A visual interpretation of consciousness as a continuous process of self-organisation and embodiment

That consciousness is ubiquitous, and relevant to autopoietic self-organisation and embodiment within every living being and/or organism, is a prevalent idea in contemporary consciousness research. However, because ‘consciousness’ as a word is derived from con or cum, meaning ‘with’ or ‘together’ and scire, ‘to know’ or ‘to see’ it infers the experience of knowing with an ‘other’ and/or ‘others’. The narrative that follows, while expressing a life of its own, documents the interdisciplinary research conducted and questions who and/or to what ‘other’ might infer. My visual diary, Dust from dust: Microorganisms and other tales: An Artist’s diary, created as the visual component of a creative practice-as-research undertaking, was silently performed amidst ‘others’ in the Unisa gallery, in an attempt to render visible, the autopoietic, self-organising embodiment essential to the conscious self-developmental component of the project. Once upon a time, I grew bacterial yeast cells in a glass vitrine to observe how they self-organised their own embodiment and photographed the process. At the same time, I conducted interdisciplinary research into consciousness as a self-developmental process, and utilising the cellular symbiosis unfolding in the vitrine as a self-reflexive mirror, came to visualise how indispensable bodily feelings are to conscious self-development, and being-in-the-world-with-others processes. As a creative-practice-as-research undertaking, I grew, manipulated and photographed the cellular imagery in the vitrine over many years in an attempt to unfold personal bodily feeling associations the imagery held captive, while gathering photographic footage I considered capable of expressing the primordial nature of certain emotive feeling experiences. Once obtained, I choreographed and performed a stop-frame video, entitled Dust from Dust: Microorganisms and other tales. An artist’s diary. The stop-frame video, along with a catalogue that focuses on the processes engaged with, accompanies the written narrative. Once edited, I macroscopically projected different phases of the video into a three-walled enclosure in the UNISA Art gallery. The three videos, representing a facet of my praxis, ran concurrently over a two week period. The fourth facet, presented with the video projections to emphasise conscious self-development as an in-the-world-with-others process, was the glass vitrine. It was positioned in a darkened enclosure in the gallery space, opposite the video projections. This narrative documents how I projected myself into the cellular imagery developing in the glass vitrine, in a way akin to how the ancient alchemists ‘projected’ themselves into the prima materia with which they worked. While the alchemists seemingly worked unconsciously, and my praxis initially started somewhat unconsciously, the process developed into a conscious attempt to embody the research findings. So, while the video choreographed, champions a microbial cell story, by referring to it as an artist’s diary, I emphasise the subjective nature of my praxis as a whole. In this creative-practice-as-research undertaking, I address the significance of bodily feelings and their relevance to being-in-the-world-with-others processes. In doing so, I aim to offer insight into how and why feelings are essential to inter-subjectivity and/or sociality, self-organisation and conscious self-development, as well as how and why conscious self-development can lead to immersive experiences, which I interpret as embodied adaptation to the rich diversity and/or fullness of life itself. / Art History, Visual Arts and Musicology / D. At the center of American modernism: Lola Ridge's politics, poetics, and publishing

Indiana University-Purdue University Indianapolis (IUPUI) / Although many of Lola Ridge's poems champion the causes of minorities and the disenfranchised, it is too easy to state that politics were the sole reason for her neglect. A simple look at well-known female poets who often wrote about social or political issues during Ridge's lifetime, such as Edna St. Vincent Millay and Muriel Rukeyser, weakens such a claim. Furthermore, Ridge's five books of poetry illustrate that many of her poems focused on themes beyond the political or social. The decisions by critics to focus on selections of Ridge's poems that do not display her ability to employ multiple aesthetics in her poetry have caused them to present her work one-dimensionally. Likewise, politically motivated critics often overlook aesthetic experiments that poets like Ridge employ in their poetry. Few poets during Ridge's time made use of such drastically varied styles, and because her work resists easy categorization (as either traditional or avant-garde), her poetry has largely gone unnoticed by modern scholars. Chapter two of my thesis focuses on a selection Ridge's social and political poems and highlights how Ridge's social poetry coupled with the multiple aesthetics she employed has played a part in her critical neglect. My findings will open up the discussion of Ridge's poetry and situate her work both politically and aesthetically, something no critic has yet attempted. Chapter three examines Ridge’s role as editor of Modern School, Others and Broom. Ridge's work for these magazines, particularly Others and Broom, places her at the center of American modernism. My examination of Ridge's social poetry and her role as editor for two leading literary magazines, in conjunction with her use of multiple aesthetics, will build a strong case for why her work deserves to be recovered.

