Ensaismo, ação coletiva e Estado nacional : uma metainterpretação de obras selecionadas da literatura Brasiliana / Essays, collective action and national state : a meta-interpretation of selected works of Brasiliana Literature

O objetivo da tese é expor o movimento de coordenação coletiva que subjaz a um conjunto selecionado de obras de autores brasileiros da primeira metade do século XX reunidas sob o título Coleção Brasiliana. Sustenta-se a hipótese de que esse grupo de intelectuais interveio regularmente no debate público durante três ou quatro décadas do século passado de forma racional e concertada com vistas a construir no futuro próximo um Estado nacional no Brasil. Se o diagnóstico procede, esteve-se às voltas com um problema de ação coletiva, posto que um Estado de tipo nacional é um bem público. A estratégia de solução intraelite consistiu na criação de uma cultura política de massas baseada na idéia de ?imperativo nacional? que, mobilizando ideologicamente a opinião pública e os governantes, logrou êxito quanto aos objetivos inscritos de antemão em sua retórica: por fim à desordem, restituir a organização da nação e criar instituições políticas congruentes com a realidade do país. Para efeito do trabalho ora apresentado, os processos de state building envolvem, entre os itens de maior importância, a territorialização eficaz, a legitimação da autoridade pública e a organização da solidariedade social. No caso do Brasil, uma vez resolvido o dilema de ação coletiva relativamente aos intelectuais, emergiria mais tarde, em 1937, a estrutura institucional destinada a fixar regras, reduzir incertezas e/ou custos de informação, dotar os atores de expectativas recíprocas, enfim, trazer regularidade e curso estável às trocas entre os indivíduos: o Estado Novo. O trabalho se divide em quatro capítulos, seguidos de considerações finais ligeiras. No Capítulo I, realizo um balanço pessoal sobre a recepção da rationalchoice no meio acadêmico brasileiro, além de chamar a atenção para certas estigmatizações comuns. No Capítulo II, o conceito de racionalidade individual é submetido a exame epistêmico e ontológico não exaustivo. Busco ainda aproximá-lo de aspectos externos que tendem a alterar sua substância na origem. No Capítulo III, ofereço o referencial geral sobre a formação dos estados nacionais, afora indicações rápidas quanto aos desafios que os esperam no século XXI. No Capítulo IV, última parte do texto, observo de maneira panorâmica as etapas de formação do Estado nacional no Brasil para depois discutir o modelo de país que os intelectuais brasilianos tinham em mente para o século XX. Também procuro especificar o método de trabalho (escolha dos autores, organização por tópicos e aplicação da perspectiva neo-institucionalista). As páginas restantes se destinam à exposição das idéias brasilianas. Fecho a tese com uma síntese geral acrescida de análise sobre a coordenação dos intelectuais em torno do projeto de Estado-nação no Brasil / The object of this thesis is to expose the movement of collective coordination which underlies a selected body of pieces by Brazilian authors of the first half of the twentieth century reunited under the title Coleção Brasiliana. The hypothesis is that this group of intellectuals regularly intervened in public debate for three or four decades of the last century in a rational and orchestrated manner in order to build in a near future a national estate in Brazil. If the diagnosis is justified, they were dealing with a collective action problem since a national estate is public good. The intraelite solving strategy consisted in the creation of political culture of mass based on the national imperative idea which by ideological mobilization of public opinion and government succeeded concerning the aims previously registered in their speech: to put an end to disarray, to restitute nation organization and to create political institutions congruent with the reality of the country. For the purpose of this work processes involve, among the most important items, state building the effective territorialization, legitimization of public authorities and organization of social solidarity. In the case of Brazil, once all the collective action dilemmas regarding intellectuals were solved, later in 1937, institutional structure would emerge, established to fix rules, to reduce uncertainty and/or information cost, to endow the actors of mutual expectations, ultimately to bring regularity and stability to the exchange between individuals: the Estado Novo. The work is divided into four chapters followed by brief final considerations. In Chapter 1, I make a personal evaluation of the reception of rational choice in Brazilian academic circles, besides calling attention to certain common stigmatizations. In Chapter 2, the concept of individual rationality is submitted to epistemic and ontological non-exhaustive examination. I make an additional effort to bring it closer to external aspects which tend to alter its substance in origin. In Chapter 3, I offer general reference about the establishment of national states as well as short indications of the challenges that waite for them in the XXI century. In Chapter 4, the last part of the text, I give an overall look at the steps of the formation of the national state in Brazil in order to discuss the country model which the brasilianos had in mind for the XX century. I also aim to specify the work method (choice of the authors, organization of the topics and application of neo-institutionalistic perspective). The remaining pages are intended for exhibition of the ideas of the brasilianos. I close the thesis with a broad summary added to an analysis about the intellectual coordination of the project of the nation-estate in Brazil

