En région montagneuse, les infrastructures et les voies de communications sont soumises à de nombreux risques naturels dont les phénomènes d’origine gravitaire. Au-delà du danger pour les usagers, les conséquences des interruptions du trafic deviennent problématiques d’un point de vue économique et il devient indispensable de sécuriser les itinéraires. La mise en place d’écrans de filets pare-pierres est une des solutions possibles pour la protection contre les éboulements rocheux. Cette thèse porte sur l’étude des écrans souples ou filets métalliques de protection contre les chutes de blocs et plus précisément sur l’écran développé par l’entreprise GTS. Le filet constitutif de ces écrans se différencie par rapport aux systèmes conventionnels par un comportement orthotrope, dû à un maillage spécifique. Dans cette étude nous caractérisons le comportement de ces écrans de filets sous des chargements statiques et dynamiques de type impact par une approche couplant l’expérimentation et la modélisation numérique. L’étude procède pas à pas, les divers constituants sont évalués de façon quasi-statique, en laboratoire, et également in-situ pour reproduire les conditions réelles d’utilisation, en particulier l’aspect dynamique. Une attention particulière concernant les dissipateurs d’énergie, qui représentent l’élément centrale de ce type de structure, nous a permis de mettre au point un élément fusible robuste et fiable. Une campagne d’essais en grandeur réel sur les écrans de filets étudiés a permis de valider deux classes énergétiques (3000 kJ et 5000 kJ) selon les recommandations européennes. Les données recueillis lors des expérimentations ont permis de calibrer et valider différentes modélisations numériques de type éléments finis et éléments discrets. La pertinence de la modélisation a été évaluée au niveau des différentes échelles étudiées, échelle d’une maille, échelle d’une nappe, échelle du dissipateur d’énergie et échelle de la structure entière. Les performances et les limites des deux approches, MEF (méthode des éléments finis) et MED (méthodes des éléments discrets) ont été évaluées pour ce qui est de nos modélisations. / In mountainous areas, infrastructures, roads and railways are subject to various natural hazards due to the gravitational phenomena. Beyond the danger to users, the consequences of traffic interruptions becomes, from an economic point of view, more and more problematic and it becomes essential to secure these itineraries. An existing method to protect against the rockfall is to set up rockfall barriers made by metallic nets. This thesis focuses on the study of the rockfall protection barriers made by metallic net developed by the company GTS. The net of these barriers is different compared to conventional systems by an orthotropic behavior, due to a special form of the mesh. In this study we characterize the behavior of these barriers under static and dynamic loading (impact) by an approach combining the experimentation and the numerical modeling. The study proceeds step by step, the components are evaluated in quasi-static, in laboratory, and also in-situ to simulate the real conditions of use, especially the dynamic aspect. A special attention concerning the energy dissipators, which represent the principal element of this structure, has enabled us to develop a robust and reliable fuse element. A campaign of full-scale tests on the studied rockfall barriers allows the validation of two energy classes (3000 kJ and 5000 kJ) according to the European recommendations. The data collected during experiments permits to develop various numerical models of finite elements and discrete elements. The relevance of the modelisation was evaluated at the different studied scales, the mesh scale, the net scale, the energy dissipators scale and the scale of the entire structure.

