Rättvis omställning av fossilintensiva industrier : En kvalitativ studie av aktörers åsikter i debatten om Cementa och Preemraff / Just transition of fossil-intensive industries : A qualitative study of actors' views on the debate concerning Cementa and Preemraff

Industrisektorn står inför omfattande omställningsutmaningar i samband med dess höga klimat- och miljöpåverkan. Trots att en omställning av fossilintensiva industrier är högst nödvändig är samhället fortfarande beroende av dem på flera sätt eftersom de bidrar till viktiga samhällsfunktioner, arbetstillfällen och produkter. Omställningar är ofta omtvistade, där framför allt klimat- och miljöfördelar ställs mot ekonomiska och sociala nackdelar. Detta har skapat en debatt om hur omställningsarbetet ska genomföras på ett rättvist sätt. Rättvis omställning är ett koncept som ska minimera de negativa effekterna som omställningar kan resultera i och samtidigt maximera de positiva effekterna. Både EU och Sverige har politiska ambitioner för att underlätta genomförandet av en rättvis omställning, exempelvis genom den gröna given, fonden för rättvis omställning och nationella styrmedel. Syftet med denna studie är att utforska hur rättvis omställning speglas i debatten kring omställningen av svensk industri. Mer specifikt kommer åsikter om de två fossilintensiva industrierna Cementa och Preemraff att undersökas genom att analysera delar av mediedebatten. För att undersöka aktörernas åsikter har kvalitativa innehållsanalyser och intervjuer genomförts. Studien visar att motståndarna till industrierna framför allt lyfter argument om den negativa klimat- och miljöpåverkan som industrierna har, medan förespråkarna främst lyfter argument kopplat till negativa ekonomiska och samhällsmässiga effekter som en omställning kan innebära. Även om åsikterna går isär kring hur omställningen av fossilintensiva industrier ska genomföras på ett rättvis sätt belyser vår studie vikten av att beakta olika perspektiv i omställningar. / Deep decarbonization of fossil-intensive industries will be necessary to keep global warming well below 2°C. However, industries play an important role considering their contribution to jobs, local society, and necessary materials. Industries multifaceted advantages and disadvantages often result in infected debates considering how a just transition should be implemented. Just transition is a concept where the negative impacts a transition could result in should be minimized and simultaneously maximize the positive effects. There are political ambitions in both the EU and Sweden to facilitate a just transition, for example through the European Green Deal, the fund for a just transition and national policy instruments. The aim of this study is to explore how a just transition is framed in parts of the media debate concerning transitions of Swedish fossil-intensive industries. More specifically the study investigates the opinions about the two fossil-intensive industries, Cementa and Preemraff. This has been made possible to investigate through qualitative content analysis and interviews. The analysis shows that opponents to the industries mainly highlight the negative climate and environmental impacts while the advocates mostly highlight social and economic concerns. Even though the opinions about how a just transition of industries should be made differs, our study illustrates the importance of implementing justice in the transition process of fossil-intensive industries.

Rättvis omställning : En narrativ studie om Norrlands industriomvandling / Just Transition : A narrative study focusing on the Industrial Transformation in Norrland

