Umgänge med umgängesstöd : Barns delaktighet i domar gällande umgänge med umgängesstöd

In 2020, approximately 6900 children in Sweden were relevant for investigation of custody disputes. During the same year, 1802 court decisions were enforced regarding supervision by a contact person. Previous research has shown that children often have a lack of participation and opportunity to influence in these cases. It has also shown that parental rights and the child´s need for protection often outweigh the child´s expressed will. The aim of this study was to investigate children´s participation in the district court´s judgments regarding supervision by a contact person. What an impact the child´s will have and how factors such as age, risks and their best interest affect children´s ability to be involved. Through a qualitative content analysis, nine judgments from various district courts in Sweden during 2018-2021 have been selected. The material was then analyzed with the help of social constructivist theory and Roger Hart´s ladder of participation. The study shows that in six out of nine judgments, children are involved based on different levels and that 44% of the judgments are in accordance with the child´s expressed will. However, it has been difficult to read out how the child´s will has actually had a bearing on the verdict. The result also shows that factors such as age, risks and the best interests of the child affects the child´s ability to participate. In cases where the district court has not reported the child´s will or participation, no explanation or clarification is given as to why it is so.

Questions concerning children's rights and children's place in society have been on the agenda for some decades now. Parallell to this movement questions about children's place in the bible, in the church and in systematic theology have entered the academical conversation. This paper attempts to find a method to investigate whether systematic theology as we know it, has the tools to address these new questions. Axel Honneth's theory on recognition will be important, since the three levels of recognitions he describes are designed to point out the difference between rights and solidarity, between formal recognition and the recognition that sprouts from genuine intrest in shared experience.  The thougths from Honneth are combined with John Wall's argumentation on seeing the child as a full humna being, as a subject. Risto Saarinen's discussion on asymmetrical relations, adds an important perspective. From these three theories, a method is formulated for putting the child in focus on the theological agenda. The gain is not only the recognition of a neglected group, measured to one third of humankind. The new viewpiont shreds its light upon questions important to all of us. The method is a systematic theological tool both useful for pointing out inconsistencies and to suggest solutions to the very same problems.  In the final discussion I show how this could be done by adressing the children's place in the postmodern family project, described by Katarina Westerlund, and children as liturgical leaders with the help of Karin Rubensson's thesis.

En färgblind och föredömlig människorättsstat? : En studie om betydelsen av att motarbeta rasism i syfte att säkerställa Barnkonventionens efterlevnad

In this thesis, I have studied the United Nations concluding observations on Sweden in relation to international human rights obligations. Specifically, in regards to the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and the Convention on the Rights of the Child (CRC).  The Committee on the Rights of the Child have, in their Concluding Observations from 2023, expressed a deep concern about continued racism and discrimination of many children in Sweden. Meanwhile, the Committee on the Elimination of Racial Discrimination has recommended Sweden to take immediate measures for the purpose of eliminating all forms of racial discrimination.  In terms of critical analysis, the aim of this thesis has been to study how the Swedish state's international human rights obligations for the purpose of eliminating racial discrimination relates to the implementation of children's rights according to the principle of non-discrimination. According to my study, it is necessary for the Swedish state to promote and respect the human dignity inherent in every child, to be able to guarantee every child within the jurisdiction the rights under the CRC. A central example is the child's right to education in alignment with general human rights principles. Therefore, it is required for the state to prevent the normalization of racism in Sweden, in accordance with the international human rights obligations under the ICERD. This includes, for example, the prohibition of racist organizations in national law, for the purpose of eliminating racist hate speech, and the elimination of racial profiling by national law enforcement. Many children's living conditions and access to the rights under the CRC are affected by racism in several ways, through structural and everyday racism, when they themselves are exposed to racism and when people in their close surroundings experience racism. This has led me to the conclusion that active and immediate measures by the Swedish state, for the purpose of eliminating racial discrimination, are necessary for the possibility of guaranteeing the children who are victims of racism their rights in alignment with the CRC.