Appelés à s’appliquer concurremment pour traiter les difficultés d’une société, il est classiquement considéré que les relations entre le droit des sociétés et le droit des entreprises en difficulté se résument à des conflits pouvant être résolus en faisant prévaloir le « droit spécial » des procédures collectives sur le « droit commun » des sociétés. Cette analyse a perdu de sa pertinence en raison de la mutation du droit des faillites en droit des entreprises en difficulté dont la finalité, le contenu, et le domaine d’application ont profondément changé, ainsi qu’en raison de la contractualisation des deux matières. Ces évolutions ont induit une appréhension nouvelle de celles-ci. Sont en effet recherchées, tant par les sociétés en difficulté que par leurs créanciers, les potentialités de l’association du droit des sociétés et du droit des entreprises en difficulté pour organiser le rebond d’une société défaillante. Leurs relations en droit positif s’avèrent ainsi plus subtiles et plus complexes. Une synergie existe entre elles lors du règlement à l’amiable des difficultés, tandis qu’une véritable soumission du droit des sociétés au droit des entreprises en difficulté peut être constatée lors du règlement judiciaire des difficultés. Malgré des origines distinctes, des finalités propres, et des fonctions radicalement opposées, une logique anime les relations des deux matières révélant un corpus légal et jurisprudentiel utilisé pour le règlement des difficultés qui témoigne de l’existence d’un droit des sociétés en difficulté. / It is commonly understood that, when considering ailing companies, the conflicts that arise between concurrently applicable corporate law and insolvency law can be solved with “special law” that prevails over “ordinary law”. This understanding has lost some relevance through the transformation of “bankruptcy law” into “distressed business law”. The trend towards the use of explicit contracts in these fields is bringing about a change in their finality, content and scope. This evolution of corporate law and insolvency law is creating new apprehension on the part of both the distressed company and the creditors, with the result that both parties are looking for means to combine these subjects when organising the recovery of an ailing firm. Their coexistence in substantive law turns out to be even more subtle and complex. In the case of an amicable settlement of a dispute, a synergy exists between corporate law and insolvency law whereas when a settlement is imposed under court supervision, the prevalence of insolvency law over corporate law is notable. Despite distinct origins, differing finality and radically opposing functions, a common logic motivates the relation between corporate law and insolvency law revealing a legal corpus and case law as a testament to the existence of an “ailing company law”.

The Church of Jesus Christ of Latter-day Saints and its membership felt a substantial impact from the effects of World War I. Although other authors have attempted to bring forward the events of these hostilities, they are few in number and the research in this area is small. Additionally, few have focused on the effects of the war on the Church. In order to increase the understanding of this influence, this work examines how the First World War affected the lives of Latter-day Saints both during and after the conflict. The entire world felt the effects of the world war and the Latter-day Saints were not exempt. Yet during this war, the LDS soldiers had an opportunity to change the way that others viewed the Church. Whether during times of training or on the battlefield, the valiant actions of these men often caused other soldiers to rethink the way they felt about the Saints. One incorrect stereotype that these men helped to remove was that the Latter-day Saints had no feelings of national loyalty. Soldiers of other faiths could not continue to hold such misconceptions after having spent time working with LDS servicemen. In addition to attitude-changing influences, Church President Joseph F. Smith was particularly conscious of the effects this conflict would have on the Church. The war would disrupt missionary work as its violence closed certain areas and missionary age young men were called on to bolster the armed forces. President Smith also feared the cost of the war in lives, which deaths increased with the outbreak of the influenza epidemic. In addition to these misgivings, the president of the Church worried about the possibility that Latter-day Saints of opposing countries would have to fight one another. it would have on missionary work, the cost in lives, and the possibility of LDS servicemen having to fight against other Saints. The influence of the war was not only felt by the soldiers. Those who remained at home learned to live thriftily and to give generously to the war effort. In addition to the general ways in which the war influenced the Church, individual soldiers also had a chance to help the Church. During this war the Church appointed for the first time multiple chaplains: Brigham H. Roberts, Calvin S. Smith, and Herbert B. Maw. These three men had opportunities to work with individual soldiers and influence them for good. Veterans from this war returned home and served in positions of leadership. Some continued military service, while others sought political positions and yet others were called to serve in general leadership positions. So, in both broad and specific ways, World War I changed the lives of Latter-day Saints.

