Para a concretização da tutela jurisdicional, é necessário que tais práticas, além de estarem em conformidade com a segurança do ordenamento jurídico e, capazes de efetivarem o direito fundamental a razoável duração do processo, contribuam, de forma efetiva, com os objetivos traçados pela Constituição. A audiência preliminar será investigada como um instrumento processual capaz de evitar dilações indevidas no decorrer dos processos, seja mediante a possibilidade de conciliação entre as partes, seja por meio do saneamento do processo. Permite a participação mais ativa dos agentes do processo, através do uso da oralidade. Neste sentido, compõe um sistema processual dinâmico, permitindo o “acesso à justiça” em sentido amplo, contemplando ao povo, a adjetivação de cidadão e difundindo a democracia participativa como proposta de Estado a ser adotada para a sociedade contemporânea. Nesse contexto, se pode vislumbrar que o dispositivo do art.331 do Código de Processo Civil Brasileiro, contribui com a efetividade do direito fundamental à razoável duração do processo, objetivando a redução da demora processual injustificável. Para tanto, cabe aos magistrados utilizarem-se de uma interpretação hermenêutica dos ditames constitucionais conjugada com os fatores externos que irão influenciá-lo. A problematização em questão pretende estudar a sociedade no momento atual, onde anseia pela consagração do direito fundamental ao processo em tempo razoável, o qual deve ser promovido por parte do Estado, já que o mesmo lhe consagrou constitucionalmente com o advento da EC 45/2004. Nesse contexto, cabe ao Estado responder pela demora injustificada dos tempos processuais. E a reparação deve manifestar-se através da indenização em favor do cidadão que teve seu direito tolhido, por conseqüência de um ato estatal, ou, no caso da audiência preliminar, sua inércia. / The proposal to develop the judicial procedures without undue delay should be developed through practices that are in accordance with the constitutional dictates. For the completion of judicial review, it is necessary that such practices, and comply with the safety of the legal system and able to enforce the fundamental right to a reasonable duration of the process, contribute, effectively, to the goals set by Constitution. The preliminary hearing will be investigated as a procedural tool that will prevent undue delays during the process, either through the possibility of conciliation between the parties, either through the restructuring process. Allows more active participation of the process’s, through the use of orality. In this sense, forms a dynamic procedural system, allowing "access to justice" in a broad sense, covering the people, the adjective of citizen participatory democracy and spreading as a proposed rule to be adopted to contemporary society. In this context, we can see that the machinery of article 331 of the Brazilian Civil Procedure Code, contributes to the effectiveness of the fundamental right of a reasonable duration of the process, aiming at the reduction of procedural delay unjustifiable. For this, use it to judges is a hermeneutic interpretation of constitutional principles coupled with external factors which will influence him, adopting the theory as formalism evaluative procedures. The questioning concerned intends to study the society at present, which yearns for the consecration of the fundamental right to process in reasonable time, which should be promoted by the state, since the constitutionally enshrined it even with the advent of constitutional emendment 45/2004. In this context, the State must answer for the undue delay of the procedural time. And the repair should be manifested through indemnity in favor of the citizen who had checked his right, as a consequence of a state act, or, if the preliminary hearing, his inertia.