[pt] A tese objetiva examinar a responsabilidade internacional do Estado brasileiro pelos crimes perpetrados por agentes estatais, no contexto do regime militar (1964-1985), a partir da jurisprudência da Corte Interamericana de Direitos Humanos (Corte IDH). A análise considerará os precedentes normativos e jurisdicionais que embasaram as condenações do Estado brasileiro nos casos Julia Gomes Lund e outros vs. Brasil (2010) e Vladimir Herzog e outros vs. Brasil (2018). Em um primeiro momento, vislumbra-se apresentar o cenário de emergência das normativas internacionais relacionadas à responsabilidade penal dos indivíduos e à responsabilidade dos Estados. Uma vez apresentado o panorama normativo global, será elencado o case law da Corte IDH referente às graves violações de direitos humanos perpetradas, de modo sistemático e massivo, por meio dos aparatos burocráticos de poder estatais. Conforme será aventado, apenas em casos específicos, a Corte IDH utiliza conceitos atinentes ao direito penal internacional como base interpretativa das obrigações consubstanciadas na Convenção Americana de Direitos Humanos, construindo um verdadeiro diálogo entre esse ramo do direito e a normativa dos direitos humanos. Finalmente, a pesquisa se concentrará nos supracitados julgados, separados por quase uma década, mas que possuem em comum o contexto no qual os fatos dos casos ocorreram. Destacadamente, o caso Herzog traz em seu bojo a qualificação dos crimes contra a humanidade – um passo significativo, em relação ao caso Gomes Lund, para ativistas e operadores do direito no âmbito doméstico. The analysis will consider the normative and jurisdictional cases that served as precedents to the Brazilian State s convictions in the cases Julia Gomes Lund et al. vs. Brazil (2010) and Vladimir Herzog et al. vs. Brazil (2018). Initially, will be presented the emergency scenario of international regulations related to the criminal responsibility of individuals and the responsibility of States. Once the global normative panorama is presented, will be introduced the case law of the Inter-American Court regarding the serious violations of human rights perpetrated, in a systematic and massive way, through the bureaucratic apparatus of State power. As will be explained, only in specific cases, the Inter-American Court uses concepts of international criminal law as an interpretive basis for the obligations embodied in the American Convention of Human Rights, building a dialogue between this area of Law and the human rights normative. Finally, the research will focus on the aforementioned judgments, separated by almost a decade, but which share the context in which the facts of the cases occurred. Notably, the Herzog s case considers the qualification of crimes against humanity – a significant step, in relation to the Gomes Lund s case, for activists and legal practitioners in the domestic sphere. Under this bias, the present work intends to investigate to what extent the framing of crimes against humanity has the power to strengthen initiatives in favor of the criminal responsibility of the agents of the dictatorial regime and the contestation of repressive structures and practices still valid.

Unexpected consequences for the Swedish signals intelligence in the light of the European Court of Justice’s case law? : An analysis of the implications the joined cases La Quadrature du Net and others and the case Privacy International might have for the Swedish signals intelligence

The Court of Justice of the European Union has in its case law been strict in its approach towards Member States’ legislative measures providing for retention of and access to data relating to electronic communications. In recent case law the Court has made clear that also such provisions with the object of safeguarding national security need to comply with EU law and the Court’s jurisprudence. This might mean that the Swedish cable-based signals intelligence is within the scope of EU law contrary to the previous conception. It is decisive for whether the Swedish signals intelligence is within the scope of EU law whether the requirement on the providers of electronic communications systems to transfer all signals crossing the Swedish border to collaboration points, in order for the signals intelligence to be carried out, is to be interpreted as a requirement on the providers to process personal data. If within the scope of EU law, a great majority of the Swedish signals intelligence could be disproportionate in the light of the Court’s case law and thus contrary to EU law. Since the signals intelligence is considered to be an indispensable tool to solve all tasks the Swedish foreign intelligence encompasses this could affect the capability of the foreign intelligence.

