Sportifs et droits fondamentaux / Sports and fundamental rights

Combien d’enfants ont rêvé de devenir un jour footballeur professionnel, tennisman ou pilote de Formule 1 ? Combien étions-nous au soir de la finale de la Coupe du monde 1998 derrière les « Bleus » ? Magie, phénomène social, vecteur d’intégration… On pourrait disserter bien longtemps sur les vertus du sport. Toutefois, le revers de la médaille est beaucoup moins réjouissant, sauf pour le juriste. En effet, on assiste ces dernières années à un processus de prise en compte du sport par le droit étatique. Le sport ne peut plus rester hors du droit. Cette pénétration du droit a forcément des incidences sur les droits fondamentaux reconnus aux sportifs. Pourtant il semble que la doctrine ne se soit que très peu intéressée au sportif, « qui est un citoyen comme les autres avec des droits imprescriptibles ».Si le principe selon lequel le sportif dispose des mêmes droits fondamentaux que tout citoyen semble largement admis, il convient de ne pas rester imperméable à la revendication d’une exception sportive. En effet, le mouvement sportif vit comme une intrusion l’appréhension du sport par le droit étatique. L’opposition entre la Commission européenne et les instances du football, concernant le système des transferts, est une preuve récente de cette réticence. Ainsi une spécificité sportive empêcherait l’application normale de la règle de droit. Qu’en est-il du point de vue des droits fondamentaux du sportif ? Existe-t-il une exception sportive en matière de droits fondamentaux de sorte que reprenant une expression de Hauriou, on pourrait considérer les sportifs comme des « citoyens spéciaux » ? Plusieurs problèmes se posent. Tout d’abord, il conviendra de s’interroger sur l’existence d’une spécificité sportive dans la reconnaissance de droits au sportif. En effet, la question est celle de savoir si le sportif est titulaire des mêmes droits que tout citoyen. Une fois les droits du sportif déterminés, la question de l’effectivité de ses droits se posera. N’existe-t-il pas une particularité sportive dans l’exercice des droits fondamentaux, de sorte que si le sportif bénéficie en principe des mêmes droits que tout citoyen, il ne pourrait pas les exercer de la même manière ? Ainsi l’effectivité des droits du sportif serait atténuée.La mise en œuvre d’une spécificité d’application en matière de droits fondamentaux révèle une protection catégorielle qui rompt avec l’universalisme traditionnellement attaché aux droits de l'homme. La recherche de l’effectivité des droits des sportifs est pourtant pertinente. Mais elle conduit le juge à reconnaître le caractère fondamental d’un droit, indépendamment de la norme qui le supporte en fonction de l’importance qu’il revêt dans le cas d’espèce. La démarche du nouvel acteur de la scène sportive montre une remise en cause de l’acception formelle de la notion de fondamentalité au profit d’une acception matérielle. Sauf à reconnaître l’existence d’un droit au sport formellement fondamental. Car « il est plus intéressant de s’interroger sur l’existence du même droit, au niveau où sont normalement reconnus les droits fondamentaux, c'est à dire au niveau constitutionnel » ( ). Même si aucun texte à valeur suprême ne consacre un tel droit, « il ne faut pourtant pas s’en tenir à ce décevant constat » ( ). Car son émergence est perceptible. L’intérêt est considérable puisque le droit au sport recouvre la quasi-totalité de la nomenclature des droits de l'homme ( ). Sa mise en œuvre devient nécessaire à la prise en compte de la spécificité sportive. / How many children dreamed to become a day professional football player, a tennis player or a driver of Formula 1? How much were we in the evening of finale of the World cup 1998 behind the French Team ? Magic, social phenomenon, vector of integration … We could talk indeed for a long time about the virtues of the sport. However, the other side of medal is much less happy, safe for the jurist. Indeed, we attend these last years a process of consideration of the sport by the state law. The sport cannot stay any more outside the state law. This penetration of the law has necessarily incidences on the fundamental rights recognized by the sportsmen. Nevertheless it seems that the doctrine that is little interested in the sportsman, " who is a citizen as the others with inalienable rights ".If the principle according to which the sportsman arranges the same fundamental rights as every citizen seems widely admitted, it is advisable not to remain impervious to the demand of a sports exception. Indeed, the sports movement lives as an intervention the apprehension of the sport by the state law. The opposition between the European Commission and the authorities of the football, concerning the system of transfers, is a recent proof of this hesitation. So a sports specificity would prevent the normal application of the legal rule. What is it from the point of view of the fundamental rights of the sportsman? Is there a sports exception in fundamental