L'aveu dans les traditions occidentales accusatoire et inquisitoire : une brève histoire de l'aveu en droit pénal

Cette thèse trace l’évolution de l’aveu dans les traditions pénales accusatoire et inquisitoire dans le cadre d’une démarche historique allant de l’antiquité à nos jours. Elle révèle que l’aveu a toujours constitué le point de tension des enjeux de vérité et de justice de la procédure pénale et explique comment l’aveu, influencé et transformé par la religion, est devenu un moyen de preuve indépendant dans les traditions accusatoire et inquisitoire en tant que récit de vérité permettant certes d’identifier le coupable mais aussi de l’analyser. / This thesis analyses confession in Western legal traditions through a historical approach starting in antiquity. Through the study of English, French and Canadian law, it shows how the suspect’s statements have been apprehend by the accusatorial and inquisitorial systems of criminal justice, revealing that confession has always constituted and still constitutes to this day the cornerstone of truth and justice in criminal procedure. It also explains how confession, influenced and transformed by religion, has become an independent means of proof in both systems as a way to both identify and understand the guilty.

La dernière crise financière et les crises des dettes souveraines successives ont mis en lumière l'enjeu majeur de l’encadrement du marché de la distribution du crédit bancaire. Le principal questionnement aura porté sur la nécessité, sinon l’opportunité, de sacrifier « un peu de liberté » pour un « peu de sécurité » dans le processus de distribution du crédit. À ce titre, deux voies ont fondamentalement cohabité dans la mise en place de limites à la une liberté totale. D’une part, les législateurs et organes réglementaires ont entrepris, du niveau interne au niveau international, en passant par l’incontournable niveau communautaire, d’encadrer les caractéristiques intrinsèques des acteurs du marché du crédit et leur environnement juridique. Cet encadrement a été impulsé par des instances internationales, plus promptes à réagir en cas de crise, mais a été progressivement adapté et intégré dans le droit positif. Cette intégration a justement eu pour effet premier de lui conférer un caractère normatif. Ainsi les dispositions normatives, légales ou réglementaires sont devenues un instrument majeur afin de cantonner les risques individuels et de prévenir le risque systémique. À ce titre, la norme, au sens extensif, est intervenue chaque fois qu’un risque était avéré, ou qu’il était soupçonné. L’écueil presque naturel a été une inflation quasi-exponentielle des normes et une juxtaposition des niveaux de normativité. La prise de conscience de cette situation a mené à faire cohabiter le « droit dur », contraignant et rigide, avec un droit plus souple et plus pragmatique. Dès lors, le droit positif a vu apparaître des obligations dites « professionnelles » qui viennent régir non pas la personne des dispensateurs de crédit, mais bien leur comportement lorsqu’ils établissement une relation contractuelle de crédit. Les obligations professionnelles ne visent pas à répondre à la même finalité que la norme au sens propre, elles ont une vocation d’indication, d’information afin d’établir des standards modulables, pragmatiques et flexible pour les contrats de crédit. Le contrat de crédit se complexifie, ce qui impose l’intervention d’un droit flexible, facilement adaptable, et dont la motivation première n’est pas la contrainte ou la sanction, mais l’accompagnement dans la vie du contrat. L’obligation professionnelle est à envisager comme une « norme de comportement ». Ainsi cette étude tente-t-elle de démontrer comment la dualité d’intervention entre norme prudentielle et obligation professionnelle permet sans aucun doute de préserver l’intégrité du marché de la distribution de crédit mais qu’elle risque également dans certaines situations de remettre en cause ses principes de fonctionnement. / The latest financial crisis and successive sovereign debt crises have highlighted the major challenge of framing the market for the distribution of bank credit. The main question was whether or not it would be appropriate to give up on a bit of freedom for more security in the credit distribution process. In this respect, two paths have basically cohabited in the establishment of limits to total freedom. On the one hand, legislators and regulatory bodies have undertaken, from the internal level to the international level, and also the Community level, to frame the intrinsic characteristics of the players in the credit market and their legal environment. This framework has been driven by international bodies, which are quicker to react in the event of a crisis, but has gradually been adapted and integrated into positive law. This integration has had the primary effect of giving it a normative character. Thus, normative, legal or regulatory provisions have become a major instrument to limit individual risks and prevent systemic risk. As such, the standard, in the broad sense of the term, has been applied whenever a risk has been proven or suspected. The almost natural pitfall has been a near-exponential inflation of standards and a juxtaposition of levels of normativity. Awareness of this situation has led to the coexistence of "hard law", which is both binding and rigid, with a more flexible and pragmatic law. As a result, positive law has seen the emergence of so-called "professional" obligations which govern not the person of the credit grantors, but their behaviour when they establish a contractual credit relationship. The almost natural pitfall has been a near-exponential inflation of norms and a juxtaposition of levels of normativity. The awareness of this situation has led to the coexistence of hard law, binding and rigid, with a more flexible and pragmatic law. Therefore, the positive law has seen the appearance of so-called "professional" obligations, which govern not the person of the credit providers, but their behavior when establishing a contractual credit relationship. Professional obligations are not intended to fulfill the same purpose as the norm in the literal sense, they are intended to provide guidance and information in order to establish flexible, pragmatic and flexible standards for credit agreements. The credit agreement is becoming more complex, requiring the intervention of a flexible and easily adaptable right, the primary motivation of which is not coercion or punishment, but support in the life of the contract. Construction et validation d’une échelle de mesure de la coercition sexuelle