Объектом исследования стал перфекционизм как устойчивая черта личности. Предметом исследования взаимосвязь перфекционизма с формально-динамическими и личностными особенностями взрослых 20–40 лет. Магистерская диссертация состоит из введения, двух глав, заключения, списка литературы (86 источников) и приложения, включающего в себя таблицы, корреляционные плеяды и диаграммы. Объем магистерской диссертации 103 страницы, на которых размещены 2 рисунка и 15 таблиц, не учитывая приложений. Во введении раскрывается разработанность проблематики и актуальность: в большинстве случаев исследования перфекционизма направлены на изучение его связи с различными психическими расстройствами и эмоциональными нарушениями, при этом остаётся малоизученным место перфекционизма в структуре личности, его взаимосвязь с формально-динамическими, характерологическими и мотивационными особенностями. На основании этого ставится цель: изучить индивидуально-типологические и личностные детерминанты перфекционизма. Формулируются гипотезы, в которых предполагается, что формально-динамические свойства и характер влияют на степень выраженности диспозиционного перфекционизма у взрослых 20–40 лет, а отдельные параметры перфекционизма связаны с разными психологическими особенностями взрослых. Указываются методы, эмпирическая база и теоретико-методологическая основа исследования, которая включает в себя когнитивную модель перфекционизма Г. Флетта и П. Хьюитта, биопсихосоциальную теорию темперамента В. М. Русалова; диспозиционный подход мотивации достижения Г. Шулера. Первая глава включает в себя обзор иностранной и отечественной литературы по теме перфекционизма. Представлены разделы, посвященные изучению понятия совершенства и перфекционизма в психологии и философии, моделям, формам, мотивационной основе и факторам развития перфекционизма. Выводы по первой главе представляют собой итоги по изучению теоретического материала. Вторая глава посвящена эмпирической части исследования. В ней представлено описание организации и методов проведенного исследования и результатов, полученных по всем использованным методикам: многомерная шкала перфекционизма П. Хьюитта и Г. Флетта в адаптации И.И. Грачевой; опросник мотивации достижения Ганса Шулера в адаптации (AMI сокращенный, адаптированный на кафедре педагогики и образования); батарейный тест-опросник «Темперамент-характер» В. М. Русалова, О. Н. Маноловой; опросник «Дифференциальный тип рефлексии» Д. А. Леонтьева, Е. М. Лаптевой, Е. Н. Осина и А. Ж. Салиховой; опросник «Уровень субъективного контроля» Е. Ф. Бажина, Е. А. Голынкина, Л. М. Эткинда. Также в главе представлен сравнительный, корреляционный и регрессионный анализ результатов исследования. Проанализирована связь отдельных параметров перфекционизма с темпераментом, акцентуациями характера, мотивацией достижения, уровнем субъективного контроля и типом рефлексии. Выводы по главе 2 включают в себя основные результаты эмпирического исследования, в которых выяснилось, что отдельные формально-динамические свойства индивидуальности влияют на степень выраженности диспозиционного перфекционизма у взрослых 20–40 лет, а отдельные составляющие перфекционизма связаны с мотивацией достижения, типом рефлексии и уровнем субъективного контроля. В заключении в обобщенном виде изложены результаты теоретической и эмпирической частей работы, а также выводы по выдвинутым гипотезам, обоснована теоретическая и практическая значимость исследования и описаны возможные перспективы дальнейшей разработки данной проблематики. / The object of the study was perfectionism as a stable personality trait. The subject of the study is the relationship of perfectionism with the formal-dynamic and personal characteristics of adults aged 20–40. The master's thesis consists of an introduction, two chapters, a conclusion, a list of references (86 sources) and an appendix, which includes tables, correlation pleiades and diagrams. The volume of the master's thesis is 103 pages, which contain 2 figures and 15 tables, not including applications. The introduction reveals the elaboration of the problematics and relevance: in most cases, studies of perfectionism are aimed at studying its connection with various mental disorders and emotional disorders, while the place of perfectionism in the personality structure, its relationship with formal dynamic, characterological and motivational features remains poorly understood. Based on this, the goal is set: to study the individual typological and personal determinants of perfectionism. Hypotheses are formulated in which it is assumed that formal-dynamic properties and character affect the severity of dispositional perfectionism in adults aged 20–40 years, and certain parameters of perfectionism are associated with different psychological characteristics of adults. The methods, empirical base and theoretical and methodological basis of the study are indicated, which includes the cognitive model of perfectionism by G. Flett and P. Hewitt, the biopsychosocial theory of temperament by V. M. Rusalov; G. Schuler's dispositional approach to achievement motivation. The first chapter includes a review of foreign and domestic literature on the topic of perfectionism. Sections devoted to the study of the concept of perfection and perfectionism in psychology and philosophy, models, forms, motivational basis and factors of development of perfectionism are presented. The conclusions on the first chapter are the results of the study of theoretical material. The second chapter is devoted to the empirical part of the study. It presents a description of the organization and methods of the study and the results obtained by all the methods used: the multidimensional scale of perfectionism by P. Hewitt and G. Flett, adapted by I.I. Gracheva; Hans Schuler's Achievement Motivation Questionnaire in Adaptation (abbreviated AMI, adapted at the Department of Pedagogy and Education); battery test questionnaire "Temperament-character" by V. M. Rusalov, O. N. Manolova; questionnaire "Differential type of reflection" by D. A. Leontiev, E. M. Lapteva, E. N. Osina and A. Zh. Salikhova; questionnaire "Level of subjective control" by E. F. Bazhina, E. A. Golynkina, L. M. Etkind. The chapter also presents a comparative, correlation and regression analysis of the results of the study. The relationship of individual parameters of perfectionism with temperament, character accentuations, achievement motivation, the level of subjective control and the type of reflection is analyzed. The conclusions in Chapter 2 include the main results of the empirical study, which revealed that certain formal-dynamic properties of individuality affect the severity of dispositional perfectionism in adults aged 20–40 years, and certain components of perfectionism are associated with achievement motivation, the type of reflection, and the level of subjective control. In the conclusion, the results of the theoretical and empirical parts of the work are summarized, as well as conclusions on the hypotheses put forward, the theoretical and practical significance of the study is substantiated, and possible prospects for further development of this issue are described.

