Le fonctionnement du Réseau européen de la concurrence : détermination et exercice de compétence par les autorités de concurrence / The functioning of the European Competition Network : definition and exercise of competences by the competition authorities

L'adoption du règlement n° 1/2003 a décentralisé la mise en oeuvre des articles 101 et 102 TFUE et a entraîné la création du Réseau européen de la concurrence. Désormais, les autorités nationales et la Commission partagent la responsabilité de l'application des règles de concurrence de l'Union européenne au sein du Réseau. Le fonctionnement de celui-ci obéit à la logique de la méthode du conflit d'autorités. Ainsi, la question de la compétence des autorités pour traiter une affaire a une importance primordiale dans le contexte du Réseau. Elle détermine la loi applicable à l'inégralité de l'affaire et exerce une influence sur les effets extraterritoriaux des décisions. Les autorités de concurrence emploient une grande variété de méthodes de coopération et de coordination afin d'éviter des conflits de compétence et les solutions contradictoires au sein du Réseau. Malgré la coopération étroite des autorités, les divergences des règles de procédure sont susceptibles de miner l'efficacité de la mise en oeuvre des articles 101 et 102 TFUE ainsi qu'éroder la protection des droits fondamentaux. / The entry into force of Regulation 1/2003 resulted in the decentralisation of the application of articles 101 et 102 TFEU. The national authorities and the Commission share the responsibility for the enforcement of the EU competition rules and form together the European Competition Network. According to the theory of conflict of authorities, the designation of the competent authority to deal with a case is crucial for the functioning of the Network, since it determines the applicable law to the case and the extraterritorial effect of the decision. Despite the cooperation and coordination mechanisms at the authorities's disposal, the divergences in national procedural rules can undermine not only the goal of efficient enforcement of competition rules in the EU, but also the protection of fundemantal rights.

Les droits fondamentaux visent à la protection et à l’épanouissement de la personne humaine. Ils suscitent l’engouement et la controverse. Adossés à des textes internationaux et européens, mais provenant aussi de la réception du terme allemand « Grundrechte », diffusés tant en droit public qu’en droit privé, ils font l’objet de différentes analyses, spécialement en droit public, afin de déterminer leur signification, leurs fonctions, et leur régime. Il apparaît que les recherches conduites en doctrine ne permettent pas d’appréhender le concept de « droit fondamental » avec certitude. En effet, il n’existe pas de conception unique de la notion, les droits fondamentaux apparaissent comme une catégorie juridique insaisissable. Faute de définition claire, ils se distinguent difficilement des notions de « droits de l’Homme » ou de « libertés publiques ». Leur nature juridique est également incertaine. Pour ces raisons, ils constituent un ensemble hétéroclite difficile à délimiter et il convient de regretter que le droit international et le droit européen, pourtant riches en affirmations péremptoires, n'apportent pas un éclairage satisfaisant. La réalisation des droits fondamentaux est également imparfaite. D’une part, ils sont l'objet d'une surenchère caractérisée par une prolifération normative tant en droit interne qu’en droit international. Celle-ci n'est guère maîtrisée et mène à d’inévitables conflits qui, en l’absence d’une hiérarchie clairement établie, sont souvent irréductibles. D’autre part, les techniques de protection des droits fondamentaux s’avèrent insuffisantes notamment en raison de leur instrumentalisation par les différents juges. Les solutions jurisprudentielles sont dès lors imprévisibles et participent au phénomène de l’insécurité juridique. / Fundamental rights aim to protect and develop the human person. They provoke passion and controversy. Supported by international and European texts but also stemming from the German term “Grundrechte”, circulated in public law as well as in private law, they are subject to different analyses, especially in public law, in order to determine their meaning, their functions and their system. It seemed that the research conducted in doctrine does not enable the comprehension of the concept of “fundamental right” for certain. Indeed, a single concept of the notion does not exist, fundamental rights are seen as an imperceptible legal category. Due to the lack of a clear definition, it is difficult to set them apart from notions of “Human Rights” or “Civil Liberties”. Their legal nature is equally uncertain. For these reasons, they constitute a heterogeneous unity which is difficult to define and unfortunately international law and European law, though rich in peremptory assertions, does not provide a satisfactory perspective. The implementation of fundamental rights is equally as imperfect. On the one hand, they are subject to an outbidding characterised by a normative proliferation in domestic law as well as in international law. This is hardly controlled and leads to inevitable conflicts which, in the absence of a clearly established hierarchy, are often relentless. On the other hand, the techniques of protecting fundamental rights prove to be insufficient in particular, due to their manipulation by different judges. The judicial solutions are henceforth unpredictable and contribute to the phenomenon of judicial insecurity.