Le capital social comme ressource intégrative d’une société locale / The social capital as an integrative resource for a local society

La recherche s'est occupée des liens de solidarité qui se créent à partir d’actions bénévoles spontanées au sein d’une communauté territoriale. L’ensemble de ces liens a été traité telle une ressource sociale conceptualisable par la notion de « capital social solidaire » et ce dernier a été considéré comme un bien public pouvant favoriser le bien-être social d’une société locale. De cette ressource, nous avons tenté d'en comprendre : 1) ses spécificités ; 2) son processus de micro-fondation ; 3) ses implications théoriques pour une théorie de la société. Le premier but a été atteint en dressant la carte des actions bénévoles mises en place dans deux provinces du nord-est de l’Italie (Trente et Trévise). La carte a montré un cadre hétérogène et diffus d’actions mises en place par les principales catégories d’acteurs de la société locale. Pour analyser le processus de création, les raisons des promoteurs ont été identifiées grâce à une série d’entretiens biographiques Les résultats des entretiens montrent une pluralité de motivations qui soutiennent ces actions et les limites de la théorie du choix rationnel à les expliquer. En ce qui concerne le troisième but, la réflexion a essayé d’éclaircir la nature de bien public du capital social et son utilité pour les débats sur la société civile et sur la cohésion sociale. Cette recherche a mis en évidence, d’une part, la contribution du capital social solidaire dans la valorisation du lien social et, de l’autre, l’utilité de la notion dans les analyses du courant associationniste de la société civile et dans les modèles individualistes de type communautaire de la cohésion sociale. / The research work presented in this doctoral thesis analysed the solidaristic bonds generated by spontaneous voluntary actions within a territorial community. Such bonds form a distinctive social resource conceptualized as “solidaristic social capital”, meant as a public good that benefits the social well-being of a local society. Three main aspects of this resource were investigated: 1) its specificities; 2) the process of its micro-foundation; 3) its theoretical implications for a theory of society. As for the first aspect, a survey of voluntary actions was conducted in two provinces in North-Eastern Italy (Trento and Treviso). Data showed a variety of types of actions producing solidaristic bonds, carried out by a heterogeneous set of social groups. In order to explain the generative process of social capital, a series of biographical interviews were conducted, which shed light on the life stories of promoters of voluntary actions, as well as on the limitations of the rational choice theory in accounting for the complexity of their motivations. Finally, the main theoretical implications of the notion of social capital were discussed, focusing on its nature as a public good and on its contribution to a theory of civil society and social cohesion. On the one hand, the solidaristic social capital emerged as a source that helps strengthen social bonds. On the other, this notion might play a crucial role in the theoretical elaborations based on the associationalistic approach to civil society and on individualistic models of community type of social cohesion.

