Récit de l’événement et événement du récit chez Annie Ernaux, Hélène Cixous et Maurice Blanchot

Cette thèse porte sur trois textes autobiographiques qui questionnent, à travers l’élaboration d’une pensée de l’événement, les oppositions convenues entre fiction et témoignage. L’Événement (2000) d’Annie Ernaux, Le jour où je n’étais pas là (2000) d’Hélène Cixous et L’Instant de ma mort (1994) de Maurice Blanchot présentent le récit autoréférentiel d’un événement traumatique, soit un avortement clandestin pour Ernaux, la mort en bas âge d’un enfant trisomique pour Cixous et la mise en joue par un soldat nazi lors de la Seconde Guerre mondiale pour Blanchot. Ce corpus, quoique hétérogène à plusieurs égards, loge à l’enseigne d’une littérature placée sous le signe de l’aveu, de la confession et de la révélation ; cette littérature porterait au jour ce qui était jusque-là demeuré impossible à dire. Partant de la figure de la honte inscrite dans ces trois œuvres, mais aussi dans d’autres textes de ces écrivains qui permettent de déployer ce qui se trame de secret et d’événement dans le corpus principal, cette thèse a pour objectif d’analyser les déplacements et les retours d’un trauma gardé secret pendant une quarantaine d’années et qui remonte, par la voie de l’événement, à la surface de l’écriture. Sous la double impulsion de la pensée de Jacques Derrida et de l’approche psychanalytique, cette thèse s’intéresse à la question de l’événement à l’œuvre chez Ernaux, Cixous et Blanchot. Dans chacune de ces œuvres, un événement traumatique intervient comme révélateur de l’écriture et d’un rapport singulier à la pensée de l’événement, marqué soit historiquement et politiquement (Blanchot), soit intimement (Cixous et Ernaux). Par l’écriture, ces auteurs tentent en effet de rendre compte de l’authenticité de l’événement ressenti, problématisant du même coup la nature et la fonction de l’événement tant réel que psychique dans le récit de soi. L’événement est ainsi abordé dans son caractère historique, psychanalytique mais également philosophique, ontologique ; la pensée de l’événement mise à l’épreuve des textes d’Ernaux, de Cixous et de Blanchot permet d’explorer les figures de la date, de l’archive, de la mort et du deuil qui lui sont liées, en plus de donner lieu à une poétique singulière chez chacun. Enfin, la thèse traite du rapport entre l’aveu de l’événement et la langue qui, défiant l’opposition traditionnelle du constatif et du performatif, entraîne l’événement du récit, cet autre événement qui arrive en même temps que le récit de l’événement traumatique. / This thesis focuses on three autobiographical texts: Annie Ernaux’s L’Événement (2000) [Happening], Hélène Cixous’s Le jour où je n’étais pas là (2000) [The Day I Wasn’t There] and Maurice Blanchot’s L’Instant de ma mort (1994) [The Instant of My Death]. Each presents a self-referential narrative of a traumatic event: respectively, Ernaux’s illegal abortion, the death in infancy of a child with Down’s syndrome for Cixous and Blanchot’s experience of having been aimed at by a Nazi soldier during World War II. These three texts work out a conception of the event and therefore question the conventional opposition between fiction and testimony. This corpus, although heterogeneous in many respects, is brought together under the sign of literary confessions, avowals and disclosures. Such literary writing is intent on unraveling or bringing to light what had hitherto remained impossible to say. This thesis analyzes the movements and returns of a trauma kept secret for over forty years which ultimately, by way of the event, resurfaces in writing. The thesis’s point of departure is the figure of shame found in the three works. Yet other texts of the same writers are summoned in an attempt to untangle the secrets and events woven in the main corpus. Under the impulse of both Jacques Derrida’s thought and that of psychoanalysis, this thesis focuses on the events in the making in Ernaux, Cixous and Blanchot’s writings. In each of these works, a traumatic event occurs and reveals the links between writing and a philosophy of the event, be it inscribed historically and politically (Blanchot) or intimately (Cixous and Ernaux). In their writings, these authors attempt to give an authentic account of the event as they experienced it, while at the same time problematizing the nature and function of both the real and the psychic event in self-writing. The event is addressed in its historical, psychoanalytical, and philosophical, ontological dimensions. Close attention to the texts of Ernaux, Cixous and Blanchot allows one to explore the figures of the date, the archive, as well as that of death and work of mourning. Moreover, a singular poetics emerge for each writer. Finally, the thesis deals with the relationship between the acknowledgement of the event and language. Notwithstanding the traditional opposition between constative and performative speech acts, another event—the event of narration—arises at the same time as the traumatic event is narrated.

