Legal issues relating to the treatment of persons living with cancer

Cancer is regarded as a global disease and one of the leading killer diseases in the world. The reason why cancer is so widespread and often misunderstood stems from multiple factors, namely, the lack of knowledge about cancer, unfair discrimination of persons living with cancer, inadequate or inappropriate treatment provided to patients, the stigma attached to cancer, misdiagnosis and late diagnosis of persons living with cancer, as well as the inadequate provision of screening programs to detect cancer at an early stage. The combination of these issues raises alarming medico-legal problems that merit further attention. The thesis will explore the origin, nature, philosophical and clinical aspects pertaining to cancer, as well as legal issues related to cancer and oncology. The study will conclude with recommendations aimed at mitigating and addressing the shortcomings that exist in the medico-legal framework. The study will also draw on a legal comparison of relevant South African, English and American laws and regulations. Since this thesis entails focussing on medico-legal principles, the study will draw on aspects of medical law, labour law, law of contract, law of delict, constitutional law and criminal law. / Private Law / LL. Discrimination on the ground of citizenship under the constitution of the Republic of South Africa, 1996

Prior to 1994, citizenship was one of the pillars upon which the erstwhile government's policy of separate development rested. The concepts of citizenship and nationality were manipulated by the apartheid government to justify the denationalisation of black people and the creation of different classes of citizenship. Race, colour and language were the distinguishing features used to classify people into the different classes of citizenship. With the advent of the new constitutional order in 1994, common citizenship and the rights associated with it were restored to all South Africans. This discussion shows how in the post-1994 constitutional order citizenship has become an element of nation-building, while on the other hand it continues to perpetuate discrimination against non-citizens. The study aims to further the debate regarding the ill treatment of non-citizens with a view of influencing legislative and policy reform to replace the existing laws which are biased against no-citizens. / Law / LL.M.

Cross-cultural adoption in constitutional perspective

Although a child's right to parental care and family life is constitutionally entrenched, many South African children are deprived of this right. Transcultural adoption could serve their need but historically this has been prohibited or discouraged by racist policies. Whether this is in keeping with the now non-racial South African society is questionable. In adoption the best interests of the child is paramount and in determining this, courts should balance children's constitutional rights to their culture of origin against their constitutional rights to non-discrimination. After considering arguments for and against transcultural adoption and the position in the United States and the United Kingdom, the writer suggests that further interdisciplinary research into the question is necessary in South Africa; inter-country adoption should be considered and law reform and governmental policy should facilitate these. / Private Law / LL. The implementation of affirmative action policy within the Pretoria District of the South African Police Service

The primary aim of this study was to investigate the implementation of the affirmative action policy within the Pretoria district of the South African Police Service. There is a need to examine and understand how the SAPS remove unfair discrimination in recruitment and selection processes in the implementation of affirmative action measures. Prior to 1994 the South African Police Force was male dominated and racism was fully institutionalised. Black people (Africans, Indians and coloureds), women and disabled people were marginalised and denied appropriate employment and advancement opportunities. The focus of the study was to identify challenges or problems encountered by the SAPS during the implementation of affirmative action policy; propose the strategies through which the SAPS can address discrimination in personnel staffing processes; and to assess and describe the criteria utilised by the SAPS in identifying the beneficiaries of affirmative action. The study includes