[pt] O acesso à justiça é uma preocupação constante dos juristas, em todo o mundo. No Brasil, a regra geral, com poucas exceções, é a necessidade da assistência de um advogado, na relação entre o litigante e o juiz. Este trabalho tem o objetivo de demonstrar que a atuação compulsória do advogado, no diálogo entre a parte e o Estado julgador, é indevida. Como método, foram utilizadas as técnicas de argumentação jurídica e de exame de proporcionalidade, propostas por Robert Alexy. Inicialmente, foram analisados a semântica das normas que fundamentariam tal imposição, a intenção do legislador, os antecedentes históricos, as exceções à regra, um sistema estrangeiro que não aceita tal imposição, os princípios jurídicos envolvidos no problema, as normas de direito constitucional, de direitos humanos, de direito internacional não-internalizado e de direito internacional internalizado, os conceitos já arraigados na dogmática processual brasileira, a jur isprudência, os dados estatísticos, os argumentos analógicos e razões de índole prática. Em um segundo momento, foram examinadas a legitimidade dos fins escolhidos pelo legislador, a necessidade da imposição do advogado, a adequação de tal medida e a ponderação entre os direitos fundamentais conflitantes. Ao final, concluiu-se pela impossibilidade de manutenção da atuação obrigatória dos advogados, nos processos judiciais. Conseqüentemente, ficou claro existir o direito de litigar sem advogado, de maneira irrestrita. / [en] One of the most important concerns for jurists, worldwide, is access to justice. In Brazil, the general rule, with few exceptions, is the necessity of the assistance of a lawyer, in the relationship between litigant and judge. This work intends to demonstrate that the obligatory presence of a lawyer, in the dialogue between the party and the Judiciary, is uncalled for. The method used was the technique of legal argumentation and examination of proportionality, as proposed by Robert Alexy. Firstly, the semantics of the norms, that would be the grounds for such requirement were analyzed, as well as the legislator´s intention, the historical antecedents, the exceptions to the rule, a foreign system that does not accept such imposition, the legal principles involved in the problem, the principles of constitutional law, of human rights, of non-internalized international law and of internalized international law, the already well-established concepts in brazilian procedural dogmatics, the legal precedents, the statistical data, the analogical arguments and the reasons of a practical nature. Secondly, the legitimacy of the ends chosen by the legislator, the need of the obligatory intervention of a lawyer, the suitability of such measure and the balance between the conflicting basic rights were examined. Finally, a conclusion was reached pointing to the impossibility of the maintenance of the obligatory performance of lawyers, in judicial procedures. Consequently, the right to litigate without a lawyer, in an unrestricted way, became clear.

Le droit à l'éducation au sein de l'UE comme droit de l'homme / The right to education as a human right in the european union

L’ « éducation tout au long de la vie », y compris dès la petite enfance, le primaire, le secondaire, la formation professionnelle, l’éducation supérieure et des adultes est devenue une priorité pour l’ONU (ODD 2030 numéro 4) et pour l’UE (moteur de la Stratégie 2020). La Commission envisage un Espace Européen d´Éducation, auprès le succès de l´Espace Européen d´Éducation Supérieur et l´Espace Européen de la Recherche. L´UE a fait de la mobilité son objectif et le programme Erasmus +, après trente ans, a bénéficié à plus de 9 millions de personnes. Pour autant, quels sont les droits dans le domaine de l’éducation des étudiants, parents, apprentis, directeurs d’établissements éducatifs publics et privés, professeurs, et des autres parties prenantes de la société civile (associations, fondations, entreprises) ? D’un point de vue juridique, les États de l’UE doivent suivre les obligations découlant de la DUDH, des Pactes, CDE, l’UNESCO, l’OIT, OMC, UNICEF, entre autres. Les États doivent répondre à ces obligations parmi les Examens Périodiques Universels, et suivre les recommandations du rapporteur spécial sur le droit à l’éducation. « L’acquis communautaire » a modelé le droit à l’éducation. Parmi les droits analysés se trouvent : le droit à la libre circulation des personnes, le droit à la libre prestation des services et d’établissement, des travailleurs, le principe de non-discrimination en raison de la nationalité, de l’égalité des genres, entre autres. Au regard de l’analyse de l’aspect international, de l’aspect européen et de l’aspect des droits de l’homme (application de la Charte des droits de l´homme et de la CEDH et sa jurisprudence), les citoyens de l’UE ont un droit à l’éducation au sein de l’UE comme droit de l’homme « sui generis » original et spécifique de l’UE. / Lifelong learning including early childhood, primary, secondary, vocational training, higher education and adult education has become a priority for the UN (ODD 2030, number 4) and for the EU (the driving force behind the 2020 Strategy). The Commission is considering a European Area of Education, with the success of the European Higher Education Area and the European Research Area. The EU has made mobility its goal and the Erasmus + program for thirty years has benefited more than 9 million people. However, what are the rights in the field of education for: students, parents, trainees, and directors of public and private educational institutions, teachers, and other stakeholders of civil society (associations, foundations, companies)? From a legal point of view, EU States must follow the obligations following from the UDHR, the Covenants, the CRC, UNESCO, ILO, WTO, UNICEF, among others. States must meet these obligations among the Universal Periodic Review, and follow the recommendations of the Special Rapporteur on the Right to Education. The « acquis communautaire » is shaping the right to education. Among the rights analyzed we find: rights of free movement of persons, services and establishment, workers, non-discrimination on grounds of nationality, and gender equality among others. After the analysis of the international aspect, the European aspect and the human rights aspect (application of the EU Charter of fundamental rights and the ECHR and its jurisprudence), EU citizens have a right to education in the EU as human right «sui generis» .

