By what right do we own things? : a justification of property ownership from an Augustinian tradition

The justification of property ownership based on individual subjective rights is tightly bound to humanist moral perspectives. God is left out as irrelevant to the just grounds of ownership, which is established primarily on the basis of human self-referential, moral capacity. This thesis aims at developing an alternative justification, both for property as an institution and as a private holding, with a view to bringing God back into the centre stage and thereby placing property ownership on the objective concept of right. A tradition hitherto generally left unnoticed, yet uncovered here as the source of inspiration, vests the whole project with a moral-teleological tone. The tradition, enunciated by St. Augustine and developed by St. Bonaventure and John Wyclif, invites us to see property from the perspective of a moral end: it ought to be used for the love of God and neighbours, and as such it can be owned only by the just. In spite of important insights into the moral nature of property, the Augustinian thesis not only fails to spell out what ‘use for love’ means but also suffers from elitism. Nor does it offer an adequate justification of private property. Such weaknesses call for revision. When we reinterpret the Augustinian thesis through the concept of the divine imperative of service coupled with a proper understanding of human work, property acquires a distinctive justification. Property, as an institution, is justified as a requisite for carrying out God’s redemptive work towards the world. From this general justification ensues the particular justification. We hold property as specifically ‘mine,’ since each person’s ordained mission to participate in God’s work requires a uniquely personal material means, although the recognition and fulfilment of individual mission still demands communal efforts. The duty to carry out the God-commanded mission at first allows us to possess private property only in a non-proprietorial and non-exclusive manner. Yet in the prevailing condition of economic scarcity and human greed, civil jurisdiction must provide a structure of rights to enforce property institution. As God’s invitation for the transformation of the world is a universal command, everybody should have a minimum of property, and yet in differentiation of the scope and kinds commensurate with the particularities of individual mission.

La fragmentation juridique de la terre en droit privé : étude des représentations sociales et historiques de la terre dans la tradition romaniste

Jusqu’à une époque récente, un juriste étudiait un modèle juridique donné car il le considérait comme le meilleur. Telle est la constatation formulée par les comparatistes Antonio Gambaro, Rodolfo Sacco et Louis Vogel dans les premières lignes de leur Droit de l’Occident et d’ailleurs. Cette attitude cadre difficilement avec le contexte globalisant actuel. En revanche, un nombre croissant de juristes manifestent un intérêt renouvelé à l’égard du génie propre aux différentes traditions juridiques. À l’intérieur même d’une tradition juridique, un recul théorique est parfois nécessaire afin de mieux en apprécier la sagesse. Pour H. Patrick Glenn, la tradition juridique est vivante et évolutive. Le droit civil privé du Québec, branche de la tradition romaniste, constitue la résultante d’un processus de transmission de connaissances juridiques dont la pertinence est constamment mise à l’épreuve du temps et du contexte social. Très tôt, les dépositaires du savoir issu de la tradition romaniste ont cherché à définir la place de l’être humain dans la nature et cela, à toute époque confondue. La relation humaine avec la terre a fait l’objet de réflexions juridiques poussées dans le droit classique comme dans le droit moderne. Le droit des biens privé du Québec, branche fondamentale du droit civil, a intériorisé et adapté la somme de ce savoir à son propre contexte social et historique. La conception juridique de la terre a varié considérablement à l’intérieur même de la tradition romaniste. Ce mémoire propose une étude des représentations sociales et historiques de la terre dans la tradition romaniste. Cette étude a été menée en recourant à une approche interdisciplinaire du droit qui puise dans le savoir des disciplines philosophiques et historiques. Au terme de cette analyse, il sera établi que la structure de la propriété civiliste a conduit à une fragmentation juridique de la terre en autant d’utilités qu’il est techniquement possible pour l’être humain d’en tirer. / Until recently, legal scholars studied the specific legal model which was considered to be the best. This is the conclusion reached by comparative scholars Antonio Gambaro, Rodolfo Sacco and Louis Vogel in the first lines of Droit de l’Occident et d’ailleurs. This approach is difficult to reconcile within the context of our current globalized world. Therefore, a growing number of legal scholars have manifested a renewed interest in the strengths of different legal traditions. Within a legal tradition a theoretical examination is sometimes necessary in order to better appreciate its wisdom. For Patrick H. Glenn, legal tradition is living and evolving. Quebec Civil law, from the Roman tradition, is the result of a process of transmission of legal knowledge whose relevance is constantly put to the test of time and social context. Early on and during all ages, those responsible for transmitting the knowledge of the Roman tradition searched for ways to define the place of human beings within nature. The relationship between humans and the land has been the subject of numerous legal reflections both within classic and modern law. The law of private property in Quebec, a fundamental branch aspect of civil law, has internalized and adapted these reflections within its particular social and historical context. The legal concept of the land has varied considerably within the Roman tradition. This thesis proposes a study of social and historical representations of the land within the Roman tradition. It is rooted in an interdisciplinary legal approach, guided by philosophy and history. Through this analysis it will be established that the structure of property within the civil law tradition has created a legal fragmentation of the land, focused on its utilities, in order to enable human beings to derive as much as technically possible from it.

