Polarimetrische Streuungseigenschaften und Fokussierungsmethoden zur quantitativen Auswertung der polarimetrischen SAR-Daten

Das Radar mit synthetischer Apertur (Synthetic Aperture Radar - SAR) liefert eine quasi-fotographische Abbildung der beleuchteten Bodenoberfläche mit zusätzlichen Informationen, die von der gesendeten und empfangenen Polarisation der Wellen abhängig sind. Eine nützliche Anwendung der polarimetrischen SAR-Daten liegt bei der Klassifizierung der Bodenstruktur anhand der polarimetrischen Streuungseigenschaften. In diesem Zusammenhang beschäftigt sich die vorliegende Arbeit mit der Entwicklung und Untersuchung neuer polarimetrischen Fokussierungsfunktion für die SAR-Datenverarbeitung mit Hilfe der polarimetrischen Rückstreuungseigenschaft, die zu einer alternativen quantitativen Auswertung der polarimerischen SAR-Daten führen kann. Die physikalische Optik Approximation wird für die numerische Berechnung der rückgestreuten elektrischen Felder der kanonischen Ziele unter SAR-Geometrie unter Berücksichtigung der Polarisationslage verwendet. Aus den rückgestreuten elektrischen Felder werden die polarimetrischen Radarrückstreuquerschnitte berechnet. Ein SAR-Simulator wird zur Datenverarbeitung der E-SAR des DLR entwickelt. Der Ansatz des polarimetrischen Radarrückstreuquerschnittes ermöglicht die approximierte numerische Berechnung der Rückstreuungseigenschaften der kanonischen Ziele sowohl im kopolaren als auch im kreuzpolaren Polarisationsbetrieb. Bei der SAR-Datenverarbeitung werden die Rohdatensätze durch die Referenzfunktion eines Punktzieles in der Entfernungsrichtung verarbeitet. Bei der Azimutkompression werden die vier Referenzfunktionen, das heißt die Referenzfunktion eines Punktzieles, die polarimetrische Fokussierungsfunktion einer flachen Platte, die polarimetrische Fokussierungsfunktion eines Zweifach-Reflektors und die polarimetrische Fokussierungsfunktion eines Dreifach-Reflektors, eingesetzt. Die qunatitativen Auswertung der SAR-Daten werden anhand des Pauli-Zerlegungstheorems, der differentiellen Reflektivität und des linearen Depolarisationsverhältnises durchgeführt.

At the centre of this study lies the question of how research-related media texts contribute to the social construction of sex and gender conceptions when they use research, either as a main source, or to support or comment on specific issues and statements, from the political arena, for example. The principal aim of the study has been to analyze and problematize the ways in which different types of newspapers, genres and editorial sections reproduce, or contribute to change, in existing gender discourses. The material was collected from two Swedish newspapers during the year 2001: the national morning paper Dagens Nyheter (DN), and the national evening paper Aftonbladet. The theories of discourse, agenda-setting and -framing in this study are related to the questions: what kinds of knowledge on women and men, and biological, physiological, psychological, social and cultural perspectives on sex/gender are represented; how are they described; and how do content and form contribute to the (re)production of, or change in, gender discourses? The main analytical perspectives are those about gender discourse (re)production, genres as ideological forms, and the epistemologies of journalism. A combination of analytical strategies and methods was used: content and thematic analysis, and qualitative analysis of text and language with methodological tools from different traditions of discourse analysis. In my study, I can see an interplay between research traditions and genre conventions in the (re)production of gender discourses. Since the news sections repeatedly choose to publish research as empiric and in the form of results, and then within that, primarily findings from medicine and the social sciences, these areas are reproduced as important and relevant, and as producers of objective, true knowledge that can be presented as simple facts. Research-related texts in culture journalism, on the other hand, follow the tradition of primarily treating research within the humanities, and nowadays also gender and queer theoretical perspectives within different disciplines. Through the genre conventions of culture journalism, this research is reproduced as something that you can reflect upon, problematize, criticize, form an opinion of, and judge. The study also gives reason to argue that media logic and institutionalized genre conventions contribute to the reproduction of science and research as different worlds and cultures, in which the natural sciences and the humanities are found in different media spaces, and different forms of knowledge about sex/gender are given space on different conditions and in different forms.