rights so that taking back an expression of Hauriou, we could consider the sportsmen as " special citizens "? Several problems settle. First of all, it will be advisable to wonder about the existence of a sports specificity in the recognition of rights for the sportsman. Indeed, the question is the one to know if the sportsman is a holder of the same rights as every citizen. Once the rights of the sportsman were determined, the question of the effectiveness of its rights will settle. Is not there a sports peculiarity in the exercise of the fundamental rights, so that if the sportsman benefits as in principle from the same rights as every citizen, he could not exercise them in the same way? So the effectiveness of the rights of the sportsman would be eased.The operated of a specificity of application in fundamental rights reveals a category-specific protection which breaks with the universalism traditionally attached to human rights. The search for the effectiveness of the rights of the sportsmen is nevertheless relevant. But it leads the judge to recognize the fundamental character of a right, independently of the standard which supports it according to the importance which it takes on in the special case. The initiative of the new actor of the sports scene shows a questioning of the formal meaning of a word of the notion of fundamentality for the benefit of a material meaning of a word. So as to recognize the existence of a right by the formally fundamental sport. Because " it is more interesting to wonder about the existence of the same right, at the level where are normally recognized the fundamental rights, that is at the constitutional level ". Even if no text with supreme value dedicates such a right, " You should not nevertheless be held in it disappointing report ". Because its emergence is perceptible. The interest is considerable because the law for the sport recovers the quasi-totality of the nomenclature of human rights. Its stake in work becomes necessary for the consideration of the sports specificity.

Les engagements internationaux et les défaillances de la protection constitutionnelle des droits fondamentaux : l'exemple des paradoxes des mécanismes de contrôle nigériens au regard des expériences française et internationale

Les États semblent ériger les Cours constitutionnelles en meilleur garant de la protection des droits fondamentaux. Cette étude propose une délimitation des compétences, voire des responsabilités constitutionnelles. Elle démontre que si l'inneffectivité de la protection des droits a été mise en évidence en dépit de l'existence des mécanismes de justice constitutionnelle et des ratifications massives des conventions internationales, c'est la recherche des défaillances de la protection constitutionnelle qui s'impose. La confrontation « des engagements internationaux aux défaillances de la protection des droits fondamentaux » pose la question du contrôle qui est censé être exercé par le juge constitutionnel. Au regard des expériences française et internationale, le Niger offre un exemple parfait des paradoxes de ces mécanismes de contrôle tant a priori qu'a posteriori. Ces défaillances apparaissent à travers les limites constitutionnelles de l'intervention du juge constitutionnel, voire du juge international. Cette étude à la fois micro et macrocomparative, révèle le décalage entre la justice constitutionnelle nigérienne et française. Bien plus, elle illustre le déficit de la protection constitutionnelle, y compris de la France, par rapport aux véritables exigences internationales de la protection. Au-delà, cette thèse propose des pistes d'une protection conventionnelle efficace, voire effective des droits fondamentaux conventionnels. / States seem to assign a more important role to Constitutional courts to protect fundamental rights. This study proposes a delimitation of powers and constitutional responsibilities. It shows that if the ineffectiveness of human rights has been highlighted despite the fact that there are mechanisms of constitutional justice and massive ratifications of international conventions, research focusing on constitutional protection deficiencies remains crucial. Comparing “international commitments and deficiencies in the protection of fundamental rights” raises the issue of control which is supposed to be exercised by the Constitutional court. In the light of the French and international experiences, Niger provides a perfect example of paradoxes of the pre-control and post-control mechanisms. Such deficiencies appear through constitutional limits of the intervention of the Constitutional judge and the international judge. This micro and macro comparative study reveals the difference between the Nigeren and the French constitutional justice. It also illustrates the shortfall of the constitutional protection including France in the face of the real international requirements of the protection. Furthermore, this doctoral thesis proposes courses of action for effective and efficient protection under the convention.