Enfin, le droit international dispose d’un ensemble de règles relatives à la responsabilité des organisations internationales pour fait internationalement illicite. Après 10 ans de travail, la Commission du droit international est parvenue, en 2011, à élaborer un projet d'articles codifiant les règles en la matière. La tâche était pourtant délicate : assujettir ces entités dont la nature et le fonctionnement sont différents des Etats, à un ensemble de règles unique dans le domaine de la responsabilité internationale. L’objet de cette étude porte sur l’œuvre de codification effectuée par la Commission dans le projet d’articles. Il s’agit plus précisément d’analyser les techniques de codification utilisées par la Commission dans l’élaboration des règles applicables : s’agit-il d’une codification stricto sensu de la pratique ou bien de l’élaboration de nouvelles règles relevant du « développement progressif » du droit international ? La réponse apportée à cette question suppose préalablement de définir les sources de la codification en ce qui concerne chacune des dispositions du projet d’articles, en se demandant si elle concrétise une pratique bien établie des organisations internationales, ou au contraire une transposition des règles du projet d’articles sur la responsabilité de l’Etat, adaptées aux particularités des organisations internationales. L’autorité du projet d’articles ne semble pas, à l’heure actuelle, faire l’unanimité, et dans ce contexte, la présente étude portant sur le rapport entre codification et développement progressif dans l’œuvre de codification de la CDI permet d’apprécier l’autorité substantielle propre à chacune des dispositions du projet d’articles. D’autant qu’on ne sait absolument pas si une convention de codification sera adoptée, qui pourra ériger les dispositions du projet d’articles en normes juridiquement obligatoires. / The international law has finally a set of rules on the responsibility of the international organizations for internationally wrongful acts. After 10 years of work, the International Law Commission was able in 2011 to elaborate a draft articles codifying the rules on the matter. However the task was difficult: subject these entities, whose nature and functioning is different from States to a single set of rules in the field of international responsibility. The purpose of this study focuses on the work of codification made by the Commission in the draft articles. This is specifically to analyze the techniques of codification used by the Commission in the elaboration of the applicable rules: is it a codification sticto sensu of the practice or a creation of new rules under the "progressive development" of the international law? The answer to this question presupposes to define the sources of codification in each of the provisions of the draft articles concerned, wondering if it embodies a well-established practice of international organizations, or rather a transposition of the rules of the draft articles on States responsibility, adapted to the features of international organizations. At present the authority of the draft articles does not seem to have unanimity, and in this context, the present study on the relation between codification and progressive development in the codification work of ILC can appreciate the substantial own authority of each provisions of the draft articles. Especially that no one knows if a codification convention will be adopted, which will set the provisions of the draft articles up as legally binding norms.