the survey of international and national literature on the implementation of affirmative action. The study was conducted at 35 police stations within the district of Pretoria. The survey questionnaires were distributed to the respondents whereby three hundred and seventy (370) returned completed questionnaires, meeting the required sample figures. The respondents were selected by using a quota sampling. Qualitative research methodology was utilised in the interpretation and analysis of data. In addition, data was also collected through the documentary study. The major findings of this study illustrated that job requirements and responsibilities are seldom adjusted to accommodate disabled people. The communication of affirmative action policy is seen by respondents as being problematic. Respondents believe that affirmative action discriminates against certain groups within the disadvantaged groups. The research has divulged that the usage of interviews and involvement of supervisors in interview panels would minimise unfair discrimination in the allocation of promotional positions. Diversity management is not fully implemented to support affirmative action. People of all races are not employed to positions on the basis of their qualifications, experience and competencies as they deserve. Access to justice for non-citizens : a constitutional analysis

Thesis (LLM)--Stellenbosch University, 2014. / ENGLISH ABSTRACT: The rights entrenched in the Bill of Rights in South Africa’s final Constitution are, with a few exceptions, guaranteed to citizens and non-citizens alike. South Africa has seen an influx of migrants, asylum seekers and refugees since 1994, and this migratory movement has posed significant challenges to the post-apartheid legal order. This thesis is concerned with the State’s implementation of its constitutional obligations to protect and guarantee the constitutional rights of everyone within the borders of South Africa. It is important that these constitutional obligations do not remain mere aspirations but should translate into reality. Most non-citizens living in South Africa face numerous barriers to accessing justice and the processes that could enable them to realise their rights. The thesis examines the concept of “access to justice” and investigates a number of obstacles encountered by different categories of non-citizens – such as refugees, asylum seekers and documented and undocumented migrants – in trying to access justice and to realise their rights. Against this background, arrest, detention and deportation under the Immigration Act and Refugees Act are examined because these processes have often been abused by State officials to prevent non-citizens from accessing the rights and protections guaranteed in these Acts and the Constitution, and to frustrate the implementation of court orders vindicating the rights of non-citizens. The application of the Immigration and Refugees Acts is discussed through the lens of sections 12(1), 33, 34 and 35(2) of the Constitution which ensure that arrest, detention and deportation are done in a lawful and procedurally fair manner, as opposed to the arbitrariness that most non-citizens experience on a daily basis. Secondly, the thesis also examines access to justice for non-citizens in the context of xenophobia and bias based crimes. The State has in the past failed to respond in a coordinated and timely fashion in the face of violent manifestations of xenophobia. Against this background, the State’s obligation to protect non-citizens from violence from either public or private sources in terms of section 12(1)(c) of the Constitution is discussed and analysed. The role, accessibility and effectiveness of Equality Courts are also examined in light of the Promotion of Equality and Prevention of Unfair Discrimination Act and the cases that were brought before them emanating from xenophobic incidents. The thesis concludes with proposals on areas which require better implementation of existing laws; and areas in which legislative reform is needed. / AFRIKAANSE OPSOMMING: Die regte wat in die Handves van Regte in Suid-Afrika se finale Grondwet veranker is, word op enkele uitsonderings na vir burgers en nie-burgers gewaarborg. Sedert 1994 het Suid- Afrika instroming van migrante, asielsoekers en vlugtelinge beleef, en hierdie verskuiwing het wesenlike uitdagings aan die post-apartheid regsorde gestel. Hierdie tesis is gemoeid met die Staat se implementering van sy grondwetlike verpligting om die grondwetlike regte van almal wat hul binne Suid-Afrika se landsgrense bevind, te beskerm en te waarborg. Dit is belangrik dat hierdie grondwetlike verpligtinge nie blote aspirasies bly nie, maar ’n werklikheid word. Die meeste nie-burgers wat in Suid-Afrika woon staar talle hindernisse in die gesig wat dit vir hulle moeilik maak om toegang tot geregtigheid te verkry en om hul regte te verwesenlik. The Legal Implications of Internet Marketing : Exploiting the Digital Marketplace Within the Boundaries of the Law

