[pt] A partir da década de 1960, consolidou-se um movimento de crítica que passou a informar investigações que se propunham a desmitificar a legalidade dogmática tradicional a partir da aproximação entre Direito e Estado das práticas sociais e da crítica interdisciplinar, propondo uma nova racionalidade para desvelar os processos de dominação e de construção de verdades que sustentam as diversas formas de opressão social. Quanto aos direitos humanos, esse movimento se colocou a analisar primordialmente as teorias que assumiam um caráter universal desses direitos e de seus sujeitos, ignorando os contextos socioculturais nos quais se inseriam e eram produzidos. Contudo, teorias de direitos humanos localizadas como críticas – a exemplo de Costas Douzinas, Richard Rorty e Paul Ricoeur –, quando analisadas em seus pressupostos de fundamentação, parecem não dar conta da pluralidade de sujeitos e modos de vida que a realidade prática comporta e exige numa perspectiva pragmática dos direitos humanos. Isso parece observável quanto aos sujeitos que desviam da heterocisnormatividade compulsória, imposta por um esquema de verdades sobre a sexualidade e os gêneros ao qual a Teoria Queer – especialmente trabalhada por Judith Butler – impõe resistência, deslocando a potência da mudança social para os (não) sujeitos com sua agência política. Dessa forma, este trabalho aborda as teorias críticas de direitos humanos e sua produção de sujeitos e não sujeitos, contrapondo-as à proposta de agência política e produção dialética dos sujeitos, objetivando responder à questão da utilidade dessas teorias à construção de uma sociedade que reconheça a pluralidade humana, sem (pré)definições do que ou de quem será considerado digno de direitos humanos. / [en] From the 1960s onwards, a critical movement was consolidated, which began to inform investigations that sought to demystify the traditional dogmatic legality based on the approximation between the Law and the State of social practices and interdisciplinary criticism, proposing a new rationality to unveil the processes of domination and construction of truths that sustain the various forms of social oppression. About the human rights, this movement focused primarily on theories that assumed a universal character of these rights and their subjects, ignoring the sociocultural contexts in which they were inserted and produced. However, critical human rights theories – such as Costas Douzinas, Richard Rorty and Paul Ricoeur –, when analyzed in their presuppositions of justification, do not seem to account for the plurality of subjects and ways of life that practical reality entails and demands from a pragmatic perspective on human rights. This seems to be observable in the case of subjects who deviate from the compulsory hetercisnormativity, imposed by a scheme of truths about sexuality and gender, to which Queer Theory – especially worked by Judith Butler - imposes resistance, shifting the power of social change to the (not)subjects with their political agency. Therefore, this work approaches the critical theories of human rights and their production of subjects and non-subjects, opposing them to the proposal of political agency and the dialectic production of the subjects, aiming to answer the question of the usefulness of these theories to the construction of a society that recognizes the human plurality, without (pre)definitions of who or of whom will be considered worthy of human rights.

[pt] A recente emergência do termo violência obstétrica abarca uma grande carga de significados e possibilidades. Fruto da busca pela ruptura com as estruturas opressoras de poder impostas sobre os copos das mulheres em período gestacional no sistema de saúde, o termo é tão polêmico e impactante quanto a violência vivenciada por essas mulheres no mundo inteiro. Diante dos debates que a expressão suscita, este trabalho consiste na análise dos mecanismos de poder que perpetuam a violação de direitos das mulheres gestantes no sistema de saúde brasileiro, sob a perspectiva de Michel Foucault, e sua caracterização como violência de gênero, estruturante da sociedade capitalista ocidental. A partir da análise de tais mecanismos, considerando fatores como o racismo estrutural, classe e as disputas políticas que envolvem a atenção de saúde da mulher, bem como o arcabouço legal disponível, pretende-se traçar um panorama das possibilidades de prevenção e enfrentamento do problema no cenário brasileiro atual. / [en] The recently emerged term obstetric violence, is capable of great meaning and possibilities. Resulting from the struggle for rupture from oppressing structures of power imposed upon pregnant women s bodies in facility-based childbirth and other health services, this term is as polemic and powerful as the violence experienced by women all over the word. Considering the debates over this expression, the present research hopes to analyze the power dynamics that enable pregnant women s rights violation in Brazilian health-care system, using Michel Foucault s perspective, and a gender-based violence approach, that is built into the fabric of patriarchal capitalist society. Based on this analysis and considering facts such as structural racism, class and political disputes that surrounds women s healthcare attention, as well as the legal available support, it is hoped to provide an overview of possibilities for prevention and confrontation of the problem, in Brazilian current circumstances.