Le témoignage comme genre littéraire en France de 1914 à nos jours / Testimonies as a Literary Genre In France From 1914 to today

Dans le sillage des guerres totales et des génocides du XXe siècle sont apparus des ouvrages d’un genre nouveau : les témoignages. Ils sont le fait d’hommes et de femmes survivants d’une violence politique extrême qui, endossant le rôle de témoins, ont entrepris de faire connaître leur expérience au plus grand nombre en rendant compte par écrit des sévices endurés. Leur mission : attester ce qu’ils ont vu et subi, rendre hommage aux disparus, initier un questionnement sur les mécanismes ayant conduit au meurtre de masse, et opposer aux tentatives de destruction de l’humain et de sa culture une réflexion sur le vivre-ensemble et la dissolution toujours possible des liens sociaux les plus fondamentaux. Le corpus légué par ces témoins constitue l’objet d’étude de cette thèse de doctorat, qui poursuit un double objectif : décrire, sur la base d’une lecture minutieuse des textes, partiellement assistée d’outils d’analyse textométriques, les principales caractéristiques du genre, et poser les jalons d’une histoire du témoignage et de sa réception, publique et critique, à partir de récits faisant état d’expériences aussi diverses que celles du feu pendant la Grande Guerre, de l’univers concentrationnaire sous le régime nazi et de la violence coloniale en Algérie. Comprendre ce qui spécifie génériquement ces textes au-delà de la diversité des œuvres et des événements dont elles sont issues, suppose de dégager le projet commun qui les sous-tend et les constitue en lignée, étant entendu qu’un genre ne se définit pas en fonction de critères ontologiques immuables. Il apparaît dans des circonstances socio-historiques précises, et se déploie à un niveau d’interférences sémiotiques qui justifie cette double approche, philologique et historique. / Books of a new kind appeared out of the total wars and genocides of the twentieth century – testimonies. They are written by male and female survivors of extreme political violence, who, taking on the role of witnesses, decided to share their experiences with others by writing of the suffering they had undergone. Their mission consists in testifying what they saw and experienced, paying tribute to those who did not survive, questioning the mechanisms which led to mass murder, and opposing to the attempts to destroy human beings and their culture a reflection about living together and the ever-present possibility of the most fundamental social relationships falling apart. The corpus left by these witnesses is the object of study of this PhD dissertation, which has two aims: to describe, based on a close reading of the texts, partially aided by the tools of textometric analysis, the main characteristics of the genre, and to create the basis of a history of testimonies and their public and critical reception, using accounts which reveal such diverse experiences as trench warfare during the World War One, the concentration camps of the Nazi regime, and colonial violence in Algeria. In order to understand the generic specificity of these texts going beyond the diversity of the works and the events they proceed, it is necessary to define the underlying common project which forms a tradition, given that a genre is not defined according to unchanging ontological criteria. It appears in precise socio-historical circumstances, and is situated at a level of semiotic interference which justifies this dual philological and historical approach.