För att stödja regioner och industrier att minska växthusgasutsläppen och nå Europeiska unionens mål om klimatneutralitet till år 2050 har EU tagit fram färdplanen “Den gröna given” och fonden för en rättvis omställning (FRO). FRO syftar till att minska negativa socioekonomiska konsekvenser som följer av omställningen mot mindre kolintensiva processer i sårbara regioner och industrier. Två av fyra utpekade svenska regioner är Västerbotten och Norrbotten samt deras metall- respektive stålindustri. Studiens syfte är att med en narrativ analys av Västerbottens och Norrbottens territoriella omställningsplaner och semistrukturerade intervjuer undersöka hur tre policynivåer (nationell, regional och kommunal) uttrycker tolkningar av rättvis omställning. Med hjälp av en abduktiv ansats har tidigare studier fungerat som ett stöd för att identifiera rättviseanspråk (processuell, fördelning, erkännande och återställande) samt berättelser i studiens empiriska material. Studiens narrativa analys har belyst vilka aktörer det är som förväntas genomföra arbetet av omställningen och vilket utfall av vinster och förluster som kan följa. Dessutom tyder studiens berättelser att ett gemensamt arbete är viktigt för en rättvis omställning. Likaså framkommer det att den nationella politiska berättelsen präglar hur den regionala och kommunala berättelsen formas, samt vilka rättviseanspråk som dominerar. Studiens slutsatser är bland annat att återställande-rättvisa dominerar i den nationella berättelsen och att ett fokus finns på tekniska lösningar. Den regionala berättelsen använder främst processuell-rättvisa och betonar vikten av politiskt ansvarstagande. Den kommunala berättelsen använder också processuell-rättvisa men även fördelnings-rättvisa genom att uttrycka att medborgare också bör inkluderas i en rättvis omställning. / To support regions and industries in decreasing their greenhouse gas emissions and reaching the European union's goal regarding climate neutrality by 2050, the EU has presented a set of proposals named “The Green Deal” as well as the Just Transition Fund (JTF). JTF aims to limit the negative socioeconomic consequences that a transition towards less carbon intensive processes in vulnerable regions and industries could result in. Two of the four designated Swedish regions are Västerbotten and Norrbotten and their metal- and iron-industry. The study aims to, with a narrative analysis of Västerbotten’s, and Norrbotten’s Territorial Plans and semi-structured interviews, investigate how three policy levels (national, regional and local) express interpretations of Just Transition. With an abductive approach, previous studies have worked as a support in identifying justice claims (procedural, distributional, recognition, restorative) and stories within the empirical material. The study's narrative analysis has elucidated which parties that are expected to contribute to the transition and what wins and losses that the transition could result in. Furthermore, the studies stories highlight that working together is important in reaching a Just Transition. It also becomes clear that the national political story influences the regional and local policy stories, as well as which justice claims that are dominating. The study’s conclusions are, for example, that the spatial and temporal aspects of the story deepen the understanding of justice, and that recognitional justice is the least used justice claim in the study's policy stories.

Die Dissertation beleuchtet die dringende Notwendigkeit, Maßnahmen zu ergreifen, um den Druck auf die Ressourcen der Erde zu mindern und nachhaltige Bedingungen für gegenwärtige und künftige Generationen zu schaffen. Zwei zentrale Strategien werden diskutiert: Die Dekarbonisierung von Energiesystemen und die Reduktion der Emissionen von Haushalten. Diese Strategien sind eng mit Fragen von Gerechtigkeit verbunden, sowohl im Zusammenhang mit einer gerechten Energiewende als auch in der Emissionsminderung von Haushalten. Die Dissertation besteht aus vier Artikeln, die diese Themen vertiefen. Die erste untersucht den Kohleausstieg in europäischen Regionen und die Wahrnehmung der Energiewende durch die davon betroffenen Menschen. Die nächsten beiden untersuchen die Emissionsreduktion auf Haushaltsebene, wobei die sozialen Realitäten der Emittenten analysiert werden, um Reduktionspotenziale zu identifizieren. Die vierte Publikation bietet einen historischen Überblick über Energiekonsummuster und zeigt vergangene und bestehenden Ungleichheiten auf. Die Ergebnisse zeigen, dass die Klimakrise nur unter Berücksichtigung von Ungleichheiten und Ungerechtigkeiten verstanden und angegangen werden kann. Lösungen müssen darauf abzielen, weitere Ungerechtigkeiten zu vermeiden. Die Ergebnisse der Dissertation bieten unter anderem wertvolle Erkenntnisse für Entscheidungsträger auf verschiedenen Ebenen, um eine gerechte Transformation zu klimaneutralen Gesellschaften voranzutreiben. Es wird jedoch betont, dass weitere Forschung in diesen Bereichen, einschließlich anderer fossiler Energieträger und betroffener Regionen, sowie unterschiedlicher Lebensstile, entscheidend ist, um effektive Instrumente zur Unterstützung nachhaltiger Praktiken zu entwickeln. / The dissertation underscores the urgent need to address the strain human activities place on the Earth system, emphasizing the necessity for sustainable solutions to ensure the well-being of current and future generations. Mitigating the impacts of the climate crisis requires significant reductions in greenhouse gas emissions, prompting a closer examination of their sources and contributors. Two primary strategies are proposed: decarbonizing energy systems and reducing household emissions. However, discussions surrounding these strategies often intersect with considerations of justice, highlighting the complex social dimensions of addressing climate change. The dissertation comprises four papers that delve into these issues. The first explores the transition away from coal in European regions, assessing perceptions of justice among affected actors. The subsequent publications focus on emissions reduction at the household level, analyzing social realities and identifying potential avenues for mitigation. The final publication provides a historical perspective on energy consumption patterns, emphasizing past and contemporary societal inequalities. Findings indicate disparities in emissions across households and individuals, necessitating urgent action to reduce per capita emissions. Moreover, sociological frameworks are employed to better understand the ecological dimensions of emissions, revealing complex relationships between social classes and environmental impact. While efforts to combat the climate crisis must prioritize justice and equity, the dissertation also underscores the need for further research. This includes examining alternative energy sources, regions disproportionately affected by climate change, as well as diverse lifestyles. Such research will be essential for developing effective strategies to support sustainable practices and address the complex social dynamics of climate action.