Apparue au sein de la péninsule ibérique à la sortie des dictatures salazariste et franquiste en vue de faciliter la transition vers la démocratie, la figure de l’ombudsman spécialisé, désormais réceptionnée par la France à travers l’institution du Défenseur des droits, trouve sa raison d’être contemporaine à l’aune de l’insuffisance des mécanismes classiques de garantie des droits fondamentaux. Spécialement aménagé pour la défense des droits et libertés, l’human rights ombudsman se présente, en effet, comme une forme de protection non juridictionnelle s’inscrivant dans une perspective de complémentarité des traditionnelles voies, spécialement juridictionnelles, de recours et, à ce titre, favorise l’émergence d’un système institutionnel de protection complet. Contribuant en pratique à une consolidation indiscutable des droits fondamentaux, la protection proposée par l’ombudsman spécialisé, aussi indispensable soit-elle, n’en demeure pas moins relative. Outre qu’il ne permet pas de combler l’ensemble des insuffisances affectant les autres instances de garantie, l’human rights ombudsman souffre lui-même d’imperfections de nature à préjudicier à l’effectivité de sa mission de sauvegarde des droits de la personne humaine. / The figure of the Human rights ombudsman appeared into the Iberian Peninsula at the demise of Franco and Salazar dictatorships in order to facilitate the transition to democracy. In France this figure finds its contemporary justification due to the insufficiency of the classic mechanisms of guarantee of the fundamental rights. The Human rights ombudsman is specially designed for the protection of fundamental rights, and is indeed a form of non jurisdictional protection in a perspective of complementarity of the traditional ways, especially the court of appeal and, as such, favors the emergence of an institutional system of complete protection. The protection proposed by the Human rights ombudsman contributes to an indisputable consolidation of the fundamental rights however it is essential that it remains relative. Yet, it does not fill all the inadequacies affecting the other instances of guarantee as the Human rights ombudsman suffers from imperfections likely to prejudice the effectiveness of its mission of protection of the person’s human rights.

The protection against dismissal in the evolution of the Constitutional Court jurisprudenceThis paper is based on the analysis of the job security schemes embodied in the Constitutions of 1979 and 1993, so as to point out the evolution of the protection granted by the constitutional system against unlawful dismissal and the legal application thereof to the models of restitutory protection (reinstatement) or compensatory protection (indemnification). Then, an analysis is made with respect to the options covered in this field by the international treaties executed by Peru and the evolution of different constitutional case law. Thus, judgments in which restitutory protection was initially oriented to outlaw the dismissal that violates fundamental rights are examined, in comparison to recent rulings in which such protection is granted against unlawful dismissal, resulting in a labor stability model different from the one set forth by the 1993 Constitution. / El presente trabajo parte por analizar los esquemas de estabilidad laboral recogidos en las Constituciones de 1979 y 1993, con el fin de advertir la evolución de la protección otorgada por el ordenamiento constitucional frente al despido ilícito y su plasmación legal en modelos de tutela restitutoria (reposición) o resarcitoria (indemnización). Seguidamente, se evalúan las opciones que sobre esta materia recogen los tratados internacionales suscritos por el Perú para luego tratar la evolución de la jurisprudencia constitucional. Así, se examinan pronunciamientos en que la tutela restitutoria estuvo inicialmente orientada a proscribir el despido que agravie derechos fundamentales, para luego analizar fallos recientes en los que se concede dicha tutela frente al despido injustificado, configurándose, por esta vía, un modelo de estabilidad laboral distinto al establecido por la Constitución de 1993.