La réception de la Constitution anglaise en France au XIXème siècle. Une étude du droit politique français / The representation of the English Constitution in French nineteenth century. A study of Political Law

Le modèle réformiste de la Constitution de l’Angleterre a intellectuellement dominé la France du XIXe siècle. Synthèse des aspirations françaises visant la stabilité politique, cette représentation mêle un historicisme de l’accomplissement libéral du gouvernement représentatif et une adhésion à la légitimation coutumière de l’innovation. Elle procède d’un jeu de projections contradictoires sur la Constitution anglaise. D’une part, les libéraux romantiques identifient dans ses institutions, les conditions propres à préserver l’individu des abus du pouvoir et à permettre le développement de la démocratie. D’autre part, les traditionalistes perçoivent dans la continuité historique de l’Angleterre, les bienfaits structurants de la hiérarchie sociale et de la liberté aristocratique. Plus particulièrement, les Doctrinaires décèlent, dans la morphologie civilisationnelle de l’Angleterre, une société déployant la liberté dans l’ordre. C’est dans le parlementarisme, produit historique de l’évolution institutionnelle anglaise, que la doctrine politique finit par identifier le régime politique susceptible de clore les tensions révolutionnaires françaises. Pensé comme une matrice libératrice des énergies individuelles et conservatrice de l’ordre politique et social, il dépossède le chef de l’Etat de son pouvoir personnel, dans la mesure où il le rend irresponsable. En outre, il consacre le règne de l’opinion publique par la prédominance de la chambre élective et par la reconnaissance de la responsabilité politique des ministres. Enfin, il encadre l’action politique par les usages historiques hérités de la monarchie représentative. Fondé sur un projet politique, le parlementarisme français donne corps à une philosophie prudentielle du droit constitutionnel. Celle-ci conçoit la constitution comme un cadre institutionnel au sein duquel l’agir politique doit pouvoir adapter la société à son stade de développement historique. Le laconisme des Lois constitutionnelles de la Troisième République témoigne de l’enracinement de ce réformisme constitutionnel. Plus qu’un compromis politique de circonstances, il cristallise en effet une politique constitutionnelle libérale et conservatrice. Ce travail entend montrer qu’elle résulte de la modélisation française de la Constitution anglaise au XIXe siècle. / The reformist model of the English Constitution was intellectually predominant in nineteenth century France. As a synthesis of French yearnings for political stability, this representation historicises the liberal achievement of representative government and endorses the legitimacy of innovation through custom. It results from contradictory visualisations of the English Constitution. On the one hand, romantic liberals identify in its institutions the necessary elements to protect individuals from abuses of power and to allow the development of democracy. On the other hand, traditionalists perceive in England’s historical continuity the structuring benefits of social hierarchy and aristocratic freedom. More particularly, French Doctrinaires see through the morphology of the English civilization a society that secures freedom within order. French thinkers recognise in parliamentarism, as a product of England’s institutional evolution, the political regime capable of putting an end to French revolutionary tensions. As a mould that both liberates the energies of individuals and protects the political and social order, it renders the Head of State irresponsible and thus strips him of personal powers. Furthermore, it establishes the reign of public opinion through the superiority of the elected chamber and the recognition of government responsibility. Finally, it disciplines political action through the historical practices inherited from representative monarchy. Based on a political project, parliamentary government in France gives substance to a prudential philosophy of constitutional law. This philosophy views the constitution as an institutional framework within which political action must be able to adapt society to its historical phase of development. The laconism of the constitutional laws of the Third Republic reflects this constitutional reformism. Rather than a circumstantial political compromise, it crystallizes a liberal and conservative constitutional policy. The present study aims to show that it is the result of how the English Constitution has been modeled in France during the nineteenth century.

Maybe the best demonstration is the increasingly prominent role of the Constitutional Court (TC) – Constitution’s Supreme Interpreter – in defining and redefining concepts, rights and legal principles touching a range of subjects, from TaxLaw to Human Rights. This is relevant to understand the Law and its current effects whether it is valued positively or negatively. / La constitucionalización de las distintas áreas del Derecho es un fenómeno cada vez más arraigado en nuestra cultura y contexto jurídicos. Tal vez la forma más evidente en que se haya manifestado sea el creciente protagonismo del Tribunal Constitucional (TC), supremo intérprete de la Constitución, en la significación y resignificación de conceptos, derechos y principios jurídicos que, a través de sus sentencias, han afectado desde el derecho tributario hasta los derechos humanos. Sea que esto se valore positiva o negativamente, su relevancia para comprender el derecho y sus efectos en la actualidad es innegable.