Au cours des dernières années, le domaine de la consommation a grandement évolué. Les agents de marketing ont commencé à utiliser l’Internet pour influencer les consommateurs en employant des tactiques originales et imaginatives qui ont rendus possible l’atteinte d'un niveau de communication interpersonnelle qui avait précédemment été insondable. Leurs interactions avec les consommateurs, en utilisant la technologie moderne, se manifeste sous plusieurs formes différentes qui sont toutes accompagnés de leur propre assortiment de problèmes juridiques. D’abord, il n'est pas rare pour les agents de marketing d’utiliser des outils qui leur permettent de suivre les actions des consommateurs dans le monde virtuel ainsi que dans le monde physique. Les renseignements personnels recueillis d'une telle manière sont souvent utilisés à des fins de publicité comportementale en ligne – une utilisation qui ne respecte pas toujours les limites du droit à la vie privée. Il est également devenu assez commun pour les agents de marketing d’utiliser les médias sociaux afin de converser avec les consommateurs. Ces forums ont aussi servi à la commission d’actes anticoncurrentiels, ainsi qu’à la diffusion de publicités fausses et trompeuses – deux pratiques qui sont interdites tant par la loi sur la concurrence que la loi sur la protection des consommateurs. Enfin, les agents de marketing utilisent diverses tactiques afin de joindre les consommateurs plus efficacement en utilisant diverses tactiques qui les rendent plus visible dans les moteurs de recherche sur Internet, dont certaines sont considérés comme malhonnêtes et pourraient présenter des problèmes dans les domaines du droit de la concurrence et du droit des marques de commerce. Il illustre par ailleurs les problèmes juridiques qui peuvent survenir à la suite de leur utilisation et définit le cadre législatif régissant l’utilisation de ces outils par les agents de marketing, pour enfin démontrer que les lois qui entrent en jeu dans de telles circonstances peuvent, en effet, se révéler bénéfiques pour ces derniers d'un point de vue économique. / The evolution of consumerism in recent years has been nothing short of remarkable. The unprecedented use of the Internet by marketers to influence consumers in original and imaginative ways has rendered possible a level of communicative efficiency that had previously been unfathomable. Their interaction with consumers using modern technology manifests itself in several different forms – all of which are accompanied by their own assortment of legal issues. To begin with, it is not unheard of for marketers to use tools meant to track the behaviour of individuals throughout both the virtual and physical worlds. The personal information collected in such a manner is often utilized for Online Behavioural Advertising purposes – a use which does not always respect the boundaries of privacy law. It has also become rather common for marketers to utilize online social media to promote conversations with consumers. It has occurred, however, that these forums have also been utilized to further the anti-competitive ambitions of companies while also serving as an outlet for false advertising – two eventualities that are prohibited by both competition laws and consumer protection laws. Finally, marketers utilize various tactics in order to more successfully reach consumers through online search engines – a practice known as Search Engine Marketing – some of which are considered to be dishonest and could present issues from both competition law and trademark law perspectives. This thesis essentially provides a detailed description of these tools and the manners in which they are utilized and then proceeds to illustrate the legal issues that may arise as a result of their use. In doing so, it outlines the legal boundaries within which marketers must use these tools so as to ultimately demonstrate that the laws that come into play under such circumstances may, in fact, prove to be beneficial to marketers from an economic perspective.