Kulturvärden och målkonflikter i Renoveringsvågen : Exemplet GotlandsHem

Syftet med denna undersökning var att belysa tre aktörsperspektiv på den kommande renoveringsvågen av GotlandsHems byggnadsbestånd: fastighetsägar-, kulturvård- och brukarperspektivet. Utifrån dessa perspektiv ville undersökningen identifiera målkonflikter samt nyansera och problematisera den rådande diskussionen kring kulturvärden i GotlandsHems bebyggelse från 1930–1975 samt sätta in renoveringsvågen av GotlandsHems bostadsbestånd i en större nationell och internationell kontext. Frågeställningarna inkluderade huruvida kulturvärden tar någon plats i diskussionen kring den kommande renoveringsvågen av GotlandsHems bostadsbestånd och vilka målkonflikter, mellan vilka aspekter, som gick att identifiera. Renoveringsvågen place- rades i en större kontext genom sitt ursprung i EU:s gröna giv och Sveriges nationella strategier. En fallstudie med tre kvalitativa intervjuer och en innehållsanalys genomfördes. Analysen identifierade fem teman: oro för hyreshöjningar, kommunikation, för- delar med energieffektivisering, återbruk och varsam renovering. I diskussionen identifierades fem målkonflikter mellan aspekterna hyresgäster, affärsmål, energieffektivisering och kulturvärden. Slutsatsen var att kulturvärden har diskuterats rikligt med flera olika infallsvinklar av alla aktörsperspektiv i denna undersökning. Diskussionen har däremot inte riktigt fått den plats som GotlandsHem borde ha gett den i förarbetet inför renoveringsvågen. En tidig utredning i renoveringsvågens projekteringsprocess av kulturvärden i GotlandsHems bostadsbestånd kommer göra avvägningar och konflikthantering mellan affärsmål, energieffektivisering, hyresgäster och kulturvärden enklare. / The purpose of this study was to highlight three perspectives on the upcoming renovation wave of GotlandsHem's building stock: the property owner, integrated conservation and user perspectives. The study wanted to identify goal conflicts as well as nuance and problematize the current discussion on cultural values in GotlandsHem's building stock from 1930-1975. From these perspectives it also aimed to place the renovation wave in a broader national and international context. The research questions included whether cultural values are considered in the discussions about GotlandsHem's upcoming renovations and which goal conflicts, between which aspects, that could be identified. The renovation wave was contextualized with a walkthrough of EU's Green Deal and Sweden's national strategies. A case study with three qualitative interviews and a content analysis was carried out. The analysis identified five themes: concerns about rent increases, communication, benefits of energy efficiency, reuse, and careful renovation. The discussion identified five goal conflicts between the aspect’s tenants, business goals, energy efficiency, and cultural values. The conclusion was that cultural values has been discussed abundantly with several different angles from all perspectives in this survey. However, the discussion has not really been given the place that Gotland- sHem should have given it in the preparatory work for the renovation wave. An early investigation in the renovation wave's planning process of cultural values in GotlandsHem's housing stock will make trade-offs and conflict management between business goals, energy efficiency, tenants and cultural values easier.