Formas de enfrentamento à criminalidade organizada

The evolution of Criminal Law was outlined, starting with the main penal schools and also with the dogmatic lines of thought, from Causalism to Functionalism. Considering the legal interest as Criminal Law's main objective, parameters based on constitutional values were established for its definition. The analysis of the legal interest was double folded, having been classified as being of both individual and universal nature, thus enabling the defence of the constitutionality of crimes of abstract danger. The warrants of criminalization, whose fundamentals oblige the infra-constitutional legislator to protect the legal interest elected by the Constitution, were object of analysis. As for organized crime, its evolution as a social and legal phenomenon was analysed, focusing on the history of Brazilian legislation, from the Imperial Penal Code to today's Law 9.034/95. The analysis of the concept of organized crime was based on the concept taken from the Palermo Convention, more open and permissive, so as not to restrict legislation on the account of the effects of the advance of globalization. Thus, in order to establish the concept of organized crime, its characteristics were identified insisting on the need for legal definition. The investigation tools of the Law 9.034/95 were also analysed, following legitimizing arguments. Lastly, the Enemy's Criminal Law and the Right to Safety were analysed as ways to interpret and provide justification for legislations both from penal as well as processual order in the fight against organized crime. From the research done, we conclude for the interpretation of the Right to Safety as a fundamental right, in its objective acception, based on imperatives of tutelage. The collision between constitutional principles must be solved through the application of the principle of proportionality / O objetivo do presente trabalho consiste na análise do Direito Penal, no que diz respeito ao enfrentamento da criminalidade organizada. Foi delineada evolução do Direito Penal, com início nas principais escolas penais e também através das linhas do pensamento dogmático, do causalismo ao funcionalismo. Com norte no bem jurídico, como finalidade do Direito Penal, foram estabelecidos parâmetros para sua definição, ancorado nos valores constitucionais. O bem jurídico foi cindido em sua análise, sendo classificado como de natureza individual e universal, classificação essa que permitiu defender a constitucionalidade dos crimes de perigo abstrato. Foram objeto de análise os mandados de criminalização, cuja fundamentação, obriga o legislador infraconstitucional à proteção do bem eleito pela Constituição. Quanto ao crime organizado, foi analisada sua evolução enquanto fenômeno social e jurídico. Foi objeto de análise a história da legislação brasileira, desde o Código Penal do Império até a atual Lei 9.034/95. Na análise do conceito do crime organizado, levou-se em consideração o conceito previsto pela Convenção de Palermo, mais aberto e permissivo, de modo a não engessar a legislação, devido aos efeitos do avanço da globalização, de modo que para estabelecer o conceito foram identificadas suas características, firmando ainda posicionamento pela necessidade de definição legal. Os instrumentos de investigação da Lei 9.034/95 também foram analisados, firmando-se por argumentos legitimadores. Por fim, foram analisados o Direito Penal do Inimigo e o Direito à Segurança, como formas de se interpretar e fundamentar legislações tanto de ordem penal como processual no enfrentamento à criminalidade organizada. Pela pesquisa feita, posicionamo-nos no sentido de interpretar o Direito à Segurança, como um direito fundamental, na acepção objetiva, com base nos imperativos de tutela. The welfare and quality of life do not rely only on the equal distribution of primary goods, according to the ancient model of Welfare State. The modification occurs on how the State recognizes and valuates its citizens, starting from the development of their capacities to reach the formation of a wealth and participative social linen. Based on this Theory, this thesis aims at proposing the right of capabilities promotion as a fundamental right, in the material sense, as the basis for the creation of a new Model of State. The starting point is the conception of persona based on the aristotelic-tomist thought, with singular identity and personality, which exists in a rational and social nature, subject and purpose of the society, of the State and of the Law. The proposed right is divided in into three aspects, needed for its concretisation: material (education), formal (public policies) and instrumental (principle of subsidiarity), which will be analysed under the Brazilian Constitution of 1988 / ONU como critério de avaliação do crescimento dos países destaca a pessoa e a expansão das suas capacidades como o eixo e finalidade das políticas propostas pelos Estados. O bem-estar e a qualidade de vida não