致無論是民族關係、經濟關係乃至政治關係上均惡化為破碎的政治文化,即漢族始終自認是政策利多的給予者,而少數民族則自視為被剝奪者與受害者。1991年蘇聯解體之後,中亞五國獨立對新疆少數民族造成磁吸效應,成為東突議題再起的火種。然自江澤民上台之後,對於東突治理的基調仍採取軍事過硬的鎮壓手段,並未從根本解決少數民族的問題,以致民族融合更加困難,暴力衝突的數量與規模屢創新高。 從區域安全角度,新疆與其隔鄰的中亞自古以來就是伊斯蘭、儒家、斯拉夫與佛教等四大文明邊緣的交會破碎區,少數遊牧民族逐水草而居的生活型態更打破國家之間的界線,伊斯蘭宗教信仰與突厥方言的識別取代了國家認同。以致本地區所謂的認同兼具有脆弱性與包容性。因此,自古以來外在強權對於本地區並不刻意建立有形的實質統治,而是透過優勢文化或軟實力滲透,讓區域內的少數民族對強勢帝權國家產生有形與無形依賴,前者是物質與經濟力量,後者是文化與心理作用。兩相交替,造成被影響國家邊境少數民族出現認同危機。過去是沙俄與前蘇聯藉此覬覦中國的領土,現今則有美國、歐洲乃至日本加入競逐天然資源蘊藏豐富的中亞地區,以各種優厚的條件,取得天然資源開發特許權。 從治理成果評估,新疆少數民族、東突議題與中共政權之間不僅在中國大陸境內出現認同分離現象,並隨著全球資訊化的發展,使得國內問題惡化為國際議題。衝突雙方藉由印象管理、符號黏合等方式,在各自的舞台上展示政治訴求。雖然在以主權國家為主體的國際體系中,東突組織屈居下風;然而受到網際網穿透性、民族宗教關懷,或者,如中共政權所認定之「國際陰謀」作用,使得部分東突組織與成員雖然不足以影響大局,但仍透過相關議題在特定國際社會場域形成動靜觀瞻之國際影響。 / From the historical aspect, Russia mixed the concepts of geography, religion and nation to establish the title of “East-Turkistan” in 19th century, and then attracted the minorities of Xinjiang into her Center Asia provinces by the ideas of Pan-Islam and Pan-Turkism. By the power of discourse, Russia’s new map about the East-Turkistan got the recognitions in the world. In 1944, the eve of Chinese Civil War, Soviet Union supported the Xinjiang minorities to establish the “Republic of East-Turkistan”. Mao Zedong praised it “Three Regions Revolution” to combine the spirit of revolution in the China Mainland. All these give the modern Xinjiang minorities fresh founding memory till now. Tracing the development of Chinese internal affairs, there are significant relations between the issues of East-Turkistan and domestic political stable. It goes without saying the worse situation during the late Qing dynasty and the early Republic of China (ROC). In the beginning of People’s Republic of China (PRC) regime, the Chinese Communist Party (CCP) taking the warm socialism reform policies, got the Xinjiang minorities’ identity and formed the unify political culture, which been broken by following political conflicts in a short time. In 1978, the CCP promoted the economic reform policies, the Xinjiang minorities got some profit from it, but the earnings could not compare with the Han immigrations. All of those led the ethnic, economic and political relations becoming a cracked political culture. In other words, the Han thought themselves as givers of the profit, but the Xinjiang minorities felt been exploited. The independent tide of the five former Central Asia Republics after dissolution of the Soviet Union in 1991 produced the magnetic effect to Xinjiang minorities and stimulated the revival of East-Turkistan issues. Since Jiang Zemin, the Secretary General of CCP still compressed the problem by military means in 1992; the ethnic integration in Xinjiang becomes more difficult. The number of violence accidents hits higher and higher level. According to the regional security, Xinjiang and Central Asia locate at the crossroad of four civilizations, including Islam, Confucius, Slavs and Buddhism. In addition to the living style of nomads breaking the boundaries in this area, the Islamic belief and Turkic dialect take place the national identity, which are full of the vulnerability and tolerance. The outside superpowers penetrate this area by excellent culture and soft power instead of creating functional institutions, causing the crisis of identity or loyalty. For example, the Russia and Soviet Union invaded the vast land of Xinjiang in the 19th; the US, Europe and Japan rapidly join the great competition of natural resources in Central Asia nowadays. Evaluation the policy of CCP toward East-Turkistan is not easy. This is not only the identity crisis in China, but also transfers into the international field. Both sides take the strategies of impression management and exegetical bonding to show their political appeals. Although the realistic international system is composed by the sovereignty states