Familjeåterförening i Sverige : En kritik av den tillfälliga lagen

Syftet med denna undersökning var att granska regeringens motiveringar för den tillfälliga lagen om begränsade möjligheter att beviljas uppehållstillstånd i Sverige. Genom att applicera en version av Faircloughs kritiska diskursanalys har undersökningen ämnat avslöja diskursiva praktiker som har lett till en begränsad rätt till familjeåterförening i Sverige. Hur kan regeringens motiveringar förstås som diskursiva befästningar av makt? På vilka sätt har regeringens diskurs relaterad till familjeåterförening förskjutits? Propositionen för lagen har utgjort undersökningens primärmaterial. De huvudsakliga fynden var regeringens sätt att påkalla en nödsituation i Sverige inom vilka begränsningarna av rätten till familjeliv tycks legitimeras, följt av en diskursiv förskjutning i regeringens diskurs som har skiftat från rättighetsbärarens perspektiv till ett perspektiv som grundas i Sveriges intresse av en reglerad invandring genom lagstiftning. Slutsatserna som har dragits är att regeringens diskursiva praktiker tydlig avviker från tidigare accepterad praktik inom diskursordningen samt att detta påvisar en oroväckande maktutövning. / The purpose of this thesis was to examine the Swedish government’s justifications for the temporary law on restrictions of the possibility to obtain a residence permit in Sweden. By applying a version of Fairclough’s critical discourse analysis, the thesis sought to unveil the discursive practices that justified the limitations of the right to family reunification in Sweden. In what ways can the justifications be understood as a discursive form of power? How has the governments discourse on family reunification changed? The proposal for the law constituted the study’s primary material. The primary findings consist of, first, a way by the government to proclaim an emergency situation in which the limitations of the right to family life are seemingly justified. Second, the governments discourse on asylum law has shifted from the rights-bearer’s perspective to the perspective of Swedish interests in upholding regulated immigration by law. The conclusion is that the discursive practice entertained by the government deviates from previously accepted practice and is showing an alarming display of power.

The aim of this study was to reach an understanding of how young adults with permanent residence permit, who came to Sweden as unaccompanied asylum seeking minors, experience their confrontation with the Swedish society. Another purpose was to understand how these young adults view Sweden and its inhabitants, as well as the experience of starting a new life in Sweden. In order to investigate these questions, a qualitative method consisting of five interviews with five young men was conducted. The results showed that the respondents feared the meeting with the immigration board and that they feel that school is divided in two groups, Swedes and immigrants. People with nonethnic Swedish background who have lived in Sweden for a long time are seen as Swedes, and in that meaning assimilated. One important conclusion we made was that the division between Swedes and immigrants have a negative influence on the immigrants´ integration in the society. Another conclusion is that school has to take more responsibility to give the children a more meaningful life.

Denna studie syftar till att undersöka hur personer som sökt asyl tillsammans med sina familjer har upplevt sin livssituation i väntan på uppehållstillstånd, där fokuset läggs på barnfamiljer. Studien bygger på en kvalitativ forskningsmetod och resultatet analyseras med hjälp av en innehållsanalys. Empirin är framtagen genom semistrukturerade intervjuer med män och kvinnor som sökte asyl i Sverige under den så kallade flyktingkrisen. Studiens teoretiska ramverk utgörs av teorin om känsla av sammanhang samt utgår från teoretiska begreppen liminalitet och resiliens. Resultatet visar att personer som söker asyl tillsammans med barn i familjen kan stå inför en rad olika påfrestningar under vänteperioden; nämligen ekonomiska svårigheter, otrygga boendeförhållanden, ovisshet inför framtiden och en dubbel orosbörda. Den ovissa framtiden gör det svårare att uppleva nuet som begripligt och hanterbart när man inte vet om man kommer få stanna i landet eller inte. Oron om barnets framtid och tankar om hur ett avslag kan påverka barnets liv präglar tillvaron i väntan. Men samtidigt är det barnen och familjen som ökar motivationen att fortsätta hålla ut. Studien lyfter också på vilket sätt det var möjligt för asylsökande att hantera sin situation. Resultatet visar att intervjupersoner har använt sig av olika resiliensstrategier och resurser för att känna sammanhang i sin tillvaro. Studien kommer slutligen fram till att en lång asylprocess påverkar asylsökande barnfamiljer på flera olika plan och för att individer i dessa familjer ska känna sig kunna hantera sin situation bör man satsa på att förstärka deras känsla av sammanhang.