Les impacts des stratégies patronales antisyndicales sur l’organisation des travailleurs

L’utilisation de stratégies antisyndicales est un phénomène de plus en plus préconisé par l’acteur patronal (Bronfenbrenner, 2009b). Une piste d’explication de cette croissance serait liée à l’idéologie de gestion se basant sur une amertume inhérente à l’idée de partager le pouvoir avec une tierce partie représentant des travailleurs (Dundon et al., 2006). Dans le but de faire régner cette idéologie et de conserver un environnement de travail sans présence syndicale, des multinationales se sont même positionnées ouvertement contre la syndicalisation, que l’on pense à Wal-Mart, Mc Donald’s ou Disney (Dundon et al., 2006). Avec cette puissance que les multinationales détiennent actuellement, il ne fait nul doute qu’elles exercent une influence auprès des dirigeants des plus petites entreprises (Dundon et al., 2006), ce qui pourrait expliquer ce recours accru aux stratégies antisyndicales, que ce soit avant ou après l’accréditation syndicale. Mais qu’en est-il de l’antisyndicalisme de l’acteur patronal en sol canadien? Pour certains, les employeurs canadiens pratiqueraient davantage une stratégie d’acceptation du syndicalisme comparativement à nos voisins du sud à cause notamment de la plus forte présence syndicale historique dans le système des relations industrielles canadien, des tactiques syndicales canadiennes différentes (Thomason & Pozzebon, 1998) et des lois encadrant davantage les droits d’association et de négociation collective (Boivin, 2010; Thomason & Pozzebon, 1998). Des travaux montrent cependant une réelle volonté de la part des employeurs canadiens à avoir recours à des stratégies d’opposition à la syndicalisation (Bentham, 2002; Martinello & Yates, 2002; Riddell, 2001). Selon les auteurs Martinello et Yates (2002), six pour cent (6 %) des employeurs ontariens couverts dans le cadre de leur étude n’auraient adopté aucune tactique pour éviter ou éliminer le syndicat : quatre-vingt-quatorze pour cent (94 %) des employeurs couverts ont ainsi utilisé différentes tactiques pour s’opposer au syndicalisme. C’est donc dire que l’opposition patronale face au mouvement syndical révélée par l’utilisation de diverses stratégies antisyndicales est aussi présente chez les employeurs canadiens. Peu d’études canadiennes et québécoises ont pourtant enrichi la littérature au sujet de ce phénomène. De manière générale, les travaux effectués sur la question, anglo-saxons et surtout américains, font principalement état du type de stratégies ainsi que de leur fréquence d’utilisation et proposent souvent une méthodologie basée sur une recension des décisions des tribunaux compétents en la matière ou l’enquête par questionnaire. Face à ces constats, nous avons visé à contribuer à la littérature portant sur les stratégies antisyndicales et nous avons construit un modèle d’analyse nous permettant de mieux cerner leurs effets sur les travailleurs et les syndicats. Notre recherche se démarque également de la littérature de par les démarches méthodologiques qu’elle propose. Nous avons en effet réalisé une recherche de nature qualitative, plus spécifiquement une étude de cas d’une entreprise multiétablissement du secteur du commerce au détail. Notre modèle d’analyse nous permet de dégager des constats quant aux effets de l’utilisation des stratégies patronales antisyndicales auprès des travailleurs visés et du syndicat visé, que ce soit sur les intérêts individuels, les intérêts collectifs ainsi que sur les intérêts du syndicat tels que proposés par Slinn (2008b). Également, nous cherchions à comprendre dans quelle mesure les stratégies antisyndicales contribuent à diminuer (effet paralysant) ou à augmenter (effet rebond) la propension à la syndicalisation des travailleurs visés par les stratégies, tout en tenant compte de la propension des travailleurs d’autres succursales qui n’étaient pas visés directement par cette utilisation (effet d’entraînement). Pour atteindre nos objectifs de recherche, nous avons procédé en trois phases. La phase 1 a permis de faire la recension de la littérature et de formuler des propositions théoriques à vérifier sur le terrain. La phase 2 a permis de procéder à la collecte de données grâce aux entrevues semi-dirigées réalisées à deux niveaux d’analyse : auprès de représentants syndicaux et de travailleurs. Au cours de la phase 3, nous avons procédé à la retranscription des entrevues effectuées et nous avons analysé les principaux résultats obtenus. La méthode de l’appariement logique (Yin, 2009) a été utilisée pour comparer les phénomènes observés (données issues du terrain) aux phénomènes prédits (constats de la littérature et propositions théoriques). À la suite de la réalisation de la phase 3, nous constatons que la campagne de peur a été celle qui a été la plus utilisée en réaction à la menace de présence syndicale avec les tactiques dites coercitives qui la composent : la fermeture de deux succursales, un discours devant un auditoire captif, la diffusion d’une vidéo interne, etc. De ce fait, un sentiment de peur généralisé (86 % des répondants) s’attaquant aux intérêts collectifs a été perçu à la suite de l’utilisation des tactiques antisyndicales. Par conséquent, nous avons pu observer l’effet de ces tactiques sur les travailleurs visés et sur le syndicat : elles auraient en effet gelé la propension de travailleurs d’autres succursales à se syndiquer (64 % des répondants) et donc freiné la campagne syndicale en cours. Nous constatons également que bon nombre de tactiques ont été déployées à la suite de l’accréditation syndicale en s’attaquant aux intérêts individuels. Mentionnons, pour n’en citer que quelques-uns, que les travailleurs feraient face à une plus forte discipline (72 % des répondants), qu’ils seraient victimes d’intimidation ou de menaces (80 % des répondants) et que ces tactiques provoquèrent des démissions à cause de l’ambiance de travail alourdie (50 % des répondants). / Anti-union management strategies are an increasingly popular phenomenon in the corporate world (Bronfenbrenner, 2009b). Management ideology could explain this tendency which results in the bitterness from sharing power with union worker representatives (Dundon et al., 2006). Corporations like WalMart, Disney, or McDonalds openly take position against unionization, thus spreading ideology and keeping work environments union-free (Dundon et al., 2006). Corporate power undeniably exerts power over smaller businesses (Dundon et al., 2006), a fact which could explain why anti-union strategies are often relied upon, even when unions are formally recognized. But what about Canadian anti-union movements? Many think that Canadian employers have officially acknowledged unionization in comparison with Americans, a belief supported by the unique historical background in regard to the Canadian industrial relation system and tactical preferences (Thomason & Pozzebon, 1998), alongside laws protecting union rights like association and negotiation (Boivin, 2010; Thomason & Pozzebon, 1998). Scientific scholarship however gives testimony of determination from Canadian employers in recourse to oppositional strategies against unionizing (Bentham, 2002; Martinello & Yates, 2002; Riddell, 2001). According to Martinello et Yates (2002), six percent (6%) of Ontarian employers covered would never use avoidance or oppositional tactics against unions: ninety four percent (94%) of employers covered thus would have used anti-union tactics. Therefore managerial opposition to union movements must certainly be present in the Canadian landscape. However, few Canadian and Quebecer studies contributed to the literature on this phenomenon. Generally speaking, management scholars —British and especially American— explicitly mention strategy types and their frequency; they follow methodologies only taking court decisions in the subject matter into account or drawing almost exclusively on surveys. Keeping this in mind, we sought to contribute to the literature on anti-union strategies; we constructed an analytic framework for identifying their effects on workers and unions. Our research methodology is distinctly orig inal: we conducted a qualitative case study of a multi-sectorial retail organization. More specifically, our model is useful in identifying anti-union strategies against workers and unions, either targeting individual or collective interests or union interests, as suggested by Slinn (2008b). Moreover, we sought to understand to what extent anti-union strategies diminish (chilling effect) or augment (rebound effect) propensity to unionization among workers, whether they are targeted or not by these strategies (ripple effect). To meet our goals, the research process was conducted in three steps. In Phase 1 several hypotheses were derived after reviewing the scientific literature. Phase 2 consisted of a data collection of union representatives and workers’ perceptions with semi-structured interviews. We then went on in phase 3 to a transcription of these interviews, and we analyzed results. Logical pairing methodology (Yin, 2009) was used in order to compare observed phenomena (fieldwork data) with predicted phenomena (theoretical and empirical predictions). After the last step, we concluded that fear campaigns were most frequent in response to unionizing threats with coercive tactics such as: closure of two organizational branches, propaganda speeches given to captive audience, an internal video, and so on. As a matter of fact, a prevailing sense of fear for collective interests (experienced by 86% of research participants) followed from recourse to anti-union tactics by management. Consequently, we observed that in effect anti-union tactics would have stopped the unionizing process in other organizational branches (64% of research participants said so), and so disrupted union campaigns in general. We also remark that many tactics were employed following the official recognition of unions while also threatening individual interests. Many side effects could be enumerated: increased worker discipline (72%), intimidations or threats (80%) and resignations caused by a bad organizational climate (50%).