The current legal scenario lives a unique moment of transition, marked, notably by the rise of principles as insertion of values to Law and legal interpretation, as constitutive activity. The Social Democratic Law State implies the intervention of the state, within the limits of the law, in order to achieve the fundamental objectives of the Republic. The principle of social solidarity in a staggered way, and decreasing, is related to the principle of contributive capacity, proportionality, progressiveness and selectivity, which are the most able to render effective to that principle. Whether for tax or extra tax purposes, social solidarity can be applied only through taxing, or taxes, that, like them, are able to measure the economic potential of the taxpayer / O objetivo da presente dissertação consiste em analisar a forma como a solidariedade social pode ser aplicada por meio do Direito Tributário. O cenário jurídico atual vive momento peculiar e de transição, marcado, notadamente, pela ascensão dos princípios como inserção de valores ao Direito e a interpretação jurídica, como atividade constitutiva. O Estado Social Democrático de Direito implica a intervenção do Estado, nos limites da lei, em prol da realização dos objetivos fundamentais da República. [pt] Violência urbana e omissões estatais: da irresponsabilidade à responsabilidade – uma análise das transformações da responsabilidade civil do Estado à luz da teoria dos Direitos Fundamentais investiga os rumos da responsabilidade civil do Estado – sobretudo na modalidade omissiva –, conectando o problema à questão da violência urbana. Embora a responsabilidade civil do Estado (independentemente de culpa) já faça parte da tradição constitucional brasileira há décadas, são raras as indagações teóricas – bem assim as decisões judiciais – que responsabilizam civilmente o Estado pelos danos sofridos pelos cidadãos resultantes da violência urbana (podemos dizer que embora a responsabilidade civil objetiva do Estado faça parte da tradição constitucional brasileira há muitas décadas, as consequências interpretativas ainda não foram adequadamente desenvolvidas). A tese, nesse contexto, analisa criticamente a jurisprudência brasileira relativa ao problema, apontando falhas de coerência e possível ausência de consistência teórica do padrão mental convencional a respeito do tema. A violência urbana, hoje, embora constitucionalmente conectada às funções estatais (ninguém põe em dúvida que o dever de prestar segurança pública é um dever do Estado), é um território de ninguém, no que diz respeito à assunção – jurídica – dos riscos, particularmente no que se refere à responsabilidade civil do Estado. A pesquisa questiona se há, nestas primeiras décadas do século XXI, uma rede de conexões normativas e conceituais que permitam repensar o problema (convém lembrar que há, nas sociedades contemporâneas, uma constante reavaliação dos riscos que são socialmente aceitáveis, bem como há uma dinâmica reavaliação de quem são os responsáveis por eles). Busca-se, por fim, a construção de um modelo teórico para a responsabilização estatal por omissão nos casos de violência urbana, a partir das categorias conceituais da responsabilidade objetiva agravada e do fortuito interno. / [en] Urban violence and State omissions: from irresponsibility to responsibility - an analysis of State liability s transformations under the Fundamental Rights theory investigates the courses of State liability, especially in the omission way, connecting the problem to urban violence issue. Although State liability (regardless of guilt) has already been part of the Brazilian constitutional tradition for decades, there are scarce theoretical inquiries - as well as judicial decisions - that make the State civilly liable for the damages suffered by citizens resulting from urban violence (we can say that although State strict liability has been part of the Brazilian constitutional tradition for many decades, the interpretative consequences have not yet been adequately developed). The thesis, in this context, critically analyzes the Brazilian jurisprudence about the problem, pointing out flaws of coherence and possible lack of theoretical consistency of conventional mental standard about the subject. Today, the urban violence, although constitutionally connected to state functions (no one doubts that the duty to provide public security is a state duty), is a no one territory, in regard to juridical assumption of risks, particularly in what concern State liability. The research questions the existence of a network of normative and conceptual connections that allow us to rethink the problem in these first 21st century decades (we must remember that, in contemporary societies, there is a constant reassessment about the risks that are socially acceptable, as well as dynamic reassessment about who are responsible for them). Finally, we aim to construct a theoretical model for State liability by omission in urban violence cases, based on conceptual categories of aggravated strict liability and internal fortuitous event.

Reparação de danos pelo incapaz (artigo 928 do Código Civil) / Indemnification payment by the disabled: article 928 from the Civil Code