Happy ending? En studie i sexuell exploatering på thaimassagesalonger i Malmö

Flera olika källor har fastställt att många av Malmös thaimassagesalonger erbjudersexuella tjänster mot betalning. Syftet med denna studie har varit att delsundersöka hur omfattande den påstådda problematiken är samt att tydliggöravilken utsatthet en del av kvinnorna på salongerna lever i. En viktig del i studienhar varit att lyfta fram vilket stöd som professionella aktörer kan erbjuda dessakvinnor. Erfarenheter och kunskaper från de professionella aktörerna, bådefrivilligorganisationer, kommunala verksamheter samt myndigheter, har legat tillgrund för studiens resultat. Informationen har hämtats genom kvalitativaintervjuer med personal från ovan nämnda aktörer. Det framgår tydligt att detförekommer försäljning av sex på thaimassagesalonger i Malmö.Samtliga respondenter i intervjuerna bekräftar att många av kvinnorna på Malmösthaimassagesalonger lever i en särskild utsatthet. En beroendeställning gentemotsin arbetsgivare eller sin svenska man, tillsammans med en bristande kunskap omsvenska lagar och rättigheter, har varit det som bidragit till kvinnornaslivssituation. En rädsla för att mista sitt uppehållstillstånd har varit en faktor somökat deras beroendeställning. Enligt en del intervjupersoner kan arbetet med att nåut till denna målgrupp bli väsentligt mycket bättre. / Multiple sources determine that many of Malmö’s Thai massage parlours offersexual services. The goal of this study has been to investigate how extensive thealleged problem is, and to clarify the type of vulnerable situations some of thewomen working in the massage parlours live in. An important part on this studyhas been to highlight the type of support professionals can offer these women.Experiences and knowledge from professionals, voluntary organizations, andmunicipalities has been the bases for this study. Data has been gained throughqualitative interviews with professionals from the above mentioned actors. Theinterviews show that sexual services are sold in Thai massage parlours in Malmö.The interviewees confirm that many of the women that work in Thai massageparlours live in especially vulnerable situations. A combination of dependency ontheir employer, on a Swedish husband and a lack of understanding of Swedishlaws and rights, have contributed to these women’s vulnerability. A fear of losingtheir residency is a factor that has increased their dependency. According toseveral interviewees, outreach work toward this group can become substantiallyimproved.

Barnets bästa i migrationsdomstolarna

I föreliggande studie undersöks om olika delar av barnets bästa nämns och/eller beaktas i 24 domar från migrationsdomstolarna. Vidare undersöks på vilket sätt barnets bästa har beaktas i dessa domar, vilka är från augusti 2006 – januari 2007 och behandlar barnfamiljer och uppehållstillstånd på grund av synnerligen ömmande omständigheter. För att skapa en förståelse av hur principen om barnets bästa kan tolkas används Johanna Schiratzkis teori om barnets bästa som ett öppet koncept samt även FN:s barnkonvention och den svenska utlänningslagen. Undersökningen visar att migrationsdomstolarna i större utsträckning nämner än beaktar barnets bästa. Otydlighet råder kring om och hur barnets bästa beaktas, vilket gör det svårt att bilda sig en uppfattning av hur domstolarna har resonerat i ärendena. Undersökningen visar även på att vissa delar av barnets bästa ges en överordnad betydelse. Endast i två av de undersökta domarna framkommer att barnets bästa har beaktats som ett öppet koncept. / This essay investigates if different parts of the principle of the best interests of the child are mentioned and/or considered in 24 judgments from the migration courts. It is also investigated in what way the principle is considered in these judgments, which are from August 2006 – January 2007 and concerns families and residence permit according to 5 chapter 6 § in the Swedish immigration law. A theory of the best interests of the child as an open concept is used to create an understanding of how to interpret the mentioned principle. The investigation shows that the migration courts in a larger extent mentions than considers the best interest of the child. Whether the principle is considered and how, is not always obvious in the judgments. The investigation also shows that some parts of the principle are given a prior importance. In only two of the investigated cases the best interests of the child are considered as an open concept.