La modernisation du droit haïtien, un défi pour l'avenir

Le droit haïtien appartient, de manière formelle, au système de droit écrit. Au lendemain de l'Indépendance, le droit Français va servir de modèle pour Haïti. Depuis lors, cet héritage de la codification n'a pas été repensé. Si en apparence, le droit haïtien succombe ainsi à une sorte de mimétisme juridique, l'existence d'un droit coutumier et informel supplée en fait à la transposition maladroite du modèle Français. Cette modernisation retardée constitue un handicap sérieux à l'avènement d'un État de droit indispensable au développement socio-économique du pays.Cette thèse, conçue comme une sorte de guide dédié à la construction d'un nouveau droit haïtien, vise à jeter les bases permettant d'adapter le « droit officiel », encore souvent imposé et trop fréquemment ineffectif, avec des pratiques sociales efficientes qui jouent un rôle indéniable de régulation de la société.La première partie révèle ainsi qu'en Haïti, la réception du droit Français est intervenue dans sa généralité, sans tenir compte de facteurs sociologiques cependant déterminants. La seconde partie démontre qu'en dépit de l'inadaptation et de l'application incomplète du modèle Français, se dessinent désormais les conditions d'un nouveau modèle juridique. Érigé sur les fondations léguées par l'Histoire, ce nouveau modèle, dont la thèse réunit les premiers linéaments, est le produit de l'association des enseignements de la tradition et des progrès récents de la législation française avec l'apport d'instruments juridiques internationaux ratifiés par Haïti, dans un contexte d'intégration régionale rendue chaque jour plus nécessaire face aux défis de la mondialisation du droit. / Haitian law belongs, formally, to the system of written law. In the aftermath of Independence, the French law will serve as a model for Haiti. Since then, the legacy of the coding has not been redesigned. If seemingly Haitian law succumbs to a kind of legal mimicry, the existence of customary and informal law compensates actually the clumsy transposition of the French model. This delayed modernization is a serious handicap to the advent of the rule of law which is critical to the socio-economic development of the country.This thesis, as a kind of guide dedicated to the construction of a new Haitian law, aims to lay the foundation allowing the adaptation of the "official law" and still often imposed and too often ineffective, with efficient social practices that play an undeniable regulation role in the society.The first part reveals that in Haiti, the reception of the French law has intervened in its generality, regardless of critical sociological factors, that are however important. The second part shows that despite the maladjustment and incomplete application of the French model, the conditions of a new legal model are now emerging. Built on the foundations left by history, this new model, which the thesis meets the first lineaments, is the outcome of the combination of the teachings of tradition and recent progress of the French legislation with the provision of international legal instruments ratified by Haiti in the context of regional integration rendered every day more necessary to considering the challenges of globalization of law.