[pt] Esta pesquisa propõe-se a confrontar a decisão tomada pelo Supremo Tribunal Federal no julgamento da ADPF 153, com a posterior e divergente sentença da Corte Interamericana de Direitos Humanos proferida no caso Gomes Lund e outros vs. Brasil, referente ao evento conhecido como Guerrilha do Araguaia. Ambas as decisões envolvem a temática da justiça de transição no Brasil e analisaram a extensão e validade da anistia concedida pela Lei 6.683/79 às violações de direitos humanos ocorridas durante o regime militar brasileiro. Os resultados desses julgamentos, porém, foram fundamentalmente opostos. O STF, em abril de 2010, declarou a constitucionalidade e eficácia da Lei de Anistia brasileira, mantendo (e reafirmando) a interpretação oficial, que perdura desde 1979, de que essa lei obstaculiza o julgamento dos crimes comuns praticados por agentes da repressão contra civis durante o regime militar. Posteriormente e de modo contrário, a CIDH, em novembro de 2010, expressamente declarou carente de efeitos jurídicos essa mesma legislação e responsabilizou internacionalmente o Estado brasileiro por sua postura anistiante. O estudo se inicia demonstrando a vinculação jurídica do Estado brasileiro ao aparato normativo internacional dos direitos humanos, nos planos global e regional, e sua submissão à jurisdição da Corte Interamericana. Na seqüência, evidencia os fundamentos utilizados para sustentar as confrontantes decisões do STF e da CIDH. Por fim, traça uma análise acerca dos resultados desses dois julgamentos e suas consequências para o trato da justiça de transição no Brasil, nos seus aspectos de justiça, verdade, memória, reparação e reformas institucionais. / [en] This research proposes to confront the decision of the Brazil’s Supreme Federal Court in the ADPF 153’s judgment with the subsequent and divergent sentence of the Inter-American Court of Human Rights handed down in the case Gomes Lund and others vs. Brazil, refered to the event known as Araguaia Guerrilla. Both decisions involve the theme of Brazil’s transitional justice and analyzed the extent and validity of the amnesty granted by Law 6.683/79 to human rights violations, occurred during the brazilian military regime. The results of these trials, however, were fundamentally opposite to each other. Brazil’s Supreme Federal Court, in April of 2010, declared the constitutionality and efficacy of the brazilian Amnesty Law, maintaining (and reaffirming) the official interpretation, tha lasts since 1979, that this law doesn’t allow the prosecution of ordinary crimes committed by agents of repression against civilians during the military regime. Afterwards and in a contrary way, the Inter-American Court of Human Rights, in November of 2010, expressly declared that the same law has no legal effects and blamed the brazilian State internationally, precisely because of its amnestied stance. The study starts demonstrating the legal linkage of the the brazilian State to the international legal apparatus of human rights, at the global and regional levels, and its submission to the Inter-American Court’s jurisdiction. Subsequently, it evidences the arguments used to support the oppositte deciosions of the SFC and the IACHR. Finally, it outlines an analysis about those two judgements and their consequences for the treatment of transitional justice in Brazil, considering its aspects of justice, truth, memory, reparation and institutional reforms.