The unfair payment of indemnification is denied by the individuals and those factors determine that the victim shall not stay without any sort of reparation, even in case of damage caused by a disabled, but financially able to pay for at least part of such indemnification. Thus, based on equity, it was introduced in our legal system that The disabled is liable for the damage that he may cause, if the ones for him responsible are not obliged to do so or do not possess the means for that. (Article 928 from the Civil Code of 2002 caput). However, as it deals with disabled people, the liability of indemnifying is subsidiary to the one of his legal representative or responsible person and must attend the concepts from the unique paragraph from the article 928: The indemnification predicted in this article, that shall be equitable, will not be valid if it removes from the disabled person his basic needs or even from the ones dependent on him. The current Civil Code followed the world tendency of making the victim in dene, whenever possible, based on the sociality, human being dignity, justice feeling, and when it comes to the disabled person, especially, on equity, that became the main point of the law enforcer. Such are the requirements for the assets of the disabled to answer for the damages caused by him: (i) the illegal act performed by the disabled would make a legally capable person responsible, in a similar situation; (ii) causation between fact and damage, injury (iii) that his responsible does not have the legal duty to answer for the damage or cannot afford the indemnification; (iv) fixation of equity as it is impossible to compromise his survival or his dependent s basic needs. Consequently, it tends to promote the social life of the disabled, granting them guarantees of constitutional rights and integration, and to the society a better result concerning the indemnification of possible damage caused by them. Although the victim shall stay with no due reparation if the responsible person does not have the legal duty for that or, no means to support such indemnification, and the disabled could not afford any indemnification without losing his basic needs for survival or of his dependents / O ordenamento jurídico absorve os fatos sociais e se transforma de acordo com os interesses, anseios e valores éticos e morais predominantes na sociedade, que hoje se preocupa com o equilíbrio, a justiça, o social. O dano injusto é repudiado pelos indivíduos e esses fatores determinaram que a vítima não deve ficar sem alguma reparação, mesmo diante de um dano causado por pessoa incapaz, mas com condições financeiras para arcar com pelo menos parte da reparação. Nesse sentido, com fundamento na eqüidade, foi introduzido em nosso ordenamento jurídico que O incapaz responde pelos prejuízos que causar, se as pessoas por ele responsáveis não tiverem obrigação de fazê-lo ou não dispuserem de meios suficientes (art. 928, caput, do CC de 2002). Entretanto, por se tratar de pessoa incapaz, a obrigação de reparar é subsidiária à do seu responsável e deverá atender aos preceitos do parágrafo único do art. 928: A indenização prevista neste artigo, que deverá ser eqüitativa, não terá lugar se privar do necessário o incapaz ou as pessoas que dele dependem . O atual Código Civil acompanhou a tendência mundial de tornar a vítima in dene, sempre que possível, calcada na socialidade, na dignidade da pessoa humana, no sentimento de justiça e, tratando-se do incapaz, principalmente, na eqüidade, que direciona o aplicador do direito. São requisitos para que o patrimônio do incapaz responda pelos danos a que der causa: (i) que o ato danoso praticado pelo incapaz responsabilize pessoa imputável em circunstância análoga; (ii) que haja nexo de causalidade entre o fato e o dano; (iii) que o seu responsável não tenha o dever legal de fazê-lo ou não tenha meios para arcar com a reparação; (iv) fixação com eqüidade em face da impossibilidade de comprometer seu sustento ou de seus dependentes. Dessa forma, pretende-se incentivar o convívio social do incapaz, garantindo-lhe o direito constitucional de integração e à sociedade uma maior eficácia da reparação de eventuais danos causados por ele. Mas a vítima ficará sem a devida reparação dos prejuízos que sofreu por ato praticado por incapaz se o responsável não tiver a obrigação legal ou não dispuser de meios suficientes e o incapaz não tiver condições de arcar com qualquer reparação sem comprometer seu sustento ou o de seus dependentes