THE CRIMINALISATION OF NGO-LED SAR OPERATIONS : A Contributing Factor Towards Crimes Against Humanity Against Migrants in LibyaKaur, Maanpreet January 2023 (has links)
In the perilous waters of the Mediterranean Sea, migrants find themselves facing limited choices when in distress. Their options are stark: either to rely on the lifesaving efforts of Non- Governmental Organisations (NGO) aid workers conducting Search and Rescue (SAR) Operations, to be intercepted by the Libyan Coast Guard (LCG) and subsequently detained in Libya where their human rights are gravely violated, or to face the tragic fate of perishing at sea. Unfortunately, the criminalisation of SAR Operations, spearheaded by NGO aid workers, hinders the rescue of migrants, thereby exacerbating the risks they face and leaving them vulnerable to interception by the LCG. This interception, as argued in this thesis, inevitably leads to the perpetration of Crimes Against Humanity (CAH) against these vulnerable migrants. This thesis sheds light on the issue of Italy’s increasing criminalisation and vilification of humanitarian aid workers engaged in SAR missions in the Mediterranean Sea. It critically examines the consequences of such criminalisation on the lives and rights of migrants, exploring the complex dynamics between SAR Operations, interception by the LCG, and the commission of CAH. Drawing upon a comprehensive lens of interpretation that integrates legal analysis, human rights principles, and the international legal framework, this study concludes that criminalisation of SAR operations is indeed a contributing factor towards the CAH faced by migrants in Libya. Moreover, it identifies the potential liability of Italian State Officials (ISO) at the International Criminal Court (ICC) for their role in enacting legislations that effectively criminalises SAR operations.

<p>This dissertation examines the impact of active shooters upon patrons attending large outdoor events. There has been a spike in shooters targeting densely populated spaces in recent years, to include open-air venues. The 2019 Gilroy Garlic Festival was selected for modeling replication using AnyLogic software to test various experiments designed to reduce casualties in the event of an active shooter situation. Through achievement of validation to produce identical outcomes of the real-world Gilroy Garlic Festival shooting, the researcher established a reliable foundational model for experimental purposes. This active shooter research project identifies the need for rapid response efforts to neutralize the shooter(s) as quickly as possible to minimize casualties. Key findings include the importance of armed officers patrolling event grounds to reduce response time, the need for adequate exits during emergency evacuations, incorporation of modern technology to identify the shooter’s location, and applicability of a 1:548 police to patron ratio.</p>

environment. This may negatively affect their wellbeing. Owing to the high crime rate
in South Africa, one of the continuous stressors security personnel experience might
be fearing for their lives. If security personnel fail to use effective coping strategies
they will remain stressed, and this may have a negative impact on them, and their
organisation or community. Challenges such as work stress in the South African
security industry have not been comprehensively researched or documented
(Sibanyoni, 2014). Consequently, no South African questionnaire measuring coping
with stress or a stress management model for dealing with stress in a security
environment, could be found.
Research purpose: The general aim of the research was to develop a valid and
reliable coping questionnaire and stress management model for high stress security
occupations.
Research methodology: A questionnaire development process, as suggested by
scientific literature, was followed. The process entailed (1) determining coping
strategies by means of a literature review, (2) developing the coping questionnaire, (3)
administering the questionnaire to the target population, and (4) statistical analysis.
The stress management model was developed by combining the results of the
confirmatory factor analysis (CFA) and canonical correlation analysis (CCA). The development of the questionnaire was based on a sample of 381 active duty security
personnel working in a high stress security environment in South Africa.
Main findings: The study resulted in the development of a psychometrically sound
39-item questionnaire. The following 12 empirically validated healthy and unhealthy
coping strategies were identified: (1) social support, (2) group cohesion, (3) physical
exercise, (4) relaxation, (5) social media addiction, (6) healthy sleeping habits, (7)
healthy diet, (8) training, (9) humour, (10) religion, (11) avoidance, and (12) denial.
CFA confirmed both the construct and content validity, and composite reliability. The
questionnaire was found to be invariant, and could thus be applied to different groups
in high stress security occupations. A stress management model indicating the
interrelationship between personality and coping was also developed.