dependem somente da distribuição igual dos bens primários (materiais), conforme o modelo antigo de WelfareState. A mudança está em como o Estado reconhece e valoriza a pessoa, partindo da promoção das suas capacidades para a formação de um tecido social rico e participativo. Com base nessa teoria, esta tese objetiva propor o direito à promoção das capacidades como direito fundamental em sentido material, como base para a formação de um novo modelo de Estado. O ponto de partida é a concepção de pessoa fundada no pensamento aristotélico-tomista, com identidade singular e personalidade, existente em uma natureza racional e social, sujeito e fim da sociedade, do Estado e do Direito. La chine et les droits de l’homme : évolution et perspectives juridiques / China and human rights : legal developments and prospects

Dès le sixième siècle avant J.-C. l’homme a été défini comme un « être d’une certaine hauteur, dont la forme de la main est différente de celle du pied, qui possède des cheveux et des dents, et qui peut se déplacer vite et debout ». Il prit alors deux formes de statut : celui de ren pour désigner un homme de vertu ou qui exerce une fonction publique ou privée ; et celui de min pour désigner celui qui n’exerce aucune fonction publique. La société chinoise s’est construite sur cette séparation : les ren, encadré par leur vertu, doivent rendre service aux min et à la société ; et les min disposent de certains droits fondamentaux vis-à-vis des ren. De ce fait, la Chine traditionnelle a mis en place deux mécanismes de protection de ceux-ci : la requête individuelle que les min peuvent utiliser pour valoir leurs droits fondamentaux contre des actes ou des hommes public qui leur ont porté atteinte, et le zuiji zhao par lequel les empereurs s’auto-punissent. Avec le temps, trois formes du contrôle de conformité des actes publics ont été successivement mise en place. A la fin de la dynastie des Qing les droits humains fondamentaux chinois seront confrontés aux droits de l'homme occidentaux auxquels les chinois s’identifièrent parce qu’ils correspondaient à leur tradition temporairement écartée. Trois réformes politico-juridiques principales furent engagées successivement par les Chinois afin de la rétablir et de la concilier avec les théories et les expériences occidentales dans ce domaine. Le point culminant de cette rencontre fut la participation chinoise àl’élaboration de la DUDH et la nomination de son représentant comme vice-président de son comité d’élaboration. En 1949 la République populaire de Chine remplaça la République de Chine. Dans un premier temps ses dirigeants se montrèrent assez sensibles aux droits de l'homme et à leur protection ; mais la Révolution culturelle anéantit cette démarche, créant une situation dont la Chine d’aujourd’hui souffre encore. Ces dernières années, les droits de l'homme connaissent en Chine une forme de renaissance qui se traduit dans les domaines législatif, éducatif, administratif et judiciaire. Le caractère encourageant et constructif de ce mouvement, qui s’appuie sur les exemples étrangers et sur certains progrès régionaux, mais qui se fonde sur les traditions principalement confucéennes chinoises, laisse envisager une protection des droits de l’homme dans le pays analogue à celle qui est garantie dans les pays les plus avancés. / The concept of human being was defined in China since the sixth century B.C. as "a living organism which has a certain height, its hands are different from its feet,covered by hair and has developed teeth, capable of moving quickly in an uprightposture". Since then, two categories of men were defined: the ren, to designate a virtuous man or somebody who xercises public or private functions; and the min, to designate men who have no public power. The Chinese society was built on thisdistinction: the ren, known by their virtuosity, might offer their services to the min and the society itself, and the min have some fundamental rights towards ren population. For that reason, ancient China set up two protection mechanisms: min’sindividual queries to request the respect of their fundamental rights against actions from public agents, and the zuiji zhao, mechanism used by the emperors to punish themselves. Over time, three compliance control mechanisms were developed. By the end of the Qing Dynasty, this Chinese approach to fundamental human rights was compared to Western approach to human rights by the Chinese population, who recognized themselves in the western approach, following the disturbance in the Chinese tradition led by the Manchu. For the re-establishment of Chinese tradition, three main political and legal reforms were carried out by the Chinese in order to restore their tradition, abandoned by the Manchus, and to conciliate Western theories and experiences with Chinese approach. A turning point was achieved with thecontribution of China in the development of UDHR, and the nomination of the Chinese representative as vice president of the redaction committee.