O objetivo desta dissertação é expor as características centrais da teoria do filósofo norte-americano Ronald Dworkin sobre a natureza dos direitos fundamentais ou morais. A referida teoria é aqui compreendida como uma defesa da noção de direitos fundamentais, tal como aparece no sistema constitucional norte-americano, contra os ataques do utilitarismo e do juspositivismo. A concepção dworkiniana dos direitos fundamentais como razões de justiça (ou princípios) que operam como trunfos contra a utilidade geral é contrastada com duas teses adversárias: a concepção utilitarista dos direitos morais de John Stuart Mill e a tese juspositivista das fontes sociais. A famosa querela entre Ronald Dworkin e os juspositivistas é analisada em um enfoque normativo, como uma disputa sobre o conceito de autoridade política: Dworkin compreende os direitos fundamentais como a fonte última da autoridade jurídica, enquanto os positivistas sustentam que uma das funções da autoridade jurídica é precisamente estabelecer quais são os direitos das pessoas. / The purpose of this research is to expound the main characteristics of Ronald Dworkins theory of fundamental (or moral) rights. Dworkins theory is herein considered as a defense of the idea of fundamental rights, as it appears in the United States Constitutional System, against the attacks advanced by the doctrines of utilitarianism and legal positivism. Dworkins conception of fundamental rights as reasons of justice (or principles) that function as trumps against the general utility is contrasted with two defiant theories: John Stuart Mills utilitarian conception of moral rights and the positivist social sources thesis. The well-known debate between Ronald Dworkin and the legal positivists is approached as a normative dispute concerning the concept of political authority: Dworkin regards fundamental rights as the ultimate source of legal authority, whereas legal positivists argue that one of laws main functions is precisely to settle peoples rights.

A substituição da contribuição sindical obrigatória pela contribuição negocial aprovada em assembleia, por decisão judicial : um caminho para a plena eficácia da liberdade sindical no Brasil

The work pursues a way to the concretization of the fundamental right to labor union liberty in Brazil. The Convention 87 of International Labor Organization - ILO, which treats of Union Liberty, was not ratified by Brazil, which maintains the system of union unicity to the labor unions, vinculated to the obligatory union contribution. The referred convention is inserted in 1998 ILO Declaration on Fundamental Principles an Rights, which integrates ILO’s Constitution. Therefore, this non-ratification affronts the fundamental right of employee and contradicts Brazil’s participation as a Member State of International Labor Organization. However, national courts must pay attention to the International Labor Law to solve litigations. In this matter, the vision of International Labor Organization is presented, found in decisions of national courts, with diverse possibilities of International Labor Law application. Under the optic of internal law, the Theory of Material Opening of Fundamental Rights Catalogues on Brazilian Constitution is studied as an instrument to the efficacy of union liberty in Brazil. In this context, even with other fundaments, recent jurisprudence of the Superior Labor Court - SLC applied the decisions of International Labor Organization’s Committee on Freedom of Association and admitted the substitution of the obligatory union contribution by the union contribution approved in Assembly, indicating a way to concretize union liberty. The relevance and the potential of this way is demonstrated to the concretization of the fundamental right to labor union liberty in Brazil. / O trabalho busca um caminho para a plena eficácia do direito fundamental à liberdade sindical no Brasil. A Convenção 87 da Organização Internacional do Trabalho - OIT, que trata da liberdade sindical, não foi ratificada pelo Brasil, que mantém o sistema de unicidade sindical para os sindicatos, vinculados à contribuição sindical obrigatória. A referida convenção está inserida na Declaração de Princípios e Direitos Fundamentais da OIT de 1998, que integra a Constituição da OIT. Assim, essa não ratificação afronta o direito fundamental do trabalhador e contradiz a participação do Brasil como Estado-Membro da Organização Internacional do Trabalho. No entanto, os tribunais nacionais devem se atentar ao Direito Internacional do Trabalho para solucionar litígios. Nesse sentido, apresentase a visão da Organização Internacional do Trabalho, colhida em decisões de tribunais nacionais, com diversas possibilidades de aplicação do Direito Internacional do Trabalho. Sob a ótica do direito interno, estuda-se a Teoria da Abertura Material do Catálogo de Direitos Fundamentais na Constituição Brasileira como instrumento para a plena eficácia da liberdade sindical no Brasil. Nessa direção, ainda que com outros fundamentos, a jurisprudência recente do Tribunal Superior do Trabalho - TST aplicou as decisões do Comitê de Liberdade Sindical da Organização Internacional do Trabalho e admitiu a substituição da contribuição sindical obrigatória pela contribuição sindical aprovada em Assembleia, indicando um caminho para a plena eficácia da liberdade sindical. Demonstra-se a relevância e o potencial desse caminho para a plena eficácia do direito fundamental à liberdade sindical no Brasil.