Från denna generella princip finns undantag från skatteplikt, varav försäkringstjänster är ett av undantagen. Undantaget för försäkringstjänster har nästan inte behandlats i doktrin och därför är uppsatsens syfte att utreda vad som omfattas av undantagsbestämmelsen för försäkringstjänster. Undantaget från skatteplikt för försäkringstjänster stadgas i 3 kap. 10 § mervärdeskattelagen<! [if !supportFootnotes] >[1]<! [endif] >, ML, vilket motsvaras av art. 135.1 a i mervärdesskattedirektivet<! [if !supportFootnotes] >[2]<! [endif] >. Då EG-rätten är överordnad svensk rätt, i och med Sveriges medlemskap i EU, sker utredningen av undantagsbestämmelsen i 3 kap. 10 § ML utifrån EG-rätten. Inom EG-rätten är mervärdesskatten reglerad i mervärdesskattedirektivet, som den svenska mervärdesskattelagstiftningen bygger på. Den svenska mervärdesskattelagstiftningen återfinns i ML. Vad som omfattas av undantaget för försäkringstjänster definieras varken i mervärdesskattedirektivet eller ML och ledning måste därför sökas i rättspraxis. EG-domstolen har tolkat omfattningen av bestämmelsen i förhandsbesked begärda av medlemsstaterna. Bestämmelsen delas upp i två delfrågor som EG-domstolen besvarar i förhandsbeskeden. Delfrågorna är vad som omfattas av en <i>försäkrings- </i>och<i> återförsäkringstransaktion</i> och vad begreppet<i> tjänster med anknytning till en försäkrings- </i>och<i> återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent</i> omfattar.</p><p>Av EG-domstolens uttalanden kan slutsatsen dras, att det avgörande för en <i>försäkringstransaktion </i>är att en försäkringsgivare eller skattskyldig person tillhandahåller försäkringstagaren en försäkringstjänst. Försäkringstagaren ska erlägga en premie till tillhandahållaren av försäkringen och i utbyte erhålla ett skydd mot risken. Inträffar en händelse ska försäkringsgivaren tillhandahålla den prestation som avtalats om. En <i>återförsäkringstransaktion </i>föreligger endast när försäkringsgivaren överlåter den överenskomna risken till ett återförsäkringsföretag.</p><p>Vad som omfattas av begreppet <i>tjänster med anknytning till en försäkrings- </i>och<i> återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent </i>kan slutsatsen dras utifrån EG-domstolens uttalanden, att det krävs ett direkt eller indirekt rättsförhållande mellan försäkringsmäklaren eller försäkringsagenten och försäkringsgivaren och försäkringstagaren. Vad som bedöms som en försäkringsmäklare och försäkringsagent ska avgöras utifrån vad verksamheten består i och att verksamheten kännetecknar en försäkringsmäklare och en försäkringsagents verksamhet.</p><p>Utifrån ett svenskt perspektiv är svenska domstolar skyldiga att tillämpa direktivkonform tolkning av nationella regler som bygger på gemenskapsrättsliga bestämmelser. Regeringsrätten och Skatterättsnämnden har tolkat omfattningen av undantagsbestämmelsen i ett flertal fall. Avseende begreppet <i>försäkringstransaktion </i>skiljer sig Regeringsrätten och Skatterättsnämndens uttalanden från EG-praxis, genom att de inte uttalar sig om att även en skattskyldig person kan tillhandahålla en försäkringstjänst. I övrigt följer Regeringsrätten och Skatterättsnämnden EG-praxis avseende tolkningen av begreppet <i>försäkringstransaktion</i>. Regeringsrätten och Skatterättsnämnden verkar däremot göra en snävare bedömning än EG-domstolen av vad som omfattas av begreppet <i>tjänster med anknytning till en försäkrings- </i>och<i> återförsäkringstransaktion som utförs av en försäkringsmäklare och försäkringsagent</i>,<i> </i>då de ställer upp ytterligare kriterier för vad som krävs för en undantagen försäkringstjänst.</p><p>Vid tolkning av undantagsbestämmelsen ska hänsyn tas till de allmänna rättsprinciper som finns i EG-rätten. Principerna är överordnade bestämmelserna i mervärdesskattedirektivet och därför ska bestämmelserna vara förenliga med principerna. Uppsatsen syftar därför vidare till att analysera huruvida undantagsbestämmelsen i 3 kap. 10 § ML är förenlig med principerna om konkurrensneutralitet och rättssäkerhet. Principerna är komplexa och definieras på olika sätt i doktrin. I uppsatsen definieras principerna och analyseras utifrån den uppställda definitionen. Analysen som görs utvisar att såsom bestämmelsen ser ut idag, är den inte konkurrensneutral eller rättssäker.