An examination of prison, criminality and power in selected contemporary Kenyan and South African narratives

Thesis (PhD (English))--University of Stellenbosch, 2010. / ENGLISH ABSTRACT: This thesis undertakes a comparative examination of South African and Kenyan auto/biographical narratives of crime and imprisonment. Although some attention is paid to narratives of political imprisonment, the study focuses primarily on autobiographical accounts by criminals, confessional narratives, popular fiction about crime and prison experience, and journalistic accounts of prison life. There is very little critical work at this moment that refers to these forms of prison writing in South Africa and Kenya. Popular prison narratives and to a certain extent the autobiographical in general are characterised by an under-theorised dialecticism. As academic concepts, both the popular and the autobiographical form are characterised by an unstable duality. While the popular has been theorised as being both a field of resistance to power and of consent to its demands, the autobiographical occupies a similar precariously divided position, in this case between fact and fiction, a place where the „I‟ that narrates is simultaneously the subject and object of the narrative. In examining an eclectic body of texts that share the prison as common denominator, my study problematises the tension between self and world, popular and canonical, political and criminal, factual and fictional. In both settings, South Africa and Kenya, the prison as a material and discursive space does not only mirror society but effects shifts and changes in society, and becomes a space of dynamic adaptation and also a locus that disturbs certain hegemonic relations. The way in which the experience of prison opens up to a fundamentally unsettling ambiguity resonates with the ambivalence that characterises both autobiography as genre and the popular as a theoretical concept. My thesis argues that during the entire historical period covered by the narratives that I examine there is a certain excess that attends on the social production of criminality and the practice of imprisonment, both as material realities and as discursive concepts, which allows them to have a haunting effect both on individuals‟ notions of „the self‟ and the constitution of national identities and nationhoods. I argue that the distinction between the colonial and the postcolonial prison is hazy. Therefore a comparative study of Kenyan and South African prison literature helps us understand how modern prisons and notions of criminality in contemporary Africa are intertwined with the broad European colonial project, reflecting larger issues of state power and control over the populace. In relation to South Africa, my study begins with Ruth First‟s 117 Days (1963), and makes a selection of other prisons narratives throughout the apartheid era up to the post-apartheid period which was ushered in by Mandela‟s Long Walk to Freedom (1994). Moving beyond Mandela, I examine other forms of South African crime and prison narratives which have emerged since the publication of Pumla Gobodo-Madikizela‟s A Human Being Died that Night (2003) and Jonny Steinberg‟s The Number (2004). In Kenya, I begin with Ngugi wa Thiongo‟s Detained (1981). I then focus on popular narratives of crime and imprisonment which began with the publication of John Kiriamiti‟s My Life in Crime (1984) up to the first decade of the 21st century, marked yet again by the publication of Kiriamiti‟s My Life in Prison (2004). Besides Kiriamiti‟s two narratives, the other Kenyan texts which I examine are John Kiggia Kimani‟s Life and Times of a Bank Robber (1988) and Prison is not a Holiday Camp (1994), Benjamin Garth Bundeh‟s Birds of Kamiti (1991), and Charles Githae‟s, Comrade Inmate (1994). / AFRIKAANSE OPSOMMING: My proefskrif onderneem ‟n vergelykende studie van Suid-Afrikaanse en Keniaanse auto/biografiese narratiewe van misdaad en gevangeneskap. Hoewel aandag tot ‟n mate geskenk word aan verhale van politieke gevangeneskap, is die primêre fokus van die studie eerder op autobiografiese narratiewe deur misdadigers, konfessionele narratiewe, populêre fiksie met betrekking tot misdaad en gevangenis-ondervindinge, sowel as joernalistieke verslae oor gevangenes se lewens agter tralies. Min kritiese werk is tot dusver in verband met hierdie vorme van gevangenis-narratiewe in Suid-Afrika en Kenia gedoen. Populêre prisoniers-narratiewe, en tot ‟n mate autobiografieë oor die algemeen, word deur ‟n onder-geteoriseerde dialektisisme gekenmerk. As akademiese konsepte word beide die populêre en die autobiografiese vorme deur ‟n onstabiele dualisme gekenmerk. Terwyl die populêre tipe geteoretiseer word as sowel ‟n vorm van weerstand teen mag as van toegee daaraan, word aan die autobiografiese tipe ‟n soortgelyke onstabiele, verdeelde rol toegeskryf – in hierdie geval, tussen feitelikheid en fiksie, ‟n plek waar die “ek” wat vertel terselfdertyd die subjek en objek van die verhaal is. Deur middel van ‟n eklektiese versameling van tekste wat die gevangenis as verwysingspunt deel, problematiseer my verhandeling die spanning tussen self en wêreld, die populêre en die gekanoniseerde, die politieke en die kriminele, die feitelike en die fiktiewe. In beide