A diversidade do uso do espaço oceânico e a antiga concepção da “doutrina da liberdade dos mares” forçou uma readequação do ordenamento político-econômico e espacial do ecossistema oceânico. Este redirecionamento, que envolveu o sistema internacional, originou uma nova geopolítica ou uma nova ordem global para o planejamento espacial oceânico, nos termos da Convenção das Nações Unidas sobre o Direito do Mar (CNUDM). Em razão de tais alterações, contextualizar-se-á a história do mar territorial brasileiro, em 1970, e suas implicações políticas nacionais e internacionais. Após, serão averiguadas as coalizões integradas pelo Brasil em uma aparente “batalha diplomática”, que se estendeu além de nove anos, envolveu mais de 130 países e originou um dos tratados mais bem sucedidos da história: a Convenção das Nações Unidas sobre o Direito do Mar. A partir de então, dentre outras conquistas, os Estados Partes garantiram o seu direito legal ao solo e subsolo marinho, mediante submissões para a plataforma continental além das 200 milhas náuticas, definidos no artigo 76 da Convenção. Tal conquista possibilitou aos países em desenvolvimento e a pequenas nações insulares acesso a valiosos recursos naturais, como o petróleo, gás e minerais. Os Estados costeiros, signatários da Convenção, passaram a ter assegurado o direito de reivindicar seu território submerso, ou a plataforma continental estendida, para até 350 milhas náuticas. Com a nova regulamentação, a análise das submissões passou a ser feita pela Comissão de Limites da Plataforma Continental (CLPC), organismo derivado da CNUDM, onde especialistas, selecionados segundo o critério de equidade geográfica, aceitam, modificam ou rejeitam as reivindicações. Demonstrar-se-á procedimentos adotados por Estados costeiros (insulares ou arquipelágicos) ao solicitar a ampliação de seus limites oceânicos, o modo dos especialistas brasileiros trabalharem a ampliação da plataforma continental estendida e de que forma foi feito o planejamento e o gerenciamento em termos políticos, através da Comissão Interministerial para os Recursos do Mar. Finalmente, averiguar-se-á se o Governo do Brasil terá condições de assumir tal responsabilidade, considerando o possível aumento de suas fronteiras e a capacidade do Estado, em termos científicos, tecnológicos e políticos, de internalizar e cumprir os preceitos da Convenção em sua política nacional para o mar. / The diversity of uses of the oceanic space and the old conception of “freedom of the seas doctrine” has compelled an adaptation of the political-economic and spatial legal framework for the oceanic ecosystem. This changing of direction encompassed the international system and has given rise to a new geopolitics for the legal framework of oceanic spaces around the globe, in terms of the United Nations Convention on the Law of the Sea (UNCLOS). Because of such modifications, this study contextualizes the history of Brazilian territorial sea in 1970 and its political implications, on the national as well as on the international level. After that, it examines the alliances Brazil has formed, engaging in a so called “diplomatic battle”. This process went on for over nine years, comprised more than 130 countries and originated one of the most successful treaties in history: the United Nations Convention on the Law of the Sea. Since then, the signatory states managed to secure their legal rights over the maritime soil and subsoil by means of submissions for the continental shelf beyond 200 nautical miles, as defined by the Convention in its article 76. This achievement was of utmost importance because it enabled developing countries and small island states to access valuable natural resources such as oil, gas and minerals. Every coastal state who has signed the Convention acquired the right to claim its underwater territory or extended continental shelf up to 350 nautical miles from its coast. Due to the new regulations, the Commission on the Limits of the Continental Shelf (CLCS) began to undertake the analysis of submissions. This Commission is a body set up by the UNCLOS, in which experts, selected according to the criterion of geographic equity will accept, modify or reject claims. Furthermore, this study aims to account for procedures taken by coastal, insular, and archipelagic states when claiming the extension of its oceanic limits, with the main focus on measures taken by Brazil. More specifically, it intends to explain how Brazilian experts have brought about the expansion of the extended continental shelf and in which way planning and management, in political terms, can be carried out through the Interministerial Commission for Maritime Resources. Ultimately, it will be examined if the Brazilian government is able to assume such responsibility in the face of the growth of its borders and the capability of the state, in scientific, technological and political terms, of incorporating and enforcing the precepts of the Convention in its national policy for the seas.