標準制定組織之智慧財產保護政策及競爭法問題探討 / A Study on Intellectual Property Protection Strategies and Antitrust Issues of Standard-Setting Organizations

「沒有標準化就沒有現代經濟。」在知識經濟時代,掌握制定規則權力者,就占有主宰市場的領導地位。由於絕大多數標準係由政府或私人組織所制定,因此,研究標準制定組織具有重要意義。此外,觀察當代立法趨勢,政府以採訂私人組織或非政府組織所擬定之產業標準的方式,擴增其管制功能,在此潮流下,採訂私人草撰標準成為法律規範一環,此舉一方面可能形成授權立法之漏洞,另一方面將迫使個人暴露於著作權侵權行為之刑事、民事以及行政制裁大帽。同時,政府將產品標準及認證之工作委由產業協會等私人組織承擔亦成主流,該項¬「公益性」作業即可能成為事實標準制定者用來限制競爭、不當逐利的手段。 本文便以上述爭議問題為出發點,討論標準制定組織所擬定之標準,特別是經過政府機關以法律規範形式採用後,是否仍該當著作權的保護客體?並將研究延伸到網路產業中標準著作權保護的適當性問題,以及針對標準這類事實編輯物的資料庫保護進行分析;其次,本文將針對一國之產業標準制定組織為研究重心,探討例如標準制定與認證中的限制競爭及獨占管制的法律問題,以及隱然成為事實標準的市場領導者涉及智慧財產權的拒絕交易紛爭等課題。然而,針對上述命題的前提要件是對標準的概念與應用有相當之瞭解,以導入標準制定組織之運作、不同層級標準制定過程之影響及其所涉及之智慧財產爭議問題研究。因此,本文將對國家標準以及行業標準制定及運用過程所涉及之著作權及競爭法問題作深入且廣泛之瞭解,以此為基礎,分析各層級標準制定體系的規範內涵,繼而詮釋一國保護行業標準之著作權與競爭法之法律規定;並提出建言作為我國標準化體系之發展、參與國際標準制定活動、標準著作權保護分析架構、事實編輯物(資料庫)保護模式、競爭法對標準與認證活動之適用以及切入拒絕交易案件等之參考。 / In a knowledge-based economy, whoever dominates rules-developing overpowers the market. Most of the standards are set by the government and private organizations; therefore, a study on standard-setting organizations is of essential value. The Government leverages its regulatory function by adopting law standards promulgated and copyrighted by non-governmental actors. Despite governmental ambitions, no one is responsible for evaluating the legitimacy of this approach ex ante and no framework exists to facilitate analysis. On the other hand, standard-developing and conformity assessment increasingly falls on the shoulders of industry associations and lead to impartiality concerns from the antitrust law perspective. Regarding standards that are generated and controlled by private actors exposing citizens to criminal, civil and administrative sanctions, this paper contributes an analytical framework and proposes institutional mechanisms to implement it in terms of copyright. This paper extends by questioning if copyright would be an appropriate form to protect standards in the Internet industry. Then, it explores ways to protect compilation of facts and databases once they are de facto standards. Following the antitrust concerns, this paper focuses on industry standard-setting organizations within a specific territory to explore the antitrust and unfair competition problems confronting the role of the de facto standard-setters or the certification performers and the refusal to deal involving intellectual property issues. As foundations, this paper initiates by a detailed study of concepts and applications surrounding standardization; then, it leads to how a standards is produced, how standard-developing organizations in various levels affect the market, and how the intellectual property problems involves in standardization. In conclusion, based upon in-depth coverage of copyright and antitrust predicaments facing applications of national standards and industry standards, this paper interprets how copyright and antitrust laws work to protect business standards. At the same time, it delivers suggestions for the development of our standardization system, involvement of international standard-setting activities, an analytical framework for standards in copyright, protection for compilation of facts and databases, and how antitrust laws works when it comes to non-governmental standard-setting actors.