kontekste, Suid-Afrika en Kenia, weerspieël die gevangenis as diskursiewe spasie nie alleenlik die gemeenskapsomgewing nie, maar veroorsaak dit ook veranderings en verskuiwings in die gemeenskap – sodoende word die gevangenis self ‟n ruimte van dinamiese verandering en ‟n plek wat sekere hegemoniese verhoudings versteur. Die manier waarop die ondervinding van gevangeneskap lei tot ‟n fundamentele versteurende dubbelsinningheid resoneer met die dubbelsinnigheid wat beide die autobiografiese as genre en die populêre as teoretiese konsep karakteriseer. My tesis voer aan dat, gedurende die ganse historiese tydperk wat gedek word deur die narratiewe wat ek hier betrag, daar ‟n sekere oormaat is wat die sosiale produksie van misdaad en die toepassing van gevangesetting begelei, beide as stoflike werklikhede en as diskursiewe konsepte, wat hulle toelaat om ‟n kwellende effek uit te oefen beide of individuele mense se sin van „self‟ en die samestelling van nasionale identiteite en nasionaliteite. Ek voer aan dat die onderskeid tussen die koloniale en die postkoloniale gevangenis onduidelik is, en dat ‟n vergelykende studie van Keniaanse en Suid-Afrikaanse gevangenes-narratiewe ons dus help om te verstaan hoe moderne tronke en idees oor misdaad in Afrika deureengevleg is met die breë Europese koloniale projek, en groter kwessies van staatsmag en beheer oor die bevolking weerspieël. Too foul and dishonoring to be overlooked : newspaper responses to controversial English stars in the Northeastern United States, 1820-1870

In the nineteenth century, theatre and newspapers were the dominant expressions of popular culture in the northeastern United States, and together formed a crucial discursive node in the ongoing negotiation of American national identity. Focusing on the five decades between 1820 and 1870, during which touring stars from Great Britain enjoyed their most lucrative years of popularity on United States stages, this dissertation examines three instances in which English performers entered into this nationalizing forum and became flashpoints for journalists seeking to define the nature and bounds of American citizenship and culture. In 1821, Edmund Kean’s refusal to perform in Boston caused a scandal that revealed a widespread fixation among social elites with delineating the ethnic and economic limits of citizenship in a republican nation. In 1849, an ongoing rivalry between the English tragedian William Charles Macready and his American competitor Edwin Forrest culminated in the deadly Astor Place riot. By configuring the actors as champions in a struggle between bourgeois authority and working-class populism, the New York press inserted these local events into international patterns of economic conflict and revolutionary violence. Nearly twenty years later, the arrival of the Lydia Thompson Burlesque Troupe in 1868 drew rhetoric that reflected the popular press’ growing preoccupation with gender, particularly the question of woman suffrage and the preservation of the United States’ international reputation as a powerfully masculine nation in the wake of the Civil War. Three distinct cultural currents pervade each of these case studies: the new nation’s anxieties about its former colonizer’s cultural influence, competing political and cultural ideologies within the United States, and the changing perspectives and agendas of the ascendant popular press. Exploring the points where these forces intersect, this dissertation aims to contribute to an understanding of how popular culture helped shape an emerging sense of American national identity. Ultimately, this dissertation argues that in the mid-nineteenth century northeastern United States, popular theatre, newspapers, and audiences all contributed to a single media formation in which controversial English performers became a rhetorical antipode against which “American” identity could be defined. / text

Cette étude s’attache à comprendre ce qu’est un habitat seigneurial secondaire en Hainaut à la fin du Moyen Age et aux Temps Modernes. La disparition de la plupart des résidences de la haute noblesse en Hainaut, nous a amenée à nous pencher sur l’étude des habitats de la petite noblesse, dont le manque de reconnaissance, entrainant la démolition ou les transformations irréversibles de ces habitats, rend ces édifices sujets à l’oubli. Ajoutons à cela que, victimes d’une tradition castrale héritée du 19e siècle, archéologues et historiens de l’art ont bien souvent eu leur attention d’abord attirée par les grands châteaux et donc la haute noblesse, laissant de côté toute une tranche de la population noble et de leurs possessions. Notre étude a comme objectif majeur de comprendre comment ces habitats ont fonctionné comme structures de vie, mais aussi comme des architectures à travers lesquelles et par lesquelles les habitants pouvaient exprimer leurs identités. Dans cette optique, après avoir considéré les différents types architecturaux (types de plans, types de corps de logis, types de tours), suivant une typo-chronologie, nous considérons les matériaux utilisés et la distribution intérieure de ces édifices. <p>Ce sont ensuite les entourages de l’habitat en tant qu’espace construit, leur situation dans le paysage, et par rapport au relief, à l’hydrographie, aux villages, aux