</p><p>Ett nytt förslag om ändring av direktiv 2006/112/EG om ett gemensamt system för mervärdesskatt, i fråga om behandling av försäkringstjänster och finansiella tjänster har lagts fram av kommissionen. Ändringarna i direktivet skulle medföra en tydligare definition av bestämmelsen samt ökad konkurrensneutralitet och rättssäkerhet.</p><! [if !supportFootnotes] > <! [endif] ><p><! From the general principle there are some exemptions from tax duty whereof insurance services are one of those. The exemption has been very little discussed in doctrine hence the purpose of this thesis is to examine what is covered by the exemption from VAT for insurance services. The exemption from VAT for insurance services is stated in chapter 3 section 10 in the Swedish VAT act<! [if !supportFootnotes] >[1]<! [endif] >, which corresponds to article 135.1 a of the VAT directive<! [if !supportFootnotes] >[2]<! [endif] >. Since EC Law is superior to Swedish law, with Sweden’s entry to the European Union, the examination of the exemptions rules is grounded from the EC law. Within the EC law the VAT is regulated in the VAT directive, which also lay ground for the Swedish VAT regulation. The Swedish VAT regulation is found within the Swedish VAT act. What is included in the term insurance services is not defined either in VAT directive nor the Swedish VAT act, hence conclusions must therefore be sought in case law. The European Court of Justice, ECJ has perceived the scope of the provision in advance notice demanded from the membership states. The provision is divided in two sub-questions that the ECJ answers in the preliminary decision. The sub-questions are; what is covered by an <i>insurance </i>and<i> a reinsurance transaction</i>, and what the concept<i>; services related to an insurance </i>and<i> a reinsurance transaction that is performed by an insurance broker or insurance agent</i> covers.</p><p>From the ECJs’ statements can be concluded that; the crucial factor for an <i>insurance transaction</i> is that an insurance provider or a taxpayer provides the insurance holder an insurance service. The insurance holder shall pay a premium to the insurance provider and in return receive protection against the risk. Should an action occur, to which the insurance holder has insurance, the insurance provider shall offer the agreed performance. A reinsurance transaction exists only when the insurance provider alienate the agreed risk to a reinsurance company</p><p>Regarding what is covered by the term;<i> services related to an insurance </i>and<i> a reinsurance transaction that is performed by an insurance broker or insurance agent</i>, a conclusion can be made from the statements of the ECJ, that a direct or indirect legal relationship between the insurance broker or the insurance agent and the insurance provider and the insurance holder is required. What is judged as an insurance broker and insurance provider shall be determined from what the main activity consist of and that the activity characterize an insurance broker and insurance agent’s activity.</p><p>From a Swedish perspective the Swedish courts are obliged to interpret the national law in conformity with EC law, when the national law is based on EC law. The Supreme Administrative Court of Sweden and Skatterättsnämnden have interpreted the extent of the exemption rules in a number of cases.  Regarding the term insurance transaction the Supreme Administrative Court of Sweden and Skatterättsnämndens’ statement differ from EC case law, since they fail to mention that also a taxpayer can provide an insurance service. Apart from that the Supreme Administrative Court of Sweden and Skatterättsnämnden follow EC case law regarding the interpretation of the term insurance service. The Supreme Administrative Court of Sweden and Skatterättsnämnden seems to make a more narrow interpretation than the ECJ when it comes to what is covered by the term, <i>services related to a insurance </i>and<i> a reinsurance transaction that is performed by a insurance broker or insurance agent</i> as they add even more criteria about what is needed by an exempted insurance service.