Contexte. Au cours des dernières années, l’évaluation de la violence sexuelle a connu un essor croissant. En effet, les milieux de la recherche tentent d’étudier plus largement l’ensemble des violences sexuelles, notamment en s’intéressant à la coercition sexuelle. À ce jour, il subsiste des différences quant à la définition de la notion de coercition sexuelle et une incertitude relative aux instruments de mesure à employer demeure. Objectif. L’objectif du présent mémoire est donc de construire et de mettre à l’épreuve la validé d’une échelle de mesure de la coercition sexuelle en utilisant les items du Multidimensional Inventory of Development, Sex, and Agression (MIDSA). Méthodes. L’échantillon est composé de 529 hommes, ayant commis une infraction à caractère sexuel, incarcérés dans une prison ou encore dans un centre de traitement du Massachusetts ou du Minnesota. Tous les participants ont complété le MIDSA. Le MIDSA propose 20 items mesurant 5 types de tactiques de coercition sexuelle : la manipulation, l’intoxication volontaire, l’action de prendre avantage d’une personne intoxiquée, la menace de l’utilisation de la force physique ainsi que l’utilisation de la force physique. Résultats. Les résultats indiquent que l’échelle de coercition sexuelle à 5 items possède les meilleures propriétés psychométriques. La cohérence interne de l'échelle est bonne. De plus, les analyses de théorie de réponse à l’item indiquent que la majorité des items étaient considérés comme difficiles et que tous les items possèdent un bon pouvoir discriminant. Enfin, l’échelle présente des corrélations de modérées à élevées avec la majorité des échelles associées, indiquant ainsi une bonne validité convergente et concurrente. / Background. In recent years, the assessment of sexual violence has grown steadily. In fact, the research community has been trying to examine broader forms of sexual perpetration and victimization, especially sexual coercion. There is no consistent definition in the literature for sexual coercion and uncertainty remains regarding the measuring instruments. Objective. The study aims to create a scale of sexual coercion using items from the Multidimensional Inventory of Development, Sex, and Aggression (MIDSA) and assess its validity. Methods. The sample included 529 adult males who committed a sexual offense. They completed the MIDSA while incarcerated in prisons and special commitment facilities in Massachusetts and Minnesota at the time of assessment. The MIDSA proposes a 20 item pool measuring sexual coercion based on 5 types of tactics to coerce someone into sexual activity: manipulation and bribing, offering drinks or drugs, taking advantage of someone already intoxicated by drugs or alcohol, using threats of physical force, and the use of physical force. Results. Findings from this study revealed that a 5-item version of the sexual coercion scale has the best psychometric properties. The internal consistency of the scale is good. Furthermore, the item response theory analysis shows that most items were considered difficult and serious and that all items present a good discriminant power. Finally, the sexual coercion scale presents moderate-high correlations with almost all associated scales, indicating good convergent and concurrent validity.