O princípio da dignidade humana necessita, como em nenhum outro momento, sair do plano etéreo. Direitos meramente de papel em nada contribuem para o verdadeiro avanço civilizacional por todos ambicionado. Para que a humanidade caminhe celeremente para a realização dos valores sedimentados ao longo de um lento processo de consciência política e jurídica que resultou na construção dos catálogos de direitos fundamentais, impreterível se mostra a efetivação plena dos direitos humanos. A convicção da imprescindibilidade da proteção da dignidade humana necessita ser materializada. A questão da efetividade dos direitos fundamentais afeta, com notável magnitude, a proteção jurídica dos trabalhadores. A Declaração de Princípios e Direitos Fundamentais no Trabalho da OIT e os postulados do trabalho decente, saudável e seguro, os quais configuram a definição dos padrões mínimos de direitos trabalhistas no âmbito internacional, não têm sido cumpridos nos diferentes países, comprometendo gravemente a tutela deferida à dignidade do trabalhador. É preciso assegurar a aplicabilidade e a realização dos direitos trabalhistas fundamentais, combatendo os abjetos casos de trabalho em condições análogas à de escravo, de discriminação de trabalhadores, de cerceamento às liberdades sindicais e negociais, de trabalho infantil, inseguro ou em condições indignas, entre inúmeras outras injustas e execráveis situações vivenciadas no ambiente laboral. No cenário econômico globalizado, em que sobressai o capitalismo financeiro, os governos necessitam assumir, como em nenhum outro momento, seu necessário papel na proteção efetiva dos direitos humanos no trabalho. Neste sentido, diante da vinculação à supremacia e à indisponibilidade dos direitos fundamentais como preceptivos essenciais da atividade administrativa no Estado Democrático de Direito, o Poder Público deve exercer sua função de induzir e modelar as condutas sociais. O trabalho acadêmico presente preconiza e defende que os governos devem exercer um papel verdadeiramente ativo, a fomentar e a exigir o efetivo cumprimento dos direitos fundamentais no trabalho, notadamente pela aplicação de instrumentos jurídicos como a cláusula trabalhista nos contratos públicos. A cláusula trabalhista expressa e proclama a emanação da força cogente, vinculante, dos contratos públicos, das disposições contratuais, e revela a capacidade de subtrair os direitos subjetivos do plano abstrato, formando uma conexão real e obrigatória, alicerçada em obrigações particularizadas, diretamente imponíveis, destinadas à realização dos direitos fundamentais no trabalho e da proteção da dignidade do trabalhador, incorrendo o infrator de seus comandos, na imediata aplicação de sanções. Por conseguinte, produz implicações jurídicas materiais para a proteção do trabalho. Os contornos da concepção contemporânea do contrato público socialmente responsável demandam a adoção da cláusula laboral para a afirmação dos direitos fundamentais no trabalho. As características e particularidades do novo regime jurídico em que se inserem os contratos administrativos exprimem e legitimam a plena pertinência e juridicidade da adoção da cláusula social trabalhista em seu núcleo. Neste contexto, a realização dos padrões internacionais de proteção ao trabalhador é condição mandatória para o desenvolvimento sustentável. A contratação pública socialmente responsável que valoriza e concretiza a proteção da dignidade do trabalhador pode, verdadeiramente, influenciar as atividades econômicas, promovendo a justiça social nas relações de trabalho que encerram ao exigir, com ênfase, a formatação de padrões de emprego e ocupação laboral que respeitam os direitos humanos no trabalho. / The principle of human dignity, as never before, has to be pulled out of its ethereal plane. Empty rights do not contribute to the true civilization progress coveted by all. So that mankind walks faster towards the achievement of the values settled along the slow process of political and legal awareness that resulted in the construction of catalogs of fundamental rights, the full effectiveness of legal rights shall not be avoided. The indispensable protection to human dignity must be enforced with conviction. The issue of the effectiveness of fundamental principles significantly affects workers legal protection. The ILO Declaration on Fundamental Principles and Rights at Work and the guidelines on decent, healthy and safe work, which define minimum international labour standards, have not been complied with in different countries, severely compromising the protection to workers dignity. The applicability and enforcement of fundamental labour rights must be guaranteed to fight contemptible cases of slavery-like work conditions, workers discrimination, retrenchment to free labour union and collective bargaining, child labour, unsafe work or under degrading conditions, among several other unfair and infamous situations experienced in the work environment. In a globalized economic scenario, where financial capitalism is emphasized, governments have to assume, as never before, their role in the effective protection of human rights at work. Accordingly, in view of the supremacy and inalienability of fundamental rights as essential principles of administrative activities of the Rule of Law, the role of the Government is to induce and shape social conducts. The present academic paper argues and claims that governments should have a decisively active role, fomenting and enforcing the effective compliance with fundamental rights at work, notably by applying legal instruments as the labour clause in public contracts. The labour clause expresses and affirms the cogent and binding force that arises out of public contracts and contractual provisions, and pulls subjective rights out of their abstract plane, establishing an actual and mandatory connection grounded on specific obligations immediately enforceable and aimed to realize fundamental rights at work and protect the dignity of workers, and applying immediate sanctions on the offender of such legal provisions. Therefore, it produces real and concrete legal developments to labour protection. The outlines of the contemporary conception of socially responsible public contracts require the adoption of the labour clause for the enforcement of fundamental labour rights at work. The characteristics and specificities of the new legal regime, which comprises administrative contracts, express and legitimize the full pertinence and legality of including the labour clause among their provisions. In this context, the compliance with international workers protection standards is mandatory to a sustainable development. Socially responsible public contracts that value and enforce the protection to workers dignity may effectively influence economic activities, promoting social justice in labour relations that emphatically claim for the structuring of employment and labour standards that respect human rights at work.