[pt] A indeterminação do conceito de intervenção humanitária é latente na literatura de Relações Internacionais e do Direito. Apesar de o tema intervenção humanitária ter feito parte da agenda internacional no período pós-Guerra Fria, o que tal prática constitui permanece sem consenso. O objetivo do presente trabalho é analisar a problemática da falta de consenso sobre o conceito de intervenção humanitária. Para tanto, serão analisados sete elementos do referido conceito: (i) o agente da intervenção; (ii) a necessidade ou não do uso da força; (iii) a postura do Estado-alvo em relação à ingerência externa; (iv) os beneficiários da intervenção; (v) as violações de direitos humanos que podem dar ensejo a uma intervenção humanitária; (vi) os objetivos da intervenção humanitária; (vii) o momento da intervenção. Em seguida, será analisado o caso do Timor Leste, a fim de demonstrar as implicações da falta de consenso acerca do referido conceito. Espera-se, assim, poder contribuir para o debate sobre o conceito de intervenção humanitária nas doutrinas de Relações Internacionais e do Direito. / [en] The International Relations and Law literature lacks a clear-cut definition of the concept of humanitarian intervention. Even though humanitarian intervention theme has been present in the political agenda of the post-Cold War period, there is no consensus around its meaning. The objective of the present work is to analyze the lack of consensus regarding the concept of humanitarian intervention. In order to achieve this task, we will analyze seven elements of the referred concept: (i) the agent of intervention; (ii) the use of force; (iii) the target State behavior regarding external intervention; (iv) the beneficiaries of intervention; (v) the human rights violations that enable the practice of humanitarian intervention; (vi) the goals of humanitarian intervention; (vii) the moment of intervention. The next step will be to study the East Timor case so as to demonstrate the implications of the lack of consensus regarding the referred concept. We hope, therefore, to contribute to the debate on the concept of humanitarian intervention in the International Relations and Law literature.

[pt] O objetivo central dessa dissertação é analisar as concepções dos assistentes sociais acerca dos direitos humanos a partir dos princípios que os fundamentam no Código de Ética do Serviço Social e no Estatuto da Criança e do Adolescente. No intuito de alcançar este objetivo, realizei uma ampla pesquisa bibliográfica acerca das categorias de estudo e analisei alguns documentos normativos da profissão e dos direitos da criança e do adolescente. Utilizei ainda, como método de abordagem, a pesquisa qualitativa e a técnica de entrevista semi-estruturada, orientada por um roteiro contendo perguntas abertas, direcionadas aos assistentes sociais, que atuam em instituições na área da criança e do adolescente no Espírito Santo. O referencial teórico adotado foi o método crítico-dialético, o que possibilitou analisar os direitos humanos enquanto um processo contraditório e de luta entre as classes que compõem a sociedade. Através do embate entre as classes, em vários momentos históricos, a classe trabalhadora avançou no sentido de inserir nas leis os direitos coletivos; porém, o controle do Estado está nas mãos dos que precisam expandir o capital. Assim, os direitos não são materializados em sua plenitude. A partir deste estudo, indico a necessidade de os profissionais terem clareza crítica dos fundamentos e funcionalidades da realidade posta, permitindo, assim, observar de forma mais nítida a não- efetivação dos direitos das crianças e dos adolescentes, e ainda avançar, juntamente com a luta geral dos trabalhadores, na materialização do Código de Ética em prol de uma sociedade mais justa. / [en] This study aims mainly at analyzing the conceptions of social workers about human rights based on the principles on which they are founded in the Social Work Code of Ethics and the Brazilian Statute for Children and Adolescents. Intending to achieve this objective, I carried out and extensive bibliographical research about the categories of study and analyzed some normative documents about the profession and about the children and adolescents` rights. As approach method, I also used qualitative research and semi-structured interview technique, which was guided by a script containing open ended questions, addressed to social professionals working in children and adolescents institutions in Espírito Santo. The theoretical basis adopted was the critical-dialectic method, which allowed analyzing human rights and as a contradict and social class struggle process. Through class struggle in several historical moments, the working class advanced towards inserting collective rights into the law. However, the control of the State is in the hands of those who need to expand capital therefore, rights are not fully materialized. From this study, I point out that these professional should be clearly critical about the fundaments and functionality of the posed reality, allowing thus, observing more clearly the non exercise of children and adolescents` rights, and also advance, together with the working class general struggle, towards the materialization of the Code of Ethics, for a fairer society.