Na presente tese, investigam-se aspectos da literariedade e as marcas enunciativas da vivência e do testemunho em dois textos da literatura brasileira contemporânea, cujo conteúdo narrativo é a experiência alheia e pessoal no universo carcerário. As discussões empreendidas neste trabalho têm como base quatro principais eixos que norteiam algumas questões concernentes à memória, responsável pelo processo de escritura de Luiz Alberto Mendes e Drauzio Varella; à escrita confessional, gênero eleito pelos dois escritores para recomporem suas lembranças; aos processos ficcionais, tão caros a ambos os autores na composição de suas memórias; e à linguagem, por meio da qual se procede à busca das pistas discursivas que diferenciam a vivência do testemunho e revelam os aspectos da literariedade nas narrativas engendradas pelos escritores referidos. A partir destes eixos, busca-se reconhecer a inserção do sujeito na linguagem nas obras Memórias de um sobrevivente (2001), de Luiz Alberto Mendes e Estação Carandiru (1999), de Drauzio Varella, a fim de explorar as marcas enunciativas que identificam e diferenciam a experiência pessoal do testemunho. Entre os diversos autores consultados para compor o substrato teórico que fundamenta as análises empreendidas estão Henri Bergson, Michel Foucault, Erich Auerbach, Walter Benjamin, Gerárd Genette, Philippe Lejeune, Wayne Booth, Wolfgang Kayser, Clara Crabbe Rocha, Antonio Candido, Lígia Chiappini Moraes Leite, Luiz Costa Lima, Bella Josef, Émile Benveniste, Dany-Robert Dufour, entre outros. / In this thesis, the aspects of literariness the experience and the testimony marks in two texts of contemporary Brazilian literature are investigated. The narrative content is the experience of other people and the personal experience, both in the prisional context. The discussions undertaken in this work are based on four main axes that guide issues, such as concerning memory, which is responsible for the writing process that Luiz Alberto Mendes and Drauzio Varella accomplish; concerning the writing confessional genre, which was chosen by the two writers to restore their memories; concerning the relevant fictional process meaningful to each of these authors during the exposure of their memories; and concerning the language through which it is possible to find out discursive clues that distinguish the experience of witness and reveal aspects of literariness in the narratives engendered by them. Taking into account the study of these four lines, this thesis aims at recognizing the subject insertion that appears in the language shown in Memórias de um sobrevivente (2001), written by Luiz Alberto Mendes and Estação Carandiru (1999), written by Drauzio Varella, in order to explore the marks of enunciation that identify and distinguish witness personal experience. A obra autobiográfica de Arenas, se entendida como um testemunho dos eventos históricos que tiveram lugar em Cuba a partir da implantação do regime pós-Revolução de 1959, servirá como base para um novo olhar sobre a história de Cuba, na medida em que será capaz de revelar acontecimentos que não foram registrados pela história oficial. / The object of this study is Cuban writer Reinaldo Arenas’ autobiography, entitled Antes que Anoiteça, 1994 (Antes que Anochezca, 2006), and its aim is to analyze how this book represents the sense of imprisonment, experienced by the author because of the sociopolitical context of Fidel Castro’s socialist system in Cuba. Such aspect is investigated in the narrative focus of both the book and its film adaptation (Antes do Anoitecer - Before Night Falls, 2000) by American director Julian Schnabel. The twentieth century context, called the “Era of Disaster” by Márcio Seligmann-Silva (2003), due to its having been the scene of wars, revolutions and genocides, suggests the need for a concept of history based on memory and not on official history linear progress. Arenas’ autobiographical work, if seen as a testimony of the historical events which took place in Cuba during the regime established after 1959 Revolution, will serve as the basis for a new look at Cuban history, since it may disclose events which were not reported by official history.