La liberté d’expression des personnes incarcérées / Freedom of expression of imprisoned persons

C’est un adage bien connu, la peine privative de liberté n’est, théoriquement, que la privation de la liberté d’aller et venir. La France s’est ainsi dotée, le 24 novembre 2009, d’une loi pénitentiaire régissant les droits et les devoirs des personnes incarcérées. Son article 26 précise que : « les personnes détenues ont droit à la liberté d'opinion, de conscience et de religion ». Ce droit implique en substance celui de rechercher des informations, de construire son opinion, puis de l’extérioriser, soit, de pouvoir librement s’exprimer. Or, la réclusion physique d’un individu entraîne inévitablement des restrictions à l’usage de sa liberté deparole, entendue au sens large. S’il ne fait nul doute que les individus incarcérés sont titulaires de droits subjectifs, dans quelles conditions peuvent-ils être exercés ? Les droits des personnes détenues sont contraints par les limites inhérentes à la détention, la sécurité et le bon ordre. Cela implique une censure des autorités pénitentiaires, tant sur la parole que sur les écrits des personnes placées sous sa garde. A ces limitations générales, il faut aussi ajouter lescontraintes liées à la surpopulation carcérale et le poids du contexte sécuritaire actuel. Il entraîne un durcissement des politiques pénales qui peut fragiliser la liberté d’expression des personnes incarcérées. / It is a well-known saying, the sentence depriving of liberty is, in theory, only the deprivation of the freedom of movement. France has established, on November 24th, 2009, a prison law regulating the incarcerated persons rights and duties. Article 26 of said law indicates : “incarcerated persons have the right to freedom of opinion, conscience and religion”. This right implies the right to search information, build an opinion and carry it out, therefore to be able to speak freely. Yet, the physical imprisonment of an individual inevitably triggers restrictions to the use of his broader freedom of speech. If there is no doubt thatincarcerated persons have subjective rights, in what conditions can they be asserted? The inmate’s rights are compelled by the limits inherent in detention, security and order, which lead the prison administration to censor speech and writing of the individuals placed in custody. In addition to these general restrictions, be added all the constraints related to prison overcrowding but also the weight of the current security context. It leads to the strengthening of criminal policies which can weaken the prisoners’s freedom of expression.

La Traité de Maastricht a institué la citoyenneté européenne. Envisagée initialement comme une conséquence de la nationalité d’un État membre, la notion a connu un développement extraordinaire au travers d’interprétations ambitieuses de la Cour de justice de l’Union européenne. Statut fondamental des ressortissants des États membres, la citoyenneté de l’Union se conjugue avec la liberté de circulation et les droits fondamentaux pour mettre à l’épreuve le statut personnel. Le temps est ainsi venu de s’interroger sur l’aptitude de la citoyenneté européenne à devenir le terreau d’un renouveau de la méthode du droit international privé au sein de l’Union européenne. La citoyenneté de l’Union constitue un fondement à la généralisation d’une méthode de reconnaissance mutuelle en bouleversant le statut personnel / The Maastricht Treaty establishes the European citizenship. Initially conceived as a consequence of Member State’s nationality, the concept has incredibly increased through ambitious exegesis analysis of the Court of Justice of the European Union. Fundamental status of nationals of the member States, EU citizenship brings together and fundamental Rights to improve the personal status. Time has now come to find out if or not the European citizenship will becomes the spring of a new Private international law method for the European Union. European citizenship constitutes the substructure of the globalization of a mutual recognition method, overthrowing the personal status.