A critical analysis of the contribution of selected Shona proverbs to Applied Philosophy

The research focuses on the epistemic tension between Western positivist epistemology and African indigenous knowledge systems particularly Shona proverbs. The research argues that Western epistemological hegemony is both unjustified and unacceptable in the context of the pluriversal understanding of knowledge where systems of knowledge are both multiple and diverse. After a critique of Eurocentric thinking, the research defends an African epistemological paradigm that emerges as an alternative framework for the authentic and legitimate study of African knowledge systems and ways of knowing. The approach opens intellectual space for the philosophical study of Shona proverbs. Under Shona environmental philosophy, it shall be argued that ubuntu respects all aspects of the environment, recognizes the dependence of human beings on the environment, sees the land as sacred and affords responsibility for future generations by encouraging the preservation and conservation of resources. Three Shona proverbs have been used to show how the Shona think about preservation of natural resources, conservation of natural resources and the interdependence between humanity and the natural world. In the context of Shona philosophy of law, it is argued that ubuntu provides the basis of a coherent philosophy of law among the Shona. Shona philosophy of law is a reflection of legal elements and the study draws these elements from selected proverbs. These proverbs have been used to show the metaphysical basis of Shona legal philosophy, the role of the law in protecting the dignity of individuals and the importance of the law in peace building within the community. Concerning political philosophy, the study has argued that ubuntu is the political foundation of solidarity, oneness and mutual support in politics. Shona political philosophy stresses coexistence and relatedness (ukama) within the community. Shona political philosophy maintains that authority should be guided by respect, good governance, solidarity and peace. Under Shona philosophy of economics, themes of human dignity, respect for hard work and the need for moderation in the desire for money are discussed in the context of the Shona philosophical worldview. A theological response to the "illegal alien" in federal United States law

Today, some twelve million immigrants are unlawfully present in the United States. What response to this situation does Christian theology suggest for these immigrants and those who receive them? To this question about the status of immigrants before the law, the theological literature lacks an understanding of how federal U.S. immigration law developed, and it lacks a robust theological account of the governance of immigration. To fill this gap, the thesis presents three stages in the formation of the laws that designate some immigrants as aliens unlawfully present or illegal aliens, drawing out the moral argumentation in each phase and responding with moral theology. In the first stage, non-citizens were called aliens in U.S. law. In response to the argument that aliens exist as a consequence of natural law, Christian teaching indicates that immigrants are not alien either in creation or for the church. In the second stage, the authority of the federal government to exclude and expel aliens was established, leaving those who do not comply to be designated illegal aliens. To the claim that the federal government has unlimited sovereignty over immigration, interpretations of the Christian Scriptures respond that divine sovereignty limits and directs civil authority over immigration. In the third stage, legal reforms that were intended to end discrimination between countries allowed millions from countries neighboring the U.S. to become illegal aliens. These reforms turn out to be unjust on philosophical grounds and unneighborly on theological grounds. While federal law classes many as aliens unlawfully present in the United States, Christian political theology indicates that immigrants are not alien, the government of immigration is limited by divine judgment, and nationals of neighboring countries deserve special regard.

Law in 3-Dimensions

This project, overall, involves a theory of law as dimensions. Throughout the history of the study of law, many different theoretical paradigms have emerged proffering different and competing ways to answer the question ‘what is law’? Traditionally, many of these paradigms have been at irreconcilable odds with one another. Notwithstanding this seeming reality, the goal of this project was to attempt to take three of the leading paradigms in legal theory and provide a way to explain how each might fit into a single coherent theory of law. I set out to accomplish this by drawing on the field of theoretical physics and that field’s use of spatial dimensions in explaining various physical phenomena. By engaging in a dimensional analysis of law, I found that I was able to place each paradigm within its own dimension with that dimension being defined by a specific element of time, and in doing so much of the conflict between the paradigms came to be ameliorated. The project has been divided into two main parts. PART I discusses the fundamentals of legal theory (Chapter 1) and the fundamentals of dimensions (Chapter 2). These fundamentals provide a foundation for a dimensional analysis of law which takes place throughout PART II. In Chapter 3, I argue that the three fundamental theses of Positivism coalesce with the 1st-dimension of law, which is defined as law as it exists at any one point in time. From there, I argue in Chapter 4 that the 2nd-dimension of law, being law as it exists between two points in time (i.e. when cases are adjudicated), is characterized by Pragmatism. I then turn, in Chapter 5, to argue that the 3rd-dimension of law, being law as it exists from the very first point in legal time to the ever changing present day, coalesces with the fundamental theses of Naturalism. Ultimately then, I argue that a theory of law as dimensions, through the vantage points of the specific elements of time, provides a more complete account of the nature of law.