本文研究之議題,並非有關政治面或其他社會面所稱之杯葛,而是競爭法領域中之杯葛行為,主要為公平交易法第十九條第一款所規範之情形。 本文之研究目的,主要希望能對公平交易法第十九條第一項之構成要件、違法性、法律效果等數項議題,參考他國立法例及學說進行研究,並就實務處理進行分析檢討,以及提出管見之看法及建議。 本論文共分為七章。第一章為「緒論」,分為研究題目之說明、研究動機與目的、研究方法、研究範圍及限制,及研究架構等部分,旨在介紹論文的基本方向與架構。 第二章,則是討論「我國法對於杯葛行為之規範及相關內容」。於第一節中,首先進行杯葛行為之基本介紹,以使讀者瞭解本文所處理之客體為何,並且明瞭規範杯葛行為之目的。第二節之內容,是針對公平交易法第十九條第一款,為一全面性介紹。第三節,是就公平交易法第二十四條之適用可能,為一討論。第四節,則是討論民法部分於杯葛行為之適用可能及適用情形。 第三章,討論「美國法對於杯葛行為之規範及分析」。第一節之概說,乃為後述討論內容作一引言。第二節,是就規範杯葛行為之條文-休曼法第一條、聯邦貿易委員會法第五條,作一相關闡釋。第三節,是就美國判例,參考學者Hylton, Keith N.教授的見解,區分三個不同時期,介紹杯葛行為於實務之不同評價演變。第四節,則對本章之內容作一總結。 第四章介紹「德國法對於杯葛行為之規範及分析」。第一節之概說,乃為後述討論內容作一引言。第二節,是就限制競爭防止法第二十一條第一項(GWB §21Ⅰ)為相關闡述。第三節,是就不正競爭防止法第三條(UWG §3),其適用情形及相關內容進行分析。第四節,是就德國民法有關侵權行為之規定(BGB §823、§826),討論杯葛行為之適用情形。第五節,乃討論杯葛行為與憲法上言論自由保護其間之關係。 第五章乃在探討「杯葛行為於我國法制面及實務操作之爭議問題研究」。於第一節中,處理者乃杯葛行為之體系定位之問題。第二節,進行構成要件之細部問題分析;例如,發話人究否應具有一定市場力量?第三節,針對杯葛行為之違法性,分析是否存在進行杯葛行為之正當理由。第四節,旨在討論杯葛行為之法律效果問題。第五節,核心集中於公平會對於同業公會所發起之杯葛行為,究應以第十四條或第十九條第一款論斷為妥?第六節,主要在處理杯葛與其他概念之區別。第七節,則在處理公平交易法第十九條第一款與其他條文競合之問題。 第六章之內容為「實務重要案例之分析及檢討建議與結論」。此部分本文選擇較具重要性之公平會處分案,整理實務之看法及處理模式,並加以分析及檢討。 第七章則是進行「結論與建議」。本文將彙整前面各章之重點,針對本文關心之相關爭點及問題,提出拙見,以供參考。 / This thesis focus on the topic of boycotts issues in competition law, especially article 19 subparagraph 1 of the Fair Trade Law of Taiwan. There are 7 chapters in this study. In chapter 1, there is an introduction to this research such as the structure of this paper. Chapter 2 discusses the regulations about boycotts in Taiwan, including article 19 subparagraph 1 and article 24 of the Fair Trade Law and article 184 of the Civil Law. Besides, in this chapter there are essential introductions to boycotts, e.g. what purpose the party has. Chapter 3 observes how U.S. treats boycotts. According to the observance of professor Hylton, Keith N., the court used different standers to judge boycotts in various periods. This chapter will focus on what doctrine the court adopted to consider boycotts-rule of reason, or illegal per se? On the other hand, chapter 4 introduces rules of boycotts in Germany. There are several important parts: GWB §21Ⅰ, UWG §3, and BGB §823、§826. Besides, there is a point about the relation of boycotts and freedom of speech. Chapter 5 deals several problems of boycotts in Taiwan practices and Fair Trade Law. Besides the opponents of the articles, this chapter tried to solve problems such as should we consider market power of the party? Further more, there are comparisons about boycotts and other similar concepts or topics. Chapter 6 proceeds analysis about the cases in Taiwan practices, especially decisions of the Fair Trade Commission. In chapter 7 the author offered his opinions about some issues of boycotts.