O fenômeno da globalização teve o condão de aproximar os diversos povos, cada um com seus interesses e culturas próprios. A existência de um consenso internacional na definição de princípios a serem seguidos quando das relações externas não consegue impedir, contudo, o surgimento de possíveis conflitos e divergências, tendo em vista a pluralidade cultural das diversas nações mundiais, fato que induziu a sociedade internacional a desenvolver meios que pudessem dirimir pacificamente as controvérsias, porventura, surgidas entre elas. A adoção dos meios para solução pacífica dos conflitos internacionais encontra-se incentivada pela Constituição da República Federativa do Brasil (art. 4., incisos VI e VII) e sua utilização não importa qualquer renúncia ao exercício da soberania, nem tampouco à imunidade de jurisdição. Para que se tenha uma eficácia maior da submissão dos conflitos surgidos no âmbito externo aos meios admitidos para resolvê-los, é importante que os países envolvidos no litígio possuam orientação interna no sentido de privilegiar o Direito Internacional frente à sua legislação infraconstitucional doméstica. A eventual primazia do direito interno pode resultar na inocuidade da adoção dos meios pacíficos de solução de controvérsias internacionais, uma vez que as autoridades dos países litigantes poderão se esquivar do cumprimento do acordo ou decisão alegando uma possível contrariedade com os ditames legais domésticos. Nesse contexto, a seara tributária tem despertado constantes divergências internacionais. As diferentes interpretações conferidas pelas diversas nações, dentre elas o Brasil, quando da aplicação dos tratados por elas firmados e que tenham vertente fiscal, em especial aqueles que visam evitar a dupla imposição fiscal da renda, ou garantir o livre trânsito de bens, pessoas e serviços, acaba trazendo grande insegurança àqueles investidores que possuem operações conectadas a dois ou mais sistemas tributários diferentes. Assim, ganham cada vez mais corpo, os debates em torno da extensão dos mecanismos pacíficos para resolução de divergências, também ao âmbito de aplicação de todo e qualquer tratado que verse sobre a matéria tributária. Tal fato propicia a busca de uma possível uniformização dos métodos hermenêuticos aplicáveis àqueles fatos geradores tributáveis que se encontrem vinculados a dois ou mais entes soberanos. É nesse contexto que se apresenta o presente estudo, o qual aborda a possibilidade de a República Federativa do Brasil submeter ao procedimento arbitral aquelas controvérsias de cunho tributário que eventualmente decorram da interpretação divergente das convenções internacionais das quais seja parte e que tratem de matéria fiscal. / The phenomenon of globalization had the power to bring together different peoples, each with their own interests and cultures. However, in view of the cultural diversity of different peoples around the world, the existence of an international consensus in establishing the principles to be followed when external relations are formed cannot prevent the emergence of external conflicts and disagreements. This led the international society to develop mechanisms that could peacefully settle the controversies that may eventually arise. The adoption of such mechanisms is encouraged by the Brazilian Constitution, whose article 4, sections VI and VII, advocates the pursuit of peace and peaceful settlement of disputes. Its use does not lead to the renunciation of the exercise of sovereignty nor to the immunity of jurisdiction. Meanwhile, in order to achieve greater efficacy in the submission of disputes arising outside of the means allowed to solve them, it is important that countries involved in the disputes have consolidated internal orientation towards favouring international law over their domestic infra-constitutional legislation. The primacy of the domestic law may result in the ineffectiveness of adopting peaceful means for solving international controversies since authorities of the countries engaged in the dispute may avoid compliance with the agreement or decision on the grounds of some contradiction with the domestic law procedures. In this context, the taxation arena has been constantly attracting international disagreement. The different interpretations conferred by various nations, including Brazil, in applying taxation-related treaties signed by themselves, particularly those attempting to avoid double income taxation or to guarantee the free flow of goods, people and services, bring a high level of insecurity to investors possessing operations connected to two or more distinct tax systems. As a result, the debates regarding the extension of the peaceful mechanisms to the solution of divergences take shape, including those related to the application of any treaty which speaks to the subject of taxation. This favors the search for the standardization of the hermeneutical methods applicable to those tax events which are linked to two or more sovereign entities. This is the context surrounding the current study, which addresses the possibility of the Federative Republic of Brazil to refer tax-related disputes, caused by divergent interpretation of the international conventions of which it is a member, to the arbitral proceedings.