Jahrhunderts in Italien und Spanien' stellt ein Standardwerk sowie den bisher stärksten und gründlichsten Beitrag zu einem der meistdiskutierten Themen der Hispanistik, zur Ehre und zum Drama des 16. und 17. Jahrhunderts unter Berücksichtigung Italiens dar, das im Rahmen eines kulturtheoretischen, semiotisch-epistemologischen Konzepts ein umfassendes Interpretations- und Erklärungsmodell für die interkulturelle und intertextuelle Behandlung der Gebiete Drama, Poetik, Ehre, Ethik, Rechtsphilosophie, Moraltheologie, Strafgesetze entwickelt. Die Arbeit gliedert sich in zwei große Abteilungen: die erste beschäftigt sich gleichermaßen mit dem Ehr-begriff, der Rache, der Ehe und dem Ehebruch in der Ethik und Jurisprudenz in Italien und Spanien. It develops a comprehensive model of interpretation and explanation for the intercultural and intertextual treatment of the fields of drama, honour, ethics, legal philosophy, moral theology and penal laws within the framework of a cultural-theoretical, semiotic-epistemological concept. The work is divided into two large sections: the first deals equally with the concept of honour, revenge, marriage and adultery in ethics and jurisprudence in Italy and Spain. (Here he draws on Roman, Greek and Spanish jurisprudence of the Middle Ages, on moral theology, on the books of the confessors and preachers, on collections of proverbs and anecdotes). On the basis of this material, the traits, the similarities and differences, between the two systems are analysed. Onore e dramma nel Cinquecento e nel Seicento in Italia' e in Spa-gna è un’opera fondamentale e il contributo più importante e completo nel contesto di un sistema semioti-co-epistemologico di teoria della cultura, che sviluppa un ampio mo-dello interpretativo per i campi del dramma, dell’onore, dell'etica, della teologia morale, della giurisprudenza, del diritto penale, ecc. L’opera è divisa in due parti principali: la prima tratta il concetto di onore, vendetta, matrimonio, adulterio, ecc. nell'etica, nella giurisprudenza (attingendo alla giurisprudenza romana, tedesca e spagnola medievale, alla teologia morale, ai libri di confessori e predicatori, alle raccolte di proverbi e aneddoti sia in Italia che in Spagna). Sulla base di questo materiale, vengono stabilite le caratteristiche fondamentali, le similitudini e le differenze tra i due sistemi. Nella seconda parte, dedicata all’analisi drammatica della tragedia e della tragicommedia in Italia e in Spagna nei secoli XVI e XVII, lo stesso procedimento viene utilizzato per lo studio storico-tipologico dei generi drammatici (e delle poetiche) in entrambi i paesi, sviluppando un sistema esplicativo e interpretativo dei drammi d’onore. Il lavoro si conclude con un modello di interpretazione epistemologica (dell’origine del discorso dell’onore e dei suoi costituenti nella rispettiva episteme del tempo) e di segni (della sua concretizzazione in ‘segni’ semantici, pragmatici e sintattici). / Die Untersuchung 'Von den Ähnlichkeiten und Differenzen. Ehre und Drama des XVI. und XVII. Jahrhunderts in Italien und Spanien' stellt ein Standardwerk sowie den bisher stärksten und gründlichsten Beitrag zu einem der meistdiskutierten Themen der Hispanistik, zur Ehre und zum Drama des 16. und 17. Jahrhunderts unter Berücksichtigung Italiens dar, das im Rahmen eines kulturtheoretischen, semiotisch-epistemologischen Konzepts ein umfassendes Interpretations- und Erklärungsmodell für die interkulturelle und intertextuelle Behandlung der Gebiete Drama, Poetik, Ehre, Ethik, Rechtsphilosophie, Moraltheologie, Strafgesetze entwickelt. Honour and Drama of the Sixteenth and Seventeenth Centuries in Italy and Spain' is a standard work and the strongest and most thorough contribution to date to one of the most discussed topics in Hispanic Studies, Honour and drama in the sixteenth and seventeenth centuries, taking Italy into account. It develops a comprehensive model of interpretation and explanation for the intercultural and intertextual treatment of the fields of drama, honour, ethics, legal philosophy, moral theology and penal laws within the framework of a cultural-theoretical, semiotic-epistemological concept. The work is divided into two large sections: the first deals equally with the concept of honour, revenge, marriage and adultery in ethics and jurisprudence in Italy and Spain. (Here he draws on Roman, Greek and Spanish jurisprudence of the Middle Ages, on moral theology, on the books of the confessors and preachers, on collections of proverbs and anecdotes). A Pragmatic Standard of Legal Validity

American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law. These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism. In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method. This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior. The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent. The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will. Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