Protection of Personal Data, a Power Struggle between the EU and the US: What implications might be facing the transfer of personal data from the EU to the US after the CJEU’s Safe Harbour ruling?

Since the US National Security Agency’s former contractor Edward Snowden exposed the Agency’s mass surveillance, the EU has been making a series of attempts toward a more safeguarded and stricter path concerning its data privacy protection. On 8 April 2014, the Court of Justice of the European Union (the CJEU) invalidated the EU Data Retention Directive 2006/24/EC on the basis of incompatibility with the Charter of Fundamental Rights of the European Union (the Charter). After this judgment, the CJEU examined the legality of the Safe Harbour Agreement, which had been the main legal basis for transfers of personal data from the EU to the US under Decision 2000/520/EC. Subsequently, on 6 October 2015, in the case of Schrems v Data Protection Commissioner, the CJEU declared the Safe Harbour Decision invalid. The ground for the Court’s judgment was the fact that the Decision enabled interference, by US public authorities, with the fundamental rights to privacy and personal data protection under Article 7 and 8 of the Charter, when processing the personal data of EU citizens. According to the judgment, this interference has been beyond what is strictly necessary and proportionate to the protection of national security and the persons concerned were not offered any administrative or judicial means of redress enabling the data relating to them to be accessed, rectified or erased. The Court’s analysis of the Safe Harbour was borne out of the EU Commission’s own previous assessments. Consequently, since the transfers of personal data between the EU and the US can no longer be carried out through the Safe Harbour, the EU legislature is left with the task to create a safer option, which will guarantee that the fundamental rights to privacy and protection of personal data of the EU citizens will be respected. However, although the EU is the party dictating the terms for these transatlantic transfers of personal data, the current provisions of the US law are able to provide for derogations from every possible renewed agreement unless they become compatible with the EU data privacy law. Moreover, as much business is at stake and prominent US companies are involved in this battle, the pressure toward the US is not only coming from the EU, but some American companies are also taking the fight for EU citizens’ right to privacy and protection of their personal data.

La problématique de l’exclusion, être altériséen raison de l’identité du droit, naît des silences de la comparaison différentielle France – Canada. Une critiqueidentitaire permet de déplacer la triple dialectique de la comparaison : positivisme c. pluralisme, universalisme c.différentialisme et républicanisme c. libéralisme pluraliste. La problématique de l’orientation identitaire du droitest commune aux deux systèmes juridiques. Aussi, la recherche est relative à l’identité du constitutionnalisme.L’exclusion se définit comme le décalage entre l’orientation identitaire du constitutionnalisme et l’identité ducorps du sujet. La méthode d’analyse proposée, afin de traiter de l’exclusion en droit, et déplacer la comparaison,est tripartite : mettre en évidence l’orientation identitaire du constitutionnalisme, en identifier la structureidentitaire, pour, enfin, en déterminer les étrangers ou « Autres. » La recherche vise à déplacer la comparaison enproduisant une phénoménologie de l’exclusion constitutionnelle, ou « dehors constitutifs, » avec une typologiedes étrangers du droit. La démonstration sera faite dans le cadre des conflits de la religion et de l’orientationsexuelle démontrant l’orientation blanche, hétéropatriarcale et hétéronormative du droit constitutionnel. / This research intends on proving how constitutionalism and exclusion collide one against the other through acritique of the french gaze on a supposedly canadian model of pluralism. The negative comparison’s silencesbetween France and Canada gave birth to this question of how one is being excluded and othered based on theidentity of constitutional law. This critique, that focuses on identities, is shifting those three dialectics supportingthe aforementioned negative comparison : positivism v. pluralism, universalism v. differentialism, republicanismv. liberal pluralism. France and Canada share the issue of how legal reality is oriented toward specific identities.This research, then, is a critique of constitutionalism identities. Exclusion is defined as the gap between theorientation of law’s identities and the bodily reality of its subjects. The analytical tool developed here to tackleexclusion in law has three steps : shedding light on the orientations of constitutionalism, its identity structure,and its constitutional Others. This research purports on turning scholars’ critical gaze towards thisphenomenology of constitutional exclusion, its « constitutive outside, » by deciphering a typology ofconstitutional Others. This will be so through the collisions of freedom of religion and sexual orientation.Constitutionalism is per se oriented towards the ascendency of whiteness, patriarcalism and heteronormativity.