L'oralité en droit privé / The orality in private law

Alors que la scène du droit semble célébrer le triomphe de l’écriture juridique, on est obligé de se poser la question de l’impact du « tout écrit » sur l’oralité juridique et de rechercher, si besoin était, la place actuelle de cette dernière en droit privé. Il est vrai que l’oralité est source d’insécurité de par ses deux caractéristiques principales : la volatilité et la versatilité. Pour autant, des vecteurs sécurisés de l’oralité existent. On est aujourd’hui en capacité d’assurer une sécurité quant à la parole et de lui conférer un caractère fiable ou pérenne ou de lui assigner un cadre, une structure permettant de développer un habitus institutionnel. L’oralité juridique demeure une notion importante en droit français mais mal définie et à caractère évolutif. Il pour autant est permis de douter que l’écriture constitue, partout et toujours, un progrès. Si l’écriture insiste surtout sur le message qu’elle véhicule et tend à l’anonymat des relations sociales, l’oralité valorise l’individualisation des rapports sociaux. L’oralité présente des caractéristiques principales essentielles telles que la rapidité, la facilité et la simplicité. L’oralité est également nécessaire au soutien des principes généraux d’organisation du procès. Elle présente des qualités indéniables rendant son utilisation indispensable, mais surtout l’oralité a vocation à replacer au centre du rapport d’obligation ou au centre du procès l’individu, source de cette oralité. L’oralité est loin du "déclinisme" qu’on lui prédit et ses apports sont essentiels. C’est la faveur traditionnelle pour l’oralité qui se trouvera ici rappelée / Nowadays the increasing number and complexity of new additional texts congest the Law. As a consequence, we can ask the question of the impact of writing on legal orality. Thus, it is required to look for the current place of orality in private law. It is true that orality is a source of insecurity because of two main features : volatility and versatility. However, there are some secured flows when using orality. Nowadays, we are able to ensure security of speech and to award it a lasting character. Also here, the possibility exists to assign to it a framework, a structure allowing to develop institutional customs. Legal orality remains an important concept in French Law, despite the current lack of structure. Whether in contractual or irrefutable proof or in procedural law, orality does not hold same guarantees as written words and without the transfer into writings, orality remains a source of concern. But we can be skeptical about the writing as a progress. If writing pays particular attention on the message and moves towards the anonymous of social relationships, orality highlights individualization of social relationships. Orality has key characteristics such as speed, ease and simplicity. Orality is also required to support of the general principles of the organization of the trial. It shows undeniable qualities making its use indispensable, but above all, orality has the vocation to put the person in the center of the contract or in the center of the trial. Today, orality is still far from the predicted decline as its contribution remains essential. It is the traditional favor for orality which will be recalled here

Jorge Semprun, survivant de Buchenwald, entend « faire [du] témoignage un espace de création ». L’inventivité formelle du roman lui permet d’exprimer la vérité de l’expérience vécue, en créant un espace textuel réflexif où auteur et lecteur, l’un mis en scène dans l’acte d’écriture, l’autre appelé à prendre conscience de son rapport actif à la constitution du sens du récit, se rencontrent dans la relation éthique du témoignage. Mon travail concerne les caractéristiques formelles de ce roman de l’histoire, pour expliciter sa relation au discours politique en particulier, et mettre en relief l’autonomie esthétique du roman, sur laquelle repose la spécificité du rapport littéraire à l’histoire. Semprun met en place cette esthétique au moyen de multiples innovations narratives et d’une conception du récit comme performance, où le Dire est distinct du Dit (Levinas) : cette dimension performative du récit est décrite dans cette étude au moyen d’une approche phénoménologique de la lecture, centrée sur les dynamiques interprétative et imaginaire mises en œuvre par le sujet lisant. Le contraste entre esthétique narrative et discours idéologique définit non seulement les stratégies d’écriture de Semprun, mais également le rôle attribué au lecteur : ce dernier, prenant conscience des motivations et procédés rhétoriques de l’auteur, qui multiplient explicitement les trajectoires interprétatives au sein du texte, réalise que l’enjeu du témoignage réside dans l’acte de lecture, une lecture engagée, participative et en perpétuel renouvellement / Jorge Semprun, survivor of Buchenwald, intends to « make testimony a space of creation ». The formal inventiveness of the novel allows him to express the truth of his experience, by creating a reflexive textual space in which the author is presented in the act of writing, and the reader is called to realize his/her active part in the constitution of narrative meanings. Author and reader thus collaborate on establishing the ethical relationship of testimony. My dissertation examines the formal characteristics of this novel of history, to describe its relationship to political discourse in particular, and to highlight the aesthetic autonomy of the novel, which defines the specificity of literature’s approach of history. Semprun develops this aesthetics through multiple narrative innovations and a conception of narration as performance, where Saying is distinct from the Said (Levinas) : this performative dimension of the narration is described in this work through a phenomenological notion of reading, centered on the interpretative and imaginary activities brought into play by the reading subject. The contrast between narrative aesthetics and ideological discourse does not only define Semprun’s writing strategies, but also the function attributed to the reader in these texts. Becoming aware of the author’s motivations and rhetorical processes, which explicitly multiply interpretative trajectories within the text, the reader realizes that the stakes of testimony reside in the act of reading, a reading that is engaged, participative, and perpetually renewed.