La motivation des décisions juridictionnelles du Conseil d’Etat / The motivation of the Conseil d’État’s court’s decisions

Cette étude se donne pour ambition de saisir et de comprendre ce qu’est la motivation des décisions juridictionnelles du Conseil d’État, au demeurant souvent critiquée. Notion fondamentale en droit processuel, la motivation est un discours argumentatif, expression d’une technique juridique, à savoir un discours visant à justifier au plan juridique et factuel la décision à travers un raisonnement afin de persuader l’auditoire. Ainsi faudra-t-il analyser à la fois son architecture et ses fonctions dans une perspective dynamique. En tout état de cause, on constate,depuis au moins le début du XXIe siècle, une certaine évolution de la motivation. Ce phénomène résulte, notamment, de l’européanisation et de la complexité normatives, de la protection renforcée des droits fondamentaux, des exigences de sécurité juridique ou encore de la volonté du Conseil d’État de promouvoir une politique communicationnelle afin de légitimer son action. L’étude implique de revisiter certaines thématiques traditionnelles, en particulier le syllogismejudiciaire, l’argumentation, l’interprétation, le style de la motivation ou encore le pouvoir normatif jurisprudentiel pour constater et mesurer cette évolution. / The aim of this research is to tackle and understand the Conseil d’Etat’s court’s decisions motivation which are often criticised. Fundamental notion in procedural law, motivation is an argumentative discourse expressing a jurisdictional technique but moreover it is specifically a discourse trying trough a legal reasoning to justify a decision in order to convince the audience. Thus we shall have to analyse its architecture and its functions in a dynamic perspective. Either way we can note that since the beginning of the 21st century the court’s motivation has evolved.This phenomenon is the result of the Europeanization and the complexity of the normative production and is also due to enhanced protection of the fundamental rights, legal certainty and the Conseil d’Etat’s wish to promote a communicational policy in order to legitimise its action. This research entails to revisit certain traditional topics such as jurisdictional syllogism, argumentation, interpretation, the motivation’s style or the normative jurisprudential power to both note and measure this evolution.

Introdução - A obesidade infantil está pautada como assunto de saúde pública e exige a análise, implementação e avaliação de novas intervenções. O marketing é apontado como um dos fatores que interferem no aumento do índice de sobrepeso e de obesidade da população. As estratégias de comunicação publicitária se utilizam de processos cognitivos para determinar, através de elementos emocionais do receptor, a escolha e o consumo de alimentos não saudáveis, já que os publicitários respondem à demanda das empresas que buscam lucrar com seus produtos. Já se afirma que a regulamentação legal do marketing dos alimentos infantis não saudáveis deve ser adotada como instrumento de política pública na prevenção da obesidade. Assim, justifica-se a investigação de quais seriam as formas mais apropriadas para regular esse tipo de marketing no Brasil, de forma a garantir o direito à saúde e à alimentação adequada e saudável. Objetivo - Analisar o papel do marketing como um dos determinantes da obesidade infantil, buscando apontar, no campo jurídico, estratégias para a sua regulamentação no Brasil. Métodos - Revisão de literatura, análise de textos legislativos e de programas adotados para controle da obesidade infantil, além de entrevistas com representantes de entidades e profissionais diretamente ligados à implementação de políticas públicas, nacionais e internacionais, de controle da nutrição e saúde infantil, bem como de proteção dos direitos do consumidor infanto-juvenil. A interpretação dos dados levantados deu-se através do método científico dedutivo. Resultados - O crescente índice de obesidade no Brasil está demonstrado através de pesquisa nacional. A presença de alimentos no mercado com excesso de sal, gordura e açúcar precisa ser controlada. As teorias de comunicação explicam a influência do marketing na decisão emocional do consumidor. Os direitos à saúde e à alimentação adequada e saudável estão previstos na Constituição Federal. Conclusão - A regulamentação legal do marketing de alimentos não saudáveis é juridicamente possível e suas diretrizes devem focar os alimentos processados e ultraprocessados, além dos fatores que facilitam a persuasão da criança, impedindo o uso de elementos emocionais. / Introduction - Childhood obesity is considered a public health issue and requires the analysis, implementation and evaluation of new interventions. Marketing is considered as one of the factors that play a role in the increase of overweight and obesity rates in the population. Advertisement strategies use cognitive processes to determine, by means of emotional elements of the receptor, the choice and consumption of unhealthy foods, since advertisement professionals respond to the demand of companies willing to make a profit by selling their their products. The regulation of the marketing of unhealthy foods for children must be adopted as a public policy instrument for the prevention of obesity. Thus, we should investigate what are the most appropriate ways to regulate this kind of marketing in Brazil to guarantee the right to health and to adequate and healthy foods. Objective - Analyze the role of marketing as one of the determinants of childhood obesity, and try to identify legal strategies for its regulation in Brazil. Methods - Literature review, analysis of legal texts and programs implemented for the control of childhood obesity and interviews with representatives of institutions and professionals directly related to the implementation of public national and international policies for the control of childhood nutrition and health, as well as the protection of children and youth consumer rights. Deductive scientific method was used to interpret data. Results - Increasing obesity rates have been demonstrated by national surveys. The presence of foods with excessive salt, fat and sugar in market must be controlled. Communication theories explain the influence of marketing in the emotional decision of consumers. The right to health and to adequate and healthy foods is determined by the Federal Constitution. Conclusion - It is possible to regulate the marketing of unhealthy foods according to the law. The guidelines for regulation must focus on processed and ultra processed foods and the factors that facilitate persuasion of children, by prohibiting the use of emotional elements.