terres de cultures, et aux réseaux de communication, qui occupent une grande partie de l’étude. Les liens avec leurs habitants, ces membres de la « petite noblesse » sont ensuite considérés. Leurs fonctions, leurs origines et leurs zones de déplacements sont abordés, afin de mieux percevoir le rôle et la détermination de ce groupe social, qui s’avère être en rupture avec la haute noblesse. L’opposition traditionnelle entre villes et campagnes est dépassée, de même que la question des maisons principales et secondaires, au profit d’une approche plus fluide, favorisant une interaction entre villes et campagnes, et considérant les mouvements de population émergeant de l’un ou l’autre milieu. <p>La partie interprétative suit ensuite, permettant d’aboutir à une caractérisation de ce type d’habitat. Le but est notamment de mettre en lumière la relation entre les aspects défensifs et résidentiels des édifices. Pour ce faire, les éléments de défense active et passive sont examinés, ainsi que le degré d’efficacité de ces structures. <p>La suite de cette partie a pour but de replacer les habitats de la petite noblesse dans le contexte des types architecturaux des campagnes, de la haute noblesse et des villes du Hainaut et des anciens Pays-Bas, afin de mieux dégager les liens ou les ruptures entre les différents groupes sociaux et architecturaux. Les rapports avec les habitats ruraux sont établis en ce qui concerne les diverses composantes que sont les douves, les pont-levis, les orifices de tir, les espaces verts et les aménagements hydrographiques d’agrément, la basse-cour, les tours, les typologies des plans et de maisons, les matériaux et leur qualité de mise en œuvre, les intérieurs, les ouvertures et les styles, les armoiries et les millésimes. La catégorie intermédiaire que sont les habitats des élites rurales, est également abordée, puisqu’elle développe des types architecturaux ambigus et se rapprochant davantage des habitats de la petite noblesse que des autres ruraux. Cette catégorie est examinée d’un point de vue architectural et social./This research is aiming at understanding what is a gentry’s settlement in the County of Hainault at the end of the Middle Ages and during the Modern Times. The disappearance of most of the castles of the high nobility in Hainault, led us to study the gentry’s settlement. The lack of recognition of this kind of building is often leading to their destruction and irreversible transformations. There is also the fact that the archaeologists and art historians often inherited from the 19th century tradition, whose attention was mostly attracted by the main castles and the high nobility, forgetting by the same occasion a side of the nobility –the gentry- and his settlement.<p>The main objective of this research is to understand how these settlements were linked with their inhabitants, expressing their identities, ways of living and behaviours. In this framework, we first analyse the architectural typologies (plans, residential buildings, towers) in connection with the chronology, the materials, and the inner organisation of these buildings.<p>Afterwards, we consider the surroundings of the buildings, the location in the landscape, the relief, hydrography, the village, the lands, the communication net. The lesser nobility is also studied, through its functions, origins, movement areas, in order to have a better understanding of the role and definition of this social group which is distinctly separated from the high nobility. The traditional opposition between cities and countryside, and between the main and secondary housing, is overstepped, in order to reach a more flexible approach. We therefore consider the topic through an interaction between cities and countryside, and their inhabitants.<p>The rest of the research is dedicated to the interpretations, in order to draw the characterists of the gentry’s settlement. First, the relationships between the defensive and residential aspects are considered. The active and passive defensive elements are studied, as well as the efficiency of these structures.<p>Secondly, we replace the gentry’s settlement in the context of the other architectural types of the countryside, high nobility and cities of the county of Hainaut and the Southern Low Countries, in order to have a better understanding of the links and breaks between the different social and architectural groups. The link with the rural settlement is established concerning the following elements :drawbridges, moats, arrow slits, green spaces and water structures, farms, towers, plans and houses typologies, materials and their quality, interiors, openings and styles, coats of arms. The intermediate category of the settlement of the rural elites is also considered, as the architectural types are close to the gentry’s settlement. This category is examined on an architectural and social point of view.<p>The link with the settlement of the cities and the high nobility is also studied, allowing to see a lack of link between the different categories at least until the end of the 17th century. <p>In the last chapters, the gentry’s settlement of Hainault is replaced in the context of the Southern Low Countries, through a comparative approach. We also consider the link with this kind of settlement and the tradition and the modernity, as well as the link with the social status of their inhabitants and builders.