obstructed the East Turkistan organizations, which still take advantages of internet, ethnic and religious methods to attract some specific concerns. This study found that: First, the proper noun “East Turkistan” does not created by the Uyghur themselves, but by the Russia in the 19th. In addition, The Republic of East Turkistan (1944-1949) organized by many minorities of Xinjiang, not by Uyghur only. Therefore, the Uyghur can’t be referred to the East Turkistan totally. Second, the definition of East Turkistan problem is rebellion or terrorist attack is decided by the Chinese central government. The Republic of China thought it as the Soviet Union agitated the local minorities’ armed rebellion. The CCP took the same viewpoints before 1990s. While, the CCP highlights the terrorism about the East Turkistan’s issues that got few recognition from the US and UN after September 11 attack. Although the change let the CCP wins tiny interest in a short period, the foreign countries use the excuse of human rights and against radical anti-terrorism strategy to intervene the CCP domestic issues. Third, the exile Uyghur does not get the general agreement about resistance movement and the core attitude toward the CCP. Those are the obstacles for the exile Uyghur to form the unify action and power. Forth, the CCP always declares to the world that the Xinjiang Uyghur relates closely with the East Turkistan terrorism organizations. That enrages some Uyghur to take fierce actions against the CCP. Now the most important duty for the CCP is to find a balance between the removals of terrorism label from the Uyghur and increasing the budget for the anti-terrorism mission. Fifth, the appeals of Rebiya Kadeer and the overseas Uyghur groups which she leads do not want to establish an independent state. Instead, she struggles to ask a higher autonomy. The idea is familiar to the Soviet republics, but refused by the CCP.

三十年前北極是一塊具有爭議的領土,許多國家因此在這塊土地產生許多衝突,鮮少透過國際合作的方式解決爭議,今日許多國際政權採取相互合作來處理爭議,在這些政權中北極理事會是最有影響力的,但是怎麼演變到這樣的呢? 這篇論文認為原因是中等強國的參與,並藉由加拿大的參與來探討北極理事會的形成,研究結果發現諸多加拿大領導人相互合作並說服反對政權的意見共組北極理事會,此研究也同時發現中等強國對政權的組成有極重要的影響,此論文的第二部份檢視中國對北極理事會的反應,此論文發現中國對北極策略採取國際法,而在此同時他們企圖在北極理事會中增進自身的影響力,總歸上述此研究在分析上有三項主要發現:中國作為外來政權的反應、中國對北極議題採取法律規範、中國對加拿大的北極主權看法。 / Thirty years ago the Arctic was a desolate region marked by territorial disputes, mutual suspicion between regional powers, and a complete lack of international cooperation. Today, the Arctic has become a hotbed of cooperation with a mosaic of international regimes governing regional affairs. The Arctic Council has emerged as the most important regime governing Arctic affairs. How did this transformation take place? This thesis argues that middle powers are crucial to regime formation. It examines the role that Canada played in the formation of the Arctic Council. It finds that several Canadian individual leaders acted collectively to bring together the Arctic states and overcome initial resistance in forming the Arctic Council. This study shows that middle powers have the ability to significantly influence regime formation. The second part of this thesis will examine China’s response to the Arctic Council. By surveying the statements of Chinese Arctic officials, it finds that China’s emerging Arctic strategy is to continually stress adherence to international law in Arctic affairs to assuage concerns about China’s Arctic activities while at the same time advocating for a greater decision-making role in Arctic governance for non-Arctic states. An analysis of China’s response to the Arctic Council also reveals three key findings of China’s Arctic cooperation: China’s response in relation to its status as an “outsider” to Arctic affairs, China’s support for the Arctic Council’s transformation from soft law to hard law, and China’s view on Canada’s Arctic sovereignty.

