Politique européenne de coopération au développement et relations extérieures DES DROITS DE L’HOMME A LA BONNE GOUVERNANCE Impact de l’interdépendance du droit et du politique sur le choix des instruments de régulation

L'étude a porté sur deux outils élaborés par l’Union européenne à l'appui de ses politiques d'allocation d'aide extérieure au bénéfice principalement d'Etats en développement et participant à sa stratégie de promotion du respect de droits de l’homme dans les Etats tiers. Il s'agit du mécanisme de conditionnalité démocratique d’une part, et de la doctrine fondée sur le concept de gouvernance d’autre part. L'une des principales critiques que la doctrine adresse à l’Union au sujet de sa politique de conditionalité est son incapacité à répondre à l’une des attentes fondamentales qui la sous-tend, à savoir : la naissance d’une politique d’aide extérieure détachée des considérations géopolitiques et visant à protéger et promouvoir efficacement les droits de l’homme. Dans la mesure où la doctrine en attribue en général la responsabilité à l’absence de clarté et de prévisibilité du mécanisme de la conditionnalité démocratique, cette critique eut dû conduire à l’élaboration d’un régime davantage juridicisé. Or, l'émergence de la doctrine fondée sur le concept de gouvernance révèle que l’Union n’a pas opté pour une telle solution. C’est alors que, divisant mon étude en deux parties, la première affectée à l’étude du mécanisme conditionnel et la seconde affectée à l’étude de la doctrine de gouvernance, je me suis interrogée sur les raisons pour lesquelles l’Union avait pu choisir de recourir d’abord à un appel au droit, et ensuite à une repolitisation partielle de son mécanisme. Prenant appui sur une étude des documents officiels des institutions européennes, de la pratique de l'Union et des théories des relations internationales, l'étude tend à révéler les atouts et les limites théoriques de chacune de ces stratégies déstinées à suciter des réformes particulières dans les Etats partenaires de l’Union.Il apparaîtra que l’appel au droit opéré dans le cadre du mécanisme de conditionnalité répondait à des besoins et à une logique spécifiques lors de son institution, mais que la forme juridicisée du mécanisme conditionnel tel qu’institué se heurtait à diverses limites. La doctrine fondée sur le concept de gouvernance, dans le même temps qu’elle acte ces limites et tend à les dépasser, amène à de nouveaux questionnements. The study related to both EU tools, affecting its external aid policies and contributing to its human rights strategy : conditionality and governance. One of the main critic that the doctrine addresses to EU conditionality, is its incapacity to lead to an external aid free of geopolitical considerations and acting to protect and promote effectively the human rights. The doctrine explains this weakness by pointing out the mechanism of conditionality’s lack of clearness and previsibility. Despite this critic is pleading for a more legalized mechanism, the governance strategy reveals that the Union did not choose such a solution.Then, dividing the study into two parts, the first assigned to conditional mechanism and the second assigned to governance, I’m asking the reason why a less legalized mecanism succeeded to conditionality. Based on cooperation agreements, strategic orientations, EU practice and the international relations theories, the study tends to reveal the assets and limits of the two strategies. It appears that the legalization process of conditionality can be explained by specific needs but it encountered various limits. At the same times, while strategy based on Governance adresses some of them, this new tool reveals new questions.

Extern rådgivares påverkan i kreditprocessen för småföretag

Sammanfattning Vi har undersökt hur kreditprocessen påverkas ur kredithandläggarens perspektiv, av att det kreditsökande småföretaget använder sig av en extern rådgivare eftersom tidigare forskning tyder på att det blivit svårare för dessa företag ett erhålla finansiering från banker. Ändringen i förmånsrättslagen 2004 är en bidragande faktor till småföretagens prekära situation eftersom det försämrade bankens utdelning vid en eventuell företagskonkurs. När en småföretagares kunskaper inte räcker till, kan en extern rådgivare konsulteras för vägledning i kreditprocessen. Vårt syfte med uppsatsen var att beskriva kredithandläggarnas uppfattning om den externa rådgivarens olika funktioner i kreditprocessen samt att analysera hur kreditprocessen påverkas av att en extern rådgivare agerar i småföretagets intresse. Vi har genom en kvalitativ undersökning och studerat fyra kredithandläggare i fyra olika banker med erfarenhet av vårt ställda problem och fångat deras respektive betraktelser. Resultaten pekar på att respondenterna upplever problemet på ett liknande sätt och våra huvudsakliga slutsatser har framkommit efter att vi studerat den externa rådgivarens olika funktioner i kreditprocessen. Konsultation av extern rådgivning innebär att kunskap tillförs i kreditprocessen vilket leder till att ett mer genomarbetat beslutsunderlag kan presenteras för banken. Vidare ger en extern rådgivare legitimitet åt kredithandläggarens beslutsunderlag och ökar därmed förtroendet för småföretaget vilket kan förbättra relationen mellan de två sistnämnda parterna. En risk har belysts för kredithandläggaren med att den externa rådgivaren undanhåller viktig information eftersom denne har ett egenintresse av att småföretaget beviljas krediten då det kan leda till ett fortsatt framtida samarbete dem emellan. Abstract We have investigated the effect on the credit process out of the creditor’s point of view, when a small business consults an external adviser since earlier research indicates that it has become more difficult for these businesses to provide capital from banks. The alteration in the Law of priority in debtor’s property on credits 2004 is a contributory cause to the small businesses precarious situation since it deteriorated banks dividends in a possible liquidation. If a small businessman’s knowledge doesn’t ad up, an external adviser can be consulted as guidance in the credit process. Our purposes with this essay were to describe the creditor’s opinion regarding the external adviser’s different functions in the credit process and to analyze the effect on the credit process when an external adviser acts in the small business interest. Through a qualitative investigation we have studied four creditors in four different banks with experience from our named problem and captured their respective reflections. The result indicates that our creditors experience the problem in a similar way and our main conclusions have emerged by studying the external adviser’s different functions in the credit process. Consultation of an external adviser represents that knowledge provides the credit process which lead up to more thoroughly decision-making data to present for the bank. An external adviser also concedes legitimacy towards the creditor’s decision-making data and increases thereby the confidence towards the small business which can improve the relation between the two last mentioned parties. A risk have become elucidated for the creditor which means that the external adviser withhold important information due to ones own interest that the small business gets granted the credit since it can lead to a continuous future collaboration between them.