Contribution/value-add: The main contribution of this study was the development of
a valid coping questionnaire and stress management model. By identifying the
specific coping strategies, targeted stress management interventions could be
developed. This could contribute to the overall wellness of security personnel working
in high stress occupations, resulting in a healthy organisation and sound relationships
with the community. Security organisations could also use the model during
assessments to identify candidates with personality traits that would lead to healthier
coping strategies, thereby selecting personnel that could better adapt to a security

sekuriteitsberoepe ’n geldige en betroubare streshanteringsvraelys en
stresbestuursmodel te ontwikkel.
Navorsingsmetodologie: ’n Vraelys ontwikkelingsproses, soos deur wetenskaplike
literatuur voorgestel, is gevolg. Die proses het die volgende behels: (1) die vasstel
van die streshantering strategieë deur middel van ’n literatuuroorsig, (2) die
ontwikkeling van die streshanteringsvraelys, (3) administrasie van die vraelys aan die
teiken populasie en (4) statistiese analise. Die stresbestuursmodel is ontwikkel deur die resultate van die bevestigende faktoranalise (BFA) en die kanoniese korrelasie
analise te kombineer. Die ontwikkeling van die vraelys is gebaseer op ’n steekproef
van 381 aktiewe diens sekuriteitspersoneel wat in Suid-Afrika in ’n stresvolle
sekuriteitsomgewing werk.
Hoofbevindinge: Die studie het tot ’n psigometries betroubare 39-item vraelys gelei.

A plm implementation for aerospace systems engineering-conceptual rotorcraft designHart, Peter Bartholomew 08 April 2009 (has links)
The thesis will discuss the Systems Engineering phase of an original Conceptual Design Engineering Methodology for Aerospace Engineering-Vehicle Synthesis. This iterative phase is shown to benefit from digitization of Integrated Product&Process Design (IPPD) activities, through the application of Product Lifecycle Management (PLM) technologies. Requirements analysis through the use of Quality Function Deployment (QFD) and 7 MaP tools is explored as an illustration. A "Requirements Data Manager" (RDM) is used to show the ability to reduce the time and cost to design for both new and legacy/derivative designs. Here the COTS tool Teamcenter Systems Engineering (TCSE) is used as the RDM. The utility of the new methodology is explored through consideration of a legacy RFP based vehicle design proposal and associated aerospace engineering. The 2001 American Helicopter Society (AHS) 18th Student Design Competition RFP is considered as a starting point for the Systems Engineering phase. A Conceptual Design Engineering activity was conducted in 2000/2001 by Graduate students (including the author) in Rotorcraft Engineering at the Daniel Guggenheim School of Aerospace Engineering at the Georgia Institute of Technology, Atlanta GA. This resulted in the "Kingfisher" vehicle design, an advanced search and rescue rotorcraft capable of performing the "Perfect Storm" mission, from the movie of the same name. The associated requirements, architectures, and work breakdown structure data sets for the Kingfisher are used to relate the capabilities of the proposed Integrated Digital Environment (IDE). The IDE is discussed as a repository for legacy knowledge capture, management, and design template creation. A primary thesis theme is to promote the automation of the up-front conceptual definition of complex systems, specifically aerospace vehicles, while anticipating downstream preliminary and full spectrum lifecycle design activities. The thesis forms a basis for additional discussions of PLM tool integration across the engineering, manufacturing, MRO and EOL lifecycle phases to support business management processes.