Barn som ‘persona non grata’ : Om barnperspektiv i utlänningslagens vandelsbestämmelse och undantag från denna

Recent changes and amendments have been made in the Swedish Aliens Act (2005:716), regarding the possibility of a permanent residence permit. These rules are regulated in Ch. 5 sec. 7 para. 1 and in Ch. 5 sec. 8 para. 2 in the Swedish Aliens Act. These amendments were made in the light of the modern society, dealing with the problem of migrant offenders in Sweden, only a couple of years after the Convention on the Rights of the Child was incorporated into Swedish law. Nonetheless, these rules have been criticized by various legislative bodies and human rights organizations. Hence, the special requirements that apply according to these conducted provisions in the Aliens Act raise questions about the child perspective in these rules. The purpose of this thesis is to identify the premises on which these rules rest, and the consideration taken of the child being a child, the child perspective, in these rules and how they relate to Sweden’s international commitments, mainly the United Nations Convention on the Rights of the Child. The purpose includes identifying and highlighting problems with the legislation and the need for changes in the Swedish law.  The conclusion drawn is that the studied provisions are not compatible with the statements made by the Committee on the Rights of the Child regarding the interpretation of the Convention, and that the legislation needs to be changed for Sweden to live up to the international obligations in the Convention on the Rights of the Child, so that these rules are reasonably legally secure and non-discriminatory. Furthermore, the conclusion is that the child in the studied provisions is not constructed as a child in need of protection, but rather as an adult being punished – as “a person”– an unwanted one – a ‘persona non grata’.

Syftet med studien är att ta reda på de bidragande faktorerna för etableringen av afghanska ensamkommande barn i det svenska samhället och därmed bidra till kunskapsutveckling om målgruppens behov hos yrkespersoner som kommer i kontakt med dessa barn. En kvalitativ metod har applicerats på studien. Studiens frågeställningar har besvarats med semistrukturerade intervjuer av åtta etablerade respondenter som har kommit som ensamkommande barn till Sverige. Utifrån tidigare forskning som handlar om ensamkommande barn och de tre teorierna systemteori, KASAM och Bourdieus fyra kapitalformer, har studiens material analyserats. Studien visar att myndigheternas insatser och stöd har varit uppskattade och betydelsefulla hos ensamkommande barn i deras etableringsprocess. Det framkommer att en kombination av flera yrkespersoners stöd och insatser, exempelvis av socialsekreterare, lärare, boendepersonal, vuxna volontärer, vänner, god man och kontaktperson, har spelat stor roll i ungdomarnas etablering. Studien visar därtill att några centrala faktorer såsom uppehållstillstånd, skapande av sociala nätverk, språkkunskap och yrkespersoners genuina intresse och engagemang att stötta dessa ungdomar, har varit avgörande för dessa ensamkommande barn att komma in i det svenska samhället. Det visas tydligt i studien att ungdomarnas egna ambitioner, drivkrafter, styrka, strategier, vilja och att målmedvetenhet har varit väsentliga i deras etablering. / The purpose of this study is to identify the contributing factors for the establishment of afghan unaccompanied children in Swedish society and thereby contribute to increasing knowledge among professionals who come into contact with this group. A qualitative method has been applied in the study and eight established participants who arrived as unaccompanied children to Sweden have been interviewed through semi-structured interviews. The results have been analysed based on some previous national and international researches on unaccompanied children and also on three theories: system theory, KASAM and Bourdeius' four forms of capital. The study shows that the efforts and support of the authorities have been significant and appreciated by unaccompanied minors in their establishment process. The study also declares that the participation of several professionals, for instance social workers, teachers, housing staff, volunteering adults, friends, gaurdian and contact person have played a major role in the young people’s establishment. Furthermore, the study shows that some central factors such as a residence permit, to have social networks, knowledge of the Swedish language and the extra support from the people involved have been essential for getting into the Swedish society. It is clearly shown in the study that the young peoples’ own ambitions, self motivation, struggles, own strategies, and being purposeful have been essential in their establishment.

This study examines how the new temporary law (SFS 2016:752) guarantees the child’s right to mental health; focusing on the asylum-seeking unaccompanied minor. This subject is examined since the Swedish law that regulates migration got reduced to the minimum standards that can be found in the EU and in international conventions when Sweden received 163 000 asylum seekers during 2015. 35 400 of them were unaccompanied minors. This leads to the question if the new regulations jeopardize the child’s right to mental health. To answer that, this study’s theoretical ground that will be used is legal positivism. By practicing a legal-judicial method and law-based sociological method the study follows three questions; 1. What is Sweden bound to guarantee according to the Convention on the Right’s of the child, associated with the mental health of children and the provisions of the temporary law? 2. Does the temporary law constitute grounds for existential uncertainty, and is it thereby violating the child’s right to mental health? 3. What does the situation look like, related to the mental health of asylum-seeking unaccompanied minors? In relation to the Convention on the Right’s of the Child this temporary law, and the impact of it, is examined. In the discussion it is clear that not only article 24 (the child’s right to health) is fundamental to the question of mental health, but several other articles. The result of this study has shown that the temporary law clearly violates the asylum-seeking unaccompanied child’s right to mental health.