Erro médico em cirurgia do aparelho digestivo: contribuição para o estudo das provas técnicas, periciais e documentais e suas implicações jurídicas / Medical malpractice in digestive system surgeries: a contribution to the study of technical, expert, and documentary evidence and its legal implications.

Neste trabalho foram analisados trinta processos judiciais, que tramitam pelos Fóruns Regionais Cíveis de São Paulo, capital e interior e Instituições Periciais da Capital. Fez-se as extrações individualizadas de cada processo, objetivando definir as principais causas e documentos juntados ao mesmo e conseqüências de cada condição. Iniciou-se pela importância prática do tema para efeito de evolução médico-social. Buscou-se estudar a visão da relação médico-paciente, mesmo durante a demanda, a informação ao paciente e seus familiares dos procedimentos e limitadores do ato médico; o documental técnico jurídico juntado ao processo; o preparo técnico-jurídico do médico e, se, a propositura de ação depende da formação e especialização do profissional. Foram analisados processos judiciais de primeira instância no período de 1996 a 2002 correlacionados à cirurgias do aparelho digestivo. Usou-se como parâmetro de análise exclusivamente os documentos juntados aos autos onde buscou-se a existência clara da quebra da relação médico-paciente, a existência de consentimento informado, a verificação do documental juntado à defesa pelas partes ou solicitação judicial e a qualificação do profissional envolvido nas ações. Finalmente, analisados os resultados, chegamos a conclusão que a melhor forma para profilaxia da ação cível indenizatória por erro médico é: a boa relação médico-paciente; a manutenção de prontuário médico preenchido, legível, com carimbo e assinatura; o consentimento informado, que, deve ser elaborado, porém, por si só não é suficiente; e a condição técnico curricular do profissional não é fator atenuante para propositura da ação. / Thirty legal proceedings, which are in progress before the Regional Civil Courts both the Capital and the countryside of the State of Sao Paulo, Brazil, besides Examination Institutions in the Capital city of Sao Paulo, have been analyzed in this work Individual excerpts of each case were taken with the purpose of defining the main causes and documentation attached to them as well the consequences of each condition. The practical importance of the subject for the medical-social evolution has been addressed in the first place. The physician/patient relationship view was sought to be studied, even during the claim, as well as the information of the medical procedures and limitations to the patient and his or her family; the technical/legal documentation attached to the case; the physician technical/legal preparation and whether the filing of the action depends on the professional education and specialization. Trial court cases from 1996 to 2002 related to digestive system surgery have been analyzed. The analysis subject hereof has been based exclusively on the documents attached to the case record, where attempts have been made to evidence the clear existence of the breach of the physician/patient relationship, the existence of informed consent, the examination of the documentation attached to the defense by the parties or court request, and the qualification of the professional involved in the actions. Finally, after the results have been analyzed, a conclusion was reached that the best way of avoiding a civil action for damages due to medical malpractice includes: a good relationship between doctors and patients; keeping the patient record completed, legible, stamped, and signed; informed consent, which must be prepared but it is not sufficient on its own; and the professional technical experience and background do not constitute a mitigating circumstance for filing the action.

O objetivo desta tese é analisar Operación masacre de Rodolfo Walsh à luz da reflexão sobre as relações entre literatura e testemunho. O trabalho tem como hipótese que Operación masacre pode ser lida como um romance de testemunho não só porque em suas páginas denuncia a prática da violência de Estado mas, sobretudo, porque essa violência gera o imperativo ético de escrever e a procura de uma forma narrativa. / The purpose of this thesis is to analise Operación masacre written by Rodolfo Walsh under the lights of reflection about the relations between literature and testimony. The work has as hypothesis that Operación masacre can be read as a testimony novel not only because in its pages denounces the State´s violence, but above all, because this violence generates the ethical imperative of writing and the search for a narrative form.