This dissertation is a quantitative study with elements of qualitative analysis. The purpose of this quantitative study was to investigate WHAT was written about Ukraine's independence 1917 in Swedish press 1917–1918. The qualitative part of the survey was intended to answer the question if the newspaper's political attitude influenced the news reports during the chosen period. The exact periodization was determined to be between March 1, 1917 and June 30, 1918. This periodization was chosen because of the March Revolution in 1917, which triggered independence declarations in a number of countries oppressed by Moscow, who now saw their chance of freedom. June 1918 became the end of the investigation because it was just when the peace agreement between Ukraine and the Soviet Union was signed. The source material has been chosen to represent a multitude of ideological orientations. It was liberal, moderate, conservative, liberal and left-wing orientations. The source material consisted of newspaper articles from the following newspapers: Dagens Nyheter, Aftonbladet, Göteborgs Aftonblad, Svenska Dagbladet, Dalpilen, Kalmar Tidning and Norrskensflamman. Quantitative methodology was used on the source material. This method consisted of a reviewing of newspaper articles in searching of news reports from Ukraine or articles which had something to do with the events in Ukraine. Every newspaper was searched day after day. The crawled material was presented in two chapters representing different periods. The first chapter of the results presented the results from 1917, and more precisely from March to December 1917. The second chapter presented the results from 1918, but also from December 1917, that is, the result from December 1917 through June 1918. The whole result was then discussed in a separate chapter where the qualitative analysis was also discussed. The result of the quantitative analysis showed that it has been written relatively sparcely about Ukraine's independence although the volume of articles increased from December 1917 and even more in 1918. Sometimes there were articles on the first page. But for the most part, the articles with Ukraine issues were placed among other foreign articles. It was also found in the survey that it was the first World War that drew attention to the newspapers, even though the events in Petrograd and then in Ukraine took more space. This survey also showed that what was written about Ukraine's independence was also what appears in the reference literature. The news reports reported how Ukraine proclaimed independence in March 1917 and later on proclaimed an independent republic in November 1917 when the Bolsheviks conducted their coup d'état in Petrograd. The newspapers also wrote how the Russian Communists sent a declaration of war to Ukraine in December 1917 and about the war that followed. The articles also tell us how negotiations on Ukraine Peace went on in Brest-Litovsk, and how they ended up with alliance between Germany and Ukraine with the campaign against the communists. It was told how the German army marched into Ukraine to free it from the bolsheviks. Until May 1918 there were battles between the German-Ukrainian Army and the Communists. In June 1918 the peace agreement was signed and this survey’s investigation ended. The survey showed that it was written about Ukraine's independence in all newspapers. Dagens Nyheter had the most news articles linked to the survey. Although the number of articles was not subject for analysis in this survey. The qualitative analysis was based on using Höjelid's theoretical concepts "positive sound" and "negative sound" on the quantitative analysis material. The qualitative analysis’ result showed that it was almost impossible to see the differences between the newspapers because the articles were traded between the newspapers, i.e. the content was copied straight away. It should be noted that not all content was the subject of copying between the newspapers. Copying occurred to a greater extent, but there were still original articles derived from the respective newspaper. Most of the articles were also direct telegrams that were communicated abroad to the newspaper's editors. A lot of these telegrammic articles were sent with a purpose to mislead society. These angled articles were published without further examination in Swedish press. There were articles from, for example, Dagens Nyheter whose editors noted the "strange Petrograd reports" and informed about it for the purpose of enlightening the public. However, as most newspapers were occupied with World War I, as was shown in the source material, the newspaper editorial office was less interested in other foreign events. Therefore, such angled articles could be found in Swedish press on a larger