In an attempt to address the issues in research and theory on consent, this thesis explores what consent can be seen as "doing" through an 'Intuitive Inquiry' (Anderson 2011a) and 'Agential Realism' (Barad 2007). Various manifestations of consent appears through: the experience of the researcher, consent research and theory, consent legislation, interviews with professionals in intimate-sexual consent, and, feminist fanzines. Consent evokes issues around agency, power, communication, respect, violence, risk, morals and ethics that go beyond sexual-intimate negotiation. Consent emerges as multiple, complex and fluid in 'intra-action' (ibid.) with the context. Entanglements and paradoxes of consent are further explored in 'diffractive analysis' (ibid.) through "bodily autonomy" and"rights/obligations". As a phenomenon, consent appears to make agency and power intelligible (to different degrees), but, can not be said to provide a viable strategy against sexual violence. The tenets of consent discourse risk (re)producing anxieties around intimacy and sex, responsibilizing survivors and obfuscating sexual violence. Further and improved research on communication in everyday sexual negotiation, sexual violence, consent legislation and what consent "does" is urgently needed.Through creative method and new epistemology the thesis (re)presents a knowledge process true to lived experience, as well as, an invitation to pull the terrible wonderful world, it's complexities, and us in it, closer. / I ett försök att ta itu med problem inom forskning och teori om 'consent' undersöker denna avhandling vad samtycke kan ses som ”göra” genom 'Intuitiv Inquiry' (Anderson 2011a) och'Agential Realism' (Barad 2007). Olika manifestationer av 'consent' framträder genom: forskarens erfarenheter, samtyckes-forskning och teori, samtyckelagstiftning, intervjuer med professionella inom samtycke, och, feministiska fanzines. Samtycke väcker frågor kring agens, makt, kommunikation, respekt, våld, risk, moral och etik som går bortom sexuella-intima förhandlingar. Samtycke framträder som multipelt, komplext och rörligt i 'intra-action' (ibid.) med kontexten. Nello studio si approfondisce il rapporto tra due realtà: l’una giuridica, il consenso matrimoniale, e l’altra appartenente all’ambito del fatto, la condotta pre e para suicidaria. La necessità concreta è stata comprendere in modo univoco l’interazione tra la libertà del consenso – quale dimensione fondamentale affinché questo possa dispiegare effetti giuridici – ed alcune condotte poste in essere da uno dei due nubenti o da terzi, così da valutare come queste possano incidere sulla validità dell’atto. Si sono considerati due capi di nullità – il metus ed il gravis defectus discretionis iudicii – che dottrina e giurisprudenza considerano quelli che coinvolgono la facoltà volitiva, approfondendo nella prima parte il rapporto tra le condotte di fatto e la libertà esterna mentre nella seconda in merito alla libertà interna. Il metodo è stato quello di analisi della giurisprudenza quale fonte che permette sia di interpretare la norma sia di precisarne ed incarnarne le fattispecie. Conclusione è che le condotte pre e para suicidarie non possano inserirsi tra le circostanze che rendono manifesta la nullità del matrimonio in relazione alla libertà del consenso, infatti non è possibile sostenerne il valore presuntivo ma è necessario, volta per volta, confrontarle con gli altri fatti riportati nelle tavole processuali. / The study examines the relationship between two realities: one legal, marriage consent, and the other belonging to the context of the fact, pre and para suicidal conduct. The concrete need was to understand in a univocal way the interaction between the freedom of consent - as a fundamental dimension for this to have legal effects - and some behaviors put in place by one of the two engaged or by third parties, so as to evaluate how these can affect on the validity of the deed. Two heads of nullity have been considered - the Grave fear and the Lake of discretion of judgment - which doctrine and jurisprudence consider those that involve the willful faculty, deepening in the first part the relationship between conduct and external freedom while in the second on the internal freedom. The method was to analyze the jurisprudence as a source that allows both to interpret the law and to specify and embody the cases in point. The conclusion is that the pre- and para-suicidal behaviors cannot be inserted among the circumstances that make the nullity of the marriage manifest in relation to the freedom of consent, in fact it is not possible to support the presumptive value but it is necessary, every time, to compare them with the other facts. reported in the procedural tables.

Adolescent dating relationships : sexual coercion and high risk sexual practices

This study investigated coercive and high risk sexual practices in South African adolescent dating relationships. Quantitative and qualitative information was collected from secondary school learners in a community near Johannesburg. Of 928 learners surveyed, 23.5% of females and 53.7% of males ever had sex. Of these, 57.8% of females and 44.2% of males reported sexual victimisation, and 46.8% of females and 50% of males reported perpetrating sexual coercion in a relationship. Significantly more males engaged in risky sex than females. Among females, sexual coercion was significantly linked to risky sexual behaviour. Among males, alcohol and perpetration of sexual coercion were significantly associated with risky sexual behaviour. Focus group data reveal how dominant constructions of gender normalise male coercion and contribute to risky sexual practices. Recommendations for sexual health initiatives include introducing alternative discourses of female sexual desire and male sexual responsibility as a means for building healthier adolescent dating relationships. / Psychology / M.A. (Psychology)