Chris Ware's Jimmy Corrigan: Honing the Hybridity of the Graphic Novel

The genre of comics has had a tumultuous career throughout the twentieth century: it has careened from wildly popular to being perceived as the source of society’s ills. Despite having been relegated to the lowest rung of the artistic ladder for the better part of the twentieth century, comics has been gaining in quality and respectability over the last couple of decades. My introductory chapter provides a broad, basic introduction to the genre of comics––its historical development, its different forms, and a survey of comics criticism over the last thirty years. In chapter two I clarify the nature of comics by comparing it to literature, film, and pictorial art, thereby highlighting its hybrid nature. It has elements in common with all of these, and yet it is a distinct genre. My primary focus is on Chris Ware, whom I introduce in chapter three, a brilliant creator who has garnered widespread recognition and respect. His magnum opus is Jimmy Corrigan: The Smartest Kid on Earth, the story of four generations of Corrigan men, most of whom have been negligent in raising their children. Jimmy Corrigan, as a result, is an introverted, insecure thirty–something–year–old man. Among comics creators Ware is unusual in that his story does not address socio–political issues, like most of his peers, which I discuss in chapter four. Jimmy Corrigan is an isolated tale with a very specific focus. Ware’s narrative is somewhat like those of William Faulkner, whose stories have a narrow focus, revolving around the lives of the inhabitants of Yoknapatawpha county, rather than encompassing the vast landscape of national socio–political concerns. Also, in chapter five I explore the intriguing combination of realist and Gothic elements––normally at opposite ends of the generic continuum––that Ware merges in Jimmy Corrigan. This feature is especially interesting because it is another way that his work explores aspects of hybridity. Finally, in my conclusion I examine the current state of comics in American culture and its future prospects for development and success, as well as the potential for future comics criticism.

Natural resources and the rural development challenge in Sudan: the case of the Greater Kordofan states

This study is a contribution to the research projects in Africa that are concerned with the analysis of the various conflicts that currently face the continent. Political, ethnic, religious, cultural, and other forms of conflicts have increased in number over the past five decades. The academic community has been making its contribution to the understanding and resolution of the conflicts through its research projects. The contributions of the academic community are widely acknowledged in this regard. This study is about those conflicts emanating from differences in the cultural interpretations of natural resources between crop farmers and nomadic herdsmen. The example selected belongs to those conflicts, which are entrenched in the cultural practices of rural communities. These conflicts are unique, since most of them predate the political, economic, and ethnic-based conflicts, most of which have emerged since the colonial era. Understanding these types of conflicts thus constitutes an important area of the development process of countries such as the Republic of Sudan, which already has many conflicts to contend with. The areas elected the North, South and West Kordofan States constitute some of the conflict hotspots of the Republic of Sudan in terms of the cultural-natural resource conflict dynamics. The understanding and resolution of the conflicts between the crop farmers and nomadic herdsmen in the region have the potential to offer enormous benefits to the peace needed for the long-term development of Sudan. The objectives of this study were chosen purposely to contribute to the research projects on the peace-conflict discourse of the Republic of Sudan. They were aimed at finding out how the cultures of the crop farmers and nomadic herdsmen of the Greater Kordofan states explain the conflicts and the efforts of the Sudanese authorities to help address them. The critical realist research approach has been selected as the framework for the study. This involved a number of steps. First, information on the nature of the current policies and plans of the government of Sudan to address the conflicts has been collected as one basic element of the challenge of development of the Greater Kordofan region. The challenge has been discussed in terms of the gap currently existing between the government’s peace building plan objectives on the one hand and the actual outcomes on the other. Next, information was collected from the relevant stakeholders on the reasons for the persistence of the conflicts between the nomadic herdsmen and the crop farmers despite the efforts on the part of the government at building peace between them. Generating information in this way led to the recommendation that the stakeholders identified in this study hold the key to the success of the attempts at building long-term peace between the crop farmers and the nomadic herdsmen of the Greater Kordofan States. The recommendations of the study are based on the idea that opportunities always exist for the stakeholders to introduce positive change in their society. / Environmental Sciences / Ph. D. Rural energy systems and the rural development process: a case study from Limpopo Province