<p>The conclusion is the occasion to remind all the characteristics of the gentry’s settlement in Hainault, and the evolution of the architectural types through the centuries. Some comparisons with the same kind of settlement in surroundings countries are also established, opening new research perspectives. In the epilogue, we consider the buildings on a conservation, restoration and preservation point of view. In the stories of olden times and in those of our own American Indians, we learned of the picture writing of primitive peoples. It became an early method of recording people's thoughts. This was a very useful method at a time when the race was young. This in turn was the beginning of our alphabet, later the beginning of shaping letters into words, and then word into sentences and paragraphs. As our world has grown older, new idea have come into use and we are no longer content to live as our grandparents lived. We travel by fast express trains, high powered auto- mobiles, airplanes, or zeppelins. The radio gives us the news before our papers containing it are on the street. are not able to talk with people on the other side of the world. Business men find this a very valuable means of doing business when time means money. The motion pictures bring us the story of the book we have not had time to read and the characters from its pages talk to us from the screen. In short, we must have quicker ways of doing things.

The design of cultural centre is situated in part Kozia Hôrka( well-known city swimming pool), in its advantage takes natural scenery and calm atmosphere of place. Into action of performance brings a message in form of body of reservoir, function of centre is divided into small parts placed in area Kozia Hôrka. Orientation of objects comes mainly from local natural ispirations. Complex is multifunctional in concept, counts with several sorts of culture - sports events. Whereby the main function of swimming pool is preserved and added for higher comfort of inhabitants. Architecture of objects comes from idea of floating leaf on water level and body of reservoir. Objects stylizely illustrate this idea. The design takes the game of solids of organic and strictly ortogonal shapes. Two mutual opposites, in interaction. Objects smoothy and with respect encroach the environment, which is enough marked by human. Simplicity in used materials ( glass, steel, wood ) give transparency and purity to whole solution.

A Pragmatic Standard of Legal Validity

American jurisprudence currently applies two incompatible validity standards to determine which laws are enforceable. The natural law tradition evaluates validity by an uncertain standard of divine law, and its methodology relies on contradictory views of human reason. Legal positivism, on the other hand, relies on a methodology that commits the analytic fallacy, separates law from its application, and produces an incomplete model of law. These incompatible standards have created a schism in American jurisprudence that impairs the delivery of justice. This dissertation therefore formulates a new standard for legal validity. This new standard rejects the uncertainties and inconsistencies inherent in natural law theory. It also rejects the narrow linguistic methodology of legal positivism. In their stead, this dissertation adopts a pragmatic methodology that develops a standard for legal validity based on actual legal experience. This approach focuses on the operations of law and its effects upon ongoing human activities, and it evaluates legal principles by applying the experimental method to the social consequences they produce. Because legal history provides a long record of past experimentation with legal principles, legal history is an essential feature of this method. This new validity standard contains three principles. The principle of reason requires legal systems to respect every subject as a rational creature with a free will. The principle of reason also requires procedural due process to protect against the punishment of the innocent and the tyranny of the majority. Legal systems that respect their subjects' status as rational creatures with free wills permit their subjects to orient their own behavior. The principle of reason therefore requires substantive due process to ensure that laws provide dependable guideposts to individuals in orienting their behavior. The principle of consent recognizes that the legitimacy of law derives from the consent of those subject to its power. Common law custom, the doctrine of stare decisis, and legislation sanctioned by the subjects' legitimate representatives all evidence consent. The principle of autonomy establishes the authority of law. Laws must wield supremacy over political rulers, and political rulers must be subject to the same laws as other citizens. Political rulers may not arbitrarily alter the law to accord to their will. Legal history demonstrates that, in the absence of a validity standard based on these principles, legal systems will not treat their subjects as ends in themselves. They will inevitably treat their subjects as mere means to other ends. Once laws do this, men have no rest from evil.