Princípio constitucional da celeridade processual / Celerity of procedure constitutional principle

O constituinte reformador decidiu tratar do problema da morosidade da justiça, à semelhança de outros países e de diversos tratados internacionais a respeito. A presente dissertação tem por fulcro a análise do novo inciso LXXVIII do art. 5º da Constituição Federal que instituiu a celeridade processual como direito fundamental. É feita cuidadosa abordagem de todos os princípios constitucionais pertinentes à matéria, especialmente o devido processo legal, desde o seu surgimento, na common law inglesa, com a Magna Carta de 1215, evoluindo pela interpretação da Suprema Corte nos Estados Unidos, de modo a conhecer sua vertente substantiva, até ser consagrado no Brasil, de modo expresso, cerca de 200 anos depois, pela Constituição de 1988. Outros princípios apresentam-se igualmente de grande relevância, como o acesso à justiça, eficiência e igualdade. Constata-se que não era imprescindível a positivação de regra específica para que a Justiça estivesse jungida ao dever de julgar com rapidez. Revela-se, porém, profícua a abordagem do tema na Constituição, dentre os direitos fundamentais. Verifica-se a ocorrência de eventuais conflitos no plano concreto envolvendo a celeridade processual e os princípios do contraditório e da ampla defesa, bem como a segurança jurídica. Dedica-se especial atenção ao papel da Emenda Constitucional n. 45, de 2004 e diversos institutos por ela trazidos no intento de se obter um Poder Judiciário mais célere e organizado de modo mais eficaz e uniforme, embora se constate a necessidade de mudanças que se sobressaem à atuação do legislador. Realiza-se pesquisa histórica e descritiva com supedâneo na doutrina brasileira e no direito comparado, especialmente nas literaturas jurídicas francesa, inglesa, portuguesa e estadunidense. Ao se analisar a repercussão do dispositivo à luz do direito constitucional, nota-se a necessidade de muitas outras alterações para que a Reforma atinja seu desiderato. Constata-se que o Poder Judiciário possui papel preponderante na salvaguarda dos direitos fundamentais, de modo que, atuando a contento, a celeridade processual pode se tornar poderoso instrumento de efetividade de tais direitos e da própria Constituição Federal. / The constituent reformer decided to face the problem of the delays of Justice, likewise that in other countries and various international treaties of the subject. This dissertation focuses on the analysis of the new item LXXVIII of article 5th of the Federal Constitution which set the celerity of procedure as a fundamental right. A careful approach is made from all constitutional principles relevant to the subject, especially the due process of law, since its emergence in the English common law, with the Magna Carta of 1215, evolving through United States Supreme Courts interpretation, in order to meet its substantive aspect, to be explicitly devoted in Brazil, about 200 years later, by the Constitution of 1988. Other principles also have great relevance, such as access to justice, efficiency and equality. It appears to be unessential to insert a specific rule by which the Justice would be bound by duty to judge rapidly. However, it is useful to approach the subject in the Constitution, among the fundamental rights. Possible conflicts are analyzed in concrete plan involving the speedy trial clause and the principles of adversarial and legal defense, as well legal certainty. Proper attention is paid to the role of the 45th Amendment of 2004 and various institutes brought by it, in the attempt to achieve a faster and more uniform and well organized Justice, although evidences the need of changes that overcome the role of the legislator. Takes place a historical and descriptive research takes place in Brazilian doctrine and comparative law, especially in French, English, Portuguese and American legal literature. By analyzing of the clauses effect under the constitutional law, its notice the demand of many other changes to the Reform reach your goal. L’immigration est un phénomène récurrent qui a aujourd’hui une grande ampleur. Beaucoup de pays développés subissent de plus en plus l’immigration et la France n’est pas une exception à cela. Face à ce phénomène qui fait l’objet de débats houleux, la France est à la recherche effrénée de voies et moyens pour lutter contre les étrangers en situation irrégulière d’où le caractère très actuel de ce sujet. Même si l’étranger est en situation irrégulière, il a des droits. Le plus primordial dont il bénéficie est le droit à la santé. Ce droit se matérialise par un ensemble de dispositifs (Aide médicale d’état, Fonds de soins urgents et vitaux, Performances d’accès aux soins de santé) . L’étranger en situation irrégulière a également, en matière familiale le droit de se marier, de se passer un