La justice est un attribut fondamental de l’Etat moderne. Elle assure, dans unesociété démocratique, la sauvegarde de l’édifice normatif ainsi que la protection des droitset libertés. Une justice indépendante et efficace est un symbole de l’Etat de droit. Ellerévèle la réalité de la séparation des pouvoirs et consacre le règne du droit. Maisl’efficacité de tout appareil judiciaire dépend de la nature et de l’ampleur des moyens dontil dispose. Or, dans nombre d’Etats francophones, le système judiciaire connaît denombreuses faiblesses, liées tantôt aux avatars des processus de stabilisationdémocratique, tantôt aux situations plus fragiles de sortie de crise. La question durenforcement des capacités des institutions judiciaires se trouve ainsi posée. Et c’est surcette base que l’Organisation Internationale de la Francophonie (OIF) a investi, depuisune trentaine d’années, le champ de la coopération juridique et judiciaire. Ayant inscrit lapromotion de la démocratie au coeur de son action politique, la Francophonie a pris desengagements forts et développé, en s’appuyant sur ses réseaux institutionnels, desprogrammes destinés à accompagner ses Etats membres dans le renforcement descapacités de leurs systèmes de justice. Cet engagement est perceptible dans le corpusnormatif de l’Organisation. Il marque la ferme volonté des Etats francophones d’ancrerleurs relations dans un cadre de coopération, attaché à la protection des droitsfondamentaux et à la régulation des pouvoirs majoritaires. La justice est donc désormaisérigée en priorité dans le champ des préoccupations francophones. In a democratic society, itguarantees the safeguard of the standard-setting framework as well as the protection ofrights. An independent and effective justice is a symbol of the rule of law. It illustrates theseparation of powers and establishes the primacy of law. But the efficiency of any judicialsystem depends on the nature and the extent of the resources at its disposal. Yet, inmany Francophone countries, the judicial system faces many weaknesses, sometimesrelated to the avatars of democratic stabilisation processes, sometimes to more fragilepost-crisis situations. So the question of the capacity development of the judicialinstitutions arises. For thirty years, the International Organization of La Francophonie(OIF) has entered the legal and judicial cooperation field on this basis. By including thepromotion of democracy at the heart of its political action, the OIF has indeed made strongcommitments and developed programs aimed at accompanying its member States in thecapacity development of their justice systems, thanks to its institutional networks. Thiscommitment can be seen in several statements of the Organization. It demonstrates thewill of the Francophone States to anchor their relationships in a cooperation framework,dedicated to the protection of fundamental rights and the regulation of majorities’ powers.Today, justice is consequently established as a priority in Francophone concerns. Aujourd'hui les droits des mineurs occupent une place de plus en plus importante dans l'agenda juridique et politique de l'UE. La promotion des droits de l'enfant représente maintenant un objectif de l'UE, consacré dans l'article 3, paragr. 3, du Traité sur l'Union européenne. Les droits de l'enfant sont également cristallisés dans l'article 24 de la Charte des droits fondamentaux de l'Union européenne. Actuellement l'Union européenne dispose de nombreux actes législatifs et de documents non législatifs relatifs aux droits des mineurs ou qui peuvent avoir des répercussions indirectes sur la vie des enfants. Ce travail analyse la nature, la portée et la valeur des mesures de l'UE dans deux domaines principaux : la protection des enfants et de leurs droits et la justice pénale des mineurs. Le but de la recherche a été d’examiner jusqu'à quel point on peut parler d’une valeur ajoutée de la promotion des droits des enfants au niveau de l'UE, par rapport au niveau national et international et également celui de proposer de nouvelles solutions pour améliorer la promotion et la protection des droits des enfants dans l’Union européenne. / Today children’s rights occupy an increasingly prominent place on the EU legal and policy agenda. The promotion and protection of the rights of the child is now an objective of the EU as set out in Article 3.3 of the Treaty on European Union. The rights of the child are also enshrined in the article 24 of the Charter of Fundamental Rights of the European Union. The EU has now many