我國全民健康保險政策是屬於社會保險,早期在推行健保時決策模式是傾向國家主義,然而隨著民主化時代的來臨,人民權利意識抬頭,各種利害關係團體相應而生,因此民主治理變成重要的課題。在重要政策參與中各個利害關係人皆希望能夠被納入決策。我國目前健保政策體制內的參與管道最主要為費用協定委員會及監理委員會,主要監督及決定健保預算分配,這兩會在2013年整併為健保會。不論整併前後,委員會基本上是以統合主義的精神運作,邀進行決議,最大的優點在於能夠藉由與多方政策利害關係人的溝通,凝聚社會共識。然而哪些團體能夠代表參與政府制定決策的過程,參與的代表能否充分表達團體的意見?因此代表性正是統合主義中最具爭議的,故如何找出遴選團體的標準是刻不容緩的。   本文嘗試以社會統合主義的觀點,套用在健保會運作上。然而社會統合主義要運作的良好,基本上必須要在水平及垂直方面的機制建構完善,垂直層面必須要各級組織匯集各級團體的意見,並由代表進入水平的平臺進行協商;而在水平溝通平臺上也需要各方代表皆能有平等及有效的決策。本文最主要了解的是垂直面的整合情形,亦即這些被派入健保會的政策利害關係團體代表是否有充分的被賦權,在會中討論的結果能否充分落實,因此要衡量團體內部本身的治理。本文欲透過專家座談建構組織內部運作的指標,建構指標測量健保會內部實際運作情況,對於好的健保會參與組織建構初探性的評估。希望未來能夠作為健保會遴選組織進入委員會的參考依據。 / National Health Insurance (NHI) policy is a part of social insurance in Taiwan. In the early stages of the program, the pattern of decision-making tended to be based on a Statist model, but as Taiwan democratizes, citizens and various interest groups have become increasingly aware of their rights. Therefore, the democratic governance of National Health Insurance policy has also become an important issue, as stakeholder groups all hope to be included in the NHI’s decision making process. In Taiwan, the two main participation channels within the system are the Medical Expenditure Negotiation Committee and the Supervisory Committee. The main missions of these two committees are to control health care costs and to allocate medical resources. In 2013, these two committees were merged to form a single National Health Insurance Committee. Whichever their merger status is, the committees basically function according to the principles of Corporatism, whereby peak-level organizations are invited to take part of the committee’s decision-making processes. The biggest advantage of the merger is that the committee would be able to achieve social cohe-sion and consensus through its direct communication with various policy stakeholder groups. But the problem with this arrangement is the following: Which groups can participate in the government’s decision-making process? Can the representatives fully express the views of their respective groups inside the committee? Therefore, the question of representation is the most controversial issue in Corporatist theory, and it is imperative to develop the proper criteria by which major interest or corporatist groups are selected. This study attempts to observe the National Health Insurance Committee from the perspective of social corporatism. For social corporatism to function well in society, basically both its horizontal and vertical mechanisms have to work perfectly. Vertically, groups must be able to amass and integrate the views of their sub-organizations at all levels; horizontally, the group’s representatives must all have equal capacity to make effective decisions. This paper will focus on understanding the vertical dimension of social corporatism, which means asking the following questions: Can/do the representatives fully and adequately represent their group? And whether the outcomes discussed at the committee meetings are fully implemented? To answer these questions it is thereby necessary to measure the internal governance of the groups themselves. This paper will examine various internal operating indicators developed through experts’ panel discussions, with the primary objective of determining good committee participation measures. It is hoped that the construction of these internal governance indicators will serve as the criteria by which future corporatist groups or stakeholder organizations are selected into the National Health Insurance Committee

共用資源治理觀點下的美濃獅子頭水圳 / Governance Change of Shihtou Water Canal in Meinung:A Common-pool Resource Perspective