Skyddsgrunder för ensamkommande barn : - en rättsvetenskaplig analys

With the increase in unaccompanied children in 2015, it has become common to discuss the legal status of unaccompanied children. By the Swedish law persons under the age of 18 are considered to be minors and therefore have no ability to make decisions in personal matters with legally binding effects. A childs case does not always require the same seriousness as adult cases to be able to obtain a residence permit. This leads to at different asylum process for unaccompanied children who lack guardians upon arriving to Sweden. Various assessments are made for unaccompanied children that adults do not need to undergo for a residence permit. Through the legal dogmatic method, an analysis and report has been made in relation to the EU law, current Swedish laws and international commitments that affect unaccompanied childrens rights within Swedish legislation. The courts way of assessing grounds for protection, as well as how these are tried has been analyzed. The concept of unaccompanied children has been defined, but the focus on their rights in Sweden has also been reported. / I samband med ökningen av ensamkommande barn under år 2015 har det blivit ofta förekommande att diskutera ensamkommande barns rättsliga ställning. Personer som är under 18 år betraktas enligt svensk rätt som omyndiga och har därför ingen förmåga att med rättslig bindande verkan fatta beslut i personliga angelägenheter. Ett barns ärende behöver inte alltid ha samma allvar och tyngd som krävs för att vuxna personer ska kunna få uppehållstillstånd vilket leder till en annorlunda asylprocess för ensamkommande barn som saknad vårdnadshavare vid ankomsten till Sverige. Det görs olika bedömningar för ensamkommande barn som vuxna inte behöver genomgå för uppehållstillstånd. Genom den rättsdogmatiska metoden har det gjorts en analys och redogörelse i relation till EU-rätten, gällande svenska lagar och internationella åtaganden som påverkar ensamkommande barns rättigheter inom den svenska lagstiftningen. Domstolarnas sätt att bedöma skyddsgrunder samt hur dessa prövas inför domstolar har bedömts och analyserats. Begreppet ensamkommande barn har definierats men även fokus på deras rättigheter i Sverige har redogjorts.

Surrogatmodern och den mänskliga värdigheten : En diskursanalys av den statliga utredningen om surrogatmoderskap, ur ett kritiskt postkolonialt feministiskt perspektiv

Uppsatsen undersöker hur ”SOU 2016:11 Olika vägar till föräldraskap” formulerar problemet med surrogatmoderskap, vilka subjektspositioner som kan urskiljas i utredningen och analyserar den ut ett kritiskt postkolonialt feministiskt perspektiv.   Utredningen utgår ifrån mänsklig värdighet, autonomi och barnets bästa vilket uppsatsen belyser får konsekvenser för hur problemet med surrogatarrangemang porträtteras olika beroende på om surrogatmodern och barnet är från det globala syd eller det globala nord. Utgångspunkterna är centrala när surrogatmodern och barnet från det globala nord lyfts men får inte samma roll gällande surrogatmodern och det barn hon föder. Vidare undersöks hur subjektspositioner formuleras utifrån emotionell/icke-emotionell, sårbar/icke-sårbar, skyddsvärd/icke-skyddsvärd och blottlägger hur den svenska surrogatmodern och det inrikesfödda barnet konstrueras som emotionella, sårbara och skyddsvärda vilket skiljer sig från hur den utländska surrogatmodern och det utrikesfödda barnet konstrueras. Dessa omges att tystnad vilket får konsekvenser för hur de porträtteras och för vilka åtgärder som föreslås.   Uppsatsen bidrar till en utveckling av tidigare forskning med ett tillägg av nyckelordet skyddsvärd för att undersöka konstrueringen av surrogatmödrar. Uppsatsen visar att begreppet är relevant genom att materialet visat på delvis konstuering av emotionell och sårbar men inte skyddsvärd och att detta påverkat resultat och åtgärder. Vidare stärker uppsatsen tidigare forskning som menar att utgångspunkten mänsklig värdighet verkar för en avhumanisering av surrogatmödrar från det globala syd samt att synen på biologi varierar beroende på var ett barn föds. Uppsatsen bygger vidare på tidigare forskning som menar att uttryckt rationalitet och brist på emotion resulterar i en avhumanisering, genom att blottlägga hur det kan räcka med att subjektspositionerna möts av tysthet för att uppnå samma resultat. Detta arbete belyser hur olika subjektspositioner framställs olika i den statliga utredningen och hur koloniala idéer hänger kvar och påverkar underlag till svensk lagstiftning, samt blottlägger vilka konkreta konsekvenser detta kan få för lagförslag och för surrogatmödrar i det globala syd samt de barn de föder.