</p><p>In the interpretation of the exemption rules consideration has to be taken to general legal principles that exists in the EC law. The principles are superior the provisions of the VAT directive and therefore the provisions must be in accordance with the principles. The examination is therefore conducted from whether or not the exemption rules in chapter 3 section 10 in the Swedish VAT act corresponds with the principles of competition neutrality and legal certainty. The principles are complex and defined in different ways in doctrine. In the thesis the principles are defined and analyzed based on that definition. The analysis in this thesis concludes that as the provisions are today, they neither fulfill the principle of competition neutrality nor the principle of legal certainty.</p><p>A new proposal to amend the directive 2006/112/EC on the common system of VAT, as regards the treatment of insurance and financial services, has been presented by the European Commission. The changes in the directive would lead to a more explicit definition of the provision and increase the fulfillment of the principle of competition neutrality and the principle of legal certainty.</p><! Untersuchungen an ungeschädigten und durch Pilzbefall geschädigten Nadelholzbauteilen mit ausgewählten Prüfverfahren

In der Arbeit wurde gezeigt, dass mit Hilfe der gewählten zerstörungsfreien und -armen Prüfverfahren der Bezug zu festigkeitsrelevanten Parametern hergestellt werden kann. Insgesamt 58 ungeschädigte und durch Braunfäulepilze geschädigte Nadelholzbalken und daraus hergestellte Prismen wurden mit Ultraschallecho und Bohrwiderstand geprüft und grundlegende Erkenntnisse für die Prüfungen an Holzbauteilen gewonnen. Die Ergebnisse wurden mit zerstörenden Festigkeitsprüfungen kombiniert. Bei den Ultraschallechountersuchungen wurde festgestellt, dass sich für die geprüfte Rohdichtespanne die Schallgeschwindigkeit der Transversalwellen mit steigender Rohdichte erhöht. Ein enger Zusammenhang konnte auch bezüglich des Feuchtigkeitsgehaltes nachgewiesen werden. Nach Durchführung multipler Regressionsanalysen mit der Rohdichte, dem Feuchtegehalt und der Messfrequenz als unabhängige Variablen wurden sehr gute Korrelationen innerhalb der Holzarten ermittelt, so dass die Schallgeschwindigkeit gut abgeschätzt werden konnte. Die Lokalisierung von Ästen und Rissen ist gut möglich. Schädigungen wurden prinzipiell durch Ausbleiben des Echos der Bauteilrückseite detektiert. War der Übergang in Schallausbreitungsrichtung abrupt, wurden die Wellen reflektiert und erzeugten ein Echosignal. Die durchgeführten Bohrwiderstandsuntersuchungen belegen einen Zusammenhang zwischen Bohrwiderstand und Rohdichte sowohl für die Prismen als auch für die geprüften Balken. Die Streuung der Werte der Regressionsanalysen wurde bei Differenzierung der Bohrrichtung und des durchbohrten Bereiches des Balkenquerschnitts reduziert. Zwischen Bohrwiderstand und Rohdichte bestand auch in den Zonen des Schadensübergangsbereiches ein linearer Zusammenhang. An Balken und Prismen wurden Festigkeitsuntersuchungen durchgeführt und die Schadensübergangsbereiche gesondert betrachtet. Eine Differenzierung von Schädigungsgraden war in der Regel möglich. Bei den geschädigten Balken wurde der reale Querschnitt ermittelt und für die weiteren Berechnungen angesetzt. Danach wurde ein mittlerer Zusammenhang von Biegefestigkeit und E-Modul für die pilzgeschädigten Balken festgestellt. Die Kombination der ermittelten Festigkeiten mit dem Bohrwiderstand führte zu mittelgroßen bis starken Zusammenhängen. Die Differenzierung der Bereiche des Schadensüberganges war möglich. Im Hinblick auf die Einschätzung der Biegefestigkeit bestehender Träger wurden multiple Regressionsanalysen mit modifizierten Sortierkriterien, der Rohdichte, dem Feuchtigkeitsgehalt, der Querschnittszone, dem Bohrwiderstand und dem E-Modul durchgeführt und ergaben einen sehr starken Zusammenhang, der das erhebliche Potenzial der entwickelten Methodik bei der Bewertung geschädigter Tragkonstruktionen aufzeigt.