Solidariedade e responsabilidade : o tratamento jurídico dos efeitos da criminalidade violenta no transporte público de pessoas no Brasil

Ce travail essaie d’analyser l’affirmation courante dans la dogmatique brésilienne de ce que les règles de la responsabilité civile objective sont destinées à concrétiser la valeur de la solidarité sociale inscrite dans la Constitution Fédérale du Brésil (article 3, III, in fine) et la directrice de la socialité présente dans le Code Civil de 2002. L’étude commence par la description d’un risque social – la criminalité urbaine violente – et par la présentation de la relation entre une certaine forme historique de manifestation de ce risque et de l’augmentation des cas judiciaires concernant la responsabilité des entreprises de transport urbain pour dommages subis par leurs passagers à cause d’actes violents pratiqués par des tiers lors du trajet. Dans la deuxième partie, on présente les origines du discours de solidarisme juridique et les influences de celui-là sur certaines constructions dogmatiques concernant le phénomène de la responsabilité civile. Finalement, ayant pour base des recherches menées à propos de la jurisprudence de deux tribunaux supérieurs brésiliens (le Supremo Tribunal Federal et le Superior Tribunal de Justiça) on analyse le fond de ces décisions, essayant d’identifier à quel point le discours théorique de la dogmatique est effectivement incorporé au moment de l’application des concepts juridiques implicite dans certains problèmes concrets. / O presente trabalho pretende analisar a afirmação corrente, na dogmática civilística brasileira, de que as regras da responsabilidade civil objetiva se destinam a concretizar o valor da solidariedade social inscrito na Constituição Federal (art. 3º, III, in fine) e a diretriz da socialidade presente no Código Civil de 2002. O estudo é feito, inicialmente, por meio da descrição de um risco social – criminalidade urbana violenta – e da apresentação da relação entre uma determinada forma histórica de manifestação desse risco e o aumento dos casos judiciais envolvendo a responsabilidade das empresas de transporte urbano em face de danos sofridos por seus passageiros em razão de atos violentos praticados por terceiros durante o trajeto. Em um segundo momento, são apresentadas as origens do discurso do solidarismo jurídico e as influências desse sobre certas construções dogmáticas relativas ao fenômeno da responsabilidade civil. The study is done initially through the description of a social risk – violent urban criminality – and the presentation of a relationship between a certain historical form this risk takes and the increase in legal cases involving the responsibility of public transportation companies for damage incurred upon their passengers due to violent acts practiced by third parties on the itinerary. In the second part, we present the origins of the discourse of legal solidarism, and its influence upon certain dogmatic constructions concerning the phenomenon of civil responsibility. Finally, based on research done about the jurisprudence of two Brazilian superior tribunals (the Supremo Tribunal Federal and the Superior Tribunal de Justiça), we analyze the contents of those decisions, aiming at identifying to what extent the theoretical discourse of dogmatic is actually incorporated into the moment of applying the legal concepts implicit in the treatment of certain concrete problems.

