INTERNATIONAL SALES DISPUTE RESOLUTION ABSTRACT This dissertation deals with judicial resolution of disputes arising from cross-border commercial relationships, more precisely from international sales contract as their common representative. The introduction defines the term of international sales contract (chapter one) and the process of its formation (chapter two) under the United Nations Convention on Contracts for the International Sale of Goods ("CISG"). It addresses inter alia the gap filling of the CISG, uniform interpretation or commercial usages. Some comparative notes are also provided. Further, it examines a phenomenon called "battle of forms" that often occurs in practice when dealing with standard terms and conditions. The focal point of the thesis is the rules of jurisdiction set out in the Brussels I Regulation Recast ("Regulation") which are analysed from the perspective of an international commercial relationship. The emphasis is on the prorogation of jurisdiction under the Regulation. The third chapter deals with the territorial, temporal and material scope of application of the Regulation, as well as with its autonomous interpretation. This diploma thesis deals with the topic of international insolvency law, in particular with certain areas of European insolvency law, with an emphasis on the matters of international jurisdiction for opening of main and territorial insolvency proceedings and international jurisdiction to hear actions related to insolvency proceedings. Furthermore, this diploma thesis is aimed at evaluation of the Czech legislation regarding cross-border insolvencies. The legal framework for European insolvency law was incorporated into the Insolvency regulation in 2002. Due to disagreements between certain member states of the EU regarding some of the important institutes of cross-border insolvencies the Insolvency regulation often contains vague provisions. It, therefore, fell to the Court of Justice of the European Union to provide interpretation of such ambiguous clauses. In 2012 the European commission created a report on the application of the Insolvency regulation and simultaneously presented a long awaited proposal for modernisation of the European insolvency law in the form of the Insolvency regulation recast. Determinação da microdureza Vickers e caracterização microestrutural das ligas de NiCr, NiCrBe, NiCrTi fundidas sob diferentes condições de fundição com reaproveitamento total ou parcial de liga

Este estudo avaliou a microdureza de ligas de NiCr usadas em prótese fixa fundidas sob diferentes condições. As condições de fundição foram: 1- maçarico chama composta de GLP/oxigênio e centrífuga de mola sem controle de ambiente de fundição; 2- indução eletromagnética com ambiente controlado por argônio e vácuo. foram utilizadas três ligas NiCr, NiCrBe e NiCrTi. Foram realizados 18 fundições com 5 corpos-de-prova para cada anel, depois de fundidos os corpos-de-prova foram embutidos e polidos para as mensurações de microdureza vickers (VH) em equipamento Shimadzu-HMV-2 (1Kg por 10s). um total de 3 edentações foram feitas para cada corpo-de-prova.os dados de VH foram avaliados pelo teste de ANOVA e Tukey (=0,05) para contraste de média. A microdureza apresentou a seguinte ordem para maçarico e liga totalmente virgem: NiCrTi (42533,4)> NiCrBe (36215) > NiCr (25314,8), sendo diferentes entre si. Os valore obtidos nas condições de argônio e indução foram semelhantes (p>0,05). A microdureza depende da liga e do método de fundição. A liga de NiCrTi foi maior quando fundidas nas condições de maçarico oxigênio/GLP e totalmente refundida (42826,7). / This study evaluated the microhardess of NiCr alloys used in fixed prosthodontics after casting under different conditions. The casting were: 1-flame/air torch flame made of a gas/oxygen mixture and centrifugal casting machine in a non-controlled casting environment; 2-induction/argon electromagnetic induction in an environment controlled with argon. 18 castings with 5 in each ring were prepared. After casting the ring were embedded in resin and polished for Vickers microhardness (VH) measurements in a Shimadzu HMV-2 (1kgfor 10s). a total 3 indentations were for each ring, one in ring. The data was subjected to two-way ANOVA and Tukeys multiple comparison tests (=0,05). The VH values of NiCrTi NiCrTi (42533,4)> NiCrBe (36215) > NiCr (25314,8). The VH values obtained in the condition of the argon and induction were similar (p>0,05). The microdureza depends on the league and of the foundry method. The league of NiCrTi was larger when melted in the conditions of blowpipe oxygen/GLP and totally recast (42826,7).

The aim of this PhD thesis is to analyse the current status of European insolvency law and with the help of both national and European judicial decisions put together an overview of practical obstacles that insolvency courts, debtors, creditors and insolvency trustees across Europe are facing when dealing with cross-border insolvencies. At the very core of this topic stands the European Insolvency Regulation ("EIR") which was adopted in 2015 and is effective within the member states as of June 2017. Since this regulation was put together as a recast of its predecessor, i.e. the original insolvency regulation adopted in 2000 and effective as of 2002, naturally this research is oriented at comparing the two legislative acts and mainly assessing whether or not the recast EIR managed to overcome some of the inconsistencies in the wording of the original EIR, often resulting in conflicting interpretations and a great deal of preliminary rulings filed with the Court of Justice of the EU. Apart from looking into good old instruments of private international law such as the scope, the jurisdiction, the choice of law and the recognition and enforcement rules governed by the EIR, this thesis also focuses on topics that are very bankruptcy-specific and dissimilar to anything we know from other fields of law....