[pt] Neste trabalho, procurei seguir os rastros de pimentas e vinagres das manifestações que tomaram as ruas do Brasil a partir de junho de 2013. Para isso, parti de um dossiê de denúncias redigido por nove organizações da sociedade civil brasileira em razão da realização da primeira audiência temática sobre protestos ocorrida em março de 2014 junto à Comissão Interamericana de Direitos Humanos da Organização dos Estados Americanos. Os rastros do dossiê se inseriam no universo do que chamei de ruas de papel que disputavam o papel das ruas, ou a verdade do que as ruas teriam sido. De modo emblemático, estas disputas evidenciavam o caráter político dos limites entre ordem e desordem, manifestantes e vândalos, cujas inscrições nos papéis apontavam para um labirinto de aporias e dissensos sobre violência, cidadania, direitos humanos e humanidade. Entre pimentas e vinagres, entre ruas e papéis, o reconhecimento de certas violências como violações de direitos humanos se (des)construía, revelando rastros de uma problemática mais profunda referente à contínua (re)fundação violenta do direito e da ordem através de referenciais negativos como a desordem e os vândalos. Diante das possibilidades de se render ou desafiar o labirinto, explorei um posicionamento em defesa da politização das práticas de autorização de autoridades e o engajamento com uma dimensão radical dos direitos humanos enquanto contracondutas críticas, táticas de subversão e estratégias de resistência. Neste percurso, procurei observar os fazeres dos direitos humanos materializados em uma teia complexa de instâncias e papéis em disputa, produzindo sujeitos, narrativas, destinos e verdades. / [en] In this dissertation, I followed the traces of peppers and vinegars from the demonstrations that took the streets of Brazil since June 2013. With this purpose, I departed from a dossier of denunciation written by nine Brazilian civil society organizations due to the realization of the first thematic audience on protests held in March 2014 at the Inter-American Commission on Human Rights of the Organization of American States. The traces of the dossier were embedded in the universe of what I called streets of paper that disputed the role of the streets, or the truth of what the streets would have been. These disputes were emblematic of the political character on the boundaries between order and disorder, demonstrators and vandals, whose inscriptions on the papers pointed to a labyrinth of aporias and dissents about violence, citizenship, human rights and humanity. Between peppers and vinegars, between streets and papers, the recognition of certain forms of violence as human rights violations was (de)constructed, revealing traces of a deeper problematic concerning the continuous violent (re)foundation of law and order, through negative references such as disorder and vandals. Faced with the possibilities of surrendering or challenging the labyrinth, I explored a position in defense of the politicization of the practices of authorization of authorities and the engagement with a radical dimension of human rights as critical counter-conducts, tactics of subversion and strategies of resistance. In this path, I sought to observe the makings of human rights materialized in a complex web of disputed instances and papers, producing subjects, narratives, destinies and truths.

[pt] Paralelo às transições do Cone Sul, a transição política para a democracia em Honduras iniciou no ano 1980 com um conjunto de caraterísticas singulares e atípicas que a distinguem do resto das transições do continente Latino-americano, visto que coincidiu com o período mais crítico de violação sistemática dos direitos humanos, incluindo desaparecimentos forçados, assassinatos e repressão política de mais de uma centena de cidadãos pertencentes aos movimentos sociais de esquerda e de oposição política. Em consequência, sob intensas lutas sociais, o dia 30 de agosto de cada ano é oficialmente reconhecido como o Dia Nacional dos Detidos-Desaparecidos em Honduras, em que centenas de pessoas se reúnem para exigir ao Estado que forneça os espaços pertinentes para reconhecer que em Honduras há desaparecidos políticos, assassinados e torturados. Diante desses acontecimentos, as perguntas que subjazem são: i) como podemos entender a relação entre os estudos e preceitos teóricos mais minimalistas das transições políticas para a democrática e essa lacerante contradição histórica ocorrida em Honduras? ii) é possível construir um futuro democrático sobre as bases de uma história negada e esquecida? Em razão desses questionamentos, decorre a necessidade e o grande desafio de desenvolver a presente pesquisa, referente à evolução da transição política e da memória em Honduras, relacionada ao passado traumático do período 1980-1993, visto que após mais de duas décadas da passagem das ditaduras militares e golpes de Estado para a democracia, percebem-se resquícios delatórios em sua estrutura atual, social e institucional. / [en] Simultaneously with the Southern Cone transitions, the political transition to democracy in Honduras began in 1980 with a unique and atypical characteristics that distinguish it from the rest of the Latin American transitions, since it coincided with the most critical period of systematic violations human rights, including forced disappearances, murders and political repression of more than a hundred citizens belonging to leftist social movements and political opposition. Consequently, under intense social struggles, August 30 is officially recognized as the National Day of the Detained-Disappeared citizens in Honduras, where hundreds of people come together to demand that the State provide appropriate efforts to recognize that political disappeared, murdered and tortured have taken place in Honduras. In this regard, the questions that arise are: i) how can we understand the relationship between studies and the more minimalistic theoretical precepts of political transitions to democracy and this lacerating historical contradiction that occurred in Honduras? ii) is it possible to build a democratic future on the basis of a neglected and forgotten history? Due to these questions, the need and the great challenge of developing the present research, referring to the evolution of the political transition and memory in Honduras, related to the traumatic past of the 1980-1993 period, arises, since after more than two decades of the military dictatorships and coups d état for the democratic transition, there are vestiges in its current social and institutional structure.