Le monde des affaires est marqué par des contrats conclus entre des personnes de pouvoir économique inégal, ce qui résulte souvent sur des abus subis par la partie la plus faible. De ce fait, la recherche de l’équilibre contractuel et, plus précisément, de la protection de la partie faible, y est constante. Dans cette optique, le droit des pratiques restrictives de concurrence, droit des pratiques économiques individuelles, est souvent présenté comme un dispositif légal permettant de répondre à cette préoccupation en ce qu’il aurait pour finalité la protection des entreprises dans leurs relations bilatérales. Cependant, cette affirmation est loin d’être exacte. En effet, l’analyse des règles de ce droit de la concurrence amène à remettre en cause ce point de vue. En réalité, les dispositions qui le composent ont une finalité qui transcende l’intérêt des parties pour s’attacher à un intérêt général économique. L'encadrement individuel des relations commerciales est un moyen pour parvenir à atteindre des finalités macroéconomiques. La protection de la partie faible ne peut être assurée par le droit des pratiques restrictives de concurrence mais ressortit à d'autres mécanismes juridiques. / The business world is marked by contracts between people of unequal economic power which often leads to abuses suffered by the weaker party. Therefore, the search for the contractual balance and more specifically the protection of the weaker party is constant. In this context, the right of restrictive practices, the right of individual economic practices, is often presented as a legal mechanism to address this concern in that it would aim to protect businesses in their bilateral relations. However, this statement is far from accurate. The analysis of the rules of the competitive law brings to question this view. In fact, the provisions in it have a purpose that transcends the interests of the parties to focus on the general economic interest. Legislature organize relations between enterprises to regulate macroeconomic problems and not regulate problems of each enterprise. The protection of the weaker party cannot be ensured by the law of restrictive practices but falls within other legal mechanisms.

La presente tesi ha come obiettivo analisare il concetto e le specie di squilibrio eccessivo della relazione giuridica di consumo, nonché la possibilitá di correzione di una delle specie di squilibrio eccessivo – l’esercizio abusivo della posizione giuridica dei fornitori – per mezzo della clausola generale di divieto di vantaggio eccessivo, previsto nel Codice di Difesa del Consumatore (Art. 39, V c/c art. 51, IV e §1°). Si tratta, in essenza, di uno studio sulla stessa relazione giuridica di consumo, ragione per la quale si impone, inizialmente, un’analisi con riferimento ai suoi pressuposti fatico-normativi, elementi costitutivi e caratteristica fondamentale (Parte I, Capitolo1) per, soltanto dopo, affrontare il tema degli “squilibri” (strutturale e eccessivo) esistenti in questo tipo di relazione giuridica (Parte I, Capitolo 2), quando si cerca di dimostrare che lo squilibrio eccessivo non si confonda con lo squilibrio strutturale (intrinseco), nella misura in cui questo è realtà costitutiva della stessa relazione giuridica di consumo, essendo, per questo, riconosciuta e tollerabile dal dirito; invece, lo squilibrio eccessivo è realtà che supera i limiti del “giuridicamente tollerabile” – cioè, dello stato di squilibrio strutturale – e, per questo motivo, necessita di essere correta da un mezzo dell’ordine giuridica ( nel caso brasiliano, dal sistema giuridico di protezione e difesa dei consumatori, centralizzato nei valori e norme costituzionali e sistematizzato nel Codice di Difesa del Consumatore – Legge n. 8.078, dell’11 settembre 1990). E per la correzione delle situazioni di squilibrio eccessivo della relazione di consumo generate dall’esercizio abusivo della posizione giuridica dei fornitori il legislatore brasiliano, attento alla necessità di comprensione del diritto privato come un sistema giuridico aperto (Parte II, Capitolo 3) ha costruito il Codice di Difesa del Consumatore come uno microsistema dotato di norme casistiche e di norme aperte (le cosidette “clausole generali”), distacandosi, tra loro, la clausola generale di divieto di vantaggio eccessivo, che si intende essere la “clausola fondamentale di correzione dell’abuso nelle