Introdução - A obesidade infantil está pautada como assunto de saúde pública e exige a análise, implementação e avaliação de novas intervenções. O marketing é apontado como um dos fatores que interferem no aumento do índice de sobrepeso e de obesidade da população. As estratégias de comunicação publicitária se utilizam de processos cognitivos para determinar, através de elementos emocionais do receptor, a escolha e o consumo de alimentos não saudáveis, já que os publicitários respondem à demanda das empresas que buscam lucrar com seus produtos. Já se afirma que a regulamentação legal do marketing dos alimentos infantis não saudáveis deve ser adotada como instrumento de política pública na prevenção da obesidade. Assim, justifica-se a investigação de quais seriam as formas mais apropriadas para regular esse tipo de marketing no Brasil, de forma a garantir o direito à saúde e à alimentação adequada e saudável. Objetivo - Analisar o papel do marketing como um dos determinantes da obesidade infantil, buscando apontar, no campo jurídico, estratégias para a sua regulamentação no Brasil. Métodos - Revisão de literatura, análise de textos legislativos e de programas adotados para controle da obesidade infantil, além de entrevistas com representantes de entidades e profissionais diretamente ligados à implementação de políticas públicas, nacionais e internacionais, de controle da nutrição e saúde infantil, bem como de proteção dos direitos do consumidor infanto-juvenil. A interpretação dos dados levantados deu-se através do método científico dedutivo. Resultados - O crescente índice de obesidade no Brasil está demonstrado através de pesquisa nacional. A presença de alimentos no mercado com excesso de sal, gordura e açúcar precisa ser controlada. As teorias de comunicação explicam a influência do marketing na decisão emocional do consumidor. Os direitos à saúde e à alimentação adequada e saudável estão previstos na Constituição Federal. Conclusão - A regulamentação legal do marketing de alimentos não saudáveis é juridicamente possível e suas diretrizes devem focar os alimentos processados e ultraprocessados, além dos fatores que facilitam a persuasão da criança, impedindo o uso de elementos emocionais. / Introduction - Childhood obesity is considered a public health issue and requires the analysis, implementation and evaluation of new interventions. Marketing is considered as one of the factors that play a role in the increase of overweight and obesity rates in the population. Advertisement strategies use cognitive processes to determine, by means of emotional elements of the receptor, the choice and consumption of unhealthy foods, since advertisement professionals respond to the demand of companies willing to make a profit by selling their their products. The regulation of the marketing of unhealthy foods for children must be adopted as a public policy instrument for the prevention of obesity. Thus, we should investigate what are the most appropriate ways to regulate this kind of marketing in Brazil to guarantee the right to health and to adequate and healthy foods. Objective - Analyze the role of marketing as one of the determinants of childhood obesity, and try to identify legal strategies for its regulation in Brazil. Methods - Literature review, analysis of legal texts and programs implemented for the control of childhood obesity and interviews with representatives of institutions and professionals directly related to the implementation of public national and international policies for the control of childhood nutrition and health, as well as the protection of children and youth consumer rights. Deductive scientific method was used to interpret data. Results - Increasing obesity rates have been demonstrated by national surveys. The presence of foods with excessive salt, fat and sugar in market must be controlled. Communication theories explain the influence of marketing in the emotional decision of consumers. The right to health and to adequate and healthy foods is determined by the Federal Constitution. Conclusion - It is possible to regulate the marketing of unhealthy foods according to the law. The guidelines for regulation must focus on processed and ultra processed foods and the factors that facilitate persuasion of children, by prohibiting the use of emotional elements.

La compétition économique impose à l'entreprise de faire évoluer la relation de travail au rythme des contraintes qu'elle subit. Elle suppose l'adaptation des conditions d'emploi, laquelle implique de faire varier la rémunération, le temps de travail, les fonctions ou encore le lieu de travail du salarié. Semblables évolutions peuvent trouver appui sur divers dispositifs légaux, conventionnels ou contractuels, dont la mise en œuvre ne va pas, cependant, sans susciter maintes interrogations. Des réponses doivent être apportées. Est en jeu la capacité du système juridique français à donner aux entreprises des outils permettant d'assurer leur pérennité, voire leur développement et, par suite, la préservation de l'emploi.