Unity, Justice and Protection: The Colored Trainmen of America's Struggle to End Jim Crow in the American Railroad Industry [and Elsewhere]

The Colored Trainmen of America (CTA) actively challenged Jim Crow policies on the job and in the public sphere between the 1930s and 1950s. In response to lingering questions concerning the relationship between early black labor activism and civil rights protest, this study goes beyond both local lure and cursory research. This study examines the Colored Trainmen's major contributions to the advancement of African Americans. It also provides context for some of the organization's shortcomings in both realms. On the job the African American railroad workers belonging to the CTA fought valiantly to receive the same opportunities for professional growth and development as whites working in the operating trades of the railroad industry. In the public sphere, these men collectively protested second-class services and accommodations both on and off the clock. Neither their agenda, the scope of their activities, nor their influence was limited to the railroad lines the members of the CTA operated within the Gulf Coast region. The CTA belonged to a progressive coalition comprised of four other powerful independent African American labor unions committed to unyielding labor activism and the toppling of Jim Crow. Together, they all worked to effectuate meaningful social change in partnership with national civil rights attorney Charles H. Houston. Houston's experience and direction, coupled with the CTA's dedicated membership and willingness to challenge authority, created considerable momentum in movements aimed at toppling racial inequality in the workplace and elsewhere. Like most of their predecessors, the CTA's struggle for advancement fits within a continuum of successive challenges to economic exploitation and racial inequality. No single person or organization can take full credit for ending segregation or achieving equality. Many who remain nameless and faceless contributed and sacrificed. This study not only chronicles the contribution of a relatively unsung African American labor organization that waged war against Jim Crow on two different fronts, it also pays homage to a few more individuals who made a difference in the lives of an entire race of people during the course of a bitterly contested, never-ending struggle for racial equality in the United States of America during the twentieth century.

A Seguridade é uma das formas da intervenção pública do governo, com o objetivo de promover sua legitimação. A partir de uma problematização teórico-histórica sobre a teoria do Estado, base para os estudos, é discutida a construção do conceito de Seguridade no país e a regulamentação das políticas que a compõem Previdência, Assistência e Saúde , além da contra-reforma do Estado no Brasil e seus efeitos sobre essa política. Apresenta considerações sobre as alterações nas políticas componentes da Seguridade, discorrendo sobre a contra-reforma da Previdência Social com a incorporação da lógica atuarial à concessão dos benefícios; sobre a assistencialização das políticas sociais e o aumento dos gastos com a Assistência Social, ainda que em nível insuficiente para lidar com as mazelas sociais do país; e sobre o processo de implantação do Sistema Único de Saúde, que trouxe uma valorização da atenção básica à saúde e dos mecanismos de descentralização dos recursos, ficando os municípios responsáveis por boa parte da operacionalização e financiamento da política. A partir da discussão sobre o financiamento público, é ressaltada a predominância da valorização financeira do capital com a destinação de parcela crescente dos recursos arrecadados pelo governo para garantir a acumulação. Os principais mecanismos nesse sentido são os instrumentos de desvinculação das receitas, agora comprometidas com o pagamento dos juros da dívida, e as metas de resultado primário positivo. A intervenção pública dos anos 90 pautou-se pela busca da estabilização da economia, sobre-valorizando a importância de uma política econômica de cunho contracionista e conduzindo a cortes nos gastos públicos para a área social com a finalidade de pagar parte dos juros da dívida pública, ou seja, remunerar o capital especulativo e manter calmos, ou melhor, satisfeitos, os ditos mercados . Na medida em que avançou a penetração da ideologia neoliberal na sociedade e a utilização dos recursos arrecadados em nome da Seguridade para os gastos específicos foi reduzida, as possibilidades para a efetivação dessa política enquanto intervenção pública consolidada pioraram, dependendo cada vez mais de uma mobilização social nesse sentido.