[pt] Este trabalho analisa as transformações normativas quanto à utilização da força pelo Conselho de Segurança (CS) das Nações Unidas e a maneira como United Nations Protection Force expressa essas mudanças. A expansão do regime de direitos humanos da ONU, combinada com o aumento da interdependência moral entre os Estados-membros dessa organização são a tônica das mudanças que desafiam os conceitos clássicos de segurança coletiva e soberania nacional. O primeiro, em razão da criação de instituições permanentes onde se debate o cumprimento desse regime, transformando, por isso, as expectativas dos Estados quanto ao comportamento dos demais. O segundo, por viabilizar o acesso às informações sobre possíveis violações aos direitos humanos. A forma como a ONU atuou no processo de desintegração da antiga Iugoslávia indica a ocorrência dessas transformações. A operação nesse país foi articulada de modo a garantir a integridade dos habitantes dessa região. As principais resoluções do CS relativas a esse conflito sinalizaram para um vínculo entre direitos humanos e o conceito de ameaça à paz previsto no art. 39 da Carta da ONU. Entretanto, os Estados membros não se demonstraram dispostos a arcar com os custos de uma operação de segurança que assegurasse o respeito a esses direitos. Isso indica que as normas favoráveis à intervenção humanitária coexistem com limitações baseadas nas políticas nacionais dos Estados. Porém, ao autorizar o uso da força para proteger grupos de seres humanos o CS adotou uma interpretação pós-westfaliana do sistema de segurança internacional da ONU, redefinindo o conceito clássico de soberania nacional. / [en] The paper analyzes normative transformations in the use of force by the Security Council of the United Nations and the way in which the UNPROFOR (United Nations Protection Force) expresses these changes. The growing widespread of the UN human rights regime combined with the increase on levels of moral interdependence among UN member states are at the center of transformations that challenge classical concepts of collective security and sovereignty. First, because of the creation of permanent institutions in which the fulfillment of this regime is debated, since they change State expectations regarding the behavior of other States. Second, for making the access of information concerning human rights violations possible. The way in which the UN acted in the process of disintegration of the former Yugoslavia indicates the occurrence of such transformations. The operation was planned to guarantee the integrity of the people in the region. The main resolutions of the SC regarding the conflict signaled a connection between human rights and the concept of threat to peace in accordance to the art. 39 of the UN Charter. Nevertheless, the member states did not seem inclined to undertake the costs of security operations that would guarantee the respect for such rights. That indicates that the rules favoring humanitarian intervention coexist with limitations derived from the domestic realm of politics. Nonetheless by authorizing the use of force for the protection of human beings, the SC adopted a post- Westphalian interpretation of the UN international security system, redefining the classical concept of national sovereignty.

[pt] Não se tem dúvida sobre o sopro de renovação produzido ao direito pela teoria dos direitos humanos. Contudo, há ainda um imenso deficit na implementação global dos direitos humanos, que a aliança entre liberalismo, democracia e direitos humanos não foi capaz de resolver. Assim, mostra-se imperiosa a formulação de uma teoria crítica capaz de dar conta de tal déficit e de questionar a afirmação de que o problema atual dos direitos humanos passa ao largo das escolhas teóricas. O papel da crítica deve ser entendido não com a pretensão de formulação de uma nova teoria dos direitos humanos nem tampouco como uma tentativa de sua desqualificação, mas, antes, na perspectiva da problematização, da desconstrução e da reformulação de alguns de seus conceitos fundamentais. A proposta se apoia na ideia de que a resistência política e a resistência epistemológica são complementares. Opta-se por Kant como ponto de partida em razão do papel central de seu pensamento na modernidade e à sua grande influência na formulação de conceitos basilares dos direitos humanos. Identificado o DNA kantiano, pretende-se construir uma alternativa crítica a partir do pensamento de Spinoza, que formula uma filosofia da imanência pura que pensa o homem como um modo expressivo da potência de Deus e o direito como potência. Três problemas principais atravessarão nossas reflexões: o da centralidade do homem na natureza e as dificuldades inerentes ao conceito de