Verkställighetshinder i utlänningslagen : En studie om reglering och Migrationsöverdomstolens tillämpning av verkställighetshinder som stadgas i 12 kap. utlänningslagen

Some expulsion decisions cannot be executed due to the existence of deportation impediments, which in this case means that foreigners are in a legal limbo in such a way that they have neither the right to stay nor the opportunity to leave Sweden. The regulation of deportation impediments is found in Aliens Act (2005:716), but it is the application of these regulations that determine how specific cases are assessed, why it is highly relevant to study said cases.  The essay deals with political, practical and medical impediments, found in Chapter 12 of the Aliens Act, in order to establish the applicable law, and by analyzing ten court cases from the Migration Court of Appeal, study how the court assesses the Swedish Migration Agency's application of these legal barriers. The provisions being studied are chapter 12 1-3 §§ Aliens Act, concerning political impediments, chapter 12 18 § Aliens Act, concerning practical and medical impediments, and also chapter 12 19 § Aliens act which establishes the possibility of a new trial in a case. The applicable law is established through a legal dogmatic method, and the legal cases from the Migration Court of Appeal are analyzed using a legal sociological method.  The study concludes that political impediments are weighed heaviest in comparison to medical and practical impediments, due to the latter two not being derived from international conventions or instruments as opposed to political impediments. Furthermore, it is easier to present evidence when invoking political impediments, as evidentiary requirements are set lower than those for practical and medical impediments. At the same time the individual has an opportunity to be granted a new trial if he or she invokes a new condition that concerns political impediments, while a new trial cannot be granted if the individual invokes medical or practical impediments. The provisions concerning practical and medical impediments should therefore be developed or amended in such a way that they are adapted to the circumstances that may arise in these cases. It is also concluded that the Swedish Migration Agency's investigation and interpretation of these impediments must be more comprehensive. It must be adapted to the conditions referred to in the case, due to the application of these provisions being complex and requiring the Swedish Migration Agency's staff to be well trained and accurate in each individual case.

Skyddsgrunder för ensamkommande barn : - en rättsvetenskaplig analys

With the increase in unaccompanied children in 2015, it has become common to discuss the legal status of unaccompanied children. By the Swedish law persons under the age of 18 are considered to be minors and therefore have no ability to make decisions in personal matters with legally binding effects. A childs case does not always require the same seriousness as adult cases to be able to obtain a residence permit. This leads to at different asylum process for unaccompanied children who lack guardians upon arriving to Sweden. Various assessments are made for unaccompanied children that adults do not need to undergo for a residence permit. Through the legal dogmatic method, an analysis and report has been made in relation to the EU law, current Swedish laws and international commitments that affect unaccompanied childrens rights within Swedish legislation. The courts way of assessing grounds for protection, as well as how these are tried has been analyzed. The concept of unaccompanied children has been defined, but the focus on their rights in Sweden has also been reported. / I samband med ökningen av ensamkommande barn under år 2015 har det blivit ofta förekommande att diskutera ensamkommande barns rättsliga ställning. Personer som är under 18 år betraktas enligt svensk rätt som omyndiga och har därför ingen förmåga att med rättslig bindande verkan fatta beslut i personliga angelägenheter. Ett barns ärende behöver inte alltid ha samma allvar och tyngd som krävs för att vuxna personer ska kunna få uppehållstillstånd vilket leder till en annorlunda asylprocess för ensamkommande barn som saknad vårdnadshavare vid ankomsten till Sverige. Det görs olika bedömningar för ensamkommande barn som vuxna inte behöver genomgå för uppehållstillstånd. Genom den rättsdogmatiska metoden har det gjorts en analys och redogörelse i relation till EU-rätten, gällande svenska lagar och internationella åtaganden som påverkar ensamkommande barns rättigheter inom den svenska lagstiftningen. Domstolarnas sätt att bedöma skyddsgrunder samt hur dessa prövas inför domstolar har bedömts och analyserats. Begreppet ensamkommande barn har definierats men även fokus på deras rättigheter i Sverige har redogjorts.