Exotic Decays of a Vector-liketop Partner at the LHC

An evaluation of how sensitive some ATLAS searches for new physics are to a new beyond standard model (BSM) vector-like quark (VLQ) and a pseudo Nambu-Goldstone boson (pNGB) scalar. This was done by simulating a signal containing these new particles and making a recast of it onto existing verified ATLAS searches for new physics at center-of-mass (CM) energy of 13 TeV (Run 2) at the Large Hadron Collider (LHC). Signals for recasting were tailored such that their final states would be appropriate in relation to each respective ATLAS search in order to use the same selection criteria as applied in the existing searches. The results are summarized in the form of significances (Z) for each masspoint of the new top-partner and S particle. Significances did not show any expectiation of excluding any masspoint in the examined mass range for the recasts at 95% CL. This suggests that a dedicated search for these particles in the considered masspoints would be required.

Omsorgsprincipen vid ansökan om internationellt sydd : En studie av det omarbetade asylprocedurdirektivet (2013/32/EU)

This paper addresses the principle of care in the recast asylum procedure directive (2013/32/EU). The purpose of the study has been to analyze how the principle of care is expressed in the directive regarding procedures for granting or rejecting asylum, as well as to analyze how the directive was implemented in Sweden. The recast asylum procedure directive aims to harmonize EU’s member states' procedures for granting and withdrawing international protection. Initially, this paper describes how the directive was created and how the principle of care is expressed in the directive and the meaning and content of the principle of care at EU level as well as its content and meaning according to Swedish law. To conclude, the Swedish implementation of the directive’s provisions directly connected to the principle of care will be discussed. The principle of care is one of the principles of good governance. The principles of good governance have been important in EU law to ensure legal protection for individuals when they are in contact with authorities of EU or Member States. In the analysis, what is found is that the principle of care can be divided into several sub-principles or requirements: individuals’ right to get their affairs treated; the obligation of authorities to investigate a request in an impartial manner; fair procedure and handling; authorities’ duty to take individual interests in consideration; authorities’ obligation to act within reasonable time and also other requirements regarding routines and procedure. Since a major part of this paper regards analyzing the relationship between EU law and national Swedish law, a discussion about the Member States’ institutional and procedural autonomy towards EU is also included. A conclusion is that the Swedish implementation of the directive's provisions related to the principle of care was deficient and that the directive itself restricts the Member States’ institutional and procedural autonomy. / Den här uppsatsen behandlar omsorgsprincipen i det omarbetade asylprocedurdirektivet (2013/32/EU). Syftet med arbetet är att analysera hur omsorgsprincipen uttrycks i direktivet avseende procedurer för beviljandet eller avslag av asyl, samt hur direktivet har genomförts i Sverige. Det omarbetade asylprocedurdirektivet syftar till att harmonisera EU- medlemsstaternas förfarande vid ansökan om internationellt skydd. Inledningsvis redogörs för hur direktivet skapades och hur omsorgsprincipen uttrycks i direktivet, vad omsorgsprincipen omfattar på EU-nivå, liksom principens omfattning i svensk rätt. Avslutningsvis analyseras genomförandet av direktivets bestämmelser med anknytning till omsorgsprincipen i svensk rätt. Omsorgsprincipen är en av principerna om god förvaltning. Principerna om god förvaltning har varit viktiga inom EU-rätten för att säkerställa ett rättsskydd för enskilda när dessa är i kontakt med EU:s eller medlemsstaternas myndigheter. Analysen kommer fram till att omsorgsprincipen kan delas in i flera mindre principer eller krav: enskildes rätt att få sina angelägenheter behandlade; myndigheters skyldighet att på ett opartiskt sätt undersöka en begäran; rättvis procedur och handläggning; myndigheters skyldighet att väga in enskildes intresse; myndigheters skyldighet att agera inom rimlig tid; samt andra krav på handläggningsrutiner. Eftersom en huvuddel av den här uppsatsen handlar om att analysera relationen mellan EU-rätt och svensk rätt, förs också en diskussion om medlemsstaternas institutionella och processuella autonomi gentemot EU. Slutligen presenteras slutsatsen att det svenska genomförandet av direktivets bestämmelser som anknyter till omsorgprincipen varit bristande och att direktivet har begränsat såväl medlemsstaternas institutionella som processuella autonomi.