Effects of taxonomic and locality inaccuracies on biostratigraphy and biochronology of the Hueso and Tapiado formations in the Vallecito Creek-Fish Creek section, Anza-Borrego Desert, California

The fossiliferous sediments of the Hueso and Tapiado formations exposed in the Vallecito Creek-Fish Creek section (VCFC) of the Anza-Borrego Desert (ABD) span the boundary between Blancan and Irvingtonian North American Land Mammal 'Ages.' Historically, the determination of the Blancan-Irvingtonian (B-I) boundary in the VCFC proved problematic. A new study to determine the B-I boundary in the VCFC revealed data inaccuracies in both published works and curatorial records of the mammal and other vertebrate fossils from the ABD. Most individual inaccuracies were minor, but an accumulation of over 50 years of multiple inaccuracies had significant effects on local and regional biostratigraphic and biochronologic correlations. A detailed investigation of the inaccurate data resulted in recognition of 17 types of error, with at least five sources. The two most prominent sources of error are those derived from publication and curation protocols. Examination of over 150 publications and in-house faunal lists produced over 830 taxonomic names and format variants, for 110 mammalian taxa identified from the ABD and VCFC. Approximately 50% of the taxonomic identifications were previously published without voucher catalogue numbers or fossil descriptions. A critical review of the taxonomic assignments resulted in an updated faunal list of ABD terrestrial Mammalia, including 110 taxonomic names, 66 unqualified genera, and 46 unqualified species. A supplemental list of 'retired' taxa includes 178 previously published or listed taxonomic names and format variants. The 4.5 km sequence of originally superposed sediments within VCFC is now tilted at 23 degrees and exposed in plan view. This exposure was captured in both aerial photos and satellite imagery. GIS layers of the Geomagnetic Polarity Time Scale and individual collecting localities are readily superposed onto the stratigraphic images. When united with the faunal database, GIS maps of biostratigraphic data facilitate detection and correction of data errors. Resulting corrected maps show highest and lowest stratigraphic occurrences of taxa, as well as geographic clustering of taxonomic groups, outlining possible paleohabitats. As a result of data improvement and GIS display, the local B-I boundary currently is best estimated by the presence of Ovibovini at >1.42 Ma. / text

A close look at income and racial disparity is used as the foundation for advocating for a more proactive and aggressive approach to the development of affordable units proximate to affordable transportation choices. Assembling financing for mixed-income TOD projects is especially challenging, and multiple layers of federal, state, and city funding mechanisms are required for achieving the capital requirements of the development. Both typical affordable housing funding methods and new and nontraditional funding methods for multifamily housing were researched and evaluated with the intention to propose possibilities for catalyzing development in DART station areas within the City of Dallas that have, to this point, experienced underdevelopment. / text

Casting no shadow : overlapping soilscapes of European-Indigenous interaction in northern Sweden

The Sámi’s past activities have been documented historically from a European perspective, and more recently from an anthropological viewpoint, giving a generalised observation of the Sámi, during the study period of AD200-AD1800, as semi-nomadic hunter gatherers, with several theories suggesting that interaction with Europeans, through trade, led to the adoption of European activities by certain groups of the Sámi (Eiermann, 1923; Paine, 1957; Manker and Vorren, 1962; Bratrein, 1981; Mathiesen et al, 1981; Meriot, 1984). However, there is almost no information on the impact the Sámi had on the landscape, either before or after any adoption of European activities, and none investigating what cultural footprint or