pacte civil de solidarité. L’irrégularité de sa situation ne le prive pas de son droit d’accès à un toit de même que l’ouverture d’un compte. En matière de travail, l’étranger en situation est exclu des étrangers pouvant travailler. Cependant, l’exercice illégalement, d’une activité lui confère des droits à l’égard de son employeur et de la sécurité sociale. L’étranger en situation irrégulière est non un sujet sans droits mais aux droits limités. Cette limitation est accentuée par les difficultés d’effectivité. La France mène une lutte contre l’étranger en situation irrégulière et plus généralement contre l’immigration clandestine. Pour ce faire un dispositif répressif est mis place avec comme mesure phare l’éloignement de l’étranger en situation irrégulière. La réaction du système français n’est pas seulement répressive car un méthode douce est dans certains cas privilégiée à savoir la régularisation. Les pays membres de l’union européenne et voisins de la France en particulier et des pays développés en général connaissent même si c’est à des degrés différents le problème des étrangers en situation irrégulière. Ce constat fait du phénomène de l’immigration irrégulière un problème européen d’où la nécessité d’une coordination pour lutter efficacement contre ce phénomène. L’externalisation de la lutte contre l’immigration irrégulière est de mise. L’universalité du phénomène impose en quelque sorte d’adopter une démarche comparative à certains égards et par-delà d’apprécier l’état de la question en France par rapport à d’autres pays. Les textes communautaires, internationaux, nationaux participent à assurer un équilibre entre le respect des droits réservés à cette catégorie d’étrangers à travers le bénéfice et l’exercice par eux de droits et le respect de la législation en matière d’immigration. Dans la recherche de cet équilibre une part significative est confiée à la jurisprudence car le contentieux en la matière est très abondant du fait des saisines fréquentes du juge français ou communautaire pour constater la violation ou non d’un droit réservé à l’étranger en séjour irrégulier ou se prononcer sur une mesure allant à l’encontre de ce dernier. / Immigration is a constant phenomenon that has reached fearing proportions nowadays. In front of this phenomenon which is now a bone of contention, France is striving for ways and means to fight against foreigners in irregular situation, hence the topicality of the issue. Even if the alien is in irregular situation is given rights the most fundamental, he benefits from is the right to health which is materialized by a set of measures State Medical Assistance (SMA), Emergency and Vital funds for health care, Permanencies for access to health care). The alien in irregular situation has also, for family matters, the right to marry, to pass a civil act of solidarity. The irregularity of his situation does not prevent him from having access to a shelter or opening an account. In terms of labour, the alien in irregular situation is excluded from the foreigners who are entitled for jobs. However, the exercise of an activity confers him rights granted by his employer and the social security. The foreigner in irregular situation is not a subject without rights but a subject with limited rights. This limitation is accentuated by constraints in effectiveness. France is fighting against foreigners in irregular situation, and generally against clandestine immigration. For this objective, a coercive apparatus is put in place with deportation as a key measure. The reaction of the French system is not only coercion because the soft approach is prioritized in some cases, meaning regularization. The European Union member countries sharing borders with France particularly, developed countries in general, are experiencing the problem of irregular aliens, even in varying degrees. With its generalization, it is becoming a European issue, hence the need of a coordination to fight efficiently against it. Externalization of the fight against irregular foreigners is in implementation. The universality of the phenomenon somehow imposes a comparative approach on some aspects, and an appreciation of the state of the art in France compared to other countries. Community and international legislations on national regulations participate in the maintenance of a balance between the respect of rights reserved for this category of foreigners through the benefit and exercise of rights by them, and the respect of legislation about immigration. In trying to achieve this balance a significant part is dedicated to jurisprudence because of the big number of litigation cases due to frequent referrals to the French court, or the European union court in order to ascertain violation - or not - of any right granted to illegal aliens, or in order to make a decision on all measures taken against them.