In the second part, we present the origins of the discourse of legal solidarism, and its influence upon certain dogmatic constructions concerning the phenomenon of civil responsibility. Finally, based on research done about the jurisprudence of two Brazilian superior tribunals (the Supremo Tribunal Federal and the Superior Tribunal de Justiça), we analyze the contents of those decisions, aiming at identifying to what extent the theoretical discourse of dogmatic is actually incorporated into the moment of applying the legal concepts implicit in the treatment of certain concrete problems.

Solidariedade e responsabilidade : o tratamento jurídico dos efeitos da criminalidade violenta no transporte público de pessoas no Brasil

Ce travail essaie d’analyser l’affirmation courante dans la dogmatique brésilienne de ce que les règles de la responsabilité civile objective sont destinées à concrétiser la valeur de la solidarité sociale inscrite dans la Constitution Fédérale du Brésil (article 3, III, in fine) et la directrice de la socialité présente dans le Code Civil de 2002. L’étude commence par la description d’un risque social – la criminalité urbaine violente – et par la présentation de la relation entre une certaine forme historique de manifestation de ce risque et de l’augmentation des cas judiciaires concernant la responsabilité des entreprises de transport urbain pour dommages subis par leurs passagers à cause d’actes violents pratiqués par des tiers lors du trajet. Dans la deuxième partie, on présente les origines du discours de solidarisme juridique et les influences de celui-là sur certaines constructions dogmatiques concernant le phénomène de la responsabilité civile. Finalement, ayant pour base des recherches menées à propos de la jurisprudence de deux tribunaux supérieurs brésiliens (le Supremo Tribunal Federal et le Superior Tribunal de Justiça) on analyse le fond de ces décisions, essayant d’identifier à quel point le discours théorique de la dogmatique est effectivement incorporé au moment de l’application des concepts juridiques implicite dans certains problèmes concrets. / O presente trabalho pretende analisar a afirmação corrente, na dogmática civilística brasileira, de que as regras da responsabilidade civil objetiva se destinam a concretizar o valor da solidariedade social inscrito na Constituição Federal (art. 3º, III, in fine) e a diretriz da socialidade presente no Código Civil de 2002. O estudo é feito, inicialmente, por meio da descrição de um risco social – criminalidade urbana violenta – e da apresentação da relação entre uma determinada forma histórica de manifestação desse risco e o aumento dos casos judiciais envolvendo a responsabilidade das empresas de transporte urbano em face de danos sofridos por seus passageiros em razão de atos violentos praticados por terceiros durante o trajeto. Em um segundo momento, são apresentadas as origens do discurso do solidarismo jurídico e as influências desse sobre certas construções dogmáticas relativas ao fenômeno da responsabilidade civil. Por fim, com base em pesquisa realizada sobre a jurisprudência dos dois tribunais superiores brasileiros (Supremo Tribunal Federal e Superior Tribunal de Justiça), realizou-se a análise de conteúdo das decisões, buscando identificar em que medida o discurso teórico da dogmática é efetivamente incorporado no momento da aplicação dos conceitos jurídicos implicados no tratamento de determinados problemas concretos. / This text aims at analyzing the current belief held by the authors of the Brazilian dogmatic of civil law, that rules concerning objective civil responsibility must realize the value of social solidarity described by the Federal Constitution (Article 3, III, in fine) and the principle of sociality presented by the Civil Code of 2002. The study is done initially through the description of a social risk – violent urban criminality – and the presentation of a relationship between a certain historical form this risk takes and the increase in legal cases involving the responsibility of public transportation companies for damage incurred upon their passengers due to violent acts practiced by third parties on the itinerary. L’Arabie Saoudite a été exposée, pendant la dernière décennie, à des actes terroristes menés par une classe déviante de certains de ses enfants, influencés par une mauvaise pensée et une compréhension confuse. Le gouvernement a entrepris de réagir fermement et sévèrement contre ces groupes déviants par tous les moyens et en ayant recours aux forces de sécurité et aux militaires. Les affrontements entre les forces militaires et ce groupe déviant ont conduit à la mort d'un certain nombre de militaires pendant l'exercice de leur devoir de défense de la patrie. Toutes les nations, à travers l'histoire, ont eu à coeur d’honorer comme des héros nationaux ceux qui étaient morts dans les batailles et les guerres, qui avaient donné leur vie et versé leur sang pour sauver leur patrie et leur nation. Cette reconnaissance inclut d’honorer les familles des morts et leurs proches. Par conséquent, le gouvernement du Royaume d'Arabie Saoudite a tenu à offrir des services sociaux complets aux familles des victimes du terrorisme. Cette étude révèle les efforts déployés par le ministère de l'Intérieur dans la fourniture de l'aide sociale aux familles des victimes après la perte de leur soutien. Elle se concentre sur l'analyse de ces aides de l’Etat dans diverses situations et de l’influence qu’elles ont sur les familles. La société saoudienne se caractérise par sa foi dans les liens sociaux ; à ce titre, ces victimes méritent d'être reconnues, et leur famille, qui a été confiée à la communauté après avoir perdu le soutien que représentait, pour elle, la victime, mérite attention et protection sociale. / Saudi Arabia has been exposed, over the last decade, to terrorist acts on the hands of a deviant group of people, influenced by wrong thoughts and chaotic perspectives. The Government has undertaken to, firmly and strictly, respond to these deviant groups by all means through its security and military institutions. The combats between the military forces and this deviant group have led to the kill of a number of soldiers during doing their duty to defend their homeland. All nations, throughout history, have been keening on honoring their national heroes; the victims, those who had died in battles and wars against terrorism paying their lives and blood for the sake of their country, and consequently, their nation. This appreciation extends to include honoring the victims’ families. Therefore, the Government of the Kingdom of Saudi Arabia has been committed to providing them with a comprehensive social care as a kind of appreciation for their efforts. This study reveals the efforts of the Ministry of Interior to provide the victims’ families with social assistance as victims of their boundless loss. It focuses on analyzing the subsidies offered for those special cases in different situations and its influence on them socially and psychologically. Saudi society is characterized by its faith in social ties; as such, these victims and their families deserve recognition and appreciation especially after losing their own support.

Challenges and potentials of channeling local philanthropy towards development and aocial justice and the role of waqf (Islamic and Arab-civic endowments) in building community foundations