Greta Magnusson Grossman : Från funkis till California Modern

This thesis explores the architecture, interior design and furniture design of Greta Magnusson Grossman (1906-1999), a pioneering Swedish Modernist who emigrated to the United States in 1940 and became part of the design movement California Modern in Los Angeles. Despite a productive and acclaimed career, her work was more or less forgotten until rediscovered in the early 2000’s.In this thesis, Greta Magnusson Grossman’s broader context is understood through literature studies of the 1930 Stockholm Exhibition, the introduction of Swedish Modern at the 1939 New York World’s Fair, the postwar design movement California Modern, and the International Competition for Low-Cost Furniture Design organized by the Museum of Modern Art in New York in 1948. Similar needs for well designed, low cost housing and furniture in the two countries are found.To further examine the work of Magnusson Grossman, her 1949 residence at Waynecrest Drive in Los Angeles is visually analyzed and compared with contemporary Case Study House #8 by American design couple Charles and Ray Eames from 1949, and Swedish furniture designer and architect Bruno Mathsson’s Exhibition Hall from 1950. Several correlations between the three environments are identified, and confirms Greta Magnusson Grossman’s progressive contributions in the fields of architecture, interiors and furniture design.

Support consumers' rights in DRM : a secure and fair solution to digital license reselling over the Internet

Consumers of digital contents are empowered with numerous technologies allowing them to produce perfect copies of these contents and distribute them around the world with little or no cost. To prevent illegal copying and distribution, a technology called Digital Rights Management (DRM) is developed. With this technology, consumers are allowed to access digital contents only if they have purchased the corresponding licenses from license issuers. The problem, however, is that those consumers are not allowed to resell their own licenses- a restriction that goes against the first-sale doctrine. Enabling a consumer to buy a digital license directly from another consumer and allowing the two consumers to fairly exchange the license for a payment are still an open issue in DRM research area. This thesis investigates existing security solutions for achieving digital license reselling and analyses their strengths and weaknesses. The thesis then proposes a novel Reselling Deal Signing (RDS) protocol to achieve fairness in a license reselling. The idea of the protocol is to integrate the features of the concurrent signature scheme with functionalities of a License Issuer (LI). The security properties of this protocol is informally analysed and then formally verified using ATL logic and the model checker MOCHA. To assess its performance, a prototype of the RDS protocol has been developed and a comparison with related protocols has been conducted. The thesis also introduces two novel digital tokens a Reselling Permission (RP) token and a Multiple Reselling Permission (MRP) token. The RP and MRP tokens are used to show whether a given license is single and multiple resalable, respectively. Moreover, the thesis proposes two novel methods supporting fair and secure digital license reselling. The first method is the Reselling Deal (RD) method which allows a license to be resold once. This method makes use of the existing distribution infrastructure, RP, License Revocation List (LRL), and three protocols: RDS protocol RD Activation (RDA) protocol, and RD Completion (RDC) protocol. The second method is a Multiple License Reselling (MLR) method enabling one license to be resold N times by N consumers. The thesis presents two variants of the MLR method: RRP-MR (Repeated RP-based Multi-Reselling) and HC-MR (Hash Chain-based Multi-Reselling). The RRP-MR method is designed such that a buyer can choose to either continue or stop a multi-reselling of a license. Like the RD method, the RRP-MR method makes use of RP, LI, LRL, and the RDS, RDA, and RDC protocols to achieve fair and secure reselling. The HC-MR method allows multiple resellings while keeping the overhead on LI at a minimum level and enable a buyer to check how many times a license can be further resold. To do so, the HC-MR utilises MRP and the hash chain cryptographic primitive along with LRL, LI and the RDS, RDA and RDC protocols. The analysis and the evaluation of these three methods have been conducted. While supporting the license reselling, the two methods are designed to prevent a reseller from (1) continuing using a resold license, (2) reselling a non-resalable license, and (3) reselling one license a unauthorised number of times. In addition, they enable content owners of resold contents to trace a buyer who has violated any of the usage rights of a license bought from a reseller. Moreover, the methods enable a buyer to verify whether a license he is about to buy is legitimate for re-sale. Furthermore, the two methods support market power where a reseller can maximise his profit and a buyer can minimise his cost in a reselling process. In comparison with related works, our solution does not make use of any trusted hardware device, thus it is more cost-effective, while satisfying the interests of both resellers and buyers, and protecting the content owner's rights.