Divine authority and covenant community in contemporary culture

The question I address is: how might a theology of authority be conceived in the light of questions raised by what is termed 'post-modernity'? Is it possible to articulate a theology of authority coming to the church community 'from God' that avoids an oppressive and alienating heteronomy? The thesis explores the question of authority as of vital importance in the sociological dimension of religion, calling for legitimisation (in light of claims made for itself) and as obligatory in the theological sphere. For this reason the project involves two methodologies (theological and sociological/ethnographic). While this investigation is relevant to all sections of the Christian church, particular attention is paid to Baptist churches in the UK, since they hold a concept in their tradition that I suggest is valuable in answering the question of the thesis, namely that of covenant. Within the Christian tradition there is an inner 'problematic' relating the personal authority of Christ to the forms of institution (church) and text (scripture). I explore this with a brief survey of theological authority as found in the fourfold foundation of scripture, tradition, reason and experience. From this is developed a brief theological and Christological reflection on divine authority and covenant theology as found in Karl Barth and his response to the 'inner problematic'. Within contemporary culture I view authority through the lens of so-called 'postmodernism', identifying four challenges to the notion of 'external authority' (all of which exemplify a move from the external to internal, and objective to subjective approaches to authority). This is further explored by means of qualitative research with one-to-one interviews conducted in a Baptist church in York. This data is reflected upon by means of ethnography and 'judicious narratives', especially in dialogue with material from Guest ('congregational study'), Heelas and Woodhead ('subjectivised-self') and Healy ('theodramatic horizon' and 'practical-prophetic ecclesiology'), providing an intersection between the language of theology and sociology. The concept of church as covenant community is explored in Baptist and (more briefly) Anglican traditions, leading to a constructive proposal that both the inner-church 'problematic' and the 'postmodern' challenge to authority might begin to be resolved with the notion of covenant. It is within this context of relationship, human and divine, that the authoritative and revelatory Word of God, the story that is Christ, is found in community and praxis. Here is a 'triangulating' relationship between authority, story and covenant revealing divine authority in a non-coercive way and relevant to contemporary culture.

By shedding light on accounts from unaccompanied Afghan asylum-seeking minors in Sweden who were child soldiers in Syria, this thesis explores and examines their narratives and their involvement in the civil war in Syria. The research aims to create a deeper understanding of how these children themselves made sense of their participation in the war by answering the following questions: How were the children approached by the recruiters? What kind of reasons for joining the war are put forward by the recruiters and what strategies do the children encounter: a) economic; b) identity formation; c) social deprivation; d) feeling of vulnerability; e) militarization; f) mental development; g) ideology/ religious-sectarian; or all together? How do the children perceive these encounters and make sense of their recruitment to the Shiite Fatemiyoun Brigade? To which extent has the ideology of Shi’ism played an important role for them in joining the Syrian War? This is a qualitative study based on in-depth interviews which combines procedures from two approaches and techniques: an ethnographic approach and a narrative approach that explores the interviewees’ experiences in a period of time and also generates detailed insights. Despite the fact that none of the respondents testified for being recruited at gunpoint or having been ill-treated, the respondents emphasized that they were forced to join due to the bad circumstances they were living in. In addition, many similarities with other cases regarding child soldiering in several countries have been explored in this thesis, for instance factors related to the socio- economic context and the experiences that are related to the children’s development processes. Differences can be located in various details regarding ideologies and indoctrination since the respondents did not share the politico-religious purposes of the recruiters.

New Criminal code came into power in 2003. It changed the concept of indecent assault. The new modern concept of indecent assault is more related to the changes in society, but sometimes is difficult to apply, because of its novelty and indetermination. Therefore it is necessary to determine the legal concept of indecent assault in order to avoid controversial evaluation of sexual offences and their elements of proof. So the aim of this study is to analyse indecent assault from historical point of view, to describe forms of indecent assault and aggravating circumstances. The proposed review of indecent assault contains legal evaluation of all attributions according to their legal evaluation in Lithuanian and foreign criminal law. Theoretical evaluation of indecent assault is linked to the examples of court’s practise by underlining controversial aspects of concept of indecent assault and proposing possible ways to define them.