本文旨在探討灌溉水資源系統中的「水圳」,在歷史的發展脈絡下如何成為農村不可或缺的依賴性治理制度。而都市化與工業發展興起後,水圳面臨了設施改造與治理困境,其制度本身所產生之變革以及新興治理機制對原有組織之影響。 本文透過美濃獅子頭水圳為個案研究,運用伊利諾‧歐斯壯(E.Ostrom)之「共用資源永續發展治理八大原則」為水圳資源有效治理之理論背景,檢視早期美濃獅子頭水圳的集體行動組織(地方水利會-農民),如何成功地在自主治理的機制中運作,並探討在現代化發展過程中宏觀的外在結構環境,包含農業轉型、停徵會費、派系競爭、水患問題等變化,對既有的共用資源制度產生的衝擊與弱化。以及民主化後由愛鄉協進會透過反水庫社會運動帶動社區總體營造對於水圳治理的創新模式。本文認為早期獅子頭水圳在資源邊界、集體選擇、對組織權最低限度認可與多中心治理等面向建立起維持永續發展之基礎。制度本身雖遭受外在環境變遷而呈現鬆散,但由於觀光休閒農業的推廣,吸引農村漂鳥回流,對灌溉水資源的參與治理渴望達到穩定的力量。並且,透過給予掌水工與水利小組的正式與非正式制度性誘因,可以有效調節灌溉用水並做為提供移轉調撥其他產業用水的基礎。最後,在地方性非營利組織「愛鄉協進會」進入水圳系統的治理後,挑戰由半官僚水利會所掌控的政治經濟功能掛帥水圳系統,更融入生態、文化、公民參與等不同的元素形成一共同治理新模式,除了延續後農業時代水圳的灌溉功能之外,也強化其制度韌性。藉由這些發現,本文進而提出實務與理論的研究建議,以做為後農業時代水資源灌溉系統的永續發展之借鏡。 / The subject of this essay is to explore the reason why an irrigation canal, in the process of historical development, became an indispensable governance institution in the villages. Also, in the advent of urbanization and industrialization, the irrigation canal faces a situation of the renovation of facility as well as the predicament of governance, in which the institution itself changes and newly governance system influences the original organizations. This study takes Shihtou Irrigation Canal in Meinung as the object. Using Elino Ostrom’s eight design principles of stable local common pool resource (CPR) management to review the successful self-governance mechanisms in operation performed by the early local collective action organization (mainly made by Taiwan Joint Irrigation Association and farmers). Also the paper explains the impacts of macro-environment, including the agricultural transformation, stop collecting fees, factional competition and flooding, on the existing system of CPR. And an innovational governance participated by a Meinung People's Association, a grass-roots organization from anti-reservoir activities to comprehensive community development in the era of post-democratization. Results of this study showed as follows: Firstly, early Shihtou irrigation canal maintain the basis for establishing sustainable development as result of clearly defined boundaries, collective-choice arrangement, minimal recognition of rights to organize, and nested enterprises. Besides, although it was weaken by the later change of external structure, the development of leisure agriculture attracted recurrent youth for agriculture, who was desired for reviving the power of appropriation in canal self-governance. Meanwhile, the institutional design of water-inspectors and water conservancy group arranged through formal and informal incentives can effectively regulate the right of water for irrigation and serve as providing the basis for the allocation of water for other industries. Finally, a local non-profit organization Meinung People's Association challenges the governance system originally controlled by a half-bureaucratic management of local Farm Irrigation Association. Compared with the mainly political and economic functions of water governance by the latter, the former emphasize the different elements of ecological, cultural, and civic participation. This formation of New model of shared governance in canal not only continue its irrigational function in post-agriculture, but also strengthen its institutional tenacity..With these findings, the paper puts forward practical and theoretical study suggests in order to learn as a sustainable development of water resources in the era of post-agricultural irrigation systems.

董監事及重要職員責任保險之需求因素路徑分析 / Path Analysis of Determinants of Directors' and Officers' Liability Insurance

本研究針對國內2008至2012年非金融業之上市上櫃公司,探討董監事及重要職員責任保險之需求因素,並研究這些需求因素之彼此關連性,形成董監事責任保險之需求因素路徑分析,最後根據實證結果建立路徑圖。 研究結果顯示,股東總數、公司規模、董監事持股比例、外部持股比例和獨立董監事比例,對董監事責任保險金額呈顯著正相關;董事長兼任總經理與董監事責任保險金額呈顯著負相關。經理人持股比例、資產報酬率和負債比率因樣本分配較分散,迴歸分析受極端值影響,導致在統計結果中不顯著。此外,董監報酬若對董監事責任保險金額採單一迴歸時,具有顯著相關。但在路徑分析中,會因受其他變數影響,導致不具相關性。 / Based on a sample of firms, except for financial companies, listed in Taiwan Securities Exchange and Gre Tai Securities Market over the period of 2008-2012, this study examines the determinants of directors’ and officers’ liability insurance and the cause-effect relations among these determinants which are presented by path diagram. The empirical result indicates that the number of shareholders, size, directors’ and supervisors’ ownership, outsider ownership, and percentage of independent directors and supervisors in the board of directors are positively related to the amount of directors’ and officers’ liability insurance. The chief executive officer as the chairman of the board is negatively associated with the amount of directors’ and officers’ liability insurance. The manager ownership, return on asset, debt ratio and the directors’ and supervisors’ reward are not related to the amount of directors’ and officers’ liability insurance.