Diese Arbeit bietet eine solide theoretische Grundlage zu Philanthropie und religiös motivierten Spendenaktivitäten und deren Einfluss auf Wohltätigkeitstrends, Entwicklungszusammenarbeit und einer auf dem Gedanken der sozialen Gerechtigkeit beruhenden Philanthropie. Untersucht werden dafür die Strukturen religiös motivierte Spenden, für die in der islamischen Tradition die Begriffe „zakat“, „Waqf“ oder im Plural auch „awqaf-“ oder „Sadaqa“ verwendet werden, der christliche Begriff dafür lautet „tithes“ oder „ushour“. Aufbauend auf diesem theoretischen Rahmenwerk analysiert die qualitative und quantitative Feldstudie auf nationaler Ebene, wie die ägyptische Öffentlichkeit Philanthropie, soziale Gerechtigkeit, Menschenrechte, Spenden, Freiwilligenarbeit und andere Konzepte des zivilgesellschaftlichen Engagements wahrnimmt. Um eine umfassende und repräsentative Datengrundlage zu erhalten, wurden 2000 Haushalte, 200 zivilgesellschaftliche Organisationen erfasst, sowie Spender, Empfänger, religiöse Wohltäter und andere Akteure interviewt. Die so gewonnen Erkenntnisse lassen aussagekräftige Aufschlüsse über philanthropische Trends zu. Erstmals wird so auch eine finanzielle Einschätzung und Bewertung der Aktivitäten im lokalen Wohltätigkeitsbereich möglich, die sich auf mehr als eine Billion US-Dollar beziffern lassen. Die Erhebung weist nach, dass gemessen an den Pro-Kopf-Aufwendungen die privaten Spendenaktivitäten weitaus wichtiger sind als auswärtige wirtschaftliche Hilfe für Ägypten. Das wiederum lässt Rückschlüsse zu, welche Bedeutung lokale Wohltätigkeit erlangen kann, wenn sie richtig gesteuert wird und nicht wie bislang oft im Teufelskreis von ad-hoc-Spenden oder Hilfen von Privatperson an Privatperson gefangen ist. Die Studie stellt außerdem eine Verbindung her zwischen lokalen Wohltätigkeits-Mechanismen, die meist auf religiösen und kulturellen Werten beruhen, und modernen Strukturen, wie etwa Gemeinde-Stiftungen oder Gemeinde-„waqf“, innerhalb derer die Spenden eine nachhaltige Veränderung bewirken können. Daher bietet diese Arbeit also eine umfassende wissenschaftliche Grundlage, die nicht nur ein besseres Verständnis, sondern auch den nachhaltiger Aus- und Aufbau lokaler Wohltätigkeitsstrukturen in Ägypten ermöglicht. Zentral ist dabei vor allem die Rolle lokaler, individueller Spenden, die beispielsweise für Stiftungen auf der Gemeindeebene eingesetzt, wesentlich zu einer nachhaltigen Entwicklung beitragen könnten – und das nicht nur in Ägypten, sondern in der gesamten arabischen Region. Als konkretes Ergebnis dieser Arbeit, wurde ein innovatives Modell entwickelt, dass neben den wissenschaftlichen Daten das Konzept der „waqf“ berücksichtigt. Der Wissenschaftlerin und einem engagierten Vorstand ist es auf dieser Grundlage gelungen, die Waqfeyat al Maadi Community Foundation (WMCF) zu gründen, die nicht nur ein Modell für eine Bürgerstiftung ist, sondern auch das tradierte Konzept der „waqf“ als praktikable und verbürgte Wohlstätigkeitsstruktur sinnvoll weiterentwickelt. / This work provides a solid theoretical base on philanthropy, religious giving (Islamic zakat, ‘ushour, Waqf -plural: awqaf-, Sadaqa and Christian tithes or ‘ushour), and their implications on giving trends, development work, social justice philanthropy. The field study (quantitative and qualitative) that supports the theoretical framework reflects at a national level the Egyptian public’s perceptions on philanthropy, social justice, human rights, giving and volunteering and other concepts that determine the peoples’ civic engagement. The statistics cover 2000 households, 200 Civil Society Organizations distributed all over Egypt and interviews donors, recipients, religious people and other stakeholders. The numbers reflect philanthropic trends and for the first time provide a monetary estimate of local philanthropy of over USD 1 Billion annually. The survey proves that the per capita share of philanthropy outweighs the per capita share of foreign economic assistance to Egypt, which implies the significance of local giving if properly channeled, and not as it is actually consumed in the vicious circle of ad-hoc, person to person charity. In addition, the study relates local giving mechanisms derived from religion and culture to modern actual structures, like community foundations or community waqf that could bring about sustainable change in the communities. In sum, the work provides a comprehensive scientific base to help understand- and build on local philanthropy in Egypt. It explores the role that local individual giving could play in achieving sustainable development and building a new wave of community foundations not only in Egypt but in the Arab region at large. As a tangible result of this thesis, an innovative model that revives the concept of waqf and builds on the study’s results was created by the researcher and a dedicated board of trustees who succeeded in establishing Waqfeyat al Maadi Community Foundation (WMCF) that not only introduces the community foundation model to Egypt, but revives and modernizes the waqf as a practical authentic philanthropic structure.