relazioni giuridiche di consumo” (Parte II, Capitolo 4), allo stesso tempo in cui suo ambito di applicazione, fissato dallo stesso leggislatore (CDC, art. 51,§1º), contiene, dovuto alla sua grande generalità, l’ambito delle altre clausole generali di correzione e abuso, così come quelle di funzione sociale ed economica del diritto, buona-fede obiettiva, buone abitudine e lesione enorme, tutelando, infine, la globalità dei legittimi interessi dei consumatori – cioè, i loro interessi di natura patrimoniale e esistenziale – danneggiati dalla attuazione abusiva dei fornitori nel mercato di consumo. / A presente tese tem por objetivo analisar o conceito e as espécies de desequilíbrio excessivo da relação jurídica de consumo, bem como a possibilidade de correção de uma das espécies de desequilíbrio excessivo – o exercício abusivo de posição jurídica dos fornecedores – por meio da cláusula geral de proibição de vantagem excessiva, prevista no Código de Defesa do Consumidor (Art. 39, V c/c art. 51, IV e §1º). Trata-se, em essência, de um estudo sobre a própria relação jurídica de consumo, razão pela qual se impõe, inicialmente, uma análise acerca de seus pressupostos fático-normativos, elementos constitutivos e característica fundamental (Parte I, Capítulo 1) para, só então, enfrentar o tema dos “desequilíbrios” (estrutural e excessivo) existentes nesse tipo de relação jurídica (Parte I, Capítulo 2), quando se busca demonstrar que o desequilíbrio excessivo não se confunde com o desequilíbrio estrutural (intrínseco), na medida em que este é realidade constitutiva da própria relação jurídica de consumo, sendo, por isso mesmo, reconhecida e tolerável pelo direito; ao contrário, o desequilíbrio excessivo é realidade que ultrapassa os limites do “juridicamente tolerável” – isto é, do estado de desequilíbrio estrutural - e, por este motivo, precisa ser corrigida por meio da ordem jurídica (no caso brasileiro, pelo sistema jurídico de proteção e defesa dos consumidores, centralizado nos valores e normas constitucionais e sistematizado no Código de Defesa do Consumidor – Lei n. 8.078, de 11 de setembro de 1990). E para a correção das situações de desequilíbrio excessivo da relação de consumo geradas pelo exercício abusivo da posição jurídica dos fornecedores o legislador brasileiro, atento à necessidade de compreensão do direito privado como um sistema jurídico aberto (Parte II, Capítulo 3) construiu o Código de Defesa do Consumidor como um microsssistema dotado de normas casuísticas e de normas abertas (as chamadas “cláusulas gerais”), destacando-se, quanto a estas, a cláusula geral de probição de vantagem excessiva, que se entende ser a “cláusula fundamental de correção do abuso nas relações jurídicas de consumo” (Parte II, Capítulo 4), na medida em que seu âmbito de aplicação, fixado pelo próprio legislador (CDC, art. 51, §1º), abarca, por sua grande generalidade, o âmbito das demais cláusulas gerais de correção do abuso, como as de função social e econômica do direito, boa-fé objetiva, bons costumes e lesão enorme, tutelando, enfim, a globalidade dos legítimos interesses dos consumidores – isto é, seus interesses de natureza patrimonial e existencial – lesados pela atuação abusiva dos fornecedores no mercado de consumo. / The present thesis aims to analyze the concept and the species of excessive unbalance of the legal consumption relationship, as well as the possibility of correction of one of the species of excessive unbalance – the abusive use of the legal position of the suppliers – by the inclusion of the general clause of prohibition of unfair advantage, set out in the Consumer Defense Code (Art. 39, V c/c art. 51, IV and §1º). It is, essentially, a study on the legal consumption relationship itself, a reason for which it is imposed, initially, an analysis concerning its phaticnormative presumptions, constitutive elements and key characteristic (Part I, Chapter 1) for, only then, face the topic of “imbalances” (structural and excessive) existing in this type of legal relationship (Part I, Chapter 2), when willing to demonstrate that the excessive imbalance is not confounded with the structural imbalance (intrinsic), inasmuch as this is a constitutive reality of the legal consumption relationship itself, being, therefore, acknowledged and bearable by the law; on the contrary, the excessive imbalance is a reality which overcomes the limits of