indicators would remain from Sámi or European occupation and/or activity within the typically podzolic soils of Northern Sweden. Consequently the thesis aims to contribute to the gap in knowledge through the formation of a podzol model identifying the links between anthropogenic activity and the alteration of podzol soils, and through the creation of soils based models which identify the cultural indicators associated with both Sámi and European activity; formed from the identification of cultural indicators retained within known Sámi and European sites. The methods used to obtain the information needed to achieve this were the pH and magnetic susceptibility from bulk soil samples and micromorphological and chemical analysis of thin section slides through the use of standard microscopy and X-ray fluorescence from a scanning electron microscope. The analysis revealed that the Sámi had an extremely low impact on the landscape, leaving hard to detect cultural indicators related to reindeer herding in the form of reindeer faecal material with corresponding phosphorous peaks in the thin section slides. The European footprint however, was markedly different and very visible even within the acidic soil environment. The European indicators were cultivation based and included phosphorous and aluminium peaks as well as a deepened, highly homogenised plaggen style anthropogenic topsoil rich in ‘added’ materials. An abandoned European site which visibly and chemically shows the formation of a secondary albic horizon within the anthropogenic topsoil also provides an insight into the delicate balance of cultivated soil in northern Sweden, whilst reinforcing the outputs identified in the podzol model. Due to the almost invisible Sámi footprint on the landscape, areas of overlap were impossible to identify however, there was no evidence of the adoption of European cultivation activities at any of the Sámi sites investigated. The only known area of interaction between the two cultures was an official market place which had been a Sámi winter settlement prior to its use as a market site. This site showed none of the reindeer based Sámi indicators or the cultivation based European indicators, but did contain pottery fragments which could be linked to trade or occupation. Overall, the thesis reinforces the low impact expected of the semi-nomadic Sámi and sheds light on the underlying podzolic processes influencing the anthropogenically modified soils of Northern Sweden. The podzol model is reinforced by several findings throughout the thesis and the soils based cultural indicator models for both Sámi and European activity have been successfully tested against independent entomological and palynological data and therefore provide reliable reference material for future studies.

Mervärdesskatterättsligt särbehandlas omsättning av upphovsrätter genom tillämpning av en reducerad skattesats. I 7 kap. 1 § 3 st. 8-9 p. ML hänvisas direkt till upphovs­rättslagen för bedömningen av förekomsten av en upphovsrättsligt skyddad prestation och rättighetens övergång. Föreligger en mervärdesskatterättslig omsättning av eko­nomiska värden samtidigt med en upphovsrättsligt giltig upplåtelse eller överlåtelse av en upphovsrättsligt skyddad prestation ska omsättningen beskattas med en reducerad skattesats om sex procent. Uppsatsen utreder intrångsersättning enligt 54 § 1 st. URL i relation till det mervärdes­skatterättsliga omsättningsbegreppet och den reducerade skattesatsen i 7 kap. 1 § 3 st. 8-9 p. ML.  