The attribution of abstract and concrete meanings by hermeneutics to democratic institutions is in favor of the sovereignty of the people, so that political participation in matters of local interest can reveal the degree of citizenship of a society. Freedom of expression, as a fundamental right of the human person, is one of the pillars of the Democratic State of Law itself and includes freedom of thought, opinion and communication. It will be examined the capture of votes for the purpose of forming the popular will, in order to substantiate a critical analysis on the establishment of rules for the mass media, on the grounds that such information vehicles could compromise the maximum equality of the electoral contest. The objective of this dissertation is to investigate the collision of fundamental rights intrinsically related to the electoral period, as well as to demonstrate attempts to give rationality to the means of control of eventual judicial decision in this matter. The methodology will be limited to the normative analysis of the matter, besides the foundations and conclusions expounded in specific judgments, like the Representation n. 165.865/TSE. Finally, the following hypotheses will be presented: the possibility of restricting the norms related to electoral propaganda in favor of the equality between the candidates and the smoothness of the lawsuit; the adequacy of electoral propaganda to its primary function, namely, to bring concrete proposals and government programs to the attention of the electorate, without entering the field of personal offenses against the competing candidate; the appreciation of the public interest to resolve the conflict between the right to the image of the candidate and the right to information of the voter. / A atribuição de sentidos abstratos e concretos pela hermenêutica às instituições democráticas caminha a favor da soberania do povo, de modo que a participação política em assuntos de interesse local pode revelar o grau de cidadania de uma sociedade. A liberdade de expressão, como direito fundamental da pessoa humana, é um dos sustentáculos do próprio Estado Democrático de Direito e abrange a liberdade de pensamento, de opinião e de comunicação. Proceder-se-á ao exame da captação de votos para efeito de formação da vontade popular, de modo a consubstanciar análise crítica sobre o estabelecimento de regras para os meios de comunicação de massa, sob o fundamento de que os referidos veículos de informação poderiam comprometer a máxima igualdade da disputa eleitoral. O objetivo da presente dissertação consiste em perquirir a colisão de direitos fundamentais intrinsecamente relacionados ao período eleitoral, bem assim demonstrar tentativas de se conferir racionalidade aos meios de controle de eventual decisão judicial nessa matéria. A metodologia cingir-se-á à análise normativa da matéria, além dos fundamentos e conclusões expendidos em julgados específicos, a exemplo da Representação n. 165.865/TSE. Por fim, serão apresentadas como hipóteses: a possibilidade de restrição das normas referentes à propaganda eleitoral em benefício da isonomia entre os candidatos e da própria lisura do pleito; a adequação da propaganda eleitoral à sua função primária, qual seja, a de levar ao conhecimento do eleitor as propostas concretas e os programas de governo, sem adentrar ao campo das ofensas pessoais ao candidato concorrente; a valorização do interesse público para resolver o conflito entre o direito à imagem do candidato e o direito à informação do eleitor.

[pt] Nesta tese enfrento problemáticas dos Direitos Humanos pela filosofia
política e crítica ao direito. Num primeiro momento, apresento crítica à tradição e
uma breve genealogia de como se dá o pensamento e a história desses direitos, tanto
da ordem dos discursos de fundamentação como da sua afirmação social. Em
seguida, trabalho a encruzilhada dos Direitos Humanos a partir da relação com a
soberania e a biopolítica, respectivamente, segundo Jacques Derrida e Michel
Foucault. Por um lado, é de se destacar o acentuado caráter histórico e político dos
Direitos Humanos, de outro, questionar seu potencial de transformação social. A
encruzilhada aparece e a problematização se dá, pois, se os Direitos Humanos são
esforço do histórico de mobilizações contrário a injustiças sociais e modelos
jurídicos conservadores, também, passam a fazer parte de nossa era de direitos
como fundamento e manifestação legítima do direito. Inclusive, por vezes, se
voltam contra seus próprios fins. Nesse contexto, os Direitos Humanos estão
atrelados ao ímpeto civilizatório ocidental, ao capitalismo global, à ordem
internacional e às violências de estado, ao mesmo tempo em que se manifestam
com as lutas políticas, as conquistas sociais e as defesas contra violações de direito.