Based on doctrinal and jurisprudencial analysis of the brazilian Democratic State components, on constitutional principles that limits and guides the use of the state punitive power, and also on the understanding that the right to protest is a fundamental right and the perception that the protesters are accused of commiting crimes just because they were part of a protest act, the goal of this scientific wok is to consider the relations e tensions between criminal proceedings, the right to protest and democracy. It is argued in this work that on the situation exposed the state punitive power was revealed as a censorship tool against the right to protest, blemishing constitutional principles of criminal proceedings and weakening the requirements of the Democratic State / No Brasil, não obstante o direito ao protesto estar protegido pela previsão expressa das liberdades de expressão do pensamento, de reunião e de associação (art. 5º, incisos IV, XVI e XVIII da Constituição da República de 1988), verifica-se ocasiões em que se dá a intervenção da atividade punitiva estatal contra participantes de manifestações, a quem são imputadas práticas de crimes comuns e de crimes constantes da Lei de Segurança Nacional. Com base na análise doutrinária e jurisprudencial dos elementos constitutivos do Estado Democrático de Direito brasileiro, nos princípios constitucionais que limitam e orientam a atuação do poder punitivo estatal e nos entendimentos que caracterizam o direito ao protesto como um direito fundamental e constata a realidade em que, em razão da participação em atos de protestos, indivíduos são acusados da prática de crimes, o objetivo do presente trabalho é o de refletir sobre as relações e tensões que se estabelecem entre processo penal, direito ao protesto e democracia. However, to have this discussion is necessary to analyze the evolution of the legislation that protect the employee, who is a victim of a labor accident, and we will see the foundation of this protection, as well as the configuration of the risks that require such protection, and the concept of a labor accident and the reformulation that this concept has gone through, considering the changes caused by society. Then, we will look up the concepts of system, effectiveness, as well as principles and rules that will provide for us the necessary support for the inclusion of the labor accident protection in the list of the fundamental rights, and their relation to the social rights. We will analyze the protection of the working environment and the impact that the lack of security measures can lead to the Social Security System. From then on, we will introduce the concept of the Accident Prevention Factor and the respective calculation methodology, and the questionings that the implementation of this tool caused. Finally, we will check why the Accident Prevention Factor is framed as a social prevention tool, and the reason why its measurement was set by economic sector, and the results of its implementation through the labor accident statistics provided by the Social Security Ministry / A presente dissertação tem o objetivo de analisar se a instituição do Fator Acidentário de Prevenção FAP atingiu a sua função eficacial, qual seja, a redução dos índices de acidentalidade laboral. Contudo, para se chegar a essa discussão, faz-se necessária a análise da evolução legislativa da proteção acidentária, oportunidade em que será visto o fundamento dessa proteção, a configuração dos riscos que demandam essa tutela, bem como o conceito de acidente de trabalho e a reformulação pela qual esse conceito passou por meio das mudanças ocasionadas pela sociedade. Em seguida, serão analisados os conceitos de sistema, eficácia, além de princípios e regras, por meio dos quais serão fornecidos os subsídios necessários para a inserção da proteção acidentária no rol dos direitos fundamentais e a sua relação com os direitos sociais. Serão analisados a proteção do meio ambiente laboral e os impactos que a ausência de medidas de segurança pode ocasionar para o Sistema de Seguridade Social. A partir de então, serão introduzidos o conceito do Fator Acidentário de Prevenção e toda a sua metodologia de cálculo, assim como as irregularidades apontadas no momento da implementação dessa ferramenta. Ao final, serão verificados como o FAP é enquadrado como uma ferramenta de prevenção social, os motivos pelos quais a sua aferição se configura por setor econômico e os resultados de sua implementação por meio dos dados estatísticos acidentários disponibilizados pela Previdência Social