Ersättning enligt 54 § 1 st. URL ska erläggas då ett intrång i upphovsrätten kan konstateras. Ersättning ska alltid utgå oavsett god tro och även i fall där upphovs­mannen, genom t.ex. positiva sidoeffekter, tjänat på intrånget. I doktrin har det därför uttalats att ersättningen inte utgör skadestånd, något som lagstiftaren uttryckligen klassificerat den att vara. Vid en granskning av ersättningens karaktär och syfte i rela­tion till upphovsrättslagens regler för rättighetens övergång framgår att en upphovs­rättsligt giltig överlåtelse eller upplåtelse inte föreligger vid en transaktion som föranlett ersättningsskyldighet enligt 54 § 1 st. URL. Enligt 7 kap. 1 § 3st. 8-9 p. ML är detta en förutsättning för att transaktionen ska omfattas av den reducerade skattesatsen. I ett mervärdesskatterättsligt perspektiv står det emellertid klart att ersättning enligt 54 § 1 st. URL är tänkt att spegla de förhållanden som hade gällt om parterna ingått avtal på för­hand och att det finns ett ostridigt samband mellan ersättningens storlek och det faktiska nyttjandet av rättigheten. Således skulle ersättningen mervärdesskatterättsligt kunna jämställas med en upplåtelse av nyttjanderätt. För tillämpning av den reducerade skatte­satsen i 7 kap. 1 § 3st. 8-9 p. ML är ett jämställande med upplåtelse ur mervärdes­skatterättslig synpunkt emellertid inte tillräckligt. Mervärdesskattelagens ovillkorliga koppling till upphovsrättslagen i 7 kap. 1 § 3st. 8-9 p. ML medför att en upplåtelse ska prövas enligt upphovsrättslagens regler för rättighetens övergång. Den samlade slutsatsen av uppsatsens utredning är följaktligen att ersättning enligt 54 § 1 st. URL kan omfattas av det mervärdesskatterättsliga omsättningsbegreppet. Mervärdesskattelagens ovillkorliga koppling till upphovsrättslagen innebär emellertid att ersättningen inte kan omfattas av 7 kap. 1 § 3st. 8-9 p. ML och den reducerade skattesatsen om 6 procent. Ersättningen utbetalas till följd av ett intrång och avsaknaden av en uttrycklig överenskommelse hindrar en tillämpning av 7 kap. 1 § 3st. 8-9 p. ML. / VAT turnover of copyrights are subject to a reduced VAT-rate. In the Value added tax act (ML) the paragraph of 7 kap. 1 § 3 st.  8-9 p. ML refers directly to the Copyright act (URL) for the assessment of the existence of a copyright and, the sale or lease of such a right. If a taxable supply is at hand while, simultaneously, a legally valid lease or sale of a copyright can be established, the turnover is taxed at a reduced VAT-rate of six percent. The thesis investigates intrusion compensation under Article 54 § 1 st. URL relative to the value added tax turnover concept and the reduced rate in 7 kap 1 § 3 st.  8-9 p. ML. Compensation according to Article 54 § 1 st. URL must be paid when an infringement of copyright is at hand. Compensation should always be paid regardless of good faith and even in cases where the holder of the right has earned revenue by e.g. spin-offs. In the legal literature, it has therefore been expressed that Article 54 § 1 st. URL does not con­stitute damages, something that the legislature explicitly has classified it to be. When reviewing the character and purpose of the compensation in relation to URL, and its rules for the transition of the right, it is clear that a valid transition does not exist in a transaction that has prompted compensation under Article 54 § 1 st. URL. According to 7 kap. 1 § 3st. 8-9 p. ML, this is a prerequisite. For the transaction to be covered by the reduced VAT-rate, a valid transition, according to the general rules of the rights transition in URL, must be at hand. However, from a VAT-perspective, compensation under 54 § 1 st. URL is meant to reflect the conditions that would have been if the concerned parties had reached an agreement in advance. There is an undisputed link between the remuneration and the actual use of the right. Thus, the compensation could be deemed equal to a lawful lease of copyright. For the purposes of the reduced tax rate in 7 kap. 1 § 3st. 8-9 p. ML, an equation of the compensation to a lawful lease of copyright is not sufficient. The provision is directly connected to URL and any transition of copyright must therefore be examined under the URL's rules for the transition of rights. The overall conclusion of this thesis is therefore that compensation under 54 § 1 st. URL may be subject to VAT. However, due to the unconditional connection to URL, the turnover cannot qualify for the reduced tax rate of six percent stipulated in 7 kap. 1 § 3st. 8-9 p. ML. The compensation is paid as a result of an infringement of copyright and the absence of an explicit agreement prevents the application of the reduced tax rate in 7 kap. 1 § 3st. 8-9 p. ML.