natureza humana; a diferença entre a moral kantiana do dever e a ética de Spinoza, fundada no critério do útil; e a relação entre moral, direito e política. / [fr] Les droits de l homme ont produit un renouvellement du formalisme juridique, il n y a pas de doute. Mais, de toute façon, il reste encore un énorme déficit dans la mise en oeuvre globale des droits de l homme, qui l alliance entre le libéralisme, la démocratie et les droits humains n a pas été en mesure de résoudre. Ainsi, il est nécessaire d élaborer une théorie critique qui soit capable de faire face à un tel déficit et de remettre en question l affirmation selon laquelle le problème actuel de droits de l homme n a rien avec les choix théoriques. Le rôle de la critique doit être compris non avec l intention de formuler une nouvelle théorie des droits de l homme, ni comme une tentative de disqualification, mais plutôt dans la perspective de questionnement, de déconstruction et de repenser certains de ses concepts fondamentaux. En bref, notre proposition est fondée sur l idée que la résistance politique et la résistance épistémologique sont complémentaires. Le choix de Kant comme le pivot de la critique découle du rôle central de sa pensée dans la modernité et de sa grande influence dans la formulation des concepts de base des droits humains. Identifié l ADN kantien, nous avons l intention de construire une alternative critique a partir de la pensée de Spinoza, qui formule une philosophie de la pure immanence dans laquelle l homme est une expression de la puissance de Dieu et le droit en tant que puissance. Trois grandes questions traverseront nos réflexions: la centralité de l homme dans la nature et les difficultés inhérentes à la notion de la nature humaine; la différence entre le devoir moral de Kant et l éthique de Spinoza, fondée sur le critère de l utilité; et la relation entre la morale, le droit et la politique.

[pt] Esta dissertação explora as formas modais de subjetividade que são atribuídas a pessoas LGBTI no discurso dos direitos humanos internacionais. Levam-se em consideração 8 vereditos do Comitê de Direitos Humanos, responsável pelo monitoramento do Pacto Internacional sobre Direitos Civis e Políticos, oferecendo-se uma leitura desconstrutiva dos mecanismos que participam da articulação dos sujeitos homossexuais e transgênero aí presentes. Sugere-se que as três representações encontradas, o homossexual legítimo, o ativista gay e o gay fora-da-lei podem ser entendidos como uma tentativa de despolitizar sexualidades desviantes, recobrindo-as sob arranjos normativos neoliberais e heterossexistas. À luz deste argumento, propõe-se uma leitura psicanalítica queer sobre a constituição subjetiva e corporal do sujeito, enfatizando as obras de Jacques Lacan, Judith Butler e Jacques Derrida. Ressaltando a contingência e a violência inerentes à organização libidinal, abre-se o caminho para uma compreensão radical da co-implicação da subjetividade e da comunidade política. Sob a égida dessa co-implicação, apresenta-se a noção de política de Jacques Rancière, revisando-a em relação ao conceito lacaniano do sinthome, de forma a propor um engajamento político-estético respaldado na quase-substãncia do sinthome, entendido como uma escrita contínua e contingente da intersecção entre o simbólico, o real e o imaginário. / [en] The dissertation explores the specific forms of subjectivity that are attributed to LGBTI individuals in international human rights law. It takes into consideration 8 rulings by the Human Rights Committee, the UN body charged with monitoring the International Covenant on Civil and Political Rights, and advances a deconstructive reading of the specific articulation of homosexual and transgender subjects contained in them. It suggests that the three representations found, the legitimate gay, the gay activist and the gay outlaw can be understood as an attempt to depoliticize deviant sexualities, subsuming them under neoliberal, heterosexist hegemonic normative arrangements. In view of this argument, it proposes a queer psychoanalytic reading of subjective and bodily constitutions, emphasizing Jacques Lacan s, Judith Butler s and Jacques Derrida s works. In highlighting the contingency and violence inherent to libidinal organization, it paves the way to a radical understanding of the co-implication of subjectivity and community. In light of this co-implication, Jacques Rancière s notion of politics is presented and reworked in light of Lacan s concept of Sinthome, in a way that appears to allow for an aesthetic political engagement based on the quasi-substance of the Sinthome as a contingent, continuous grafting of Lacan s three metaphysical orders, the real, the imaginary and the symbolic.