A partir disso, problematizo os Direitos Humanos diante de seus fins e de sua força
como direito, também, lanço a problemática de como pensá-los diante dos caminhos
cruzados, da diferença das forças e da contínua abertura à mudança social presentes
em sua atualidade. Com essa delimitação, estudo o potencial dos ‘Direitos Humanos
na encruzilhada’, segundo a produção social e a definição da humanidade. Isso se
dá, pela intersecção da soberania e da biopolítica, conforme são ultrapassados
limites do direito e atingidos novos domínios da vida e da sociedade. O que implica
reformular questões em torno da normatividade, da força e da realização dos
Direitos Humanos. Por fim, destaco algumas tensões em meio às relações sociais e
às composições de poder dos Direitos Humanos no cenário político atual. / [en] This thesis consists of a study about problems concerned to Human Rights
from political philosophy and critique of law. At first, with a critique of the tradition
of Human Rights and a brief genealogy of how thought and history of Human
Rights took place, both in terms of foundational speeches and social statements.
After that, due to open fractures with the philosophy of Jacques Derrida and Michel
Foucault, the idea is to distinguish how Human Rights function when related to
sovereignty and biopolitics. It is important to highlight the historical and political
nature of law, and to question its potential of social transformation, once Human
Rights are at the crossroads: If Human Rights are an effort of the history of
mobilizations contrary to social injustices and conservative legal models, they also
become our era of rights as foundations and part of legitimate law. Even, at times,
they turn against their own ends. In this context, the concept of Human Rights is
linked to western civilization, global capitalism, international order and state
violence, at the same time that Human Rights are made with political struggles,
social conquests, institutional protection and defense against rights violation. In
this context, is important to investigate how to think about Human Rights once
considered the difference of forces of their formation and continuous openness to
changes. This work turns to the potential of Human Rights at the crossroads, which
is crucial to the crossroads itself, according to its social production and ability to
define the political and humanity. Which results from the intersection of sovereign
power and biopolitics, as the premises of law are displaced and the Human Rights
reaches new domains of life and society. This implies reformulating questions
about normativity, enforcement and achievement of Human Rights. At the end, it
is consequential to highlight tensions of these rights in the midst of social relations
and compositions of power in the current political scenario. / [fr] Dans cette présente thèse, les questions de Droits de l Homme sont
confrontées à la philosophie politique et à lacritique du Droit. Dans un premier
temps, il se fait une critique de la tradition et une brève généalogie de la manière
dont la pensée et l histoire de ces droits se déroulent, tant au niveau des discours de
raisonnement que de leur affirmation sociale. Ensuite, le travail se retrouve dans
une sorte de croisement des Droits de l Homme à partir du rapport à la souveraineté
et à la biopolitique, respectivement, selon Jacques Derrida et Michel Foucault.
D une part, il faut souligner l important caractère historique et politique des Droits
de l Homme, d autre part, s interroger sur leur potentiel de transformation sociale.
La croisée des chemins apparaît et la problématisation s opère, car si les Droits de
l Homme sont le résultat de l effort historique de mobilisations contre les injustices
sociales et les modèles juridiques conservateurs, mais, ils s inscrivent aussi dans
notre ère des droits comme fondement et manifestation légitime du droit.Parfois, ils
se retournent même contre leurs propres fins. Dans ce contexte, les Droits de
l Homme sont liés à la poussée civilisatrice occidentale, au capitalisme mondial, à
l ordre international et à la violence d État, mais aussi aux luttes politiques, aux
conquêtes sociales et à la défense face aux violations des droits. A partir de là, les
Droits de l Homme sont premièrement problématisés face à leurs fins et leur force
en tant que droit, et, ensuite, problématisés sur la façon de les penser face aux
chemins croisés, à la différence des forces et à l ouverture continue aux
changements sociaux présents de nos jours. Dans cette délimitation, il convient de
souligner le potentiel des Droits de l Homme à la croisée des chemins à partir de
leur production sociale et de leur capacité à définir l espace politique et celui de
l humanité. Cela arrive à travers l intersection de la souveraineté et de la
biopolitique, au fur et à mesure que les limites du droit sont dépassées et que de
nouveaux domaines de la vie et de la société sont atteints. Cela implique de
reformuler les questions autour de la normativité, de la force et de la réalisation des
Droits de l Homme. Enfin, les tensions de ces droits sont questionnées face aux
relations sociales et aux compositions du pouvoir dans le scénario politique actuel.