The rapid and sustained development of the rural regions of South Africa continues to pose an extraordinary challenge to the development community of the country. Policy makers continue to be overwhelmed by the lack of development in the rural areas in spite of the various efforts made to develop them. A review of the publications and development plans of the study region indicates that the planners have for long been pre-occupied with taking limited perspectives of the development planning problems. Development plans have been conceived and implemented in terms of individual sectors instead of looking at their relations with other sectors and regions. This study seeks to make a contribution to the solution of the development problems of the rural areas of the former homeland regions by demonstrating how an integrated approach to the research process and to development planning could make a difference to the lives of the rural communities. Au cours des dernières années, les communautés virtuelles de patients se sont énormément développées sur l'Internet. Ces communautés permettent des échanges fréquents entre les patients, qui peuvent partager des informations liées à la santé dans un environnement interactif. Alors que beaucoup s'accordent sur l'opportunité représentée par ces communautés pour ses utilisateurs, les connaissances sur ce qui détermine l'action collective en ligne des patients ainsi que sur les fondamentaux de l'action collective en ligne dans ces espaces virtuels sont relativement peu développées. En conséquence, ce travail doctoral examine les raisons pour lesquelles les patients interagissent entre eux et comment ils procèdent. En nous appuyant sur le modèle du comportement orienté vers un but, la théorie de la valeur de l'attente, la théorie des forces du champ, les concepts de dons et les interviews menées, nous avons développé un modèle qui examine les interactions en ligne des patients dans un contexte d'action collective en ligne. Une approche multi-méthode, qualitative et quantitative, permet d'explorer les interactions des patients et de mesurer les déterminants de l'action collective en ligne sur ces espaces virtuels. L'analyse qualitative de 54 entretiens menés avec des patients, des proches de patients, des professionnels de la santé 2.0, des médecins et des soignants permet d'affiner le modèle de recherche, qui a ensuite été testé au travers d'une enquête quantitative auprès de 269 patients. Cette recherche contribue à la recherche en systèmes d'information en augmentant nos connaissances sur la dynamique individuelle et les interactions qui entourent les communautés de patients en ligne. / Over the last few years, virtual patients’communities have been developing tremendously over the Internet. These Web 2.0 communities allow frequent interactions among patients, who can share health-related information within an interactive environment. While many agree on the opportunity represented by those communities for its users, we know very little about what determines patients’ online collective action, specifically on virtual communities as well as the fundamentals of online collective action in these virtual spaces. Accordingly, this doctoral work examines why patients interact with others and how they interact on topics related to their disease through these virtual communities. Drawing on the goal-directed behavior (MGB), the expectancy-value (EVT) theories, the field force theory, gift concepts and field interviews, we have developed a model for examining patients’ online interactions and identified gift-giving behaviors in the context of online collective action. A multi-method, qualitative and quantitative approaches, enables us to explore patients’ interactions and measures the determinants of online collective action on these virtual spaces. The qualitative analysis of 54 interviews conducted with patients, patient’s relatives, Health 2.0 professionals, doctors and caregivers allows refining the research model, which has then been tested through a survey handled with 269 patients, members of patient’s communities. This research contributes to IS research by increasing our knowledge regarding the individual dynamics and interactions that surround online patients’ communities.

The first intention of this thesis is to identify, define, and organize the different subgenres that appear within the twenty-first century iterations of the musical film. The second, and principal, intention of this thesis is to explore contemporary representations of African-Americans, women, and queerness throughout the defined subgenres. Within this thesis, key films are analyzed from within each subgenre to understand these textual representations.

Mirrors and Vanities is a multi-modal collection which showcases the diversity of working in long and short storytelling forms. Featured in this thesis are fiction, nonfiction, graphic narrative, and screenplay. Using unconventional approaches to storytelling in order to achieve emotional resonance with the audience while maintaining high standards for craft, these stories and essays explore the costs inherent to the subtle nuances of interpersonal relationships. The fiction focuses on the complications of characters keeping secrets. A husband discovers the truth behind his wife’s miscarriage. A girl visits her fiancé in purgatory. A boy crosses a line and loses his best friend. Meanwhile, the nonfiction centers on self-discovery and gender roles associated with power struggles. A schizophrenic threatens to ruin my mother’s wedding. I rediscover my relationship with my father through food writing. Sword-work teaches me to fail and succeed at making martial art. The title work of the thesis is a collaged story highlighting the tribulations of a physicist fixated on recovering his lost love by manipulating the multiverse. The multi-modal format implicates the nebulosity of physics theories and how different aspects of the narrative can be presented in various formats to best suit the nature of the storytelling. Through the interactions of characters in mundane and extraordinary circumstances, the works in this thesis examine the consequences of choice, the contrast between reality and expectation, coming of age, and the Truth of narrative.