legislative documents and non-legislative acts related to children’s rights or that may have the potential to impact on children’s life. This Phd thesis analyzes the nature, scope and value of EU measures in relation to children in two main areas : child protection and juvenile criminal justice. It investigates if there is an added value of children’s rights at EU level and it also makes some suggestions to improve the promotion and protection of children’s rights in the EU. / Al giorno d’oggi, i diritti dei minori occupano uno spazio sempre più importante nell’agenda giuridica e politica dell’Unione europea. Attualmente, infatti, la promozione dei diritti dei minori rappresenta un obiettivo dell’Unione, consacrato nell’articolo 3, par. 3, del Trattato sull’Unione europea. I diritti fondamentali dei minori sono poi sanciti esplicitamente nell’articolo 24 della Carta dei diritti fondamentali dell’UE. Oggi, l’Unione europea può disporre di numerosi strumenti normativi (e non) dedicati espressamente ai diritti dei fanciulli e tanti altri possono avere delle ripercussioni indirette sulla loro vita. La presente ricerca analizza, pertanto, la natura, la portata e il valore delle misure intraprese dall’UE in due settori principali : la protezione dei minori e la giustizia penale. Lo scopo della tesi è esaminare in che termini si possa parlare di un valore aggiunto della promozione dei diritti dei minori a livello UE, rispetto alle normative già in vigore a livello nazionale e internazionale. A partire da tale analisi, essa cerca di proporre nuove soluzioni per migliorare la promozione e la protezione dei diritti dei minori nell’Unione europea.

Les recours individuels directs devant la juridiction constitutionnelle sont marqués par une forte originalité. Leur originalité se caractérise tant par la possibilité qu’un individu puisse accéder sans intermédiaire au prétoire du juge constitutionnel, que par la diversité des actes contestables devant ce juge et par cet individu. Afin d’appréhender les diverses formes de recours individuel direct en Allemagne, Autriche, Belgique et Espagne, il convenait de mobiliser un instrument qui mette en évidence cette double spécificité d’études : le droit processuel. Celui-ci se définit en effet par l’ambition de traiter les divers contentieux de manière comparée, au-delà de leur nature particulière.Cette démarche comparative permet plus spécialement de relativiser le clivage droit privé/droit public : tandis que le droit processuel trouve habituellement son terrain d’élection dans le droit judiciaire privé, alors que le contentieux public est accaparé par la dimension du « procès fait à un acte », l’analyse des recours individuels directs permet d’appréhender pleinement le contentieux constitutionnel comme structure procédurale de protection des droits. Le droit processuel permet ainsi d’analyser les recours individuels directs comme forme entièrement développée de recours en protection des droit devant la juridiction constitutionnelle, forme qui n’existe pas en France : il permet une mise en perspective de notre culture juridique centrée sur la conformité juridique objective des actes. / Direct constitutional complaints before the Constitutional Court appear as a strongly original procedure. It is caracterized both by the possibility for an individual to have direct access to the Court and by the wide variety of the legal acts that can be challenged there. The analysis of the diverse forms of direct constitutional complaints in Austria, Belgium, Germany and Spain requires a conceptual framework that allows those two characteristics to stand out: processual law. Processual law can be defined by its ambition to consider various kinds of litigation in a comparative way beyond their specific nature. This comparative approach especially allows for a relativisation of the public law/private law distinction. In France, processual law is generally used in private litigation context, whereas public litigation is more focused on the “procès fait à un acte” dimension. By contrast, the analysis of direct constitutional complaints through processual law sheds a specific light on it as a procedural structure directed towards the protection of rights. In other words, direct constitutional complaints appear in this light as a fully developed form of procedure for the protection of rights, a form that does not exist in France. Our legal culture which is focused on the question of the objective legal conformity of acts is thus put into a new perspective.