scale. / Denna avhandling är en kvantitativ studie med inslag av kvalitativ analys. Syftet med denna kvantitativa studien var att undersöka VAD som skrevs om Ukrajinas självständighet 1917 i svensk press 1917–1918. Den kvalitativa delen av undersökningen ämnade att besvara frågan om tidningens politiska hållningen påverkade nyhetsrapporteringen under den valda perioden. Den exakta periodiseringen fastställdes att vara mellan den 1 mars 1917 och den 30 juni 1918. Denna periodisering valdes på grund av marsrevolutionen 1917 som utlöste självständighets-förklaringar i en rad länder som var förtryckta av Moskovitien och som nu såg sin chans till frihet. Juni 1918 blev slutpunkten i undersökningen därför att det var just då som fredsavtalet mellan Ukrajina och Sovjet undertecknades. Källmaterialet har valts att representera en mångfald ideologiska inriktningar. Det var liberal, moderat, konservativ, frisinnad samt vänstersocial inriktningar. Källmaterialet bestod av tidningsartiklar från följande tidningar: Dagens Nyheter, Aftonbladet, Göteborgs Aftonblad, Svenska Dagbladet, Dalpilen, Kalmar tidning och Norrskensflamman. Det användes kvantitativ metod på källmaterialet som bestod i en genomsökning av tidningsartiklarna efter nyhetsrapporter från Ukrajina eller som hade något med händelserna i Ukrajina att göra. Varje tidning genomsöktes dag för dag. Det genomsökta materialet presenterades i två kapitel som representerade olika perioder. Det första resultatkapitlet presenterade resultatet från år 1917, och mer exakt från mars till december 1917. Det andra kapitlet presenterade resultatet från år 1918, men även från december 1917, det vill säga resultatet från och med december 1917 till och med juni 1918. Det hela resultatet diskuterades sedan i ett eget kapitel där även den kvalitativa analysen diskuterades. Resultatet från den kvantitativa analysen visade att det har skrivits relativt sparsmakat om Ukrajinas självständighet även om artikelmängden ökade från december 1917 och ännu mer under 1918. Ibland förekom det artiklar på första sidan. Men för det mesta placerades artiklarna med Ukrajina-frågor bland andra utlandsartiklar. Det framgick också i undersökningen att det var mest första världskriget som upptog tidningarnas uppmärksamhet, även om händelserna i Petrograd och sedan i Ukrajina tog allt mer plats allt eftersom. Denna undersökning visade också att det som skrevs om Ukrajinas självständighet var också det som förekommer i referenslitteraturen. Nyhetsrapporterna berättade hur Ukrajina utropat sin självständighet i mars 1917 tills landet proklamerat en oberoende republik i november 1917 när bolsjevikerna genomförde sin statskupp i Petrograd. Tidningarna skrev också hur de ryska kommunisterna skickade krigsförklaring till Ukrajina i december 1917 och om det kriget som följde efter det. Artiklarna berättar även om hur förhandlingarna för Ukrajinafreden gick till i Brest-Litovsk samt hur dessa avslutades med att Tyskland allierade sig med Ukrajina i kampen mot kommunisterna. Det berättades hur den tyska armén marscherade in i Ukrajina för att befria det från bolsjevikerna. Fram till maj 1918 pågick det strider mellan tysk-ukrajinska armén och kommunisterna. I juni 1918 undertecknades fredsavtalet och där slutade undersökningen. Undersökningen visade att det skrevs om Ukrajinas självständighet i samtliga tidningar. Dagens Nyheter hade flest nyhetsartiklar kopplade till undersökningen. Även om antalet artiklar ej var i syfte att analysera i denna undersökning. Den kvalitativa analysen gick ut på att använda Höjelids teoretiska begrepp ”positiv klang” och ”negativ klang” på den kvantitativa analysens resultatmaterial. Det kvalitativa resultatet visade att det var nästintill omöjligt att se skillnad mellan de olika tidningarna eftersom artiklarna traderades mellan tidningarna, det vill säga innehållet kopierades rakt av. Det bör påpekas att inte allt innehåll var ämne för kopiering mellan tidningarna. Kopieringen förekom i större utsträckning men det fanns ändå originella artiklar som härstammade från respektive tidning. De flesta av artiklarna var dessutom direkta telegram som kommunicerades i utlandet till tidningens redaktioner. En hel del av dessa telegraferade artiklar skickades med ett givet syfte att vilseleda samhällsopinionen. Dessa vinklade artiklar publicerades utan vidare granskning i svensk press. Det förekom artiklar från exempelvis Dagens Nyheter vars redaktion uppmärksammat de ”märkliga Petrogradrapporter” och informerat om det i möjligt syfte att upplysa allmänheten. Men eftersom de flesta tidningarna var upptagna med första världskriget, som det visades i källmaterialet, var tidningsredaktionerna mindre intresserade av andra utländska händelser. Därför kunde sådana vinklade artiklar förekomma i svensk press i en större omfattning.