the “legally bearable” – that is, the structural imbalance status - and, for this reason, it has to be corrected by the law (in the Brazilian case, by the legal system of protection and defense of consumers, centered in the values and constitutional norms e ordered in the Consumer Defense Code – Law n. 8.078, from September 11th, 1990). And for the correction of excessive imbalance situations in the consumption relationship caused by the abusive practice of the legal position of the suppliers, the Brazilian legislator, attentive to the need of understanding of the private law as an open legal system (Part II, Chapter 3) created the Consumer Defense Code as a microsystem with cauistic norms and open norms (the so-called “general clauses”), highlighting, concerning these, the general clause of prohibition of unfair advantage, which is understood as the “key clause of abuse correction in the consumption legal relationships” (Part II, Chapter 4), inasmuch as in its scope of application, set by the legislator (CDC, art. 51, §1º), embraces, due to all things considered, the scope of the other general clauses of abuse correction, such as the law social and economic function, bona fide intentions, good manners and serious harm, tutoring, then, the whole of legitimate interests of the consumers – that is, their interests of property and existential nature – harmed by the abusive practice of suppliers in the consumer market.

Le législateur et le marché vinicole sous la Troisième République / French Legislator and Wine Market under the Third Republic

L’étude de la genèse parlementaire de la législation vinicole française sous la Troisième République est une approche fondamentale afin de comprendre les tenants et les aboutissants de l’ensemble du droit positif vinicole. C’est, en effet, entre les années 1880 et 1930 que l’ensemble du droit que nous connaissons aujourd’hui se met en place. L’analyse de la démarche entreprise par le législateur met alors en avant la volonté de mettre en place une politique d’envergure permettant de protéger une production souffrant, de manière récurrente durant cette période, d’une crise de mévente liée à un marché structurellement déséquilibré. La fraude, tant sur la composition du vin, que sur son origine, macule les relations commerciales entretenues, durant les dernières années du XIXe siècle et les premières du XXe, sur un marché dévoyé par la concurrence déloyale et la perte de repères du consommateur. La surproduction endémique de la viticulture française durant la première moitié du XXe siècle, la concurrence des vins étrangers, ainsi que la restriction des débouchés tant nationaux, qu’internationaux, poussent dès lors le législateur à protéger la viticulture nationale par un ensemble de mesures propres à redéfinir les comportements du commerce et de la production, le tout dans un esprit de promotion de la qualité vinicole et de régulation du marché. Protectionnisme et agrarisme triomphent alors au sein du Parlement et des gouvernements afin de protéger le produit phare de l’économie française de la Troisième République. / The study of the genesis of French law surrounding the wine trade under the Third French Republic is essential to understand the ins and outs of French present wine law. Actually, almost the whole present wine law appears between the eighties of the nineteenth century and the thirties of the twentieth century. The analysis of the French legislator’s approach displays the determination to set up a large-scale policy in order to protect a production enduring, during this period, a structural slump crisis. The fraud on the composition of the wine and on its origin, during the last years of the nineteenth century, characterizes the market of the wine. This one is led astray by unfair competition and the loss of consumer’s landmark. Endemic overproduction of French viticulture during the first part of the twentieth century, competition of foreign wines, and restriction of French and international outlets, push legislator into protecting national viticulture by several measures for redefining behavior of the trade and the production. French legislator tries, at the same time, to push for quality and controlling market. Protectionist and agrarian policy triumph in the French Parliament and government to protect this flagship of the French agricultural production in the Third French Republic.
